apple said the u.s. government is asking for the company for something it does not have, and something they consider is far too dangerous to create. so now, apple is preparing for a very big fight. a fight that it claims is all about protecting the company's the world. >> reporter: for the last two months, fbi investigators have been trying tothe encryption code on faede's phone. freang people were killed -- 14 people were killed and 24 killing. they wanted to break into farouq's phone. apple's tim cook responded sternly, saying they'll fight the order, saying it's an overreach of the federal government. in a statement, cook said, quote, while we believe the fbi's actions -- intentions are

heavy weapons team that patrol transportation hubs. we'll have more on the funding coming up at 12:30. new at noon, an ex-con being questioned in battery park. police took 25-year-old anderson into custody today. anderson is on probation and has 10 prior arrests. police want to know if anderson struck a tourist, after the 33- year-old woman refused to purchase tickets. the man is being treated at bellevue hospital for a fractured skull. an 18-year-old man, caught on camera, now on his way to face a judge. police say the suspect, scott clark, beat the 62-year-old driver on a bus in east flatbush last month. night. he was accompanied by his mother and a representative network. ill. jury selection is under way in the trial of a mom charged with murdering her son in new jersey.

azinski and her son, timothy wilsy. azin ski claims her son was abductedded in 1991. his remains were later found in marshes in edison. jury selection could last two weeks. police have made an arrest in connection with a stabbing death of a man at a restaurant in brooklyn. 35-year-old lan shu yu is facing murder charges. she worked as a wait resat -- pate ress at a -- wait resat a lucky restaurant. investigators say the argument escalated and that is when yu stabbed mr. zang in the back and neck. police say yu fled the scene but was later arrested at her home. eight firefighters were hurt while battling a fire inside an apartment building in yonkers. crews were called to the complex on park avenue, around 1:30 this morning as flames grew inside one unit.

an environmental investigator from self ridge air force base is expected to visit a michigan neighborhood that is being blanketed by a mysterious tar-like substance. residents say the goop suddenly began appearing on the hoods of vehicles, on boats and driveways and on their homes. firefighters say they don't think the tar-like substance is harmful, but sure looks gross. >> well, i don't know. between the lead in the water and flint. now this story here, michigan

we probably see a decent sunset. a little chilly, breezy for the afternoon. sun breaking through that cloudy sky. below normal temperatures tomorrow. and friday. and really no major storms on the way next seven maybe we could even say 10. riverside and riverdale and murray hill, all of them are about 39 degrees. 40 on long island. and 40 here around the newark area, down toward the jersey shore. you can see the winds here are out of the northwest. single digits to 13, 14 miles an hour. if you want to see a wind chill, feels like 33 in the park. 36 up toward the bronx. 18 around monticello. 33 on long island. this is not harsh. the wind is not really all that strong. but we have a few clouds that are coming across, out of this flow. but as you see to the west here, the lakes are not frozen. they're almost frozen. but there's lake-effect snows here. shouldn't be happening this time of year. but we will have colder air that will pour in from the northwest tonight. so you'll see this flow when the temperature gets to about 42 degrees this afternoon.

vi a scare in the subway. a back hoe chase and a young boy dangling from a ski lift, just some of the stories caught on camera, and definitely caught our attention. we're going to start with scary moments on board a subway car in boston. passengers kicking out windows, after smoke filled the station in boston. you can imagine how upset they were. damage to the third rail cause the murder of a subway car to overheat and smoke up. and it sounded like a bomb to some. and got some of the passengers really adding to the panic of

everybody got out safely. no one was hurt. transit authority, now investigating. bizarre police chase, involving a back hoe caught on camera. watch as the sparks fly, from the bottom of that construction vehicle, as it crosses seven- mile bridge in the florida keys. police say 59-year-old carl blahnik stole the back hoe for a joy ride, and along the way, dumped large boulders on the road. after an hour and a half, deputies brought the vehicle to a stop, by placing spikes on the road. that man now facing several charges. in a daring rescue from a ski lift, a boy, dangling from a chair this weekend. and this was no way to pull him to safety at that point. so bystanders grabbed the tarp. look. they held it under the boy. he let go. he was safely caught thank goodness. you can hear the cheers. and they tell us, he is perfectly fine. shirleen? >> what a rescue. thank you, david. plenty of treats for

postal workers have to deal with rain, sleet and snow. and now, they can add wild turkeys to that list. a flock of turkeys ganged up on a mail carrier yesterday. the worker was on his route yesterday afternoon, when a turkey surrounded his truck and blocked him in. when police showed up, the turkeys scattered and trotted back into the woods. the male worker was not hurt. but at least three homes did not get their mail.

beach affiliate has been following the 18-year-old. and even sat him down for an interview. he admits a year ago, he was the same teenager detained, after a gynecologist found him in an exam room, wearing a hospital lab coat and a stealth scope -- stethoscope around his neck. >> i didn't snatch a baby, i didn't do anything like that. >> police say he liked to call himself dr. love, where he calls him a well-rounded professional, who uses psychotherapy, and electrotherapy and other lists of things. police sent an undercover cop posing as a patient. when he started giving her a physical exam, she put him in handcuffs. >> how do you feel now, to all the people who believed in you that thought you knew what you were talking about? . >> i'm hurt because of the accusations. but like i said, this is not the first time i've been
