according to witnesses waving a gun in the air. there were witnesses walking down the street and they said they flagged down a patrol car saying look, there's a guy on the street waving a gun. at that point there were three officers in the patrol car. they stopped. they instructed the suspect to put his gun down. they did not follow that directive. at that point one or more nypd officer discharged their weapon. the suspect was shot in the right was then taken to lincoln hospital. at this point no life-threatening injuries. it was not a crime in progress in terms of an assault or robbery but this was a person possibly under the influence of drugs walking down the street waving a gun. some people saw something, they said something, they flagged down a patrol car. no time to call 911. luckily there was a patrol car in the area and they were able to alert police of this person walking down the street with the gun. he's been taken to lincoln hospital and no life-threatening injuries. darla miles, channel 7

we're going to turn now to the weather. you've got snow falling outside. mayor bill de blasio issued a travel advisory in new york city. it goes through tomorrow. he's asking people right now to be extra careful. governor chris christie in new jersey tweeting 20 minutes ago asking people in that state to stay off the roads. road cam 7 is out checking things out. right now this is the view in the cross bronx express way. >> people are taking it slow in nassau county. at the airports there are delays and cancellations here and across the country. nationwide more than 1100 flights have been canceled. meteorologist lee goldberg is tracking it all. he's live on the upper west side. >> we're just not wasting a flake today. after that frigid weekend, everything sticking. new york city, it's rare to see the snow stick this quickly. this is what's happening. and weekend snow for the next hour or two before sleet and ice mix in, eventually over to rainfall. you're looking at the toll plaza in the george washington bridge.

after 7:00, 7:30, steady snow across the area. heaviest over parts of fairfield, westchester, rocklin county. it is changing to rain and coastal monmouth as well as these winds continue to come off the 40-degree ocean water. we're less than 36 hours removed from subzero temperatures. it's going to take a while to scour this out. we're seeing a steady climb in temperatures but still in the teens well north and west. proung laed period of icing north and west. here's the way everything evolves here in the evening hours. climbing above freezing. because roadways have been so cold, it will still be before 8:00 and 9:00 when we get wet roadways. then we go to straight rain by 11:00. unless you're north of i-84, or in the catskills, still some snow as well. by tomorrow morning, morning travel has wet roads and lighter rainfall gets heavier later tomorrow. winter weather advisories go until midnight but it goes until

of it blocked off to riders and visitors by police and the national guard. >> i thought something happened. i couldn't tell. it was kind of weird. >> reporter: trains on this president's day were all routed to upper level tracks when power was lost to the tracks and the entire lower level at midmorning. >> fortunate if you look at it that this happened on a holiday because we don't have a rush hour level of service in which we would need all of our tracks. >> reporter: the power was lost when a 6-inch pipe burst. >> it delivered 18 inches of water in to the vault. we're dewatering the vault. >> reporter: emergency generators provided backup power to the main hall and other entrance areas. because of the holiday, many pausing as they watched the uncertainty, were visitors and tourists, not really knowing what was going on. >> a little scary? >> yeah, it was scary. >> i wouldn't have thought it was much more serious than a power outage. >> reporter: metro north riders came flooding off their trains this afternoon seeing very few if any of the power outage. >> there was no delay.

running without delays and while ticket machines were not operating, riders could buy tickets on trains. about 100 stores and food vendors were forced to close the better part of the day as police and state troopers barred the >> back live. you can see they're still barring that entrance to the lower level. this at the eastern side of grand central. you have to also remember, there's a holiday schedule so you might want to give yourself extra time and we could see some delays because of the snow outside. reporting live at grand central, tim fleischer, channel 7 eyewitness news. a family and a community in new jersey tonight struggling with the senseless murder of a bodega owner. someone shot and killed 64-year-old jose tavares in the ellerson mini market. he was rushed to the hospital. but he did not survive. long time customers say he and his son lived and worked in the

>> whenever you didn't have enough, you would go in there and he would give you groceries and say don't worry about it. pay me another day. >> customers say he supported a wuf and relatives in the -- a wife and relatives in the dominican republic. police have not made any arrests in the case. the fire started in the basement of the building on olmstead avenue shortly before 6:00. flames quickly spread to the roof of the three-story building. it took just over an hour for crews to contain the fire. there was another fast moving fire involving several homes. crews battled the fierce flames on a house in diamond street but it was difficult to contain. the flames jumped to two nearby homes around 10:00 last night. more than 140 firefighters braved the brutally cold temperatures. four people were hurt but not seriously. no charges tonight against former governor elliot spitzer

choking her. tale for spitzer. the plaza hotel. >> i think this is going to be a difficult police investigation because the alleged victim in this case, she's not cooperating with the police. she's not helping out. also we've been told she probably returned to russia out of jfk airport. this is where it all happened, just cross from central park. >> reporter: the former government who's 56 is accused of assaulting a 25-year-old woman at a $1,000 a night suite at the plaza. the call came in around 8:00 saturday night. our cameras got this video of a crime scene tape nearby. they went in and asked, is there a problem? police say spitzer at the doorway responded everything is fine. there's no problem. police left but for some reason returned.

and broken glass. sources say she cut herself. spitzer went with her. that's where she claimed spitzer earlier in the night tried to choke her. >> this woman went to a hospital. she made admissions which are prompt outcries to hospital workers that she had a physical fight with him and that he injured her. so i do think they have enough to arrest him. >> reporter: this defense attorney says there's already enough evidence to charge spitzer but sources tell us the alleged victim is not cooperating and she may have returned to russia on sunday. >> i have disappointed and failed to live up to the standard i expect of myself. >> reporter: spitzer resigned in 2008 when accused of soliciting prostitutes. he ran for city controller two years ago but lost. >> i'm asking forgiveness but also i hope they will look for the record that i had as attorney general, as governor, assistant district attorney. >> reporter: on this current investigation, a spokesman for

tonight they'll rally voters to house. another former president on the campaign trail, bill clinton rallied support for his wife hillary in florida. meantime the democratic presidential candidate met with supporters in nevada. hillary clinton will be in manhattan tomorrow morning to meet with reverend al sharpton and leaders of numerous civil rights organizations. fellow democratic presidential candidate bernie sanders spent the day rallying in must. snow may be on the ground but spring is in the air at citifield. mets fans came out for the spring training send-off. mr. and mrs. met greeted the crowd who got to take a free tour of the clubhouse and see off the team's equipment truck. that truck is headed for port st. lucie, florida, where the mets report for spring training on wednesday. >> it's hard to believe that spring is almost around the corner after dealing with this weekend's bitter, bitter cold snow showers today. >> and by tomorrow afternoon it will feel like you can play ball. it will be that mild as

right now it's all about snow. great pictures for you across the area. couple from facebook. this is near yonkers. the common theme is snow covered roads. we've had so many snows where it's on colder surfaces. this isn't that type of storm. it's not a lot of snow but all of it is sticking. in ocean county it's already changing over to rain. you've got slush covered roadways here even on the west side of manhattan. we've only got about another hour or two to hold snowfall. then it will go over to icing and eventually rain after about 7:00 or 8:00. easterly wind at 8. barometer on the fall. high today so far 27. we'll probably be about 40 by midnight getting closer to normal. about a half an inch i'd estimate in central park. sunset at 5:30. last year on this date we had a trace of sunset and cold at 25. the problem is this, 15, stanhope. 21, randolph. the cold air gives away along the coastline northwestward.

at 5:30 we continue to follow the latest developments on that police shooting in the bronx. witnesses say a man was walking down tinton avenue in the morrisania section. he was waving a gun. witnesses flagged down police who ordered the man to drop the weapon. when he did not do that, one or more officers opened fire. he was shot in the right shoulder and has been taken to the hospital. he is expected to survive. we're also tracking snow now. it's already coating the roadways. this is a live look from east meadow in nassau county. >> let's get right to lee goldberg for a check of the accuweather forecast. >> should be changing over within the hour in east meadow. county. we're getting reports of snow covered on route 4. definitely some slippery spots. rumson.

eight weeks later a drone flew over the same prison wall all around the prison yard. you're about to see more of the exclusive video of this breach and meet the drone operator. but more importantly, you'll see how little prepared our prisons security threat. >> eight weeks after two inmates grabbed national head weeks after prisoners escaped from the facility in new york, there was another unreported security breach at the prison. a drone flew over the wall at the maximum security prison and flew all around the prison yard, taking high definition video of correctional officers below, of prisoners walking in the yard. this exclusive video shows the drone penetrating the prison perimeter at a time when the facility was supposed to be on lockdown. the drone operator was adam repekea of troy who said he was just testing his constitutional rights. >> don't you dare touch my

police in yonkers are investigating the death of one of their own. detective frank fernandez was off duty when his suv crashed in to a fire truck yesterday morning near palmer and sunny brook roads. four firefighters were on the ladder truck. they suffered minor injuries. the 45-year-old was with the yonkers police department for 15 years. no one was hurt in a home invasion on long island. police say the men forced their way inside a home in newcastle this morning. they led five people to an upstairs bedroom and demanded money at some point. one of the men fired a bullet. the homeowner came home during the invasion. he gave the men money and they ran off. two people hurt in a machete attack in ohio are speaking out from their hospital beds. gerald and debbie russell were sitting in the first booth at a restaurant in columbus when they say a man with a machete came in and attacked them. police later shot and killed that suspect, muhammad barry, but not before he attacked several other people.

and attacked me, it's a miracle that i'm alive today. >> i know people were running, and then he started beating someone in the very back booth and he was beating them with everything he had. >> the victims both have cuts on their hands and nearly lost some of their fingers. they have a couple months of rehab ahead of them but say they're just thankful to be alive. on this president's day, an announcement of a generous gift to spruce up the lincoln memorial. it comes from billionaire philanthropist david rubenstein. they'll repair the roof, clean the marble, and add a second elevator and create space for exhibits. more than 7 million people visit the lincoln memorial every year. new york city has gone to the dogs, at least for one more day. the 140th annual westminster kennel club dog show is underway at madison square garden. over the weekend, an australian shepherd named holster won the

as ice hidden inside heart supplies and silicone bra inserts. it was part of a shipment traced to a hong kong storage facility. the amount seized, worth about $700 million u.s. dollars. they arrested four people. one of the biggest drug busts in australia's history. police in stran are trying to figure out who attacked two people on the golden gate bridge with blow darts. the darts hit a man and woman walking across the bridge on friday, both in their legs. they were not seriously hurt. the darts were tested to make sure they weren't coated in chemicals. it's not clear where they came from. investigators are looking for surveillance video that may provide some clues. parents of little league players stripped up their world series championship say their kids were exploited and they're suing to get the title back. the lawsuit claims league officials concealed information to reap the benefits. the parents are also suing the so-called whistle blower and

one of our viewers spotted a seal enjoying the snow and ice. this is a harp seal apparently. it wasn't stranded or hurt. in fact, harp seals live on the ice which means this little guy was just chilling. the seal eventually went back to the water and is on his way. >> white face mountain near lake placid, in that area the wind chill reached negative 84 degrees. as lee would say, that's 84 below. the wild center is a nonprofit organization. they shared this picture of some of the intense ice in that area. experts say the temperature

that snow is starting to change over on the island. now. probably a fresh 3/4s of an inch snowfall. still snowing and an east wind at about 8 miles per hour. incredible turn around from the well above average temperatures. we went in to this weekend 8 degrees above average and we weekend. the month. it's been extremes. you can see the raindrops mixing in 6:00, 7:00 tonight. going to straight rain, above freezing in the five boroughs after 8:00 tonight. going to take a while for things to get wet because of how cold we've been. during the day tomorrow, light rain. heavy rain in new jersey probably at the noon hour. getting in to new york city, 1:00 or 2:00. heaviest through 4:00 or 5:00 and that's where the windswept rain, half inch toen a inch of rainfall that winds down during the evening hours. can be some street flooding.
