most of the heaviest precipitation has moved out of the city. >> we have two reports, kala rama is in rockland county. but bill evans is outside the studio on the upper west side. >> we have rain, drizzle and cloudy skies and when you look from our camera in brooklyn you'll see how low that cloud cover is and that's reduced visibility and now the winds picked up so as we go through the afternoon we've seen the rain is kind of pushing east but we have been seeing what is temperatures now well above the freezing mark at 46 degrees and we'll go on to see the temperatures even to the north around 34 of the hudson river valley up above the freezing mark, monticello is still around the freezing mark and that slush is still hanging around there but visibility is low in a couple spots. as you'll see around you'll go toward white plains, three mile visibility, two mile visibility at laguardia with the low cloud cover and the fog here so the rain is pushed to the east out toward the eastern end is now behind that and we'll get dry wind in here with drizzle for

rainfall amounts liquid equivalent of what we've had up towards poughkeepsie you'll see a half inch over four tenths, over toward the urban areas of new jersey but now for the afternoon we'll see all that pushing out and we'll get some partly cloudy skies tonight. it will be rather comfortable and back into the 50s tomorrow. you'll see tomorrow night there might be a sprinkle overnight but really end the year with very mild temperatures. now this afternoon, we'll see those temperatures into the 40s and overnight into the 40s and tomorrow we're back into the low 50s with 40s overnight again and then back into the low 50s for new years eve which we will talk about next in your accuweather forecast coming up in just a moment so don't get rid of those umbrellas. hang on to them for just a couple more hours. david? lori? great advice. the snow and sleet moved on but it left a slushy mess in the area.

fire inside a bar and liquor store on north 7th street at about 11 last night. sims died of her injuries a short time later. the other victim remains in the hospital. police are trying to determine the motive for the shooting and no arrests have been made. also in new passenger went to the windshield of a bus near the lincoln tunnel and the public safety director says the private bus stopped abruptly at a traffic light at jfk avenue. that passenger who had been standing went through the front window. >> how fast could i be going? i mean i came to the stop, so i wasn't going at any, you know? fast speed or anything like that. i just he was standing up and he went through the windshield. >> the victim landed on the street. he was rushed to the hospital be okay. also, new at noon, u.s. authorities confirm now that a

link to the paris attack has been killed. the terror suspect worked with paris ringleader but we're also told that he was killed on christmas eve. they're hoping to learn more about how and where he was killed as well as his exact connection to the later today. meanwhile authorities in belgium have arrested two people accused of planning terrorists attacks during new years celebrations in brussels. police seized isis propaganda, military style uniforms and the suspect's homes. they were allegedly planning to target the cities main square and shopping centers as well as police headquarters. here in our area security will be tight as new york gets ready to ring in 2016. more than a million people will be in times square thursday night and police will surely be visible as well. eye witness news is live in times square with more on the security measures. >> reporter: dave it's misty, cold and raw here in times

good thing it's not going to be like this on thursday night. you can bet it's going to be a lot more crowd and yes there's a lot more security. they are already getting into the spirit of things here in times square, tossing confetti from the marquise at the hard rock just across the street this morning. a fraction of the 3000 pounds of confetti that will be dumped here on new years eve. there is hundreds of thousands of people here and millions more watching around the world. security is going to be as tight as it has ever been. the mayor, the cities police commissioner, the head of the new york office of the fbi will hold a news briefing in about 90 minutes here in tended to reassure sure people that times square is going to be as safe as it can be. head of the times square alliance says all of the security may be deterring terrorists but it is not deterring tourists. more people come here for new years eve every year.

abc's elizabeth hurr has more on their capture. >> reporter: according to authorities after the u.s. marshals notified mexican officials that couch and his mother were there, it took just two days to track them down in that busy tourist town. the international manhunt for the fugitive from texas is now over. >> after 11 days of the u.s. marshall service tracking down ethan couch, we can finally say he's in custody. >> this the first image of ethan couch since his in mexico. his blonde hair gone, his hair is now died black. this blurry looking photo was of his mother tonya who according to authorities refused to sit still for the picture, but you can see she also changed her look cutting her hair. >> what we suspected all along it happened that they had planned to disappear, that they even had something that was almost akin to a going away party before they left town.

killed four people driving drunk in 2013 but was sentenced to probation using the affluenza defense, an unrecognized condition caused by his wealthy upbringing that prevented him from knowing right from wrong. couch now 18 vanished earlier this month, he was a no show at his probation hearing after this video allegedly showing couch at a party near a beer pong table was posted on twitter. >> just being at the party where people are drinking isn't going to be enough to put him behind bars but the fact that he left and if they can prove that he was trying to escape, that could do it. >> for his mother we're told a warrant has been issued for her arrest and she will be charged with hindering apprehension but first they have to be brought here back to the u.s. and that process is well under way. channel 7 eye witness news. well the mayor of cleveland claims the city and police department will review the

a grand jury failed to indict following shooting death of 12 year old tamir rice. overnight protesters condemned the decision not to charge a rookie officer timothy lowman and his partner in rice's death. prosecutors say newly enhanced video shows rice was removing his pellet gun from his waste band. he claims the officers could tell it was not a real gun. >> the death of tamir rice was an absolute tragedy. it was horrible, unfortunate and regrettable, but it was not lie the law that binds us the crime. >> there's absolutely no question that the prosecutor orchestrated an effort to exonerate these officers. >> the two officers involved in the shooting are on restricted duty. officials in cleveland are asking demonstrators to remain peaceful. well he had the police lights but not the badge. coming up on eye witness news the fake police officer arrested after pulling over a

and you're with him all the time. >> a former aid and christie appoint see had been indicted in connection with the bridge scandal; however the governor has not been charged. so far christie's campaign has not responded trump's comments. a man from hawaii won't face charges after authorities say that he flew a drone near president obama's motorcade. the incident occurred yesterday on the island of oahu where the president is on vacation with his family. secret service says that the drone briefly flew along with the presidential motorcade yesterday and officials say the pilot of the know the motorcade was in the area and immediately stopped flying the drone when asked by law enforcement. the 14 year old boys out of the hospital and talking about his fight to survive frigid temperatures in the utah wilderness. an ordeal that lasted nearly 30 hours. brayden neilson and a friend went hunting saturday morning

well, time to get a check on the accuweather forecast for the first time i've seen meteorologist bill evans close the umbrella. >> uh-huh. >> good sign. >> well there are folks with the umbrellas out and a little drizzle here and wind and if you open up the umbrella now the wind actually flips it back. just a moment ago a little while ago across the vote i helped a lady whose umbrella popped open in the wind and all of the metal rods stuck in her hair. i helped get it out of her hair in the afternoon. temperatures on long island are low to upper 40s, even up to the north temperatures are in

wind speeds here, out of the east as you'll see comes from a high about 10-18 miles per hour, 12 miles an hour this will go on for the afternoon so just want to give you what some of the real deals are out there so its been in the low 40s some in the 30s so it's kind of windy and raw and has that feel to it but it certainly won't have that feel to it by the time we get to new years eve and actually into new years day so there you'll see the last of the rain is across shelter island, twin forks keep pushing east and we start to dry out tonight and our futurecast shows that. temperatures in the 40s for the afternoon getting to the low 50s and have upper 30s and 40s and tomorrow afternoon we'll be back into those 50s once again where we get into the low 50s by afternoon with clouds and there might be a sprinkle or shower late in the day but it doesn't look like there's a whole lot of that so you'll see for our planner we just got cloudy skies as we go into the evening temperatures in the 40s so you're out and about tonight and you just need the jacket and sweater, so for new years

when the ball drops at midnight and that will be great and won't be brutally cold and we won't go into the new year with any harsh temperatures or any snow for that matter so what we have is some rain still and now we're seeing last of that little ice exiting connecticut and headed into massachusetts. we'll get to 52 this afternoon. tonight cloudy skies up 45 and tomorrow, we've got clouds, we'll get to 52 degrees and there might be a sprinkle or a shower late in the day or at night but not a big deal and then on new years eve on thursday, we got clouds in the morning and breaks of sun we get to 52 and thursday night looking great as we're going to be looking at temperatures in the mid 40s dropping on into the 30s and a little cooler on friday but still those temperatures going into the weekend and the new year in the next week are above normal for this time of the year normal high is 39 and normal low is about 29 so next week we're still having temperatures above normal and no snow on the horizon any time soon. snow, not ice. snow. >> [laughter]

a fire chief in pennsylvania rescuing a man from a car that was engulfed in flames and that rescue was caught on camera. now watch as chief nate tracy races toward a firefall in the distance. it's actually a car that burst into flames after hitting a utility pole. well with no time to put on his gear, tracy snatched the car door, causing thick black smoke to pore out of the vehicle and then grabs the man trapped inside dragging him to safety. the man was taken to the hospital with unknown injuries. also caught on camera, two stranded snowmobilers got stuck in the sierra mountains on sunday they made a cell phone recording of the fort they built to stay warm in the below zero temperatures. fortunately another member of their group was able to hike

the rescue was also caught on camera by search teams and helicopters. and a bizarre mile long traffic jam in california. and this is why. a 500-pound seal trying to cross a highway, you just don't see this every day. drivers stopped when the mammal reached the median to avoid hitting that mammal police say the seal made three attempts to try and reach a dry field. you can just see it because she was about to give birth, but she didn't make it. instead the seal was coaxed back into the water and as far as we know everything worked out fine. >> i hope so. still to come, on eye witness news at noon a man busted for pretending to be a cop in new jersey wait until you hear who he targeted and how he got caught. plus, a swimming tragedy. how does a member of an ivy league team die while doing laps?

this bar and they started shooting and she was just shot up. >> three gun shots, two people struck inside of this paterson liquor store and bar. >> i don't know why they would shoot her because everybody loves her. >> police say the 27 year old was killed and a man in his 30s was struck when a gunman walked into andy's on temple and north 7th street in paterson just after 11:00 p.m. monday and opened fire. >> it was three gun shots. >> and did you know what was going on? >> no. >> store employees say the gunman did not demand any money. he just walked in and started shooting. the whole thing caught on surveillance video. >> she was sitting in the corner and over there. she was just sitting there drinking her drink talking and the guy was standing over here like listening to the music. everything was fine. nothing. >> now 27 year old was a mother of a 10 year old boy.

standing there in the orange hoodie and she told me that her sister was just a happy go lucky funloving person, even showing me videos of her just having a good time so they the rug. they are very eager for the this gunman is. if you have any information about this shooting, please call paterson police. reporting live in paterson, channel 7 eye witness news. new at noon a man arrested in new jersey after he tried to pull over an off duty police officer. police say 68 year old richard goldrick is acused of impersonating an officer when he pulled over a vehicle on the garden state parkway near homedale last monday. well the driver of the other car was an off duty officer. the off duty officer then pulled over but then drove off. he was able to get goldrick's license plate and police arrested him the next day. happening today, services

new york air national guardsman and nypdkilled in afghanistan. the body of joseph lemm received a hero's welcome yesterday. suicide bomber struck his unit just before christmas killing him and five other americans. his wake will be held at st. anthony church in his hometown of west harrison that starts at 2:00 p.m. and then tomorrow, his funeral will be at st. patrick's cathedral. new video now in of that violent robbery in brooklyn we told you about yesterday at noon. take a look at the new surveillance video. it shows two suspects walking down a street. police say they attacked and robbed a 55 year old man yesterday morning on avenue m in midwood. the robbers punched and kicked the man and knocked him to the ground and continued beating him. the two ran off with the mans wallet. the victim treated at the hospital and released. four people including two bankers from brooklyn are accused of stealing from accounts belonging to seniors and deceased customers.

chase personal bankers stole $400,000 from at least 15 accounts. most of those accounts belong to dead clients. the brooklyn da says the scheme has been going on for at least a year. >> the way they went about doing it we charge they've identified the accounts that were dormant, very little activity and accounts where the holder, the customers actually an elderly customer. >> along with two alleged co- conspirators are charged with grand larceny and conspiracy. now to the extreme weather across the country the midwest from deadly flash flooding homes are still under water this afternoon and meanwhile families are still picking up ripped through texas. abc's lauren lister has more from dallas. >> reporter: that string of tornadoes were the deadliest in 90 years here and that's just one of the severe weather events that killed more than 45 people over the last week.

abc has the latest. >> reporter: as the lead singer of the country band back road anthem craig strickland plays to packed houses. friends and family fear for the 29 year olds life after he and a friend 22 year old chase moreland set out near tulsa, oklahoma to do duck hunting, in an area with record rainfall and flooding. moreland's body turned up overnight. authorities discovered their boat capsized but no sign of him. just hours before the two set out moreland sent out this tweet, in case we don't come back, craig strickland and i had are going right through winter storm goliath to kill ducks in oklahoma. he recently married a 2014 miss usa contestant miss arkansas retweeted the message. the duo were last seen spotted two hours after they set out. the band is asking its fans to pray for strickland's safe

back with a horrible tragedy at a pool, a college student drowning in front of his family after attempting a pretty risky feet under water. abc has the story. >> reporter: a day at the pool during a family holiday ended in tragedy monday for 21 year old dartmouth swim team member. >> cardiac arrest, the ymca. >> the ivy league swimmer pulled from the pool at a sarasota ymca, after relatives noticed he wasn't moving under water. according to a police report he had already been swimming some 4000-yards before trying to do four laps across the pool without coming up for air. a dangerous way to train for endurance putting even the most experienced swimmers at risk for potentially deadly condition called a shallow water blackout. essentially fainting after holding their breath under

high humidity and rather damp and chilly so we're looking at 33 andover, 30 monticello, and still some left over ice pellets falling but that's about done there now but the wind coming in, as we head out of the northeast and east will make you feel chilly and still these visibilities are pretty low at two miles from the park to teterboro to laguardia mile and a half at jfk, this might actually slow things down at the airports and newberg has a mile and a half visibility so we have clouds and the last little wave of ice coming across here to the north up toward albany and that will keep sliding east ward with cloudy skies and then gets to very nice improving conditions as we head toward the new year so new years eve, thursday we're looking at sunshine 53 degrees dropping to 43 by the time we get to midnight so things start to dry out over the next couple days so can't rule out a sprinkle for a shower and windy with that east wind 52 degrees the afternoon tonight we drop down to 45 and wind dies down everything starts to dry out and tomorrow we got sunshine clouds in the
