which has an out to sea possibility, although remote and a possibility of making landfall to the south of the carolinas, mid-atlantic coast, this advertise the area of that window that we favor. with a new update, they have shifted the forecast track to the west which i will have for you in main weather. eastern long island is no longer in their cohn and maybe new york city south and west is there. i like the idea of favoring that most likely track into either the carolinas or the mid- atlantic. steadier rain will stay away until tomorrow night into friday. we will get rain on the coast. a coastal flooding and beach erosion will be a big concern through the weekend. that track is trending south. we will have the latest track and the seven day forecast if a few minutes. back to you for now. towns and communities are preparing for both storms. the thought of another hurricane has a lot of people on alert. new jersey anthony johnson is in seaside with a look at the preparations taking place there.

i am standing on top one these dunes, 8 to 10 feet high on the jersey shore. many towns have down exactly the same thing. this is to protect against beach erosion as many towns prepare for the doubling whammy of rain and high winds. there is already a significant amount of street flooding on the bayside of seaside heights. that was the result of last night's rainstorm. here homes are still being raised because of the damage when the water was so high and superstorm sandy. this time residents are getting prepared. >> right now taking anything that is loose or from the property and putting it inside. i am making sure there is no debris that gets on my neighbors or become flying objects. >> reporter: the town is prepared to use military equipment to evacuate if necessary. electric generators are on standby. a mobile command center is ready in case the police and fire

sandbags are also available for residents to help with any potential flooding. these precautions began right after labor day weekend and are now in high gear. >> we have all our equipment, all our evacuation vehicles running this morning. they are full of gas, fire equipment and running morning. >> all along the shore front- end loaders were used to build dunes to product property in case the waves get too high. officials are urging residents to be prepared and not take anything for granted in case hurricane joaquin becomes a big threat to the shore. >> sandy put a strain to remember it. we don't want that to happen again. >> reporter: and one other thing they want to stress, if they tell residents to evacuate, if it gets down to that point during hurricane joaquin, if it gets to this area, they want residents along the jersey shore to get out

right away, no waiting around. that is the latest live from seaside heights, new jersey, anthony johnson, channel 7 eyewitness news. >> anthony, thank you. from new jersey to long island, social security continues our coverage from long beach where storm preps are underway. stacey? >> reporter: well, hi, sade, we heard what lee said. hurricane joaquin is only a possibility. we want to emphasize that. it may not affect long beach at all. this is the reality. it's a berm about 10 feet tall stretching east to west here in long beach. it was put in these past two days just in case. >> everything is all new. >> reporter: henry cutler just finished rebuilding after superstorm sandy. joe recalls the flooding like it was yesterday. >> this was like a 4,000-pound vehicle, you know what i mean? it eventually, from wave action, wave action, wave

>> reporter: now even the possibility of hurricane joaquin striking while it's cringe worthy. no one is saying that it will take sandy's path or pack the same punch not to mention the protective measures area residents have which they did not have then. >> i feel confident that we will not have a direct hit the way we did with everything floating away because of the dunes. we didn't have the extensive dune structures. >> reporter: these arm dunes stretch through neighboring long beach as well and this berm which public works has been constructing as the area braces for heavy rain storms in the next few days completely apart from but prior to the possibility of joaquin. >> we are all very sensitive now post sandy. so, any time any sort of potential storm is on the horizon, everyone is, for good reason, hyper vigilant. >> reporter: better prepared with a new and stronger

a medical examiner ruled the child died of natural causes related to sudden infant death syndrome. prosecutors are taking another look at the case to be sure. barry is in jail charged with the murder of her newborn baby girl on monday. she initially denied she was pregnant before telling detectives she gave birth in the shower. she claims the baby was stillborn but the medical examiner says the baby was full term and had air in her lungs when she died. developing right now, we learned one person has died in the latest cluster of legionnaires cases in the bronx. 13 cases popped up in the morris park neighborhood with onset dates before september 31st. cooling towers were sampled last weekend and 15 tested positive for the legionella bacteria. moments ago mayor de blasio talked about legionnaires at a senior center in morris park. >> we went around the city,

cleaned the cooling towers around this neighborhood and other parts of the city and we have gone back and looked at all the cooling towers in this area. any one that we want to recline we are going through the process of cleaning again. >> all 13 patients had underlying implications. a frightening crash on a bronx sidewalk. surveillance video captured the seconds before a driver lost control on kingsbridge road in the fordham section. eyewitness news reporter kemberly richardson is joining us with more on what happens. kemberly? >> reporter: diana, let me show you where this started. that black car was coming down valentine avenue right here. witnesses say it was making a whiz selling sound like something was wrong. the car jumped this curb. it crossed this island and get going into that sidewalk. it was crowded, looked very much like it looks right now

their day, these little ones were just starting their day. >> to witness something like that, it's really bad, something that i don't want to see again. >> reporter: one minute everything was okay. surveillance cameras captured kids heading to school, parents by their side. but in a split second, you could tell by the look on their faces, their body language, something was very wrong. >> that's when i saw people flying in the air and, so, i ran. >> reporter: the impact is too traffic to show. in the end, this black car plowed into five people on east kingsbridge road antonio was right there. >> he was waiting for his wife to come out of the store and that car came so fast that he didn't have a chance to get out. >> his nephew hit, the little boy thrown. antonio picked up the child who was bloody but not seriously hurt. another child, a little girl

>> she wanted a phone to call her dad. this lady gave her the phone and she tried to call her dad and then she looked at everybody and said i forgot number. so, that's when everybody broke down here. >> reporter: a woman was also hit and two more boys. >> miguel, wake up, miguel, don't close your eyes, please, tell me -- tell me if you are watching me. miguel, your little sister will be here soon. you are not alone. >> reporter: the driver seen here in a gray shirt stayed at the scene. several people tried to lift the vehicle, get it off of those trapped. >> a lot of people trying to help. a lot of people trying to do something. everybody was really worried and scared. >> reporter: again, back live, all of this -- some of the little ones, their umbrellas, their sweaters, this is what was left under the car. all of the victims are expected to live. antonio's nephew was treated

and released from the hospital. the 9-year-old is at home resting. i spoke to his aunt. she said he is doing okay considering. as for the livery driver, his license is current and in good standing. at this hour, no charges. for now live in the fordham section of the bronx, kemberly richardson, channel 7 eyewitness news. >> kemberly, thank you. russia claiming it began air strikes in syria targeting isis fighters but u.s. officials are casting doubts on the motives. jets struck near the city of holmes. ash carter said the russian air strikes didn't appear to be targeting areas held by isis forces and instead they believe the motive is to strengthen the hand of bashar as said. today palestinian president declared that palestinians are no longer bound by agreements signed with israel.

abbas told the u.n. general assembly that israel violated the agreements and there is no reason any reason for palestinians to follow them. he stopped short of giving any specifics. israeli prime minister benjamin netanyahu denounced the speech. moments ago the house passed legislation to prevent a government shut down. the senate overwhelmingly approved the legislation. that keeps the government funded until december 11th. the president said he will sign it. some republicans say -- they refuse to pass an agreement that has federal funding for planned parenthood. tonight what the kentucky clerk at the center of the same- sex marriage controversy is revealing and what the vatican has to say about it. >> a dangerous prank smashes through the window of a father's car. what he saw moments before it happened. >> and a drone warning. the number of close calls in

members of dignity, the gay catholic organization. one said he is terribly disappointed in today's news that he thought this pope would be different. conservatives are cheering the news clarifying the church's position on same-sex marriage and new life to the antigay marriage movement in america. his schedule was jam packed. lots of people would have loved to meet the pope one on one. one private meeting in d.c. at the vatican embassy is raising plenty tf eyebrows. >> i was crying, had tears out of my eyes. >> according to kentucky clerk kim davis, who refused to issue a license for same-sex marriage she got the privilege of 15 minutes with francis, given two rosaries and he supposedly told davis stay strong. >> i put my hand out. he grabbed it. i hugged him and he hugged me and he said that for your courage. >> reporter: for a pope who offered a kindler gentler church news of the meeting is a

meddle in politics. >> the vatican says the church doesn't deny the meeting took place but refused any other comments. some gay catholics wanted to meet with the pope and they say this meeting with davis and not with them makes it clear the church's position on same-sex marriage. >> thank you. pope francis is reflecting on his historic ten day pilgrimage. he called his flight from havana to washington, quote, an em blah mat particular passage. he said his address to the united nations general assembly was renewing the catholic church's support for the promotion of peace. got lee back with the weather. you have busy days ahead to follow the storm and figure out where it's going. >> yes, we have a lot of items to look at. their impact is in question. what we suspected would happen with the hurricane center track has happened. it shifted away but including part of the tri-state area.

we will see if it continues. outside a fair amount of cloud cover. it's a lot cooler. we have seen a north wind kick in. numbers are dropping. so long 80 degrees. on the last day of september will go down as the warmest september ever on record. we are at 700. a north wind at 18. just after midnight, around 79. the day goes in the books as well above average. the average around 70. we are well short of that to start october. rainfall an inch and a third, more to come. sunrise and sunset times, last year a couple of showers, 71 and mostly cloudy skies. we are down to 62 in junction. 63 in monticello. winds are gusting out of the north about 25 miles per hour. montauk the front went through. belmar 72. humidity dropping a little bit. it's not the most warm and muggy feel but a bit of a cool clammy feel. 23 miles per hour winds at teterboro. minor delays at the airports

that's what we will have through the night. mainly cloudy. yankee game will play. take the jacket to the stadium. lots of clouds tomorrow. rain developing, especially from the city south and east. it won't be terribly heavy but more rain coming in. rain seems to be moving out with a cold front but down the coast is another low trying to form and will ride up the front. that is for friday. but with the front in this place, the heaviest rain will be on the coast. northwest suburbs won't get heavy rainfall and may be spared completely. look at this futurecast, fast forward tomorrow afternoon, a band of rain over the area from the city south and east. that retreats. there is the thursday into friday rain. there is heavy rain there. swipes through by saturday morning. saturday we are in another break then we watch joaquin to see what type of impact it will have. i put a different color table to show you the red. that is an organized storm with thunderstorms rotated completely around the center.

a healthy storm at this point. still moving to the southwest toward the central bahamas. the new track from the hurricane center, it's curling near the bahamas the next 24 hours. this is the key time period. tomorrow afternoon to tomorrow evening it will take a northerly turn to the u.s. one computer model at that time says it's staying there and turns out to see. that is a remote possibility. the new hurricane center track is focusing more on the mid- atlantic, chesapeake bay and it may be farther south and west than that. we are still in the cone. it's a dangerous place to be but the trend is for the storm track to be to the south and west. the computer models are focusing on the carolinas and mid-atlantic and not northeast. better chance of rain south and east in the afternoon hours and steadier rain friday. that will be along the coast. only in the 50s friday. cooler and damp. plenty of clouds. speaking of 50s, 55.

new w at 5:00 warnings tonight about an increase in drone traffic around airports including sightings here in our area. there have been at least 50 reports from planes heading to kennedy and laguardia this year alone. >> pilot sightings of drones doubled last year and are on track to quadruple this year. that has airlines and the faa worried. >> brandi hitt has more on the danger and what can be done. >> we almost got hit by a drone. >> reporter: it's an increasingly dangerous problem across the country.

>> reporter: one close call after the next. drones nearly hitting hell hems and commercial airplanes. >> just below us on the right wing. >> a huge spike in the drone encounters. >> reporter: the situation so out of control denver international airport officials met with the faa to discuss risks to passengers, potential drone use by terrorists and outreach efforts. >> to get rid of the grandparents with their grandkids out there operating just because they don't know where they are. >> reporter: the faa says drones have nearly hit ten planes at denver international this year alone. >> sooner or later we are going to lose an airplane due to a collision. >> reporter: the unmanned aircraft in such high demand surveillance video shows thieves stealing drones this week worth $2,900 each from this california store. while the footage can be magnificent, california fire crews say drones are getting in their way during critical fire fights. >> we shot the aircraft down

i hope whoever did it doesn't do it again. >> this was bad, he said it could have been much worse. that is because he said the rocks hit where his 3-year-old son normally sits in the car. >> he was alone at the time and he got a look at the person that threw the rocks. >> long island reporter kristin thorne joins us with the search to find the rock thrower. >> reporter: he was driving on rosalyn road about to get to the overpass when he saw a small rock come down. he looked up through the roof and saw a hand over the bridge and larger rock come down. it was about this size. approaching the overpass, doing 15, 20 miles per hour when chris said someone hurled two rocks over an overpass causing this damage to the back

>> my son, 3-year-old has his car seat in the back. when it hit and i saw the glass god forbid he was in the car. >> reporter: it happened as he was leaving work heading south on rosalyn road approaching the overpass around locust when he saw -- >> a rock fall. i was about this close. it hit the front. i looked up through the sun roof and saw someone lob the rock over the side, smashed in my rear windshield. >> he said he immediately pulled over his car here to the side street, ran up the hill to try to find the person but it was too late. they were gone. >> the police walked up there to take a look, he said there were a bunch of these up there between the overpass and the railroad tracks. >> he is telling his story because he wants people to understand how serious this is. >> it's stupid, dangerous.

never does it again and hopefully gets caught so people reconsider when they do a stupid prank like that. >> reporter: nassau county police are investigating. they say they have no other reports of anything else like this happening around the area. if you know anything, you are asked to call nassau police. live in rosalyn heights, kristin thorne, channel 7 eyewitness news. >> thank you, kristin. more now on a breaking story we told you about earlier in connection with the death of a newborn girl thrown from a window in the bronx allegedly by her mother. prosecutors are reopening an investigation into the death of jennifer barry's baby boy 7 1/2 years ago. eyewitness news reporter a.j. ross just arrived with more on the new twist in the case. a.j.? >> reporter: diana, just days ago, as you mentioned, jennifer barry, according to police, threw her infant from a 7 story window.

infant son that passed away in 2008. then the medical examiner attributed her son's death to natural causes. now the prosecutor's office is reapparently ming the case and forensics. this is video of jennifer barry as she was escourted from the precinct tuesday night. she is being charged with murder and manslaughter after her daughter was found lifeless after apparently being thrown from a window. hours ago, authorities confirmed that she gave birth to another infant son that passed away. the baby boy with well documented medical issues lived for 17 days before he was found dead in barry's basement seven years ago. the death was ruled part due to sudden infant death syndrome. now prosecutors are reviewing the forensics of the case. we are learning details about barry's employment with acs. she was a trainee for six

months before she was fired for not showing up to work. officials confirm she had limited contact with 11 families and all of those encounters were well supervised. now her caseload will be reviewed. live in the bronx, a.j. ross, channel 7 eyewitness news. >> thanks. we have new details about a woman that died after getting silicone injected in her buttocks. her death was ruled a homicide. the medical examiner's office says kelly may hugh died after the silicone entered her bloodstream. she was found unresponsive may 30th. authorities are looking for the woman suspected of giving her the injections. we have been showing you how communities are getting ready for the bad weather that will be hitting our area. tonight the office of emergency management and a city council member from the upper east side will hold a training session on how to prepare for emergencies and plan for a disaster. it will be held at the stanley isaac neighborhood center from 7:00 to 8:30.

the threat of the two storms including a hurricane have people very nervous, especially on staten island which was hard hit by superstorm sandy. eyewitness news reporter rob nelson is in south beach. rob? >> reporter: sade, of course, sandy was three years ago. for folks devastated by the storm, the memories are fresh. with so much rain in the forecast and, of course, the potential for a hurricane late into the weekend, you can imagine why folks are watching the weather very, very closely. >> it's an anxious feeling for the whole neighborhood and the communities down here. >> the staten island alliance was formed in the afternoon math of sandy to help folks recover from the storm. workers said they already started to receive visits and calls from residents nervous about the forecast. >> the phone has been ringing. people are coming in. we just had a wave of seniors here. >> reporter: flooding is the biggest worry here, especially in low-lying areas where it

does not take much to overwhelm the streets and send water straight into people's homes. some streets already had ponding water from today's light rainfall. >> we have puddling from drizzle. a storm of any intensity will put them back under water. >> reporter: we ran into one woman heading into the alliance today for prestorm advice. >> scared, don't know what to do. really don't know what will happen. and just hoping for the best. >> reporter: during sandy, 16 years of staten island flooded impacting nearly 80,000 residents. with heavy rain expected this week and hurricane joaquin looming, it's the kind of forecast greeted with high anxiety. >> scary. like a nightmare reemerging. >> others enjoyed a breezy stroll on the boardwalk, mindful of what might come. >> you have to take heed. you have to listen. a lot of people thought they were safe.

new information on the deadly car crash involving caitlyn jenner. prosecutors decided not to charge her citing insufficient evidence. her car crashed into two other cars in february in malibu pushing one into oncoming traffic. the driver of the car was killed. jennifer faces lawsuits by howell's stepchildren. a lawyer says a jury trial in the civil case is the only way to hold again near accountable. a federal appeals court, a judge ruled universities could pay addition one men's basketball and football players. the ncaa sued. the ncaa welcomed the decision by two of three judges on the

it has a connection to this low off the carolinas. another area of rain, jet stream energy combines. we get the equivalent of a nor'easter type day on friday. raw, windy, periods of rainfall. the steadiest will be at the coast. here is joaquin. that is thunderstorms around the center. healthy storm. circular and moving to the south and west. not a lot of sheer ripping this storm apart. it will stay as a cat one then go to a major cat 3 in the atlantic. look at the adjusted track in the hurricane center. it was centered. now you are talking about mid- atlantic. i can see how through the night at 11:00, i wouldn't be surprised if this track isn't more south and west to the carolinas and virginia coastline. we will watch that closely for you. no matter what because you have a hurricane and a big high over

and days of winds offshore. even if joaquin doesn't come up here, we will have beach erosion. it will start thursday through the weekend. advisories and watches are up and high wind watches. watch the futurecast here. tomorrow morning it's fine. rain south and east during the afternoon hours. that should retreat. cool on friday. heavy rain on the coast on friday. now, the trend has been to see the heavier rain offshore but i think we could pick up an inch on the coast. letter seven-day forecast, breezy, cool tomorrow, damp in the afternoon south and east. in the 50s friday. that's the next heavy round. not in the northwest suburbs. not a lot of rain the next couple of days. saturday rain early. a lull during the middle of the day. sunday is all about the connection we make with joaquin even if the storm does go way to the south bands of rain and gusty winds and coastal flooding. >> thank you, lee. new at 5:00 tonight a new location for a manhattan
