police officers on the roof of one of the locations. they hear and they see individuals firing weapons at each other. we know from the evidence that we recovered at the scene that there were at least three firearms that were used during the shooting that transpired on the street. >> these are stills of the three men wanted in connection with the shooting. they are wanted for reckless endangerment. two are wearing dark jackets with hoodies. the one in the middle is wearing a white sweatshirt. if you recognize any of the men or have any information, crimestoppers. reporting live in far rockaway, darla miles, channel 7 eyewitness news. >> darla, thank you. the eyewitness news investigators tonight with stunning new revelations about the accused killer. tyrone howard sentenced to a residential drug diversion program but there were not enough beds so i was back on the streets, turned away from

a big fall from the cracks in a diversion program that gets high marks. jim hoffer is here with that part of our coverage. jim? >> reporter: that's right. the state's drug court deversion is affected. in the scrutiny of the program following the shooting death of an nypd officer we are finding out there can be problems here. we have learned that it's not the kind of program for violent offenders. now we are finding out there can be delays to treatment and daily monitoring for lack of rehab beds. tyrone howard avoided prison by agreeing to undergo 18 months of in patient residential treatment in a drug rehab facility. but the treatment was delayed because there was no bed available. instead, the court drug program required howard to check in once a month for drug testing. the first two months he showed up. in september he didn't. he eluded authorities until resurfacing this week, the prime suspect in the killing of

nypd officer randolph holder. >> that is unacceptable. >> reporter: former prosecutor david schwartz says the failure to have a bed available is an indictment not of the diversion program but a lack of commitment to funding it. this report shows out of more than 4800 offenders statewide who applied for drug diversion, 43% of them, more than 2,000 were admitted. schwartz wonders how many of these offenders are awaiting treatment and beds. >> these programs work. they are proven that they work. we just now need to put more money in the system so everybody can have a bedey one. >> reporter: many from the police commissioner to the mayor say tyrone howard with his life of crime should never have been in the drug rehab program to begin with. today the mayor proposed new laws to keep dangerous offenders out of court discretion. >> because the judge was not required to consider the danger he posed, again, the decision

was made that had costly consequences and howard was sent to treatment. he didn't show up. >> as we confirmed late this afternoon, the treatment was delayed because of a shortage of beds. and that delayed daily monitoring associated with in patient residential treatment. >> obviously he would have been closely montoward, he would have been treated and maybe this horrible tragedy would not have taken place. that's the cold-hearted facts here. >> reporter: the state division of criminal justice says the rearrest rate among offenders in drug rehab is about 10% less than among those who serve their sentence in prison. proof that these programs do work. and they are cheaper, that's for sure. how many others are in awaiting beds? we don't know. we just don't know. we are waiting for the new york drug court system to tell us. back to you, liz. >> clearly this guy fell through the cracks. we turn to the breaking

news we told you about. a synagogue in new jersey, new brunswick engulfed in flames. >> this is a look at the scene a short time ago. floors. at 6:04 in new jersey, it's the sabbath and that semple is not going to open, at least not time. toni yates is at the scene with the latest. >> reporter: yeah, bill and liz, we are on nielson street, less than a block away from right now. they are still trying to get a handle on this fire at the synagogue. smoke is heavy in this area. i will step out of the way so you can see. they are still shooting four water hoses inside the synagogue at this point. a few minutes ago we saw some windows. they will be here for a while trying to make sure that the

they get all of the hot spots, four floors collapsed under the fire. at one point they had this area cordoned off. they evacuated people but we see people walking around at this point, walking around the street. some have masks on, some don't. some are taking pictures. this synagogue was on the historic register because it is more than 100 years old. the question is, as several fire departments are trying to put out the fire, the question is how did it start. we know it started on the third floor. the good thing at this point, there are no injuries. we have heard that no one was injured in the fire. new brunswick fire officials tell us that they have mutual aid from several surrounding fire departments here. they have closed off some of the streets. you can see the flames were

it is more than 100 years old, put on the national historic register back in 1995. they will have their hands full trying to get this fire out and fire marshals will be looking into the cause of this fire. live in new brunswick, toni yates, channel 7 eyewitness news. we learned a partial stop work order was issued in august at the site of a water main break in queens. it's unclear if today's work violated it. a construction crew accidentally struck a 20-inch main in elmhurst around 8:00 this morning. it spewed out water for about four hours before it was shut off. several buildings were evacuated most of the day. >> the flooding condition was such that dep had a difficult time finding the exact valves to shut down toite the -- to isolate the problem area. >> officials say the contractor

responsible for break will be billed for the cost to clean up the mess. mexico bracing for what is called the most dangerous hurricane ever, thank you el nino. patricia is a category 5 storm. the storm is expected to make landfall in southwestern mexico. residents and tourists in the area are trying to find a safe place to wait out the storm. lee goldberg will have more in the weather forecast. we switch gears on this busy friday night and talk about the mets. the team took part in the first practice since clinching the berth in the world series. tonight they will hopefully find out who they will be eyewitness news reporter marcus solis is at citi field with much more on how the players upcoming series. marcus? >> a lot of the players are saying they are happy to be back playing baseball. for many of the fans that showed up at citi field, they

a community remembering an innocent girl killed by a gun. >> the 12-year-old was hit in hempstead a week ago today. her funeral held today. people are struggling saying her death is just senseless. >> her life was cut short for no reason. no reason to explain this. you are at home and your life is just taken. >> for all of us here, very mad and sad. don't know why. questioning god. don't know how to digest it. >> all understandable. a horse-drawn carriage took her coffin to the cemetery for her burial. police have not made any arrests. in france, 40 victims in the deadliest road accident in more than 30 years. a truck and a bus carrying mostly retirees collided on a rural road. the fire quickly consumed the vehicles leaving 43 people dead.

have a tropical the remnants of hurricane patricia. winds are gusty out of the north and most west, 12 miles per hour, maybe 20 miles per hour gust then after that not that gusty. 55 manhasset. 52 hampton bay. long island a frost advisory until 9:00 in the morning. most suburbs will, even near freezing north and west. wouldn't be surprised to see monticello go to a 28. we are running from 13 to 24 degrees cooler than yesterday at this time. nice and clear overnight. diminishing winds. want to see the sun early on. clouds fade the sun through midday. thicken up during the afternoon. remain dry during the daylight hours but highs in the mid- to upper-50s with showers later on. clear right now. there is moisture offshore. some of that will get drawn in tomorrow. then the storm to the west. we have a window of high pressure that will last through the daylight hours tomorrow. there is the next storm system. the heaviest is heading up here to the north.

we will get into this broken line of showers late tomorrow night. there is a connection to patricia with this but that rain is heading to texas and louisiana. our wind stream lines incredible on the storm showing the big winds on shore. the eye is 30 miles offshore. 200 miles per hour winds. strongest in the western hemisphere in terms of wind, not pressure. cat 5 hurricane 190 about to come on shore. you can see what will happen in the next 24 hours as it weakens but brings a foot or two of rainfall, mudslides and huge storm surge. close at home, tomorrow a high of 58. sun gives way to clouds. a gray finish to the day. have the umbrella later on. drizzle on the coast in the evening hours. the rest of us wait for showers after midnight. umbrella sunday morning. rain leaves. breaks in the clouds monday afternoon. connection with tropical moisture is heart wednesday and first half of thursday. update on the timing.

the royals and blue jays meet in kansas city. a bp from late this afternoon. kc leads 3-2. a win tonight at home vaults the royals into the world series. if toronto wins there would be a game 7 tomorrow to decide everything. so, we wait for baseball. we have football. we have two darn good nfl rivalry games. the jets, divisional game against the patriots at new england. so many moving parts in this game because of the history, the employers involved and how tight the afc east is. the pats lead the jets by one game and the rivalry is big on both sides. >> they are similar to us in a lot of ways. big, tough, physical team. you play in these elements. i think there is a lot of characteristics that make them tough to beat. >> now to the giants. they get the cowboys.
