sandra? >> reporter: this hearing, the appearance very brief. take a look at the video of khari noerdlinger who seemed very nervous, looking around the courtroom for his mother and others who had gathered in the courtroom to support him. of course, noerdlinger is charged with stabbing to death one of four people who police say attempted to rob him in edge water the other night, but prosecutors were explaining today, as you said shirleen, that it now appears the younger noerdlinger knew the victim. they explained, the prosecutor did, why it is that she's asking for that $500,000 bail with no option to post the customary 10%. >> he had a pre-existing relationship with the victim who we'll continue to identify as l. sam.

they also shared a business together. the evidence does show that they, in fact, were drug dealers. >> reporter: now, the prosecutor also said today in court, accused noerdlinger of going back to the scene of that stabbing and taking away evidence. the prosecutor also said he was assisted by another person, although they did not say who the person is. pleaded not guilty. his attorneys say they are hoping to get him out on bail the next day or so. later this afternoon, the four people accused of attempting to rob noerdlinger will be in court here this afternoon. we will, of course, cover that hearing and have much more on the story coming up later today on "eyewitness news." i'm sandra bookman, channel 7 "eyewitness news." >> thank you, sandra. we're also following a developing story in new jersey right now. an elevator repairman fell to

guttenburg this morning. toni? >> reporter: the police officials are here and osha is here and hudson county prosecutor's here are all in this building number 2, tower 2 at the galaxy towers where the accident happened. we are told that it is a worker from slade elevator. he fell to his death more than 40 stories down on elevator shaft this morning. the company he works for, again, slade elevator released a statement this afternoon saying that the company is saddened to hear of the accident at galaxy towers. they are expending sympathies to the family and say the cause is not yet known. we spoke earlier to a person who lives in tower 2. >> it's kind of quiet, you know, people want to respect this guy and what happened. i don't think anybody really knows for sure besides the

talk right now. >> reporter: again, osha is in the building as we speak. they've been here for about two hours or so. the hudson county prosecutor's office is leading this investigation. it's too early at this point for the company to release the name of the person who died. we will, of course, have more later on "eyewitness news." for now, we're live near in guttenburg, channel 7 "eyewitness news." firefighters in manhattan are battling a three-alarm fire on the upper west side. the flames broke out in the duct work of a restaurant on the first floor of a building on west 100th street. it quickly spread to the apartments upstairs and sent air. no injuries have been reported. turning now to vote 2016 anded candidates are in new hampshire today, just hours after the iowa caucus. the democratic race in iowa is still too close to call. hillary clinton and bernie sanders both collected more than 49% of the vote.

comedian bill cosby back in court in pennsylvania for a crucial hearing in his sexual assault case. cosby walked in to court where the case dismissed. elizabeth? >> reporter: david, right off the bat, the judge denied the prosecutor's request to postpone the hearing. yes that hearing is happening right now. while we don't know if cosby will take the stand himself, we do know that a former d.a. who's been testifying all morning for the defense. bill cosby back in court this morning, and by the end of the day, he could learn if the criminal case against him will proceed or if he can avoid prosecution. his attorneys are fighting to have the case thrown out, arguing cosby had a deal that he would never be charged. last december, just days before the statute of limitations was set to expire, the embattled comedian was charged with

assaulting former temple university employee andrea in his pennsylvania home in 2004. of the dozens of women accusing cosby of sexual assault this is the only criminal case filed against him. cosby has denied all of the allegations, and in an interview with action last may, cosby reacted to the allegations pouring in. >> i have been in this business 52 years, and i've never seen anything like this. >> reporter: the defense is now asking the judge to dismiss the case saying the 78-year-old struck a deal with then district attorney bruce caster in exchange for his testimony in the civil suit. in his deposition, cosby later admitted he had a number of affairs, and gave him pills at his home, which he said were ben drill.

the counterterrorism program of top law enforcement across the country. a day of fun on the ice turned tragic after an ice fishing accident claimed the life of a father and 4-year-old son. the 30-year-old man and his son fell through the ice in michigan sparking a rescue effort with two firefighters goating into the icy water use -- going into the icy water using 250 feet of rope and special equipment. it took a dive team about an hour to pull them out. in the end, it wasn't enough. both dad and son died at the hospital. senator chuck schumer is stepping in to help one new york village with contaminated water. a chemical found in household cleaners was discovered in the water supply which is along the vermont border. that chemical has been used by a manufacturing plant in that town. senator schumer is putting pressure on the plant's owner to fix the problem. >> it has the resources.

a warmer day with temperatures very comfortable. 59 was the high yesterday. so far the high today is 48. so this is even going to tap out at 10 or 11 degrees, warmer than normal for this time of the year. sunshine and shadows for today. i don't know why we're not seeing the shadows. it would mean six more weeks of winter. soggy and 60 tomorrow. cooler by the weekend. 48 to 50 around the five boroughs. we're looking around 47 in poughkeepsie. we've got winds that are light and out of the north. it is just a perfect february winter's day. tomorrow we have this flood watch that is in effect. there will be more counties. this is for the storm system coming tomorrow. we have clear skies and sunshine right now all the way back to the great lakes. this is the storm we're talking about that'll bring us rain. the main part of the storm will cut up through the great lakes.

investigation and appealing to mayor de blasio to fire those involved. gathering four years to the day that graham was gunned down inside of his home. to be clear a bronx grand jury declined to indict any of the officers involved. graham was 18 years old. officers say they followed graham to his home and into his home in the mistaken belief he was carrying a gun. no, no weapon was recovered, but officers claim that graham was shot because he refused police commands to show his hands. graham's family long insisted that officers overreacted and their son posed no threat to anybody. the city of new york paid $3.9 million to settle a civil lawsuit with the family there is no word on whether the justice department will seek to prosecute the officers who remain on the job.

now in the stunning twist, he wasn't just planning murder, police say he already committed one, allegedly killing an elderly neighbor. in the newly released indictment, they say he fatally shot john clark, 74, and stole $678. his father frantically died 911 last april concerned his son was becoming a terrorist. >> i come home and he's burning stuff in the house. >> reporter: sun van can be heard in the background. >> why are you trying to say i'm a terrorist? >> reporter: the fbi sent in an undercover agent posing as an isis sympathizer. sullivan laid out a chilling problem to kill as many as 1,000 people, first using an assault rifle then graduating to a truck bomb. when his parents became

new jersey state police troopers risking their lives and coming to the rescue of barn animals trapped by a raging fire. take a look at the pictures of the flames posted on the state police facebook page. troopers rushed into a burning weekend. in the end, they managed to save all of the goats, sheep, llamas, and even the chickens inside. new york police working on solving a series of crimes involving victims in the bronx. they are looking for one man in particular thought to be behind four cases. he's either brought a gun to threaten victims, punched them, and snatched their money. it started in november with a street corner mugging. the man then moved on to cell phone stores and 99 cent store as well.
