exactly what happened. to add to all of this, this is surveillance camera video that shows the child falling through the air onto the courtyard below. again, a woman found that child, the wife of the super of that child found the child in the courthouse. police are investigating the circumstances. they believe this child was thrown out a seven floor window at about 2:30 this afternoon. nobody has been charged. we want to be clear about that. nobody yet charged in this case. but police are investigating it as a homicide. you walk through this neighborhood right now and you talk to people and they keep saying we would have taken that child, so many people want a child. it is a desperate situation here, people trying to imagine what in the world could lead to this situation. again, police now investigating this as a homicide. for now reporting live from the west fordham section of the bronx, jim dolan, channel 7 eyewitness news.

>> boy, just so sad. jim, thank you. now the mta bus driver arraigned today on several charges including reckless endangerment and drunk driving. this for taking a city bus on a joyride. but in an exclusive interview today he denied being drunk and blamed his condition on other medical problems. eyewitness news reporter kristin thorne at the courthouse in hempstead in long island with the latest. kristin. >> reporter: alexander copeland tells me simply he doesn't remember anything that happened that day including going from his home in suffolk county to the bus depot in queens on a day he wasn't even supposed to be working. >> don't remember the trip in, don't remember being at the depot, don't remember leaving with a bus. don't remember the stops. >> reporter: alexander copeland says all he knows about what happened the afternoon of sunday, september 13th, is what his coworkers tell him. >> i was told i showed up at work, said what day it was, was told it was a different day, but there was two runs available, i was going to be given the first one but somebody else took that run so i was going to get the second

run so i was waiting for my time to do the second run which was when during that time when i fell and hit my head. >> reporter: he says he doesn't remember taking this bus from the mta depot in jamaica and driving it onto the northern state parkway. police received several calls from drivers reporting a bus swerving on the road around exit 32. when police pulled copeland over, they say he had a blood alcohol content of .20. is it accurate to say you're day? >> he's not saying anything with regard to that right now. we are talking about sunday, absolutely the night that he drank on sunday. no doubt about that. but whatever he did on saturday or friday or all of that stuff and the absorption rate of alcohol into the bloodstream and all that, that's going to be the focus of why we are here and what we are doing. >> reporter: copeland's attorney, knefel mitchell says copeland takes several different medications. they need to see if those had any effect on the breathalyzer. >> and we are very grateful, he is and his wife is very grateful this happened without

without any accidents. >> reporter: copeland's attorney says they have statements from two doctors that he did suffer a concussion that day. the judge today suspended copeland's license. he has been suspended from the mta without pay but has an administrative hearing tomorrow. we are live in hempstead, kristin thorne, channel 7 eyewitness news. >> thank you. new york city tonight is investigating a new cluster of legionnaire's disease in the bronx. seven more people have become sick in this latest outbreak. all of the victims either live in the morris park area or have a connection to it. eyewitness news reporter sandra bookman is there tonight with more. >> reporter: yeah, liz, right now geography is the common denominator here but health officials are telling us tonight that none of these seven people that are affected with the legionnaire's disease were either -- either lived or worked in the same building. that means it has them looking at outdoor sources like cooling towers.

individuals in the morris park neighborhood of just the quick facts, all currently hospitalized, age t"io"yy(b`qa'range 40s through 70s, all seven have underlying health conditions. >> reporter: mayor bill de blasio today updated new yorkers on the latest cluster of legionnaire's disease cases in the bronx. the 71st identified a week ago -- seven first identified a week ago and not related to the deadly outbreak this summer that claimed 12 lives. >> i want to emphasize seven people hospitalized, thank god all getting treatment, there have been no deaths in this situation. >> reporter: over the weekend crews tested 35 cooling towers across morris park as they searched for the source of the outbreak. >> this task was made much simpler by the fact that we had, due to the efforts of the mayor, the speaker and our council, a law in place which requires the registration of cooling towers.

legionnaire's disease around here. >> really? >> reporter: in morris park, yeah. >> that >> reporter: while word of this latest cluster came as a shock to some area residents who believe the summer's outbreak of legionnaire's would be the last was a hotel cooling tower was identified as the source, others took the news in stride. >> if you know what the safe things are and you know the precautions and what you should do when you see the signs and get it taken care of, you should be fine. >> leashed a lot from the first go -- learned a lot from the first go-around and hopefully after these seven individuals we won't see any more cases in this area or any other area of the bronx. >> reporter: and that is, of course, what city health officials are hoping as well. they are also telling us tonight that they are sending staff members to 40 locations, locations that have identified to -- have been identified to have vulnerable populations, those are elderly people like nursing homes, senior centers,

systems, these people at risk for dealing with legionnaire's disease. again, samples from those towers are -- have been taken to a lab. those results expected soon. we are live tonight in morris park in the bronx, i'm sandra bookman, channel 7 eyewitness news. >> fingers crossed on this. sandra, thank you. a federal judge say dismissing four bribery accounts against bob menendez and an associate. ma den nez did -- a 22 count indictment accused menendez of accepting donations and gifts from melgen. a street in midtown manhattan still blocked by construction equipment tonight. thankfully nobody was hurt when the piling rig tipped over on west 30th street near sixth avenue this morning. but surveillance video obtained exclusively by eyewitness news shows it came close to hitting pedestrians. the vehicle tipped while trying

the race for president tonight offering something a bit rare, a plan from donald trump. >> trump outlining how he would change the country's tax code. those making below the average income would pay nothing, no taxes. >> and the very wealthy, well, the numbers appear a bit fuzzy. here's political reporter dave evans with more. >> well, bill, donald trump says under his plan he will have to pay a lot more in taxes because so many deductions and eliminated. but also he's proposing a big cut on top earners by lowering the highest bracket, it's now at 39.6%, he would lower it down to just 25%. today's tax news comes as a new poll shows trump still in the lead but not by those huge 30 plus percentage numbers we saw a couple of weeks ago. today's tax plan would cut taxes for millions of

americans, both the poor and rich alike. >> i think this is a common sense, well thought-out tax proposal that's going to trigger the economy. >> reporter: trump's plan would mean a couple earning less than 50,000 a at all. the top business tax would be reduced to 15% and trump would cut deductions and loopholes often favored by the rich. >> it will be simple, it will be easy, it will be fair. >> reporter: today's tax plan comes right as a new poll shows the race essentially tied between trump outsider, retired surgeon ben carson. >> i think again it's the voters being angry that they don't think their voices are being heard. >> reporter: but trump for you isn't the answer? >> no. what do i think about donald trump? >> yeah. >> do i have to think about donald trump? >> reporter: today's poll has marco rubio and carly fiorina battling for third place, rubio and trump have lately bickered a lot. rubio called trump part of a freak show last night and today trump fired back. >> look, look, senator rubio is a lightweight. we understand that.

>> reporter: although trump is not enjoying as huge of a lead as he's had lately, he is still the front runner. what do you think of donald trump is this. >> great. >> reporter: why? >> because he's going to turn the country around. we need an outsider. >> reporter: and as an outsider, trump says whatever he wants about anything. today he was asked why cbs "60 minutes" supposedly was tougher yesterday on him than on vladimir putin. >> why he is hashedder on -- harder on me than putin? i would say because putin is a nicer person than i am. >> reporter: trump has been accused of being all bluster but today's tax plan is actually his third major proposal. he's made similar outlines on guns and immigration and today on taxes. also this new poll shows hillary clinton on the democratic side, she is still the front runner, but she too is losing ground, now leading bernie sanders by just seven points if joe biden is also in the race. back in july she was 34 points ahead of sanders. nasa finally revealing what its scientists have been

especially north and west, could be a few inches of rain and less rain during the afternoon but still damp so a shower or two tomorrow at 81 and the big slug of rain coming in tomorrow night into wednesday. 8 inches below average for the year. we could really carve into that this week. considerable clouds, spotty shower tonight and also a little sun, warm and humid. then tomorrow night the heavy rain comes in later, allow for extra time for your wednesday commute, especially north and west. then opportunities for rain each and every day into the weekend and of course that's going to depend on what happens with that brewing tropical system.
