jim? >> reporter: let's explain what the huge piece of equipment is. it's called the casa grande. it's a massive hydraulic drill that drills holes deep into the ground for the footings of what will be a luxury hotel in midtown south. to get an understanding of what happened, we spoke to some construction workers that didn't want to go on came -- on camera but he was trying to maneuver it over the sidewalk into the construction site around 8:45 this morning. during that process, he may have partially raised the boom and that could have shifted the boom's center of gravity causing it to tip over on top of an nypd police van. fortunately no one was in the van. no wane was walking by on the sidewalk. that could have been some real serious injuries taking place if that had been the case. in the words of one

construction worker basically the driver of this boom pulled a wheelie, that simple. we should note here that the general contractor is flint lock. flint lock construction out of mamaroneck, westchester county. they built other hotels in midtown including fairfield in and suites a few blocks from here, another luxury hotel. what we can say about this is this flint lock has a history of some safety violations in the past few years. they have been cited by osha for four safety violations including in 2013 they were fined a quarter of a million dollars in the building of a hotel because they didn't provide at least osha alleges, fall protection workers. in the quarter million dollar fine, osha said that flint lock workers were, quote, one trip, slip or misstep away from a deadly fall. injured.

whether 0 show comes in and investigates, usually they don't unless there is an injury or fatality but they could because of the potential severity of this accident. one final note here, the city is undergoing a massive construction boom. down the street there are two high-rises and cranes all over the city. and we can tell you that construction accidents, because of this boom, are up so far this year. live in midtown south, jim news. >> jim, thank you. in other news, a difficult day for students returning to class at a high school in new jersey where a quarterback died after taking a hit on the field. a memorial for evan murray now grows outside of warren mills regional high school. new jersey reporter toni yates is live at the school with more on this tragedy. toni? >> reporter: good afternoon. i will step outside of the way so you can see the memorial. it is everything you would

community from loving families and high school friends and staff. they are, as they have written out here of the football field where evan murray quarterbacked for the warren high school blue streaks, they are number 18 strong. now, 18 was murray's number on the team friday against summit's team, murray reportedly took a couple of hard hits. the last one, fellow players helped him off the field. he was taken to the hospital where he passed away. the autopsy report is not in yet. the district has grief counselors at the school. this morning, not surprisingly, many students are taking advantage of the help. murray was 17 years old. he was very popular, not only quarterback but a pitcher on the baseball team, the basketball team, he excelled in studies. i spoke to the acting superintendent about the grieving process here and moving forward. >> the kids are doing wonderful fully.

we had a -- wonderfully we had a great number come in in a state of grief and emotional state. we were fully prepared. >> reporter: going forward with the football schedule this year, any changes. >> we are assessing the football schedule for this week. we will make an announcement on that before the is out. it has to do with all consideration of emotion, physical readiness, the feelings of the team, the coaches of all concerned. that's an important decision that we will make before the day is out. >> reporter: again, back to the memorial outside the high school, the football field is right across from the high school. the warren county prosecutor's office may release the findings in that autopsy report as early as today. it may not happen today. there will be awake for evan murray on wednesday. his funeral will be on thursday.

brooklyn. looking to the lower east side, a day where we start out with clouds and sun and we will look at a beautiful -- kind of a beautiful afternoon in that we get sun, clouds, sun, clouds. a little bit of a northeast wind out here. afternoon. there you see the seastreak working its way up the east river at noontime. and the ferry boats will be working across. you have a mix where you get breaks of sun and a cloudy sky. depending on where the sunny breaks are is where the temperature will warm up. the humidity is in the moderate range, 66%. noontime. a northeast wind at 5. pressure has been falling. it's above 30.00. it's falling really slow. still we have moderate to strong high pressure over the northeast of new england. normal high is 70. sunsets about 6:44. muggy through tomorrow. clouds and sun and highs near 80, ten degrees warmer than normal for this time of year.

showers stay spotty through at least the daylight hours of tomorrow. a couple of showers. you may need to take the umbrella with you. warm and humid. steadier heavier rain tomorrow night, wednesday, particularly north and west. we will get much needed rain around. so, for the afternoon, the air quality is good. cloud cover and u.v. index is moderate at 5. three, four hours to get a sunburn. ragweed and sagebrush. 74 murray hill. 75 newark. 76 islip. where the sun gets through some of the clouds, you are getting more in the way of warmer temperatures. now, we are looking at a northeast wind off the atlantic. it's light. from the late week, weekend, there is a tropical depression in the atlantic around bermuda. we are keeping an eye on that to see if it brings big time rain possibly into the ends of the week and into the weekend. so, you can see there is a

here on the south shore of long island cutting into here from queens. you may run into a sprinkle in a few spots. the rain is off to the west and then this front to our northwest and you got a system out in the atlantic. start tomorrow evening through the rest of the week and into the weekend. warm and humid. normal high is 70. we are at 80. of the tonight there is some clouds around, still warm and humid. there could be a spotty shower tonight and overnight. tomorrow we will do this all a shower or two. and the heavier rain will be starting tuesday night through the day wednesday there could be an inch of rain, might be local spots that get a couple of inches of rain in the afternoon and evening then we are in the 60s by the end of the week. >> did knife you get a chance to see the super moon.

a wild baseball fight, an nfl player's wife in handcuffs and a moose becomes a squatter. we begin with the fight that many are calling a national embarrassment. it involved teammates on the same washington nationals baseball team. bryce harper returned to the dogout after he flood out in the 8th inning. there he goes. jonathan papelbon had something to say. they are going at it. the team getting between them. later harper tweeted that

described it like brothers fighting. a low point of a disappointing season for washington. from baseball to football, the wife of a miami dolphins player was arrested outside the stadium for allegedly head budget a police officer. police say mico grimes wife of brent grimes tried to walk into the stadium through a restricted areas. officers warned her to stop but she kept going. when police tried to subdue her, she fought back yelling obscenities. finally calmed down when officers pulled out a taser. grimes was arrested and faces several charges. a community in colorado defending a family of moose caught on camera throughout the town. the mother moose and her two calves have been reported by security cell phones in vail. many outraged when word spread the city was planning to put down or relocate the animals. more than 1,000 people signed a petition for authorities to let the moose remain in the resort town. >> yeah, vail officials say

murray took a hit on the field but walked off. he was taken to a nearby hospital where he died. president obama addressed the united nations this morning. he told the u.n. they must work together and cited the iran nuclear deal p. vladimir putin just finished addressing the u.n. his face-to-face meeting with president obama is scheduled for 5:00 p.m. hello, i'm david novarro. >> i'm lori stokes in for shirleen allicot. we start with an eyewitness news exclusive. the mta bus driver accused of driving a bus on long island while he was drunk is talking to us about his arrest. >> alexander copeland was arraigned in court. kristin thorne has the exclusive interview. >> reporter: alexander copeland tells me simply he doesn't remember anything that happened that day. he said before he took the bus, he apparently suffered a concussion and he doesn't remember anything before or after that happened.

morning as copeland went before a judge in hempstead on aggravated dbi charges. he went into work from his home in suffolk county only to find out he didn't have to work that day. he tells me he fell at the bus depot in queens and doesn't remember anything. later on that afternoon, drivers called 911 reporting seeing an mta bus swerving erratically all over the northern state parkway around exit 32. a trooper pulled over copeland, gave him a breathalyzer that registered a .20 blood alcohol content. copeland tells me he didn't drink that day and he is happy he didn't hurt anyone. >> i don't remember the trip in. i don't remember being at the depo. i don't remember leaving with a bus. i don't remember the stop. >> reporter: his attorney says that copeland is on a number of medications so they are trying to figure out if that had anything to do with the .20 blood alcohol content reading. they have statements from two

doctors that copeland did suffer a concussion that day. today the judge registered his license as suspended so it is suspended now and he has been suspended from the mta without live in hempstead, kristin thorne, channel 7 eyewitness >> thank you, kristin. also on long island, one man is in custody for dwi after brentwood. police say 22-year-old anthony brody santos drove his nissan altima into a motorcycle turning on to clark street. the man on the motorcycle was killed. brody is being held at the third precinct. he will be arraigned today. new details about a deadly shooting early this morning on a street in queens. this happened about 4:00 this eyewitness news reporter kala rama has more about the victim >> >>reporter: police say a 26- year old man was gunned down in the middle of the street and the shooter is on the loose.

night from. sunday is the quietest time of the week. four girls living here, we feel safe until now. >> we looked at the crime stats in the 114th precinct and found six murders so far in 2013, 200% more than last year. police have been going door to door in this neighborhood asking what witnesses saw and looking for surveillance video hoping the incident was caught on camera and can give them a better picture of who they are looking for. >> from astoria, queens, kala news. a woman in brooklyn has good proof that a letter sent to her by the city is 87-year-old selma cohen got a letter in the mail saying she no longer would receive medicaid benefits because she is dead but she isn't. and she needs the benefits as a cancer survivor who depends on to stay healthy.

the five victims killed were among dozens of exchange students heading to an orientation event at north seattle college. more than a dozen people are in the hospital. we are learning more about the death of bobbi kristina brown, the atlanta medical examiner says the 22-year-old's cause of death has been determined but the results won't be revealed to the public because of a court order. bobbi kristina died in july. after spending inerm six months in hospice care. she was discovered unconscious in her bathtub in january. the parents from atlanta who were drugged then viciously attacked by their own sons are speaking out about why they forgave their kids. in an exclusive interview, they said they are recovering from the injuries they suffered at the hands of their own son christopher and cameron. the couple said prior to the assault, the boys showed no

one family's journey took them one family's journey took them six months. yep, they are from argentina. that is the pope's native country. they started in march driving more than 13,000 miles in a 1980 volkswagen van. it broke down several times. >> wow. >> but it was all worth it when they got a surprise call sunday morning to come and meet pope francis personally. >> we were like -- it's like being with an old friend, really. he is so warm. he was -- told us we were crazy and but we made jokes. he said pray for us. >> the family says that they have been following the pope's teachings for years since his time as cardinal. >> we will have stories about this pope's visit for a long time to come. one is better than the next. >> that is good. this afternoon we have cloudy weather. temperatures are comfortable. humidity on the high side. it's warmer than normal for this time of the year. this is the few weeks where we transition from warm to cold to

warm to cold, that kind of thing. we have a lot to talk about. we have cloudy skies. we will have breaks of sun for the afternoon as we look across central park. and we will look at a temperature of 74 degrees. that is already above the normal afternoon high. we have a northeast wind here and the pressure at 30.37. we will get close to 80 in several spots. 74 across fire island to 72 to 75 down the jersey shore. 72 monticello. wind. when the someone breaks through that allows to do its magic. to the late week, we are looking at a tropical depression that can give us more rain, much needed rain. a couple of showers are showing up on the radar. keep your fingers crossed that you get one for the afternoon. clouds, rain to the west here and the front here. so, this sweeps in. with the rain off to the west, we could get a few showers out of that tomorrow. that is showing up on

shower in the afternoon. look at wednesday. overnight tuesday into wednesday, heavy soaking rains, heaviest north and west and maybe a few showers left over wednesday into thursday. then we will see what happens in the atlantic. that could throw back rain over us into thursday into friday. so, a shower or two tomorrow. then here comes the front with a big batch of rain coming. then we have the depression down to the south. that runs into the front, that keeps us cooler and wetter and a few showers for thursday into friday. temperatures tonight are really warm. 70 in the city. 60 north and west. normally this should be about 56 to 46. it's way warmer. tomorrow 10 warmer than normal. 11 warmer than normal park to newark. breaks of sun, humid this afternoon. 80. tonight there might be a spotty shower around. a warm muggy stuffy 70 in the city. and 65 north and west to 60 well north and west. tomorrow 81 with a little shower possible.
