i'm asking this individual, he can run but he cannot hide. we have the resources, the personnel, the technology, we will find him as we have done in the past. >> he's just mind-boggling because when you have children and you see this tragedy, everything happened in front of the mother. it's just terrible. >> reporter: the mayor says he is covering the cost of the little girl's funeral personally out of his own pocket. the mother is someone he knows. she works in a nail salon. the father works in a factory. there's a memorial at the site of the crash, the hit-and-run at 62nd and van buren in west new york. >> it's a 7-year-old wonderful girl, 1st grader, and it could happen to all of us. the father said this is my little angel. i lost my little angel. and i feel the same. >> reporter: 7-year-old sheyla is described as fun loving, caring, and a little girl who loved life. >> if i tell you about sheyla, a smile comes to my face.

she was the happiest baby. >> what happened was so careless and cruel. police plead with the public, please keep your eyes out if you know of any idea who may have done this, please contact them. live in west new york, new jersey, michelle charlesworth, channel 7 eyewitness news. another pedestrian killed even though good samaritans rushed to her aid. police say a livery cab was turning on to east 36th street in marie hill when the driver hit 77-year-old carol dauplaise. she later died at the hospital. >> we tried to get her out. >> that was the only way to get her out. >> how many others? >> about 10 of us. >> the driver did stay at the scene. at this point no charges have been filed. new information in a hit-and-run that killed an off duty nypd officer. cops have found the car and identified the driver that

harrison on the new jersey turnpike on sunday. eyewitness news reporter n.j. burkett is in valley stream where harrison lived. >> that's right. in the officer's neighborhood here in valley stream, long island where friends and relatives have been gathering all day to support one another. mayor de blasio called it tragic. a rookie officer struck and left to die in the new jersey turnpike. >> reporter: his friends and fellow officers are consoling the officer's family in valley stream tonight. 25-year-old vincent harrison was struck and killed this weekend by a hit and run driver. after a fender bender on the new jersey turnpike. investigators say officer harrison was off duty at the time and had just stepped out of his car to inspect the damage when he was struck by a passing car at 3 a.m. on sunday in elizabeth. police say the car stopped briefly then sped off.

in exchange for political fairbs. menendez maintains meetings he had with government officials were about policy, not to help the doctor. governor christie is trying to fill a longstanding vacancy on the supreme court. he announced he would like david bowman to fill the post. he pointed out the state legislature approved bowman a few years ago. he says if he is confirmed, history will be made. >> this continues my effort to bring diversity to the court, by bowman being the first asian-american to serve on the supreme court while also maintaining the partisan balance on the court with a full court confirmed justices. >> if confirmed, the supreme court will have four republicans, which christie says is allowed in the state's constitution. there were audible gasps today at the u.s. supreme court when justice clarence thomas broke a decade of science. the conservative justice asked a

argument and this was the first time in 10 years. the court is considering placing new limits on laws of preventing people violence to own guns. a shooting in a school cafeteria happened at madison senior junior high school, about 30 miles south of cincinnati. the 14-year-old boy walked in to the room and started firing, hitting two students. police say two others were also injured. the shooter then dropped the gun and fled but was quickly captured. >> it's sad that anybody got hurt and i'm not sure why a young man would feel compelled to do something like this but when they do, it affects everybody. >> the four students are expected to recover from their injuries. an army sergeant assigned to the pentagon now admits he shot and killed his wife and a rookie

very first patrol. 32-year-old ronald hamilton was arraigned in virginia today. prosecutors say he shot and killed his wife on saturday and then shot three officers responding to her 911 call. rookie officer ashley guindon had just been sworn in the day before. stocks on wall street kicking with broad losses. dow tumbled by triple-digits. the dow closed at 16,516. s&p 500 lost 15 points. new information about that bus crash in new jersey that caused an 11-vehicle pileup. coming up, what investigators say the bus driver was doing right before the collision. plus, more delays and cancellations on the lirr. what's to blame for the increase? >> and a secret message during the oscars. the news of winning director

station. >> the railroad insists that the issue is really due to a combination of factors. first there are events that it derailment. combine that with ongoing infrastructure projects like east side access. that will eventually link the terminal. passengers, well, they say they don't want to hear it. they just want to get where their going. >> reporter: the mad dash to the tracks is familiar for long island railroad regulars. but also all too familiar these days is the wait for trains that arrive late or not at all. >> the last year or so it's been tough. >> it seems like they're always late or they're canceling a lot of trains or they're just really crazy. >> reporter: in fact, according to the lirr's own annual operating report, on time performance is down across the board. consider the number of canceled trains.

a 40% increase. >> we're working always to avoid these delays. >> reporter: lirr spokesman salvatore reyna insists those numbers are greatly affected by events out of the railroad's control, like bad weather or the plane that made an emergency landing on the tracks last summer, as well as ongoing improvements to the system. >> there are a lot of major construction projects going on influences on-time performance but it's really a promise for could get better. >> reporter: some riders say promises about the future aren't enough. they're demanding improvements now. >> their time is very frustrating and you wonder if they couldn't do better. >> we're constantly reminded by the railroad to watch the gap. i guess our message to the railroad is to watch the gap. the gap that's forming now between the riders and the railroad. >> the lirr is insisting this evening that it hears that growing frustration and it does care.

performance all of the time but insists the ongoing infrastructure improvements will do just that. they just ask passengers for a little bit of patience. station. sandra bookman, channel 7 eyewitness news. a judge has delayed a ruling about whether she'll throw out the defamation lawsuit against bill cosby. this is the case that involves model janice dickinson. cosby's lawyers say they want her case dropped because over the years she gave differing accounts of what happened with the entertainer. she said cosby drugged and raped her in the 80s. dozens of other women have made similar claims. a funeral became the site of a suicide bombing killing a senior militia leader in iraq. the bomb went out in a town north of baghdad. 25 people were killed and dozens wounded. police say a powerful shiite militia leader died in the attack. the funeral bombing came hours

two bombs at a market in baghdad. that attack. president obama today giving the nation's highest military honor to a navy s.e.a.l. who helped rescue an american hostage from the taliban. the president awarded the medal of honor to navy senior chief edward byers. byers and his team brought dr. 2012. one team member was shot and killed that day. mr. obama says u.s. special forces keep americans safe. >> we sleep more peacefully in our beds tonight because patriots like these stand ready to answer our nation's call. >> chief byers is the sixth navy s.e.a.l. to receive the medal of honor. he's the first active member of the navy to get it in four decades. >> he's a hero. >> he is. he put the focus to the man they lost that day. he is very honorable. turning to weather, it was so mild out. it feels like springtime is here.

you know march can throw a lot of wrenches in to the mix. but we're looking pretty good. we have a few bumps to get through this week. we look outside, george washington bridge on the fort lee side. a few patchy clouds. 58 degrees. the air is dry. west wind about 9 to 16 and the high managed to reach out to 60 degrees. of course that's after we had the morning rain showers. 45 is our average high. only .05 of an inch of rainfall at 5:46. usually you do last year on this date but we'll go back four years ago on february 29th when it was raining. rainfall today, less than .1 of an inch. it's moved out east of the twin forks. 59 in soho. same woodhaven and bayside. 56, yonkers. brighton beach, 57. we've dropped in to the 40s well north and west. chilly air will start to move in later on tonight. gusty breeze with us during the early evening hours. it backs off a little bit. becomes a chilly breeze as we go

wake up tomorrow, it's in the mid and upper 40s. sun and patchy clouds tomorrow. mid and upper 40s. probably come up just short of the 50-degree mark. still some clouds in the east end. that's why it's 49 in the hamptons. clear for a while and then clouds will come in later this evening. there's a reinforcing cold shot of air coming in from canada. that will drop our numbers later tonight. that's why it will be 10 degrees colder during the afternoon hours. at least it's bright and sunny out. we're not getting true arctic air. it's more pacific air coming across the country. we're getting cooler, not colder. with the next system, there's going to be gulf moisture getting involved. what you see here, this little area of snow and rain will expand in to a bigger area of rain later tuesday night and in to the morning hours on wednesday. then another piece of the pacific system may make a run at us on friday. that one is a close call. notice the futurecast here, nice during the early evening, even though you have a chilly breeze. there's that cold front. it's really weak but it's a little cool shot of air coming

we've got new details on a charter bus that crashed in to 10 other vehicles in new jersey. >> police now blame the crash on distracted driving. the driver of the bus faces multiple charges. >> eyewitness news reporter tim fleischer in south brunswick with more. >> that bus driver surrendered to south brunswick police and now faces serious charges stemming from this accident.

was horrific. this coach usa bus slamming in to two cars waiting at a red light on route 130 early last wednesday morning. some cars smashed on the roadway, others pushed out of sight in to the woods. south brunswick police described it this way. >> the bus failed to stop. it struck 10 vehicles, sending some of the vehicles in to a nearby field. two of the people had to be extricated from their vehicle by the fire department. >> reporter: in this video you can see the driver of the bus in he's identified as 30-year-old jamal penton and is being charged with assault by auto. he surrendered to police and posted bail. now police reveal he allegedly became distracted for over 1,000 feet prior to the collision. they add he was traveling at 50 miles per hour. police officials say drivers have to focus on their driving. that responsibility, the chief said in a brief statement, was

despite him driving a 50,000 gross weight bus at highway speeds. this crash was easily preventable. accident investigators claim at least for 10 seconds this driver was not looking at the highway in front of him. >> the victims who were all hospitalized are said to be in good condition. reporting live in south brunswick, tim fleischer, channel 7 eyewitness news. a prison guard has pleaded guilty to helping two convicted killers escape from an upstate new york prison. gene palmer admitted to unwillingly smuggling tools and giving them to sweat and matt. the pair led authorities on a escaping. matt was fatally shot and days later sweat was captured. palmer will spend six months in penalties.

calling for action after a fire shut down a charter school in manhattan. parents and children protested outside the charter school near union square. the building on irving place hasn't had power since an electrical power last thursday. >> you represent all of these children who are enrolled in whether they're charter or district schools. and you need to be accountable to all of us. >> the education department says success academy has turned down several alternate spaces. officials also say crews are working around the clock to repair the damage. now to a very sad update to a story we told you about last week about a severely malnourished dog left on the side of the road in orange county. the pit bull named sally has died. she was abandoned in deerpark, weighing just 25 pounds. police are trying to figure out who mistreated and abandoned her. we've got new information on

pictures. we told you earlier about sheyla pichardo hit while walking with her mom. her mother seriously injured. we'll have much more coming up on eyewitness news at 6:00. >> hopefully they'll track down that driver. a temporary restraining order now in place, blocking new york city from enforcing sodium warnings on restaurant menus. today an appeals court granted a motion filed by the national restaurant association. the city's department of health is temporarily prohibited from enforcing the law that was supposed to go in to effect tomorrow. it requires restaurants to post salt icons on menus next to food that exceed the daily recommended amount of sodium. anthem of the seas cruise ship forced to turn around and head back to its port in new jersey. royal caribbean says the ship is returning to avoid a powerful storm. there's also been an outbreak of the norovirus. but the company insists the outbreak played no role in the decision to come back. this comes three weeks after the

storm on a trip to florida. an antigay sticker at one school has some students rallying to support the lgbt community. a few students at a high school decided to decorate their i.d. badges with this anti-gay symbol. an 8th grader at a middle school saw the stickers on social media. she decided to make smily rainbow stickers which are now being worn by students and teachers. >> i saw it and got angry. i'm accepting to everyone's sexuality and it's okay to be that way. >> the school district says it's investigating. it knows students have free speech rights but says bullying will not be tolerated. reverend al sharpton claims the drop in ratings for the oscars is the result of his boycott over lack of diversity. sunday's telecast was the lowest rated ceremony since 2008. he released a statement saying in part, quote, this is not about actors and actresses getting awards.

respect of ticket buyers and viewers who are ordinary struggling american citizens who have been marginalized. last night's oscars did turn out to be a big night for the white house campaign to prevent campus sexual at some time. the twitter page, it's on us, received 300,000 pledges. it came after lady gaga's powerful performance of "till it happens to you." you've probably seen the attempt to speed up the oscars by letting them say their thank yous in a scroll on the bottom of the screen. one included an exciting surprise for his children. he sends his love to his three kids and then adds okay, yes, let's get a dog. you know they were jumping up and down. we don't know if they would have gotten the dog if he didn't win but we like to think they would have.

a renewed battle brewing between broadway shows and times square characters. ticket buyers have dropped in the last few years and the broadway lead says the characters are to blame. shirleen allicot is in times square. >> it's amazing, broadway shows hit a record this year. 13.1 million people coming to see shows. but no help from the suburbs. a new survey is pointing to these pedestrian plazas as the reason why they're staying away. >> i like the pedestrian plaza. i don't like what goes on here. >> reporter: ever since the pedestrian plazas were instituted, parents have complained about the environment it's created. >> i have a 6-year-old daughter and when you come down here they harass you and harass you and take pictures. i think everybody has to work, but at the same time, let us come to you. >> reporter: pushy characters, construction, congestion are being blamed for the latest drop in theater goers from the suburbs.

league, in 2010, the year the plazas went up, is when ticket sales started going down from people who live in long island, westchester, and rocklin counties and northern new jersey. >> we've lost 33% of the suburban market that represents over 870,000 theater goers. >> reporter: charlotte st. martin is president of the organization. she believes the drop-off is because suburbanites sent a drop-off. they're most impacted by the traffic jams the plazas have brought. >> we've got to have something go on with regard to the construction and the number of people that are trying to earn a dollar in an aggressive manner. >> reporter: but others i spoke to from local suburbs don't think the new walkways are a bother at >> something like that is not going to stop me from coming in. >> if you've grown up on shows and love broadway, you're not going to stop going because of a pedestrian walkway. >> those two women i spoke to

overnight period. there's a cold front that's coming in during the overnight that probably arrives here around 2:00 in the morning. partly cloudy skies right now and a west wind around 9 to 16. because long island took a little longer to clear out that's why you're in the upper 40s. we're also starting to see colder air come in to the catskills. most of us very comfortable despite the breeze. the february calendar, you see a lot of red here. a lot of above normal temperatures. 2 degrees above average for the month. precipitation was below normal by an inch and a quarter. we got 4 inches of snow. snow. the 5th, 8th, and 15th. we should have 9 inches of snow in february and we only saw 4 below normal there. between the 9th and 19th we got the cold spell, subzero for the first time since 1994 but then four out of the last six days of the month we go in the 60s to propel us above average. numbers will be drawning dropping in to the 40s. dropping during the evening hours, it will feel a little bit

overnight, dropping in to the mid 40s and even upper 30s. your planner for tomorrow, about a 6 to 12-mile-per-hour wind. a cold start. partly to mostly sunny skies. 46 to 48 for your high temperatures. i think we'll come up just shy of the 50-degree number. there's the band of rain that moved off the east. still clouds moving in. mainly clear for now. but there's a cold front right here coming through ontario. it's getting in to the great lakes right now. that will come through overnight. by tuesday night and wednesday, we'll watch this system come in, and i think it will give us a decent period of rain. maybe 3 to six hours. during the overnight hours tuesday night in to wednesday morning. by the way, that cold front that's coming through around 2 a.m., it's a sneaky little shot of cold arctic air that tries to get in here. glancing shot. the 40s. you look at the futurecast here, you've got below freezing temperatures north and west. middle 30s on the island and down the shore. during the afternoon hours,

temperatures in the upper 40s. 48 tomorrow, cool blue skies but less wind than today and then look at wednesday's number. 51 degrees and falling during the day. in terms of the rainfall on wednesday, i think we'll start to see some rain come in late tuesday night, maybe 10:00 or 11:00. could be a little bit of a mix in the catskills. but the key time period is right around sunrise. leaving in to that morning commute, there could be a few-hour period of rain. maybe puddles and gusty winds, especially where we have the heavier downpours. wouldn't be surprised to see a 40 or 50-mile-per-hour gust. that will exit as we go through the afternoon. on thursday brisk and cold, 38. friday, this is a close call here on friday. i think the bulk of this storm system is going to go just to our south but there's going to be an area of snowfall. best chance will be south of i-78 to see a little light snow or flurries but i don't think we're talking about accumulating snow at this point. we'll keep you posted. the first weekend of march, 43.

finally tonight, a big cleanup is underway after an oil spill in westchester county. >> hundreds of thousands of gallons leaked and that means a big headache for people living in the area. joe torres has more. >> reporter: there shouldn't be people inside this storm drain. then again, there shouldn't be oil in the drain either. but the presence of the ladder prompted ladder -- but the presence of the latter, some of the oil made its way in to the storm drain. all of that led to a sifz cleebup operation. operation.

credit to the oil delivery driver who when he pulled up in to this driveway and heard his truck bottom out, got out to investigate, saw the oil leak, and then alertly pulled this truck out in the street further down the block away from the storm drain. that allowed first responders to block and divert the oil. 48 hours later the result is this. >> there's no concentrated pockets of oil. it's just a sheen at this point. we'll be monitoring and the cleanup company will do more cleanup as needed. >> reporter: nonetheless, the spill impacted some neighborhood people. this woman emerged from cvs carrying a jug of water. >> we have to get water because we have no drinking water right now and we're not sure when we'll have good water. >> the fire chief estimates 500 gallons of oil leaked. he thinks less than 100 gallons made it to the river. the monitoring and cleanup should last another day or two.
