>> reporter: karim baker's life, he claims, has been turned upside down when he was questioned by police during an investigation by the nypd into the murders of two detectives last december. >> i was being harassed with cops outside my door and my family member's doors, friend's doors and just everybody. >> he was pulled over by the police for various minor traffic infractions 20 times in the span of nine months. >> reporter: baker, his attorney, says appeared on security cameras for a brief moment when the detective's killer brinsley stopped him and asked directions to two housing directions. >> the conversation lasted ten seconds and they parted their ways. >> reporter: after the detectives were shot and killed baker said he was questioned by police about his brief conversation. then on october 21st, baker claims he suffered these injuries after being beaten by officers and was unjustly

he had to show them id. >> i'm physically i'm in pain but most of all it's just like i said, those are the people i call for help. i'm just hurt. >> both of them stomped into his head and pushed his face into the concrete and gave him a serious and severe beating. >> reporter: the nypd said the arresting officer's supervision notified them he was injured while resisting arrest. no allegation -- now he's turning to the court. >> i have no hate towards police officers at all and that's who i call when i need help. so i'm just hurt and it's a lot of things. >> reporter: mr. baker is back in court to face charges from that arrest next month. reporting live, tim fleischer,

channel 7 eye witness news. >> tim, thank you. developing news right now in manhattan. new video of protesters getting arrested at a demonstration. 50 demonstrators have been arrested charged with disorderly conduct. this for blocking the building's entrance. faculty and staff members demanding a fair contract offer. protesters say they've gone five years without a contract and six without a raise. an mta bus driver accused of a deadly hit and run faced a judge for the first time. he set bail at $25,000 for paul roper. he's accused of running over 70-year-old carole bell yesterday. surveillance video shows he made a left turn just as she was crossing the street and plowed right into her. he stopped for less than 5 seconds and never got out of depot. his family claimed he had no idea he hit someone.

used duct tape to make his point. parents of the kids who were there are speaking out on his behalf. >> we miss him. we all love him. we got respect for him. >> reporter: students here at is-292 and parents from east new york hoping people understand the full story about their community marching band leader. he was arrested last week after allegedly duct taping a 9-year-old boy's mouth shut. hughes runs the soul tiger marching band, well known for doing good in the community. even the subject of a documentary. >> there was a lot of gang violence. band like distracted kids and took kids off the street. >> he's like a father figure to me. i look up to me as a father. >> reporter: last week hughes was charged with assault endangering the welfare of a child.

he had nothing to say at court. today these parents say the incident just didn't happen the way people think. >> he was talking about kim krou. >> reporter: he insists. >> he didn't just hold a kid down and stick tape to his face and try to hurt the kid. he was like look, this is what would have happened. >> the demonstration lasted for about one minute. >> reporter: through a prepared statement this mom of a band member says that the principal of is-292 wanted the soul tigers out of the building anyway long before this. >> used this situation as leverage to finally get mr. hughes and his program out of the building. >> reporter: the department of education had no comment about that and continued to call the allegations deeply troubling. parents say they're drubled about their kids once in band and now out here on the streets. in east new york, stacey saeger,

channel 7 eye witness news. the government's star witness taking the stand in the corruption trial of former new york state assembly speaker sheldon. millions of dollars in legal referral fees but when the lawyer is also one of the most powerful men in the state, an elected officials federal prosecutors say that's illegal. dave evans with the latest at federal court in lower manhattan. >> reporter: you just mentioned it. he supposeedly steered $500,000 in state money to a doctor for cancer research. that doctor testified in federal court he steered cancer patients to silver's law firm and he got $3 million in fees for all that. today the first big day of testimony. september 11th and a cloud of

envelope lower manhattan plays a significant role. the prosecution's star witness is dr. robert tow. today he testified he pushed silver for grants totalling $500,000. i hoped to develop a relationship with silver that would help fund research and help my patients. the doctor also had is also silver wanted. as a lawyer for whites and luxenburg, he wanted asbestos referrals. they could earn the firm a fortune. the doctor said i knew it would benefit his standing in the firm. it could be very valuable, yes. today the doctor testified he met him in 1984 and became friends, spent time during weddings and passovers. prosecutors asked how he made referrals. he said it was easy. i would ask patient contact mr. silver.

i called him. i called his state office. silver's defense team is already questioning a government agreement granting him immunity from prosecution in exchange for his testimony. today he was asked about a 6:00 a.m. visit by federal investigators one day in the summer of 2014. agents asked about those patient referrals. the doctor testified that i denied doing so. i was terrified and panicked. i wanted to divorce myself from pending investigation. he is fighting to keep his job at columbia university. silver is no longer the speaker but remains an assembly member. if he were to be convicted he would lose his job and could spend the rest of his life in prison. reporting live in lower manhattan, dave evans. >> fascinating trial. thank you. as we continue on eye witness news, new fears that terrorists may have brought down that russian plane that crashed

tonight, u.s. officials are joining uk officials saying they have information a bomb may have brought down a russian plane. the u.s. official says it intercepted communication led to a tentative conclusion the isis affiliate in egypt put an explosive on the plane. the official says this is not a final judgment with forensic evidence that is still being analyzed. 224 people on the plane died on saturday. in the race for president, republicans donald trump and ben carson are in a statistical tie for first place. the first full poll since last week's debate shows trump with 24% and carson with 23 and marco

outside we go tonight with new york city looks fantastic right now. the empire state building is in orange but this is the sunset over new york harbor that happened at 4:59. another gorgeous one. it's one after the other. getting so spoiled. we have a great shot of the skyline and the streets are packed. the water is like a piece of glass. it's calm and it's almost as crowded on the west side tonight as the balloon inflation night before thanksgiving. it's 61 degrees and southeasterly wind is light. tomorrow will be a close call. we may reach the 70 mark at the record high is 78. way above the average of 58. there are the sun vise and sunset times. it was 70s in the afternoon but this cooler along the coast. that's a sign of things to come. we'll have more clouds tomorrow. temperatures will be near 70s. a balmy breeze friday and record warmth and the fall feel will

we have the winds out of the southeast. you see the 50s now. we're cooling off a little faster right now because of the ocean wind. the cooling will slow because the clouds are coming in and we won't have upper 30s and 40s in the suburbs. it'll be 45 to 50. low clouds will be building tonight and mostly cloudy tomorrow and might be a spotty shower in the afternoon and take the umbrella for the most part. we're clear for right now. with this high in cape cod, it's going to drag up some of the cloudiness reaching up through virginia into the delmar. it's only a matter of time before low clouds come in. mid-40s to mid-50s and tomorrow making a run at the 70-degree mark despite the lack of sunshine and a spotty shower in the afternoon hours. 69 and will here's the story. we're forecasting a run and a record at 74. it's going to start out gloomy with low clouds.

when a southwest wind kicks in the sky will clear in a hurry. temperatures will be off to the races. we could be in the mid and upper 70s holding in the 60s at the coast and they'll be a small window where it feels summery in the afternoon hours. it's not right from the get go. fall foliage will be peaking over the next week or two. 56 degrees increasing clouds tonight. low clouds and fog late. little different look tomorrow and gloomy and we'll get up to 69 despite the sun and shower. there could be a touch of drizzle tomorrow night into friday morning. then the clouds should break and we go into the mid-70s. 65 on saturday and clouds along the coast and give way to sun and a cool breeze. warming up next week. there's the thundershowers tuesday into wednesday. >> okay. >> gloomy would be snow. rob is up next with sports. >> the mets are still in the news. if there's a team that's been on

decisions to be made? sure. all in due time. it's new york versus florida sunday. we start with the giants at tampa bay and jason pierre paul might be ready to go. the giants have been increasing the workload and they could use somebody to help the pass rush. he injured his hand in the fireworks accident and trying to convince the medical staff he'd be ready to roll against the bucs. >> it's going to be a big adjustment. it's something that i got to get over and playing football they'll be things i have to adjust. there's nothing i can't do. >> if he's ready we'll play him. if he's not ready we'll take more time. >> jets at home seasoned against jacksonville. ryan fitzpatrick will start at quarterback. he tore a ligament at oakland and eventually he'll have to do something about that. today he wore a glove. fitzpatrick did everything in practice today. i'm sure there's concern about playing but the jets hope their qb keeps improving. >> i want to go out and help the team.
