a powerful weapo until we have a congress in line with the majority of americans, there are actions within my legal authority that we can take to help reduce gun violence and save more lives actions that protect our rights and our kids after sandy hook, joe and i worked together with our teams and we put forward a whole series of executive actions to try to tighten up the existing rules and systems

but today we want to take it a step further. let me outline what we will be doing. >> number one. anybody in the business of selling firearms must get a license and conduct background checks or be subject to criminal prosecution. it doesn't matter if it's over the internet or a gun show. we are checks to cover violent criminals that try to buy some of the most dangerous firearms by hiding behind trusts and corporations and various cut outs. we are also taking steps to make the background check

under the guidance of jim comey and the fbi, deputy director tom brandon, atf, we will hire more folks to process applications faster and bring an outdated background check system into the 21st century. [ applause ] these steps will lead to a smoother process for law abiding gun owners and gun dealers and a stronger process for protecting the public from dangerous people. that's number 1. number 2, we will do everything we can to ensure the smart and effective enforcement of gun safety laws that are on the books which means we will add 200 more atf agents and investigators, we will require firearms dealers

or stolen guns on basis. we are working with advocates to protect victims of domestic abuse from gun violence where too often people are not getting the protection that they need. number 3 we will do more to help those suffering from mental illness get the help that they need. so, high profile mass shootings shine a light on the few mentally unstable people that put harm on others but two in three gun deaths are from suicides. so, a lot of our work is to prevent people from hurting themselves. that's why we made sure

as obama care -- . [ applause ] >> under that law, made sure that treatment for mental health was covered the same as treatment for other illness and we will invest $500 million to expand treatment across the country. it's always why we will ensure that federal mental health records are submitted to the background check system and remove barriers that prevent from reporting relevant information. if we can get folks proper care and fill gaps in the background check system we can spare more families the pain of losing a loved one to suicide. and for those in congress that so often rush to blame mental illness for mass shootings as a way of avoiding actions on guns, here is your chance to

money where your mouth is. [ applause ] number 4, we will boost gun safety technology. today many gun injuries and deaths are the result of illegal guns stolen, misused or discharged accidentally. letter in 2013 alone more than 500 people lost their lives to gun accidents including 30 children younger than five years old. the greatest most technologically advanced nation on earth, there is no reason for this. we need to develop new technologies that make guns safer. if we can set it up so you can't unlock your phone unless you got the right fingerprint, why can't we do the same thing

if there is an app that can help us find a missing tablet which happens to me often, the older i get, if we can do it for your ipad, there is no reason why we can't do it with a stolen gun. if a child can't open a bottle of aspirin, we should make sure that they can't pull a trigger on a gun. we will advance research, work with the private sector to update firearms technology and some gun retailers are stepping up by refusing to finalize a purchase without a complete background check or retraining from selling semi-automatic

magazines and i hope that more retailers and manufacturers join them. they need to care about a product that kills almost as many americans as car accidents. i make this point because none of us can do this alone. that point was made earlier. all of us should be able to work together to find a balance that dechairs the rest of our rights are also important. second amendment rights are important. there are other rights that we care about as well. you have to be able to balance them. because our right to worship freely and safely that my was denied to christians in charleston, south carolina and that was denied jews in kansas

muslims in chapel hill and sikhs in oak creek. they had rights too. [ applause ] our right to peaceful assembly, that right was robbed from moviegoers in aurora, lafayette, our right to life, liberty and the pursuit of happiness, those rights were stripped from college kids in blacksburg and santa barbara, high schoolers in columbine and

from every family who never imagined that their loved one would be taken from our lives by a bullet from a gun, every time i think about those kids it gets me mad. by the way, it happens on the streets of chicago every day. [ applause ] so, all of us need to demand a congress brave enough to stand up to the gun lobby's lies. all of us need to stand up and protect its citizens. all of us need to demand

businesses do our part to make the community safer. we need the wide majority of responsible gun owners who grieve with us every this happens and feel like your views are not being properly represented to join with us to demand something better. [ applause ] we need voters who want safer gun laws and disapril painted with leaders that -- disappointed with leaders to stand in their way come election time. [ applause ] some of this is simple math. yes, the gun lobby is loud and

it effortless for guns to be available for anybody any time, you know what, the rest of us have to we have to be just as organized in defense of our kids. this is not that complicated. the reason congress blocks laws is because they want to win elections. if you make it hard for them to win an election if they block those laws, they will change course, i promise you. yes, it will be hard and it

won't happen during this congress. it won't happen during my presidency. but a lot of things don't happen overnight. the woman's right to vote didn't happen overnight. the liberation of african americans didn't happen overnight. lgbt rights, that was decades worth of work. just because it's hard, that is no excuse not to try. if you have any doubt as to why you should feel that fear sure again see of now, think about what happened three weeks ago.

he played football, be loved by his classmates and teachers. his own mayor called him one of the city's success stories. the week before christmas he headed to a friend's house to play video games. he wasn't in the wrong place at the wrong time. he hadn't made a bad decision. he was exactly where any other kid would be, your kid, my kids. then gunmen started firing. and he was in high school, hadn't even gotten started in life, dove on top of three girls to shield them from the bullets and he was shot in the head and the girls were spared.

an act of heroism a lot bigger than anything we should expect from a 15-year-old. greater love hath no man than this than a man lay down his life for his friends. we are not asked to do what he did. we are not asked to have shoulders that big, a heart that strong, reactions that quick. i'm not asking people to have that same level of courage, sacrifice or love but if we love our kids and care about their prospects but if we love this country and care about its future, we can find the courage to vote and we can find the courage to get mobilized and organized.

our coverage begins with meteorologist bill evans in the weather center. bill? >> we are very cold. take a look at these temperatures. it's a pretty picture outside, blue skies, gorgeous, our temperature has been running at 19 to 22 degrees. 22 in the park this hour. that is quite cold. the temperature should be in the mid-30s this hour of the day, this time of the year. 22 poughkeepsie and over to -- around kingston and down around newburgh you see we are in the low 20s, upper teens, armonk 24. 23, 22 down the jersey shore. these numbers are cold. then you tack on the wind out of the north. it has been calming down a little bit. it's still enough when you have a 7, 8, 9, 10, 15 miles per hour wind that it makes it a few degrees colder. 22 in the park but 11 with the wind out of the north. 10 laguardia. 15 j.f.k. 13 poughkeepsie.

that's the real feel outside if you don't have gloves, ska f. it will be that way through the afternoon. temperatures in the mid- to upper-20s to near 30 this afternoon. then we are down to the teens north and west. tomorrow near 40 in the afternoon. it will feel better tomorrow afternoon then we are probably going to see the temperatures climbing into the mid-40s thursday and friday. it will drop down to a cold down. jeff smith is in elmhurst queens where it's cold and he blowing. a pretty day but a cold day. weather issue. >> reporter: i was going to say, bill, you can see the sun. it's brooklyn dingily bright. the temperature is 22 degrees right now. the wind is coming up gusting times. that is sending windchills closer to 11 or 12 degrees.

my son wants a snowman, i want a snowman. why not. >> i love winter. >> you love winter? >> yes, i do. >> reporter: the good news is there is lots of winter left. we will send it back to you. >> that's right. over half the winter still left, jeff. thank you very much. we will talk about when we might get some snow after a warm up this weekend. we will talk about that when we might be able to make a snowman in the weeks ago as we go into winter. we will talk about that in a few minutes. with the temperatures below freezing, governor cuomo's new executive order for the home list is in effect -- homeless is in effect. it requires municipality to get homeless people into shelters when the temperature drops below 32 degrees. the police commissioner says the city has taken special measures when the temperature drops.

closer look at the issue but in new york, we were already doing it. >> police commissioner says so far officers have taken 56 people off the streets. most have gone to shelters. others were taken to hospitals if they needed medical treatment. now to president obama. moments ago he announced sweeping executive actions aimed at reducing gun violence. one of the keys to the goal is to increase the number of background checks on prospective gun buyers. political climate surrounding gun control. >> instead of thinking about how to solve the problem, this has become one of our most polarized partisan debates. inaction no longer new. that's why we are here today, not to debate the last mass shooting but to do something to try to prevent the next one. >> mr. obama even getting

after sandy hook but there is more we must do as a nation. the progress we made in new york state on this issue, the continues to leave the communities in the line of fire. we are hoping to hear from connecticut governor who was in washington with the president shortly. fellow nypd officers are holding a vigil at this hour for detective joseph lemm. he was killed in an attack while an on air national guard duty in afghanistan, that is. officers at the bronx precinct where he worked are taking part in a vigil. lemm's funeral was held last cathedral. here for the ceremony. when they went home to iowa, they received a hero's welcome. such an northern for people to come for him, for his respect.

and two sons are coming to terms with the loss. coughlin is steming down as the head coach of the giants. he talked about the pride he had over the years. laura behnke is in east rutherford with more on what the coach had to say. >> reporter: tom coughlin conducted the final press conference the way he conducted everyone of his team meetings. with pay sorb -- passion, enthuse i didn't mean and five minutes before schedule. leaving will be difficult for the man who has run the show the last 12 years but simply put it was time to move on. coughlin will win two super bowls at the helm of big blue. he even dared himself to nearly everyone that played with him. after three straight losing seasons, he spoke to ownership and they say it was him who suggested he step down first.

emotional and determined president obama announcing executive orders on gun control. >> joining us on the phone is connecticut governor dan malloy at the white house for the president's announcement. we know what a huge supporter you are of gun control. he saw those tears streaming down the president's face. what did you think of that? >> they were streaming down my face as well. i thought he did a great job. a moving address.

whether it's increasing the number of atf agents or modernizing the background check system or more money for mental health, the things that he outlined today should be done shirleen and david. it's important work and it's clear that this has taken a toll on the president to have to go to speak to families time and time again. i had to do it one time at sandy hook. i can't imagine what it's like to be in his position and to have to grieve with so many families. >> governor, you heard the critics who question if the president overstepped his authority bypassing congress with his plan to tighten gun control measures. what is your reaction? >> they are wrong. he has the right. he has the responsibility. why anyone should be able to buy or sell a gun on the internet that is not subject to the same background check as every other gun doesn't make

it's down right stupid and it's time to use common language to describe these loopholes which are letting to the deaths of tens of thousands of american citizens. we decry terrorism but a fraction of the people that died in the last 14 years died as a result of terrorism. over 400,000 americans have died as a result of gun use. that is since 9/11 alone compared to 3800 in terrorism. let's do something about making our own country today and let's not sell guns to terrorists either. they can go on the internet and buy guns right now. the president is doing everything in his power to close the loophole and i support him 100%. >> we know if anybody is a supporter of gun control, it's you, especially in light of what happened at sandy hook elementary. any advice for a new administration going in or what you would hope for a new

white house. >> i hope poly they aren't visited by this damage and sorrow in the future. everything we can do to prevent families from experiencing this is god-awful important. the president summed it up. it won't happen overnight. he is taking serious actions today as he has at other times in his presidency but he has outlined what i think is a smart course. hold people accountable. any democrat or republican that doesn't support shutting down loopholes, any democrat or republican that doesn't support making americans safer doesn't deserve reelection and we should hold people accountable. >> republican candidates are promising to repeal these measures if elected into office. how fearful are you that this may be a symbolic measure. >> they shouldn't hold their breath. >> you are confident that it will hold. >> what i said time and time again is what happened in

in aurora virginia and what happened in colorado and what happened in oregon will happen in your neighborhood. eventually americans are going to wake up and smell the coffee. >> another question to follow- up on that, does this measure go far enough? >> no. obviously there are more things that could be done if the congress would act. and i think that this is a clarion call for congress to act. he didn't let anybody off the hook. he was quite clear that more can be done and should be done, not to take people's guns away that die serve to have the guns but to make america i think his analogy about car safety is important. we require people to wear seat belts, rollover bars,ing we require collapsing columns for driving cars. letter why would we not invest in technology that make guns

doesn't want us to do it. quite frankly in that case they are, again, just darn wrong. >> well, governor, we know you have a busy day on tap for you. we thank you nor weighing in on this ongoing issue. >> thanks, david, shirleen, you are doing a wonderful job. great to be with you. >> thank you. we will turn to a theft caught on camera at a restaurant and the thief is a young boy. >> the child grabbed the smartphone off the floor. new jersey reporter anthony johnson is live in saddle brook with what happened before the child grabbed the phone. anthony? >> reporter: shirleen and david, the video is very, very disturbing because it appears that an adult made the child steal the cell phone on the floor. if you take a moment, focus your attention on the three people walking out of the restaurant at the top of the screen. the young boy in the yellow jacket is with two adults. when they get near the exit the

the floor then dashes out. the troubling thing about the video is that it appears that the adult woman with the child tell the boy to grab the phone. the control phone was left behind by another child who was using his dad's phone while the family was waiting to be seated. it's easy to see that the woman and child were wrong and should have turned the phone into someone at the front counter of the restaurant. police hope this video lead to an arrest and send a strong message. >> well, it's safe to assume that the juvenile doesn't know it's a crime to take that phone off the ground and walk out the door. an adult should know. especially if it's a guardian or even worse a mother of that child. we need to send a message out only to the child but to the mother that you cannot instruct your child to be a criminal. >> of course police say that the owner of the phone is easily able to shut off the phone and try to locate it but

some serious charges. that's the latest live from saddle brook, new jersey, anthony johnson, channel 7 eyewitness news. >> thank you. also in new jersey, we know the identity of the woman that died in a house fire on new year's day. authorities say susan castellone died in the fire in clifton. at first investigators thought no one was inside the home but remains were discovered. there is no word on a cause. two firefighters were hurt battling a house fire in freezing temperatures in suffolk county. it broke out at a home on virgil drive in brentwood last night. one of the first had to be rescued after falling into a staircase. both suffer minor injuries. the chick-fil-a restaurant in midtown reopened after an inspection by the health department. the location closed voluntarily for six days. it shut down to fix a number of

the nypd is looking for three suspects in a home invasion and robbery in the bronx. this video shows video of three men entering building in fordham heights on the afternoon of december 14th. police say they went into a man's apartment, assaulted him and tied him up, stole cash, jewelry, cell phones and a laptop. police in brooklyn are searching for two men after a robbery. surveillance video shows the pair attacking a 45-year-old woman on bleecker street in bushwick. this happened december 27th just after 7:00 at night. police say the men threw the victim to the ground and took off with her bag which had $600 inside. the mother of the so-called affluenza teen will be heading back to texas. tonya couch was in court and

now to the hit series making a murder. there are petitions calling for the convicted killers at the center of the story to be pardoned. the serial documentary has hundreds of thousands in an uproar after watching the story of steve avery. he was freed after spending 18 years in prison for a crime he didn't commit. the series show cases riveting courtroom testimony questioning the evidence against avery and his teenage nephew as well. outraged viewers want them free. 200,000 people signed a petition at change.org and another 30,000 are asking for a presidential pardon. >> we wanted to present as many sides as -- sides as we could. >> it's a fair representation

and that the prosecution and the victims family have voices in the series. we hear them talking how they are feeling. we hear the prosecutor talking about why he thinks his case is strong. >> but in a statement to action news it allegation important evidence was left out of the documentary evidence like avery had drawn a torture chamber in prison and he called her cell phone three times, twice using the star 67 feature to hide his so, still the prosecutors say many questions involved. >> a lot of people are cap at the vlade by the series for sure. a woman in upstate new york desperate to find a kidney donor hopes her car will help her find the answer. >> michelle charlesworth shows us her unusual approach. >> reporter: robin ann is advertising for someone to save her life. >> you are constantly thinking

the humidity is dry. good barometer at 3061. that is the evidence of strong arctic high pressure. winds northwest at 10 in the park gusting to 18. a 10 miles per hour wind makes 22 feel like 11 for the windchill. today we will be around 30. tomorrow back to 40. we will be hovering tomorrow back toward a normal high. today it will feel better if it wasn't so windy out there. we have some of the winds out there that make it team like teens where we have 22 in the park, 22 poughkeepsie. 21 sussex. the real feel 11 in the park, 10, 15 from long island to belmar, 10 up to monticello. this will be the feel for the afternoon. even though the wind will continue to die down, the real feels will be in the 20s. high-pressure ridge slides eastward. it will feel better tomorrow. we will get into the 20s by 4:00. tomorrow morning around 7:00. 23 in the park.

by afternoon we start to get into the upper 30s to near 40 degrees tomorrow. this will be a high temperature day tomorrow at normal averages. it will feel like it should. then as we go into thursday, it warms up a little more. low 20s to the north. we will look after school, kids, at a cold after school. 30 degrees. if you have the outdoor hockey game, dress warmly. we will watch next week the possibility of our first significant snow. i thought i would give you that head's up. lee goldberg will talk about that at 4:00. tomorrow plenty of sunshine. not as cold. near 40 which is near normal. the morning temperatures will start a little chilly then everything kind of bouncing back and warms up into the weekend. we may get to 50 this weekend and rain. we will keep an eye on that. >> okay. we can deal with this. >> we can handle this.

it's time for the feed, stories that got the start on social media. many people use the internet to share their negative experiences on airlines, stores, restaurants. sometimes the customer doesn't know the whole story and maybe should have taken time to find out before posting that slam. case in point. customer complaining about a new year's at a restaurant bar in indiana. she wrote the night was ruined by having someone nearly die in the establishment then get wheeled out in front of them. the customer referring to the fellow customer as a junky and complained the staff didn't pay enough attention to her own party. the owner pointed out the victim was an elderly woman that had a heart attack and the incident took an emotional toll on the staff. the owner's defense of his staff shared around the world. there is always more to the story. >> i hope she deleted her review promptly thereafter.

mark suckerberg's epic new year's resolution. >> just being zuckerbergish. >> that facebook post prompted a lot of responses, one from darlene loretto. i keep telling my granddaughters to date the nerd in school. he may turn out to be a mark zuckerberg. much to darlene's surprise, zuckerberg responded. check this out, he said even better would be to encourage them to be the neared in their school so they can be the next successful inventor. >> that is the smart thing for mark. you don't have to marry to be successful. be sunk full. >> he is a father of a little girl. he wants to empower young women, too. >> no wonder it's getting reshared. >> one of the coldest days, bill. what do you have for us. not a lot warmer. sunny, beautiful, blew outside. as we go through the rest of the afternoon it will feel like the teens and 20s.
