>> this is gerritsen avenue. at the end of the it it dead ends. that where that car is submerged in water. the drivers from the harbor unit are also in the water. take a look. this is the car that's now underwater. this video was taken 10:00, about 10:05 yesterday morning. the car comes racing down gerritsen avenue speeding toward the water then, of course, it plunges in to the water. a gentleman who lives here in the neighborhood was here yesterday morning after this happened. he noticed a wooden kind of ply board fence was missing. there is construction going on at the end of the road. he looked in the water. he didn't see anything. he didn't think anything of it. then he looked at that surveillance video, the video you're seeing and he realized something was very wrong and called police this afternoon. that's why they're out here now. i spoke to him just a few minutes ago. take a listen to

what chris had to say. >> yesterday evening i noticed the fence was damaged, the plywood was damaged. i are didn't know why. i thought maybe something had hit it but i didn't really think too much of it. there was no vehicle visible or anything like that. >> then you went and looked at surveillance video? >> yes. some of my -- saw my neighbor today and he had a video. >> what did you think when you saw it? >> unbelievable that a car would go so fast and no indication of stopping. >> all was no sign, no indication that car, the driver of that car was going to stop. that video taken just before 5:00 yesterday morning. live look now, divers from the nypd harbor unit kid go -- did go down in the water. this is early in the investigation but they did discover a man inside that car who was dead.

in going on here. again, if we have anymore information we'll bring it to you. live in brooklyn, kemberly richardson, channel 7 eyewitness news. >> what a story. now to that decapitated body. late this afternoon police identified the victim as 50-year-old pamela davis who had been reported missing. >> police are questioning one person. the victim's decomposing body was found in a home on 11th street in newark today. >> toni yates at the scene tonight. >> pamela davis' family had been looking for her ever since she went missing on october 30th. they obviously suspected they did not have to go we're told their son went to the house where her body was found. he smelled that foul odor and he called police. >> reporter: this is the picture davis' family posted in the area offering a reward for information to help find her.

police responded to 803 south 11th street around midnight last night after that call from davis' family. sources it tell us her body was bound, decomposing and can capitated in a garage. crews today removed two cars from the property and interviewed people at the house. an older couple and their tenant, a man who grew up in the area, tells us the tenant is a well known street mechanic who lived in the house for about 12 years but lived in newark all his life. in fact, joseph max said he was headed to see that tenant for him to work on that van until he saw all the police activity. >> he'd always been a mechanic. everybody know him so we always come by and let him do small things like when it comes to our cars. >> was he a violent person? >> never seen him hurt nobody. everybody know him so everybody say he's a pleasant guy so that's why it's a shock to hear something like this drastically could happen. >> of course police are questioning everybody at the

house where the body was found. the elderly couple who owns the house, the street mechanic who lives there, but at this point no one has been arrested. no one has been charged in this death. the investigation continues. for now we're live in newark, toni yates, channel 7 eyewitness news. a murder mystery in westchester county. an 83-year-old woman found dead in her home and tonight no suspects. new york state police spending hours scouring the woods of the north salem property of lois and eugene colley. caretaker found lois colley's body in a laundry room. police say she died of blupt force trauma. they do not consider her husband known for her empire of mcdonald's franchise restaurants a suspect. parents of some of the 20 students on long island suspended over a sexting scandal are promising a fight tonight. two 14-year-old boys have been arrested. one of them for taping the other student having sex with a young girl. that video was sent to other students at kings park high school who

were also suspended. did the school go too far? n.j. burkett is there with the latest. >> that's right, the suspensions had been handed out and tonight administrators here say they're ready to close the book on the scandal but some parents are furious, saying their children are being punished for someone else's crime. >> reporter: students left kings park high school as administrators here moved quickly to put the scandal to rest. announcing just 90 minutes ago that the district has conducted and completed a thorough investigation surrounding the alleged sexting incident. we do not anticipate any further suspensions. the district said the superintendent regrets that this incident ever happened. end quote. that is surely an understatement. a total of 20 students were suspended in the scandal. one boy, a sophomore, defied the suspension with the support of his parents but was sent home.

my son received the video. that they don't even have. they just have hearsay that i sent the video to aj and my son saying yeah, i saw the video. i opened the video that came to my phone. >> reporter: but administrators were firm, suspending not only those suspected of forwarding or showing the video but even those who simply received it yet failed to report it to school officials. >> people that send it around, i understand that. but people who receive it and aren't asking for it, that's not right. >> reporter: the video depicts a sexual encounter of two teenagers in neighboring smithtown. two boys accused of making the video have been arrested and charged as juveniles. we will be conducting our own investigation to further explore this incident, said the superintendent. and students found to be involved, they face serious disciplinary consequences. end quote. administrators in smith town

clearly determine to see how far this video district. we may learn more about that at the smithtown school board meeting tonight. live in kings park, long island, n.j. burkett. >> the latest tonight on eyewitness news at 11:00. now to the weather. pretty dreary day outside. more rain heading our way tonight. parts of the area got pretty strong storms. this is hail. this was sent to us by an eyewitness news viewer who tweeted it. let's check in with meteorologist lee goldberg. >> good news right now. more leaves fall ing than raindrops at this hour because we're in a lull that will get steadier as we go through the evening hours. a look outside. you're not seeing umbrellas on the west side but roads are slippery. we're at 54 degrees. it's been busy. 15 but gusting over 20 miles per hour near 30 in some spots. we've had very light rainfall amounts to the north. we'll make up for lost time over the evening hours. 1.4 inches in tom's river and nearly a half

inch on the east end of long island. we're in this break here. by the way that thunderstorm that caused the hail over parts of new jersey, it blitzed across new jersey. there's the cell and there's still lightning over the last hour in bridgeport, connecticut. we're in the zone where says patchy light rain. look what has to curl in during the evening hours. this is all coming in from pennsylvania. i don't think it comes steadier until after 8:00, 9:00. it's a windy and wet commute this evening. mainly light rain but that round of steadier rain comes in a couple hours. it's likely to be focused more north and west. expect the wet roads and low visibility. that could linger for some in the evening commute. a pay raise in store for about 10,000 state workers in new york. governor cuomo today signing an executive order raising the minimum wage to $15 an hour for state workers. this comes as rallies were held today for a national day of protest

wage for all workers. political reporter dave evans with the story. >> we actually had three rallies in new york city on this issue including this one wrapping up in foley square. i think all three of these rallies probably more sparsely attended than organizers had hoped for. that may be because of today's rain but it's probably because they've been at this for quite some time. most eleblthed officials support this idea. the mayor and governor have already been pushing for $15. >> reporter: late today the governor made a new push in his fight for $15. he wants all workers in new york to some day make $15 an hour. today he ordered all state workers to earn at least that much. >> we're going to start in our own house and every employee of the state, we will adopt this law and there will be a $15 minimum wage for all state

employees. >> reporter: in new york they began at 6:00 in the morning in flatbush. harlem was the spot at lunchtime. then lower manhattan. their message, that it shouldn't be 15 for just fast food workers. it should be that way, they say, for everyone. >> right now i'm making $10 an hour. $15 an hour to me would mean spending more time with my children instead of working two jobs. >> reporter: the push is making its way in to national politics and next year's race for president. republicans saying the economy can't afford it. democrats say it can. >> i feel like it's good that they're opening their eyes to see that if you really want our vote, you will come out and support this cause. >> and the new head of the state senate up in albany, a republican says he's opposed to the idea of $15 an hour minimum wage. he says the economy simply can't afford it so i would expect in the next legislative session we'll see a big fight on this issue. it

a multimillion-dollar oil scandal and it cost taxpayers millions. >> charged with not delivering what they say they were. fill her up? hardly. >> hundreds of victims including the nypd, hospitals, schools, and homeowner. here's darla miles. >> reporter: those accused of stealing oil from the manhattan criminal courthouse are inside of it tuesday afternoon. 44 people arraigned on charges to include enterprise corruption and grand larceny. >> the defendants in this case include oil delivery companies and the owners, truck drivers and dispatchers who facilitated the scheme. >> reporter: prosecutors say these three men orchestrated the whole scheme. frank carlo, mike reardon. >> they used something called shorting which means simply delivering less oil to the

customer than the meter on the tanker truck shows what's delivered. >> reporter: this is how prosecutors say shorting works, by rigging trucks to fill customers' tanks partially with air pressure instead of oil or by diverting oil back in to the oil truck's tank. they say the suspects try to hide the fraud by speaking in code over the phone. >> when say say see the super on the third floor, that meant steal 300 gallons. >> reporter: in the bronx three oil companies have been indicted to include casanova fuel. there are five in brooklyn including enterprise transportation and new york liberty. then there's century star in westchester. >> you're also working with the city, with the business's integrity commission, with the department of consumer affairs to prevent further schemes like this one. >> prosecutors say the suspect shorted customers out of $34 million but they say this investigation is ongoing so that number could get larger and so

after today there certainly doesn't seem to be that many leaves on the trees anymore. >> if they're not gone today they certainly will be this weekend. weather is starting to get a little bit more interesting. we still have fairly mild conditions. that's in astoria looking toward the manhattan skyline. that's probably the biggest weather factor right now, low ceiling of the gusty winds. rain is fairly light across much of the area. a little steady rain across the jersey shore. 54 degrees. northeasterly wind gust ing near 30 in a couple spots. barometer still on the fall and 57 the high, still above average even though it was damp. only .2 of

an inch of rainfall. closing a half inch in some spots. we've already had 1 and 1/3rd near the coastline. visibility has come up nicely just in time for the evening commute and will stay up for a little while. more steady rain begins to move in. low and middle 50s. we'll stay in place tonight with these numbers with the clouds and notice rain gets steadier this evening. maybe even heavy at times overnight. by 7:00 in the morning i think the steady rain is moving away from new york city. mostly over connecticut, hudson valley and long island. mostly cloudy by noon time. we're drying out by the veterans day parade. yes, right now it's just patchy light rain. still steady near kingston and poughkeepsie and getting a little heavier in the jersey shore. these are the areas that have already seen an inch of rainfall. a little downpour between stafford and toms river. with the wind stream lines you can easily find the low here. counterclockwise flow. that's headed offshore taking the first batch of rain.

we were in this low for a little while. then there's the second low that has to curl through. the heaviest will bypass us to the north. see this area here, that could enhance as it gets closer. i do think we'll go through several hours starting at 8:00, or 9:00, where we get another steady batch of rain. meanwhile tropical storm kate hitching a ride on this storm but thankfully it's well offshore and that storm is going to go off to sea. winds of 70 miles per hour forecast to become a hurricane thankfully in open waters and going out in to the atlantic. futurecast here. notice how we're getting steadier. this time the steadier rain is likely to be in the north or west suburbs. we'll still have rain along the coast. there's the rain pivoting out around daybreak. it will still be a wet community. south and westward drying out. clouds starting to thin out through the afternoon. slow start for veterans day. cloudy and breezy, rain and drizzle at times, getting steadier later on. cloudy and

then clouds try to brighten a little bit. then partly to mostly cloudy. your 7-day forecast, light rain coming thursday. the morning commute should be dry. then blustery. but the sun shine is back mixing with clouds. a little chilly, i like sunday as the warmer more comfortable part of the weekend. when we come back, for the girl scout meeting... for the soccer team... for the girl scout meeting... how many meetings are you having?! at stop&shop, prices are down. savings are up.

are set to appeal. jose reyes was arrested in hawaii after an argument with he plays with the rockies who stated their disappointment. there's a new policy in place for situations like this one is alleged to be. the commissioner with broad discretion when it comes to punishment. at yankee stadium this morning over 250 volunteers helping assemble over 5,000 care packages for active duty members. >> the physical and mental stress that they go through on a daily basis to keep us safe is probably something none of us can really imagine. obviously we have fans all around the world and hopefully they come back safe and you can watch a game. last july the city of new york honored the u.s. women's soccer team for its world cup championship. we do have a reminder today, team captain
