wounded correctional officer. he and his union rallying around city hall demanding greater protection and the firing of the prison chief. >> they claim the use of force guidelines puts correction officers at greater danger from inmates. darla miles is at city hall with the latest. >> bloody and gruesome photos of corrections officers who they say have been assaulted by inmate. one of these pictures included a corrections officer who had part of his thumb removed and they say the inmates who have committed these assaults are laughing and joking about it because they believe the use of force policy has given them all a free pass. >> this city would have been turned upside down. >> reporter: it was two one last thursday. gang members

>> this could have easily been a funeral today. >> reporter: members who rallied outside city hall this afternoon say new d.o.c. guidelines will only make jobs more dangerous. >> whoever thought getting rid of solitary confinement good idea, you need to pack your stuff up and you need to go. >> reporter: it took legal action monday, requesting an injunction to put the brakes on rules like no solitary confinement for inmates under 21. >> you cannot hold someone in a position of power in the new york city department of corrections and their main objective is to assure those correction officers are stabbed on a daily basis, sexually assaulted on a daily basis and nothing happens to them. the bronx district attorney refuses to prosecute inmates that assault correction officers. >> reporter: but the bronx district attorney says so far this year it has charged 308 inmates for assaulting

corrections officers, 40 of which are felonies. and the force policy was drafted with recognition from members of staff including the unions. >> i believe we're on the right track to reduce the use of force properly and to get away from things like punitive segregation. >> mayor deplauz -- de blasio continues to stand by the newd.o. commissioner -- stand by the new d.o.c. commissioner but the union today still calling for his resignation. darla miles, channel 7 eyewitness news. now to that taxi accident, fatal accident. an 88-year-old woman killed by a 73-year-old taxi driver in manhattan. >> the driver told police he had started his shift nearly 16 hours before the crash but now

>> louisa rosario hit and killed. 108 pedestrians killed in new york so far this year, 12 since halloween. eyewitness news reporter mallory hoff in the bronx with the latest. >> this is the area where this cab driver and his son share an apartment. his son shared with me earlier today his father is incredibly sorry and tonight for the first time we're getting a look at the moments before this accident. >> reporter: this surveillance video captures a woman as she steps off of the sidewalk in to a crosswalk. a cab then turns the corner before hitting her. khalil's 73-year-old father cab driver is charged with failure to yield to a pedestrian. investigators say he hit and killed 88-year-old louisa rosario early sunday morning. >> what has he said to you? >> he's truly sorry. i feel sorry for him. >> reporter: police say rosario

109th street in the marked crosswalk with a green signal when she was hit. candles burn near that area in remembrance. >> how many hours did you work that day? >> i don't know. >> reporter: according to the technology inside taxis, he logged in to his cab at 9:00 in the morning. he worked five hours until 2:00 p.m. when he took a break. he was back behind the wheel at 3:00 and was active till 5:40. he took another break and began driving around 7:00 p.m. and remained behind the wheel until the accident at 12:40 in the morning. his license was immediately suspended when he was charged with failure to yield. mayor de blasio said today the specifics of the driver's shift are being investigated. >> we have an aggressive approach to the taxi and limousine commission to inhibit anyone from working more hours than they should. it's important that we keep those

about the safety of our people so we need to know a lot more case. >> this man we've learned has been a cab driver for 26 years. mid-december. live in the bronx, mallory hoff, channel 7 eyewitness news. the nypd tonight searching for two suspects in a triple shooting near penn station that police say may be drug related. surveillance video shows a man reacting to gunfire just after 6:00 this morning. investigators say the got in to an argument with two men wearing hoodies inside of a nearby mcdonald's. the victims left and went in to the subway. the gunman followed them and opened fire at the bottom of the stairs. angel kin you -- quinones was shot. he was a known heroin dealer.

aka milton gomez, under arrest tonight accused of sexually abusing a boy that he baby sat for for six years. police say he videotaped the assault. narvaez also worked at a custodian at a church in midtown. authorities expect he likely abused other children. horrific car crash on staten island. one person is this is near the dongan hills section. a 28-year-old male passenger hit a utility pole. the 25-year-old driver suffered head and body trauma. the 18-year-old in the back seat and 88-year-old driver of the other car have neck and back pain. new at 6:00, the incoming mayor of mount vernon is now going to court to stop the current mayor from doing more work at a local park. he and some community leaders claim the administration has mismanaged millions of dollars spent on memorial park and some potentially contaminated dirt may have been dumped there as well. here's tim fleischer. >> we

over a sexting scandal. the 14-year-old boys filmed a sexual encounter with a young female student and the video was passed around kings park high school. school officials would only say any student involved in any way with the incident is now under suspension. parents are outraged because some students were punished just for viewing the video. >> it's impossible to believe that your son could get in trouble because somebody forwarded a video to his phone that he has no control over receiving it. >> suffolk county police say they could also arrest some students who happen to pass along that video as well. also on long island we have new information in a pit bull mauling that killed a little girl. 9-year-old amiyah dunston suddenly attacked by the dog. happened in the backyard of a friend's home yesterday. n.j. burkett with the story. >> this is the house where the little girl was visiting friends

yesterday and where the man on the second floor of the upstairs tenant had a pit bull terrier. tonight neighbors tell me the dog seemed aggressive. the family friend says the little girl was afraid of the dog. >> reporter: the little girl's mother left her home today, too distraught to talk about it. the horrifying end to her 9-year-old daughter's life. brian willis is the girl's stepfather. >> amiyah was a phenomenal little girl. touched many lives with her presence, smile, and laughs. we thank you for your support and prayers. please let terrible tragic loss. thank you. >> reporter: a miyah kayla dunson was playing in her friend's backyard sand morning when she was mauled to death by a tenant's snarling pit bull terrier. whizzes -- witnesses say the attack was unstoppable until it lufgd it -- it lunged at a police

officer who shot and killed it. >> a lot of people were struggling to get away but they couldn't. my daughter can't sleep. >> reporter: the dog's owner is 29-year-old carlyle arnold, arrested at the scene on an outstanding warrant, but eyewitness news has learned authorities are now considering criminal charges in this case. on arnold's facebook page is this photograph with a caption that reads the beast. neighbors we spoke with said the dog seemed aggressive. >> if he's aware that you're passing by he will bark. he will bark very aggressively. he'll be angry. >> reporter: a family friend said amiyah was afraid of the dog. >> she's afraid of the dog when she goes there. so if the child is always afraid of the dog, you know? that says something. >> to

at stop&shop, prices are down. savings are up. my stop&shop. new information right now, a breaking story we've been following since eyewitness news at 5:00. you're look at a serious car accident happening in prospect park south. there have been some injuries and shannon sohn has the latest on that. >> three people are in serious condition and one in critical condition after this car flipped over on the sidewalk in front of 992t flatbush avenue. you can clearly see the car back on its back end.

it took down a pole as well as a tree. to give you an idea how fast this car was moving, this pile was where that tree was planted when it went up on to the sidewalk. police are investigating what caused this accident to happened. but three in serious condition and one in critical condition after this accident. reporting live over brooklyn, shannon sohn, channel 7 eyewitness news. >> just a horrible two weeks for pedestrians in new york city. >> more tonight at 11:00. you're tracking some rain for tomorrow. >> i think for the most part from new york city north and west, going to be light, soggier rainfall amounts are going to vary quite a bit. leaves could be a little bit slippery. keep that in mind the clouds always build when a storm is approaching high to low so you have the high thin clouds working in. later on. a pretty sunset and it's going to be a nice pleasant our temperatures are still working in the mid 50s. with this blanket of clouds, the

numbers we don't know drop too rapidly tonight. upper 70s in the northern suburbs. southerly wind around 3. barometer still high. the high today just shy of the 60-degree mark. average high, 56. we'll be right on that tomorrow, maybe a little bit above. there are your sunrise and sunset times. occasional rain tomorrow. steadier, soggy along the coast. damp daybreak on veterans day. that would be early on. clouds will slowly break from lunchtime in to the afternoon. another round of rain thursday. that's primarily midday and afternoon. morning looks okay then it turns in to a nice weekend, friday through sunday looking okay. sayreville at 50. these are the areas where i think we're guaranteed at least some rainfall by tomorrow morning. it becomes questionable north and west of new york city. the difference between the south shore and north shore will be a difference can -- during the day tomorrow. showers sneaking in to extreme southern ocean county.

central southern. steadier along the coast. here come the clouds working in. a lot of dry air in place. that's definitely drying out the leading edge of some of this rainfall. it's multiple areas of low pressure. one is going offshore. one is going to our west. this part in the middle, if they don't remain linked, we get robbed from any of the rainfall. i think some of the steadiest rainfall is going to get close or the had coast. tropical storm kate, it's going offshore but it has some pluns in the storm track of that -- some influence in the storm track of that low. it will weaken, morning commute is wettest to the south. not much going on from the city on north and long island. then during the midday and afternoon occasional rainfall, steadier at the coast. another batch is going to try to come through the entire area tomorrow evening and things dry out by wednesday morning. 60 degrees tomorrow, damp at times. on wednesday it's the early morning giving way to sunshine during the
