of course our coverage begins with eyewitness news reporter kemberly richardson. she is in midtown. >> reporter: a briefing wrapping up just a few minutes ago here. it was an all encompassing rundown of what to expect when pope francis arrives here in new york city on thursday. officials here at the mission of the holy sea spoke about the pope's visit to the united nations on friday. really what to expect in terms of the tone of his message. pope francis will be the fifth pope to visit the u. n., the fourth one to speak there. he will meet with a small group there first. the secretary general, his wife and a group of children. the pope will then address the staff, about 400 people before entering the general assembly around 10:00. now also this morning, we heard from archbishop timothy dolan. >> a couple of things. obviously there's a lot of last minute details. so today, tomorrow, i'm just

actually the eighth homicide from a very violent weekend. the car of that driver, the green car was pulled from this intersection a short time ago. here is the crime scene. the more interesting element as shirleen mentioned that the driver was on the phone before he was killed talking to his brother-in-law. >> i was on the phone with him, and he tell me the guy has gun. i said be careful. okay. he said okay. >> augustine was talking with 39-year-old mamadou berry who had just told his brother-in- law that his passenger had a gun. >> i call him back one time, second time, called him back five time and then i see something happen. >> police found mamadou berry's body slumped over the wheel of his green livery here where east 109th street intersects with beaumont avenue. he had been shot to death. his family, his wife and his sisters now come together to mourn his loss.

speak of a good hardworking man. >> he's the best husband everybody can ask for. he's the best brother everybody can ask for, the best son. he is the best in everything. >> such a tragedy. his family is mourning. at this point the driver has three children and he and his wife are expecting a fourth child. so far police have not made an arrest. reporting live in the belmont section, tim fleischer channel 7 eyewitness news. new at noon, a police officer in new jersey who was involved in a deadly wrong-way crash on staten island went before a judge to face charges. linden police officer pedro abad junior turned himself in this morning using crutches as precinct. anthony johnson live outside the courthouse with more. >> reporter: david, that horrible crash left two people the injured officer, they were also hurt in that crash.

but he was seriously injured like we said in the crash which took place back in march. finally he's recovered enough to come to court today. linden police officer pedro abad junior did take a few steps on crutches before being placed in a wheelchair and rolled into the precinct wearing a boot on his right foot which was injured in that horrific accident. abad was driving the wrong way on the staten island expressway when he slammed head on into a tractor-trailer. now he's been charged with several counts of aggravated vehicular homicide, manslaughter, and dwi all part of a 43 count indictment. these serious charges all stem from the deaths of 28-year-old joseph rodriguez, linden police officer frank viggiano, and pat cud lack was seriously injured. abad pleaded not guilty to all the charges. according to reports abad was driving three times over the legal limit after he and friends left a staten island strip club.

his lawyer was asked if his client has any remorse. >> he's upset. i mean he's upset. he's as upset as you would expect somebody to be. he's upset. . >> reporter: abad was able to post a $25,000 bond. he also gave up his passport and his driver's license. the interesting thing about the driver's license abad had previously been charged with dwi in the past. of course those charges were apparently dropped, and they were dropped before this horrific accident took place back in march. that is the latest live from staten island, anthony johnson channel 7 eyewitness news. anthony thank you. a man is dead following an overnight fire on staten island. firefighters found the 54-year- old as they were battle flames at a home in the rose bank section. the cause is under investigation. no one else was hurt. the nypd's public case of

mistaken identity is the subject of a high profile private meeting. former tennis star james blake is sitting down with mayor de blasio and police commissioner bratton. an officer tackled blake thinking blake was a suspect in a fraud case. that officer is on modified duty. blake has said he should be fired. now to the race for president and shifting attitudes of voters. the latest poll on the republican side shows a drop of support for donald trump. with 24% of the vote. carly fiorina has been rising republican debate. she is now in the number 2 spot with 15% of the vote. ben carson is right behind her. another leading republican candidate is being criticized about muslims. the nation's largest muslim advocacy group is denouncing ben carson's comments that the islamic faith is inconsistent with the constitution and that he would not agree with a

muslim being elected president. on the democratic side, hillary clinton's lead is widening according to a new poll. it shows that among democrats she has 42%, but check out vice president joe biden. he has about 20% of the possible votes, and he hasn't even announced whether he's running. new reports say that top democratic fundraisers are circulating a letter urging biden to jump into the 2016 race. a man accused of a road rage attack with his 2-year-old son sitting in the car. explodes injuring several people. forecast. >> and governor cuomo's long- time partner sandra lee steps out for the first time since surgery. recovery. summer of 2015. the temperatures outside are pretty much where they should be this hour of the day around 70s today. we're going to be looking at

two americans and other westerners held hostage in yemen. the two americans are now in oman. they were released by yemen's shiite huthe rebels, the civil war in yemen escalated in march as a saudi led u.s.-backed campaign. a law enforcement authority say bullet fragments have tied a 21-year-old landscaper to a string of shootings that struck phoenix. leslie allen merit. he claims he didn't have access pawnshop. officials say they have proof during four shootings. a pastor and church members in alabama are being hailed as heroes after a gunman opened fire during sunday services. police say 26-year-old james junior minter shot his girlfriend and their baby at

the oasis tabernacle in east selma yesterday. the church's pastor was shot when he tried to intervene. all three of them are in the hospital. minter was captured by police less than a mile away. he faces charges of attempted murder. hackers have made their way into apple's app store. a malicious program called x code ghost infiltrated 344 apps in the store. hackers tricked developers into using a counterfeit version of x co, the system that runs apple's ios and mac apps. apple released a statement it has removed defective apps from the store. tv chef sandra lee is opening up on her facebook page about her recovery following treatment for breast cancer. lee told her followers that with them she is going into autumn stronger, wiser and better. governor cuomo's girlfriend made her first public appearance last night at the emmy's looking stunning. next week lee will sit down for

don't know where i'm going. going to the wall. this is where i live. as we look over here toward the east river we've got a couple of ferryboats working up and down. we've got a great day for it. a light wind that's been out of the northeast, but at times it's been gusting up to 22 miles an hour. humidity is dry, and the pressure is at 30.25, steadying the temperature 68. with the pressure that high we have a brand new high pressure ridge over us giving us that northeast wind and i'll explain how that's working. normal high is 73. we should hit that later on. sun is going to set at 6:56. just a little bit before 7:00, and we should have a pretty sunset too. send us your sunset pictures, and we'll put those up this evening. lee goldberg will have that at 4 and 5. feeling like fall for the end of summer, but it's going to feel like summer for the beginning of autumn on wednesday when temperatures get into maybe the low 80s. cloudiest day is tomorrow. there might be a sprinkle. looking at 68 this hour now around murray hill, 69 over

towards whitestone, 66 belmar, wrightstown, and 59 in the north. these are cool numbers with a little bit of cloud cover and a northeast wind. i guess the meter is broken here at newburgh. either that or your lawn furniture is going to be missing at 116 miles per hour. that's the automated guest. here we go, high pressure ridge and low really this wind comes in today and tomorrow out of the northeast. as we get to the first day of fall, this high pressure ridge kind of works alone. the low leaves and as the high slides toward the east we get warmer air with temperatures 5 normal. clouds and sun will be here this afternoon. clouds more likely to come right across eastern pennsylvania and new jersey and right on through the tri-state about. this kind of slides out into the atlantic. there might be a sprinkle with that. then this high pressure ridge firmly in control giving us great weather as we get into wednesday thursday and the beginning of fall. 73.

most of the time, a very comfortable 61. tomorrow cloudy and breezy. a few sprinkles could be around tomorrow, particularly from the city on east. then look at the first day of fall. it's going to feel like summer. it's going to be 80 degrees. you know, this is the month, september, october, where you kind of get those up and down periods. it's warm, it's cool. it's warm, it's cool. we're looking at 80 on thursday. we're looking at clouds and sun on friday. 76 on the weekend looks nice. mid-70s and mid-50s to low 50s. the roses that just started blooming in front of my house again, going to love that little stretch you just gave them there. >> nothing like frost on the roses. >> that is a beautiful image. >> yes, it is. >> thank you bill. >> all right. >> horror at the zoo. a zoo keeper and mom of two killed by a tiger. we'll tell you what the zoo has decided to do with the rare animal.

football fans brawling, a family's boat goes up in flames, and alleged diamond difficulties. just some of the stories that were caught on camera and caught our attention. we begin in california where a

rival football fan got into a knockdown drag out fight. dave amaro posted cell phone video of the melee on his facebook page. a witness claims some 49ers fans started insulting steelers fans inside a restaurant in downey when both groups met outside a massive brawl erupted. some bystanders stepped in and broke up that fight. a family in texas thought that there was a little smoke on their boat coming from oil burning in their engine. they did not realize that flames were actually consuming their boat. look at that. horrified onlookers rushed over to tell them what was happening. the family jumped into the water, good samaritans and other boats pulled them to safety. moments later that boat exploded and sunk. a pair of diamond thieves in ohio may have had a harder time than most. video shows one thief slashing his leg, kicking in the glass door of the store, even the get away went wrong.

the two ran down a stairwell that did not go to the garage where their car was parked. when the duo jumped on an elevator it took them to the garage. the doors would not open trapping them until police arrived. >> why do i feel like if bill and i turned to a life of crime that would be us. why do i feel that way. >> stick to your day jobs guys. >> yes, we should just go to work and mind our own business. >> a good lesson for all of us. thank you. >> a good deed means one man will spend the year in pizza heaven. he ordered a pizza and wings from dominoes, scarfed down the box. hours later he received a frantic text message and phone call from the delivery driver that who realized that instead of wing he had delivered a box. >> i made a facebook post and there's a long list of people arguing you should keep it. i wanted to keep it believe me

the meadow brook state parkway yesterday afternoon and proceeded to run up to the window and beat the 27-year-old man in the head causing a fractured jaw, nose, and cheek. his family, hinton's family was in court this morning. according to court papers the victim told police he was driving north on the meadowbrook state parkway around old country road when he accidentally cut off hinton's car. hinton began to drive erratically and yelled at the victim he had a child in his car. he says hinton forced him off the road. the victim rolled down his window to apologize but he says hinton began to punch him in the face until he blacked out. hinton is being charged with assault in the second degree as well as endangering the welfare of a child again for allegedly having his 2-year-old son in the car when this all happened. bail. we are live in hempstead, i'm kristin thorne channel 7 >> thank you.

mother of the girl whose body was found inside a trash bag on a boston harbor island is being arraigned along with her boyfriend, and among those in court for the arraignment is the biological father of the baby doe. abc's marci gonzalez joins us now with more. >> a difficult day for him and other loved ones who were in that courtroom listening as prosecutors shared how they believe the little girl was killed and what happened next. >> the horrific details of little bella bond's death laid out today in court. an emotional outburst as bella's mother rachelle stood wincing behind a glass partition charged with accessory to murder after the fact. her boyfriend michael mccarthy stoic charged with first degree murder. the prosecutor claiming mccarthy punched bella in the stomach for being unruly at bedtime, then reportedly called the girl a demon saying it was

her time to die. >> when ms. bond looked at bella her head appeared to her to be swollen, and her face was gray. she knew her daughter was dead. >> prosecutors claimed the 2- year-old's body was put into a plastic bag and left in the family's refrigerator for days before bond and mccarthy dumped seaport. the girl's remains washed up in a massachusetts park in late june with investigators spending the three months since trying to identify baby doe. this computer generated image viewed more than 50 million times on the internet before finally prosecutors say a friend realized couple's claims that bella wasn't with them because she'd been taken by the department of children and families was a lie. >> ms. bond broke down crying and said i'll never see my daughter again. >> and bond has a long history with dcf and of drug and prostitution charges. she's now being held on a million dollars bail while the

judge would not set bail for mccarthy. david. thank you marci: a man from tennessee accused of climbing the brooklyn bridge illegally 21-year-old david carnuch snapped a selfie in july. he was extradited from his home in chattanooga last month for his attorney says they are two students in colgate university were killed when their plane crashed in a wooded area in rural upstate new york. their single engine plane went down in morrisville yesterday afternoon. the two freshmen were from ridgefield connecticut, cathryn depuy and ryan adams will be remembered this evening at a vigil on the colgate campus. the federal aviation administration is investigating the crash. a major update to the new jersey fire code takes effect today. it will not include the changes that firefighters and other

safety advocates recommended after january's massive fire in edgewater. that fire consumed much of the avalon apartment complex displacing more than a thousand residents. the new code ignores calls for new restrictions on the use of lightweight construction materials. those materials were blamed for allowing the fire to grow and spread quickly. in queens, 19 people are okay after finding themselves stranded in the east river. it happened yesterday when a competitive paddling team's boat capsized near the whitestone bridge everyone was wearing life jackets. they opted to wait for fdny rescue teams instead of swimming to shore. the sunken feeling put a damper on a marriage proposal somewhat went down. [ laughter ] >> it was really hard not to but i would have said yes anyway. i'm still more in shock about the ring than i am about going under. remember.

a new zealand zoo makes a gut wrenching decision after an animal trainer is killed. when the zoo worker was killed by a tiger, euthanize it or not. in the end they decided not to euthanize it. it was likely the tiger felt she was a threat to a female tiger in the enclosure. the two appeared together in a tv feature a few years ago. >> the zoo is a family. they support each other and this is how it's going to stay. >> while the talking letter not be put -- tiger will not be put down, the zoo is deciding when he'll go back on display. a neighborhood is on edge after a black bear was spotted near homes. a resident spotted a picture after it scaled a fence between
