in about a half hour. then later tonight a star studded fundraiser at radio city music hall. josh einiger with more for us. >> we're here at the north pavilion of the javits center. a little hard to hear you because this rally is well underway here. a large contingen't of hillary clinton supporters, union members, volunteers waiting to meet her at a homecoming rally. in the meantime there's breaking news in the republican primary. dr. ben carson reportedly planning now to suspend his campaign. this development announced late this afternoon by ohio governor john kasich. >> reporter: saying he sees no political path forward after losing big on super tuesday, retired neurosurgeon announced he'd skip the next republican debate. for the party establishment, it's still not enough to coalesce around anyone but donald trump. >> well, they can always do that. then they'll just lose everything.

developer swept seven states last night. today senator marco rubio cast his early ballot in his home state of florida. >> we feel good about it. >> reporter: he has to win there if he has any prayer of getting the nomination, just like john kasich must win his home of ohio. >> i just as soon go back to there. >> reporter: both of those primaries on march 15th. meanwhile, ted cruz managed to win his home state of texas last night, meaning for party leaders it leaves too many candidates to skip the anti-trump vote. >> get behind marco, ted, casey, get behind somebody. this divided field helps trump. >> reporter: meanwhile last night hillary clinton eliminated many doubts she might win the democratic nomination. like trump, she won seven states and beat bernie sanders in massachusetts, seen as a must-win for him. with tens of millions in the

new jersey's is june 7th. stay with eyewitness news, abc news and abc7ny for coverage of the primaries and results as they come in. to weather. today's strong winds causing a mess in westchester county where wind just knocked down this tree in pelham, ripping out power lines. in new york city concern about the strong wind gusts prompted the buildings department to issue an advisory and ordered crane activity to stop today. and ahead of tomorrow's snowfall, the sanitation department has issued a snow alert. meteorologist lee goldberg is outside our studio on the upper west side. the temperatures are beginning to fall. >> this is really more like march. we're not talking about yesterday's tame weather with sunshine and light winds. now things are getting a little bit more volatile and we have cold air with us and eventually some snow. also mild weather to tell you about on the road. let's address what's happening right now. the feels like reading was at 55. now the wind chills have dropped below freezing.

it's been a challenge with the bridges and overpasses with the gusty winds over 40 miles per hour. the winds will probably peak but we've had gusty breezes. 39 right now. wind chills are now dropping in to the 20s in many areas for islip, white plains, sussex and feels like 12 in monticello. peak wind gusts today were over 40 miles per hour. these were wind gusts in the last hour. we've dropped mostly up to about 30 miles per hour. still gusty breezes in the early morning and will gradually drop off. dropping below freezing with the actual temperature by midnight and again the wind getting a little lighter by morning, 7 to 14 miles per hour. skies will be clear overnight. we'll have a fair amount of sunshine for the first part of the day tomorrow. then we turn our attention to the storm over the middle of the country. watch how the bulk of it is sliding to our south. we're just close enough that a band of snow will impact us. put a snowfall map together. the latest on potential

warmup next week. all in the 7-day accuweather forecast in just a few minutes. bail has been set for the couple involved in a hit and run in new jersey that killed a 7-year-old girl. fabian rodriguez and his wife joanne rosas-alvarez were in a jersey city courtroom a short time ago. he's accused of driving the suv that fatally struck sheyla pichardo monday. bail is $250,000. rosas-alvarez is charged with hindering apprehension. her bail is $7500. the couple has a 7-year-old son. the former nypd officer who moved to texas because he thought it would be safer was killed in a shootout. david hofer and his partner were called to a park in a suburb yesterday. the suspect started shooting and they returned fire. the gunman was killed. officer hofer died at a hospital. hofer joined new york's police force in 2009. he left for texas in 2014.

this one happening at a dunkin' donuts. the store owner was cut across her face with a razor blade after asking a homeless man to leave early this morning in the kingsbridge section of the bronx. joe torres is on the scene. >> as if this slashing wasn't disturbing enough, consider this. the man police arrested for the crime, his name is ronald thompson. he's 31 years old. he's been arrested 30 times. >> reporter: about 5:30 this morning the manager and co-owner of this dunkin' donuts in kingsbridge asked a homeless man to leave. he did. but police say he returned 10 minutes later, approached the walkup window, reached in and slashed a 34-year-old female worker's face. >> i feel bad for her. she's a good lady. i've been working here for one year and nice lady. it's hard. it's tough.

employees told us the victim, doxa patel of flushing worked alongside her husband. doctors closed the facial wound with 7 stitches. this latest slashing has neighborhood people searching for answers. >> i'm curious why now, what's behind it? why are we seeing more of it now? i'm very concerned. >> be very careful. >> reporter: responding officers caught up with the suspect a block and a half away from the crime scene, a homeless man with a lengthy criminal history. >> we're very concerned about it because about january 4th we had something very similar in the bronx in a mcdonald's where a young man was murdered. homeless person sleeping inside a restaurant. >> i've seen some homeless, what could be homeless people sitting down for a moment warming up or something, but it's never been a hangout. >> never trouble? >> never. >> somem today from chief boyce at his news conference. he strongly recommends anyone to

commercial location, if you come across a homeless person, immediately contact police. do not, do not try to address the situation on your own. live in the kingsbridge section of the bronx, joe torres, channel 7 eyewitness news. nearly two dozen 3rd graders sickened by fumes at their school in south amboy, new jersey are going to be okay. an unknown odor that filled two rooms had the students and teacher complaining of burning in their nose, throat, and eyes. they went to the hospital and all were released. hazmat teams couldn't find any sign of the problem. the school was evacuated but students eventually returned early. >> they just said there was a weird smell and there was a teacher and a few students that had to be brought to the hospital. and immediately, i don't know if that's one of my kids that had to be taken to the hospital. >> hazmat crews will continue monitoring the air in the school throughout the night.

monoxide sent workers at the huntington panera bread restaurant to the hospital. a leak at a restaurant under construction next door is being blamed tonight. the problem was fixed and panera reopened for business at lunchtime. everyone there expected to be okay as well. wall street remaining relatively flat today as investigators look ahead to friday's job report. stocks suffered small losses but rebounded before the close. energy companies climbed today after another rise in oil prices. the dow gained 34 points, closing at 16,899. nasdaq gained 13 points. s&p 500 gained 8. still ahead, new developments in the custody battle between madonna and guy richie. what a judge in manhattan told them during a hearing today. >> plus big changes coming in new york city for low level offenses. the manhattan d.a. says he won't prosecute them but there's a warning from some of the city's top cops.

do you know the difference between an arrest and a summons? thousands of people will soon find out. new york city is changing the way it deals with quality of life infractions starting here in manhattan. hoping to relieve court backlogs and allow police officers to focus on more serious crimes. eyewitness news reporter cefaan kim explains how it will work.

seats on the train and riding between subway cars, to littering and public consumption of alcohol. if you're guilty of these minor offenses, you can breathe a sigh of relief. starting soon these low level crimes will result in summonses only, not arrests, but only in manhattan. the city's top cop says the shift in policy is about more efficient policing. >> this is not a get out of jail free card. there's an expectation that the public will respond to this. and if they don't appropriately, then there will be warrants issued and they'll be arrested. >> every quality of life offense matters. we're not going to tolerate. but a summons is a real penalty. >> reporter: it's an initiative spearheaded by manhattan district attorney cy vance. officials say the changes will result in about 10,000 fewer criminal cases a year. the policy shift though would

commissioner william bratton's signature, broken window crime fighting approach. >> broken window is here to say, but it's the amount we'll adjust to meet the existing circumstances. >> reporter: advocacy groups that have been calling for the commissioner to abandon broken windows say they agree with him. change much. >> our objection is it mainly targets lower income people of color, virtually decriminalized in white communities. >> the new policy goes in to effect monday. the mayor says depending how this goes, it could spread to all five boroughs. cefaan kim, channel 7 eyewitness news. an investigation is underway tonight in a fire that left one woman dead and nearly a dozen others fighting to escape. fire officials say the house on stevens street in danbury was engulfed in flames by the time firefighters arrived early this morning. an elderly woman crawled on to a

and rushed over to help. >> two couples managed to get out. they had their children in the car. the moms were very scared and everything. we offered help and all that. >> two people suffered burns and smoke inhalation. the homeowners are an elderly couple who lived on the second floor. the plane part that washed up on shore is on its way to malaysia to determine if it's from the missing malaysian airlines flight. it's been tentatively identified as coming from a boeing 777. that's the same type of plane from flight 370 and the only 777 known to be missing. the plane disappeared on the way to kuala lumpur in march of 2014. another nation hit by the zika virus. cuba has its first case of the mosquito-borne illness. a recommendation to reduce the risk of human cell and tissue donation. new guidelines make people

diagnosed with the virus or have other risk factors. we've got lee back with us. temperatures are going back down where they should be. we've got snow showers on the way. >> we're all over the place. classic march. that march wind is certainly with us. the way you get march normal is you have snow one week and big time mild spring temperatures the next. that's what we're going to advertise for you. that's a shivering camera there looking from astoria to the manhattan skyline. then the sun which is definitely a lot higher, days getting longer. 39 degrees. march 13th is daylight saving time. 29% humidity, air is very dry and cold. the high today is 55. been an upside down day with the high. the numbers have dropped during the day. the sun will be going down. the numbers will start to tank. 38 degrees in comack. 40 in roslyn. hudson valley, down to the mid 30s. 25 in monticello. 40 in wrightstown. wind chills are generally in the 20s.

teens during the evening hours. gusts for the next few hours could be over 30 miles per hour. then i think the wind starts to gradually subside. still gusty by midnight. by morning, 7 to 14 miles per hour. fair amount of sunshine. it's cold. during the day only 5 to 10-mile-per-hour winds. not as harsh in the afternoon as temperatures get in to the mid and upper 30s. so we're clearing out right now as a few patchy clouds over the catskills. these snow showers are coming off the great lakes. they'll die off after sunset. we're wedged between last night's low and high pressure trying to come in. the pressure gradient in between is pretty gusty. once this high gets a little subside. just indicates lighter winds. then we'll look at these two pieces of energy. one coming out of canada in to the dakotas and one the surface texas. they'll join forces, produce the storm that heads off the carolina coast thursday night in to friday and then heads offshore far enough offshore

big snowstorm but close enough that we get a nuisance storm thursday night in to friday morning. clouds increasing during the day tomorrow. definitely chilly in the morning. mid and upper 30s in afternoon with light winds shouldn't feel too bad. thursday night plans are okay. it's late at night snow showers start to come in from southwest to northeast. note this. we'll have snow showers on friday morning and maybe even a steadier snow especially south and east. our temperatures are below freezing here. there can be slippery spots for the friday morning commute. as the day goes on, even though we're not seeing sunshine, when you're talking about a that happens in march, it's harder and harder for the road to stick. mostly wet roadways. a little bit more snow south and east and that will continue at least in to the early morning hours. right now i'm thinking a coating to an inch north of new york city and 1 to 3 inches south. the jackpot amounts will be south and east of new york city mainly in middlesex or monmouth county, parts of long island.

we're back and we've got breaking news in brooklyn where a man has been struck by a hit-and-run driver. this man, 70 years old. he was on a scooter at the intersection of 85th street and 25th avenue. he has been taken to lutheran medical center in critical condition. right now the only description

at this time is that it was a white vehicle. we do have a crew headed to the scene. of course we'll bring you more information as soon as we get it. an earthquake hits indonesia, rattling nerves, but not much else. the 7.8 magnitude quake was centered off the coast. a tsunami warning was issued but has since been canceled. no damages or casualties reported. however there's now a fear smaller earthquakes closer to land could be triggered. tightening sanctions against north korea. the council approved the toughest sanctions against the nation in two decades. that includes mandatory inspections of cargo leaving and entering the country. transfer of small arms are banned. this is in response to north korea's recent claims about its nuclear and missile programs. the football season may be over but the deflate-gate scandal is not. tomorrow federal judges in manhattan will hear the nfl's plea to reinstate new england quarterback tom brady's

>> new jersey reporter toni yates was in court today where this new information came to light. she joins us now live. >> this new information revealing the off duty nypd officer harrison had been in a minor accident on the turnpike with another driver that they pulled over, and that he stepped out of his car, walked over to the other car, and pointed his gun at that driver. they say as he stepped away from that car, he stepped in to oncoming traffic where he was struck by another car. the driver of that car in trouble because he left the scene of the accident. police discovered who he was under investigation. he turned himself in on monday. >> reporter: william gia rr made an appearance where his attorneys say the fatal hit and run was an accident that the client did not intend to escape

>> a not guilty plea will be entered on your behalf. >> reporter: vincent harrison was struck and killed by a car early sunday morning on the new jersey turnpike in elizabeth. the investigation revealing the officer had gotten out of his car after a minor accident with another car that he pulled his gun on the 26-year-old woman who had her 2-year-old with her. pointed the gun, threatening to shoot. investigators say when he took steps away from her window, he stepped in to oncoming traffic where they say espinal-mejia's car struck him fatally. he left the scene. in court, his attorney said he the law. situation. he had his wife and and cousin in the car and made the decision to leave. >> reporter: the prosecutor disagreed. roadway. he left. he didn't pull over somewhere further down and make a highway. he didn't drive to a police station and make a phone call.

the cause of that fire is under investigation. an indicted former staffer for governor chris christie wants to get names of people who possibly knew about closed lanes on the george washington bridge. in a court filing, it says the government admitted it has names of people that may have knowledge of the conspiracy but didn't join it. kelly and former court authority official face charges that they created traffic jams near the bridge to punish a local mayor for not endorsing christie. the supreme court taking up the most important abortion case in two decades today. demonstrators rallied outside the supreme court building as the court took up the first high profile issue to be heard since justice antonin scalia's death. >> reporter: pro choice

protesters joined by house speaker paul ryan. on opposing sides of an abortion case argued at the supreme court this morning. >> this was the most important abortion rights case to be argued in almost 25 years. >> reporter: at issue, a 2013 texas law that imposes a variety of regulations on abortion clinics. supporters of the law say it's about protecting women's health. >> if the supreme court in this case upholds these laws, it will be a victory for patient health and safety. >> the law is really important because it addresses a predatory abortion industry. >> reporter: those challenging the law say it places an undue burden on women trying to get a legal abortion. >> there is no medical justification for this law. it's just burdening women. >> reporter: if the law stands, 3/4s of clinics in texas will close, leaving five facilities for 5 million women. a decision could matter for more than texas. >> the court hasn't said that

about how much latitude states have. this is an opportunity potentially for the supreme court to really offer some guidance to states regarding how far they can go. >> the case could be impacted by antonin scalia's recent death, leaving the court with eight justices and the potential for a 4-4 tie. that would affirm the lower court decision, upholding the texas law, but wouldn't create new law, meaning it wouldn't have a national impact. universal pre-k is a signature issue of mayor de blasio's administration. there are numbers out that show families are overwhelmingly happy with the program. this new survey finds 92% of families rated their child's pre-k program as good or excellent. 83% say their child learned a lot. more than 68,000 children are enrolled in pre-k this year and the city has extended the pre-k application deadline for the fall of 2016 until the 9th.

conducted by the firm west stat research. it's part of a series of polls and surveys being done at a cost of $2 million. troubling new development tonight in connection with the consumer's crisis in new jersey. a billionaire investor says if new casinos are approved in northern new jersey, he will not invest $100 million in to the taj mahal casino. he says his planned is contingent on new jersey not approving two casinos outside new york city. the first round of payment is going out to hundreds of september 11th first responders and survivors. the september 11th victim compensation fund has authorized payments of more than a thousand claims, totaling more than $230 million. the fund hopes to send out these payments by june. congress reauthorized the fund last december. background checks linked to gun sales are shooting through the roof. the fbi processed 2.6 million firearms background checks last

all new at 5:00, police in new jersey arrested 23-year-old helen carrasco of jersey city with improper disposal of human remains. 25-year-old francine vincent was last seen leaving a midtown bar where she worked february 8th. the body was found wrapped in a tarp outside an abandoned home later that night. investigators have not determined how she died.

urging madonna and her ex-husband to resolve the custody dispute over their 15-year-old son. the state supreme court justice recommended the singer and director guy richie settle the matter after a potential agreement fell apart yesterday. the same judge ruled in december that rocko returned to madonna's custody. madonna is pushing for the judge to enforce that order. a state of emergency in effect tonight in upstate new york town where a freight train derailed carrying a dangerous liquid. crews spent the day trying to clear 16 cars from the tracks ripley, southwest of buffalo. they derailed around 9:30 last night and two of the tankers began leaking ethanol. dozens of homes were evacuated but fortunately no one was hurt. heart stopping moments when a child fell out of the back of a van in to traffic. this happened where the van was stopped at a red light in china. the child's grandfather was behind the wheel and did not

light turned green. so the toddler gets up and starts running down the road. another driver pulled over, grabbing the child and another good samaritan chased down the grandfather who was then reunited with his grandson. nobody hurt in all this but so scary. >> hard to watch. a cashier fighting back against a robber. he pulled a gun on a worker in georgia. she smacked the crook's hand. he points the gun back at her but she shoves his hand down, takes the drawer from the register, whacks the guy over the head with it. the robber is now on the run. i don't think he's coming back. police hope their surveillance video will help them catch him. >> she was gutsy. a very special celebration for a barber who is truly a cut above the rest. plus this. >> caught on camera, a local dog walker is supposed to take daily walks. something else entirely.

subsiding a little bit. it's gradual. we'll have winds that go to 10 to 20 during the first part of the night as we drop below freezing and eventually 7 to 14-mile-per-hour winds by morning with sunshine to start the day at about 27. so wind chills in the teens. not as harsh in the afternoon. fair amount of sunshine through early afternoon and clouds start to gather late day but light winds. then tomorrow night the clouds will thicken and the first snowflakes should hold off until maybe even midnight. could be as early as 11:00 over parts of central and southern new jersey. we have clear to partly cloudy skies. winds coming down lake ontario and lake erie. you'll see these clouds disappearing on the evening hours on satellite. high pressure moves in tomorrow. then we focus on this area. there's an area of low pressure forming over northern texas right now which is going to head to the carolina coast. the question far north can that storm track get during the day on friday? i think it's far enough to south and east that we're not getting the brunt of any significant

i think that's a possibility. and it's going to be a cut-off where some of our far northern suburbs may not even see a flake out of this. here's the way the futurecast looks. tomorrow morning clear, cold. clouds will increase during the afternoon. not as harsh. still dressed winter. clouds will be increasing in to tomorrow night. there are your first snowflakes coming in close to the midnight hour. then snow showers and periods of snow south and east of new york city in to the morning commute. you see how to the north have a tough time getting that snow in to the area. going to be a sharp cut-off. i do think we'll have slippery roads especially from the city south and east. notice how our temperatures are close to freezing. as the day wears on numbers are going to get above freezing. the snow may linger especially on parts of long island and the jersey shore. that's where we may get some of our higher totals at least on the colder surfaces. right now we're looking at a coating to an inch. hudson valley and connecticut will be close to that inch amount in new york city and 1 to 3 inches south. it's really parts of central new
