eyewitness news reporter cefaan kim just arrived on the scene. >> reporter: well, sade and diana we were at 29th street and fifth avenue still a very heavy police presence here. let me take a step out of the way to give you a look. moments ago, police have taken out -- they took out a suspect in a red t-shirt and handcuffs and shortly after that you're seeing now the office workers building. this is about a 13 or 14 story commercial building from what it looks like it's an office complex and all of the employees inside were watching from the window. when this arrest was made and he was taken into custody. we heard loud cheers here for the nypd. now we are leaning this that suspect is connected to an early morning deny larceny this morning -- larceny this morning at 66th and madison avenue on 27th and 28th street not too far from here. in that incident, a woman 41- year-old woman came home to find that suspect in her

doorway holding on the a watch. she was not injured but we're being told that's the same suspect as they tracked down to this building just a few blocks away. unclear how they found him here. but again, at this point, it custody. and these employees here at this office building are now beginning to to be allowed out to go home that's the latest from here on 29th street and fifth avenue. cefaan kim, channel 7 eyewitness news. thank you. and now to a developing story. we are just learning about on the lower east side. a woman bum rushed by a stranger in her own apartment then sexually assaulted. eyewitness news reporter josh einiger on this scene. josh? >> reporter: and sade we're here at the baruch how wases off the fdr drive where -- houses off the fdr drive. a very disturbing bit of news for anyone who lives in this sprawling housing project. this happened at around 9:00 this morning, we can show you video of the houses, at 9:00 this morning police sources tell eyewitness news a man pushed his way into the apartment of a 40 clear worm.

she by the way has at least one child who was not home at the time. police sources say that man then sexually assaulted the victim. grabbed her cell phone and then fled. i spoke to one man who lived on the same floor as the victim who told me -- he said that massive police response just half this happened -- after this happened and he blames night shift for pailing to main tan -- failing to maintain the doors to this building and others in the project keeping them unlocked autoall hours of the day. >> really sad that people do that and then doors you know, they can walk in doors are broken. still need a lot of prepares you know. -- repairs you know. it's sad. >> there should be a lock over here and all the projects too. you know because i've got a 13- year-old daughter. she come out at 7:00 in the morning and i don't want this to happen to my daughter too. >> reporter: a lot of people sharing that same sentiment unprompted here tonight. we're going to be trying to talk to night shift in the next couple of hours about that.

we are also awaiting surveillance video we're told police have recovered from cameras here at the baruch houses. in the meantime the suspect is described as an african- american man, 5'7," wearing a black bubble jacket a black hat and he had facial hair and a dark complexion. and was wearing a gray sweater and blue jeans. police of course are hoping that if you saw someone fitting that description you will give them a call. it's pretty specific description. and when we get the video we will have it on the social media channels at abcny7 and of course right here on eyewitness news. for now we're live in the lower east side, josh einiger, eyewitness news. expect big changes tomorrow and winds are expected to pick up dramatically. lee goldberg at the weather wall. lee? >> yeah, sade, this time tomorrow night, going over the area bridges going to be pretty damaging with the wind that could be gusting near 40 miles per hour. already this particular camera in queens bouncing a little bit. we're at 60 mild degrees the wind only 40 miles per hour. but rainfall amounts have been

attorneys for mccollum say he has aspergers' syndrome and they say the disorder is the reason that he served time far series of similar incidents. a suspected accomplice in the deadly triple shooting near penn station is now in custody. police say vincent arcona walk wood bronx lebanon hospital this morning asking for medical care and giving a fake name. somebody recognized him and then contacted police. the gunman in monday's shooting at 35th street and 8th avenue is still on the loose. one person was shot and killed. two others were wounded. police in newark are looking for two suspects who posed as police officers and shot an off-duty postal officer. detectives say the men pulled the victim over near 18th avenue and winans avenue just before 4:00 the morning. somehow the victim got into a scuffle with them and was shot in the hand. he was treated and released if the hospital. -- from the hospital. the gunmen fled in a white ford crown victoria. war of words today between the mayor's office and a sitting judge. the judge today calling autothe mayor and police commissioner

during the sentencing of tyrone howard. the man charged with killing nypd officer randolph holder. howard got 12 years today for unrelated drug charges. but the bigger story was the judge's harsh words for the mayor and the police commissioner. eyewitness news reporter darla miles with the story. darla? >> reporter: well, diana, it was tyrone howard who was in court today for violating that plea agreement that sent him to a drug diversion program. but seemingly the judge patricia nunez had more harsh words for the mayor and police commissioner. howard under heavy guard thursday. in court for violating the plea agreement on a drug indictment that gave him the chance to participate in a diversion program. but the focus today not totally on him. >> this is an extraordinary case. because the media or the -- media in particular attacked the judge. for her actions in the case. and they did it unfairly and that's just not the atmosphere

for a calm deliberation and position of a sentence. >> reporter: mayor bill de blasio and police commissioner bill bratton reamed by judge nunez for comments like that. after the shooting death of nypd police officer randolph holder. >> the perpetrator was obviously a harden violent criminal. and should not have been on the streets. >> he would have been the last person new york city i would have wanted to see in the diversion program. he has shown no propensity with the number of arrests over many year period of time for changing his ways. >> reporter: i want to correct what was a false narrative in the press begun by the mayor of new york and his police commissioner who made statements without checking the facts, nunez addressed them from the bench. she said the defendant was out on the streets because he made the $35,000 bail. >> i think it would have been more appropriate had she -- adjourned the case to the atmosphere and the imposition the sentence would have been clearer and have been less volatile. >> reporter: the judge went on

flight 587 that crashed 14 years ago. mayor bill de blasio preeved over the servicement he arrived a half hour early and spent time talking with relatives of the victims. last year, the mayor missed most of the service because he was late. today, he said the crash may have been back in 2001, but he says the pain is still fresh. >> 14 years but the pain is still so strong. there is always the hope that time provides a little healing but at the same time, the grief is sharp and remains intense. >> the american airlines flight went shortly after takeoff en route to the dominican republic. isis claiming responsibility tonight for a pair of deadly bombings in lebanon. suicide bombers targeted a southern suburb in beirut killing at least 37 people and leaving scores of others hurt: the explosions came within minutes of each other during rush hour. isis' claim has not been verified.

and we are following some breaking news in new jersey. a teenager is in the hospital now after being stabbed near elizabeth high school. we're told this happened near pearl and south streets. the student was rushed to the hospital. we're told at this point, it life-threatening. we to have a crew on the way and we'll have much more as we get it. tonight we're hearing from the father of the 24-year-old man who was killed in

yesterday's explosion in new jersey. the blast also injured more than a dozen people and left many others homeless. the cause of that blast a gas explosion. new jersey reporter anthony johnson has more. >> reporter: the victim 24-year- old femi brown died as a result of the blast. his father is struggling to come to grips with the loss of his son. brown says his son was a hard worker whose life was getting on track. >> when he comes to a -- that you proud to say is your child, fe mi is that child. he's very intelligent. and he's very ambitious. >> reporter: the victim's father says his daughter was also hurt in the explosion. the family of four lived on the top floor. his son's girlfriend had moved in when her father died and was a couple of weeks pregnant. he says his son's body was landed on top of his girlfriend and that may have saved her life. but today, he's upset because he had smelled gas in the

but left it up to the landlord to call the gas company. he can only wonder if he could have saved his son's life. >> i don't know why i didn't think -- that's why i keep blaming myself. even when water happened i was the one that called 91 is. >> reporter: meanwhile residents are trying to see if they can gather any belongings but so far they have not been able to get in. >> i see -- take my documents. >> reporter: and money. >> yes. money, i don't know. document importants. >> reporter: this woman lives next door to the home where the explosion occurred and she wonders if she will ever see any of her possessions. >> they said that we can't do go back that -- go back in because it's distressed. >> reporter: right now the community is coming together to support the family of femi brown. they lost everything in the explosion and need to pay for the funeral. donations are being collected at the second macedonia baptist church.

looks great if it were a cityscape. the temperature at 60-degrees and south wind 9 to 18 miles per hour. the high today 60 degrees out there. now the barometer is still falling right now. and that just gives you indication of a front is still to our west. so we still have to have a shower threat through the early evening hours and then that will end. rainfall amounts have been light. there are the normals another day above average. and last year in the state it was partial sunshine and mild at 65 degrees. there are still some 60s in the accuweather seven day forecast. 58 kingston and same thing poughkeepsie right now. there's some rain near car mel and then 56 in armonk and it's at in yonkers -- 59 in yonkers. middletown and orange county in the mid 50s. so a pretty comfortable evening out ahead of the cold front. but there'll be a band of showers with the actual front that will come through. during the evening hours. notice from a southwest wind at 7:00 to a west find -- 7 at wind to a west wind at midnight. the winds gusting to near 25 by dawn. already breezy.

and then you have 54 by noon. but now the wednesday gusts are around 30 miles per hour. it will get pretty blustery outside. the winds will be whipping. so the rain just over fish kill and hopewell junction and that's now moving into northern fair field near brook field. it will be gone within about 15 minutes or so. there's a little shower here over southern passaic near wayne that's going to go into bergen county and maybe near mahwah. that's bro. but the showers here along with couple of hours lock pretty considering -- thundershowers look pretty organized during the front. another period of rain. i think steadiest west and knot of new york city. but not so much across central and southern new jersey. though and if you can see the timing on this futurecast, will shot its around 9:00, 9:00 from northeast hudson valley can connecticut and parts of long island. then it's listen gong. but it gets gusty tomorrow. again that front is coming through tonight and winds are breezy to window tomorrow morning but then howling during the afternoon hours so there can be some tree limbs knocked down. certainly will be challenging

a jaywalking crackdown. action tonight against pedestrians who cross the street without using the crosswalk. it's just one thing police are doing tonight to try to make our streets safer. they're cracking down on drivers too. >> since halloween, 13 people have been killed in new york city in accidents involving pedestrians. eyewitness news reporter stacey sager is live on the upper west side with what's being done. stacey? >> reporter: well, you know diana, it was only four days ago that an 88-year-old grandmother was killed on this block her block west 109th street. memorial is really a sad reminder of why most new yorkers will tell you the city can and should do more. well, today they were. the nypd spending time and

south street here on the lower east side. one of many places across the boroughs where additional police are now out on the streets. more than 1700 of them. working more than 12,000 hours. the crackdown? on bad drivers. and giving the number of pedestrian fatalities in new york city in recent weeks, enforcement is badly needed. it has been horrific. more than a dozen pedestrians now killed since halloween. three at once here in the bronx. among them, a 10-year-old girl, and her grandfather. and here on the upper west side, last sunday, 88-year-old louie so rosario was killed by a driver so tired he didn't notice her in the crosswalk. today her grandson just hoping the new initiative can make a difference. >> i hope -- help us you know prevent tragedies from occurring in such a you know unique and wonderful city that we all live and work in. >> reporter: in a separate initiative here in flushing,

jaywalkers are now being warned then cited if they don't follow the rules. but some suggest it's taking the focus off the real problem. >> what we need the nypd to do is to focus on the violations that are causing the deaths and injuries. and that is speeding and failure to yield. >> reporter: they say in some precincts speeding enforcement is actually down compared to last year but given the scope of the yes cent fatalities, attorneys are quickly -- authorities are clearly attacking the problem on all fronts. as for row czar owe, her wake begins tomorrow. her family is just hoping that this latest enforcement can actually save someone's life. it will continue through november 22nd. we're live on the upper west side, i'm sisters sisters -- stacey sager, channel 7 eyewitness news, the search is on for a standpoint in an attack that left a man on the tracks at a subway stop on the lower east side.

somebody pushed him off the platform. this happens early wednesday morning. the suspect then took off on a southbound f. train. the victim was taken to the hospital for observation. health officials are investigating the sudden and mysterious death of a student at ithaca college. 21-year-old shannon sakotas from new jersey died yesterday after a brief illness. the cause has not been determined but preliminary testing doesn't indicate a bacterial infection. just a short while ago it conducted tests and there's no public health risk to anyone who came in contact with shannon. new york senator schumer is speaking out tonight about the dangers of laser attacks after three television news corporates including newscopter 7 were hit by green laser lights yesterday. newscopter 7 was over new jersey when a laser was pointed at the point. our reporter shannon stone and our pilot contacted police and

local leaders and residents in brooklyn are fighting to shut down a massive two day electronic music festival in crown heights. the time warp festival is set to come to the bedford union armory next weekend. problem is, there are more than half a dozen houses of worship near the armory. the festival runs from 10:00 p.m. to 6:00 a.m. friday and saturday. and people will be leaving the concerts as others are trying to go to church. >> it would appear to me that the city would at least reach out to not just the churches, but to the members of the community to find out how -- how does this event fit in with the fabric of this community? >> the city says it's reviewing the event to see how kit minimize the impact on local residents. emergency crews responding to a house fire in new jersey found more than they expected. they found a marijuana growing operation. firefighters responded to a garage fire. it happened in paramus about 2:00 this morning. the flames start today spread to the main part of the home when firefighters arrived.

after putting out the fire, police found a marijuana plant facility in the basement. officers seized about 50 pot plants and arrested the four people who live in the home. another battle for the boy scouts of america. as a group of girls out in california are fighting to become one of the boys. the girls joined a program called learning for life. where they're taught many of the activities that the boy scouts learn. their participants are expected to -- parents are expected to protest tomorrow hoping the girls can join the program. they say joining the girl scouts is just not an option. >> i was jealous of what my brother got to do. how outside he got to be. >> for me being a girl honest the buys it was a police -- boys it was a place where i learned to pork with people of my -- work with people of my own gender and people of the subpoena sit gender -- opposite gender. >> the local scouts council says there's nothing they can do because the boys only rule is a national boy scouting policy. lee's accuweather forecast is up next.

this is the futurecast wind if you notice the start of the day sustained winds are numbers, 16 miles an hour and see the blues, 20, 25 miles an hour for your gusts. but then during the afternoon, all fills in, 20 to maybe 40- mile-per-hour winds during the afternoon hours, the accuweather seven day forecast looks like this. we've got a gusty day tomorrow at 58 but then you've got a gusdy tea on saturday at -- gusty day on saturday at 50. your wakeup windchills could be in the upper 20s to middle 30s. so that's one of the colder days so far this season. but on sunday, after a chilly start. really a nice recovery during the afternoon with less winds and partial sunshine. 58. feels pretty good. we can do even better early next week, back to beautiful on monday and 62 on tuesday. now clouds are going to be on the increase on wednesday. there might be a shower late in the day or at night. but if we can hold off those showers, 65 to 70 over parts of interior new jersey. before some more showers on thursday. you know you keep waiting for the cold spells to be the one that throws us into the you know cold pattern for the rest of the year. not the case yet.

new at 3:00, one of the boldest anti-smoking campaigns in history and it is unfolding right now at public housings projects across the country. >> and here in new york city, smoking may be banned in apartments soon, housing nearly half a million people. officials say the cost savings for taxpayers, more than $150 million a year. >> eyewitness news reporter rob nelson has more.

>> reporter: it's a move that would impact about 400,000 residences in about 180,000 apartments throughout new york city. a national ban on indoor smoking in public housing across the country. >> if that's what they need to do to keep everything healthy from getting cancer and all that other stuff, that's understandable. >> reporter: officials say the move would not only cut back on the impact of secondhand smoke, but would also lower building maintenance costs. and reduce the risk of fires. still, critics say it's just another example of government overreach. >> it's a benefit in one way. but it's intrusion in your personal life and your privacy. >> reporter: smoking is already prohibited in the hallways and lobbies of public housing buildings in the city. but this latest move would be a step further. leaving some to wonder about how to possibly enforce it across the city's more than 300 public housing complexes. in a statement today, the new york city housing authority said quote -- it's no secret there is an environmental,
