>> reporter: jose, like others are left stunned by the accidental death of 57-year-old clifford la may who was killed after he fell from the seven- story office building around 7:00 a.m. tuesday morning. a statement police say it afears his death can be attributed to a horrific accident and no foul play is suspected. >> nothing happened when i came in at a quarter to 7:00. 7:15 the guard called me down. >> reporter: they believe he had gone to the roof of the building to check on possible damage from the high winds overnight. when he fell he struck a tree before landing. police say the investigation is on-going. investigators are trying to determine if high winds played a factor in his death. >> shock. i'm shocked that it could happen. he goes to work in the evening

>> reporter: a neighbor clifford la may lived alone in a third floor apartment in this palisades park. he knew him only in passing but said he was a good man. >> think kept to himself? >> pretty much. he was a hard worker and did his job. >> reporter: he was the building manager for alfred enterprises. in a statement from company officials this afternoon they write, we are heart broken to have lost an individual who has been a part of our daily work life for four years. he was highly regarded by all of us. a very tragic death. >> for sure. thank you very much. high winds knocked down trees and power lines across our area overnight. some of the worse damage was in westchester county.

>> reporter: the single mom is in critical condition. the sidewalk was packed when fall drove her car into the crowd. several small children and others also came within inches of getting hit. >> i froze. i wanted to tell my niece move, run! i couldn't. there was no words that i could say. >> reporter: she is talking about her niece. we have learned her injuries are so severe. but this cell phone video shows the 25-year-old lying unconcious on the sidewalk just after 6:00 last night. the single mom had just been hit by a car police say driven by sinbo fall. it came within inches of her who was standing with three small children. she is talking only to eyewitness news. >> she fell. the car kept going into the wall. it was like how did me and the three kids survive. >> reporter: this started at

>> must be sent her back to fight. i hope she fights fast because of it. >> reporter: again at this hour it is not clear what spark had the initial clash between the suspect and the victim. suspect is charged with aggravated assault and criminal attempt homicide. kimberly richardson. the man accused of shooting and killing a mother and son on staten island was shot during a confrontation with police. u.s. marshals tracked down anthony morales and shot him during a confrontation. he is wanted for the murderers of anthony and adill rivera last week. another man was hurt in the shooting. authorities believe a dispute over a car lead to the murders. police released video of a man wanted at a sexual assault at the historic stone wall inn.

good evening. it is 6:00. i'm liz cho. bill is off tonight. sismatic failures is the conclusion by investigators in new york on the death of an 84- year-old man. a couple hours before the accident a tenant reported a dangerous problem with that specific elevator. why wasn't it fixed? m.j. has the lead story tonight. >> reporter: maybe because it was given low priority or maybe because it happened on christmas eve. city investigators were determined to figure out whether this was an isolated incident or something even worse. >> one of these days it will happen again. >> reporter: residents are still traumatized tonight. months after their neighbor was killed in the building's elevator. the man was 84 years old and died of a fractured skull after he became pinned in the doors when the elevator began moving. >> the elevator was going up and down up and down.

>> he wanted to get out. he got so scared. he pushed the door like this. the door closed on him and hit his head. that's what happened. >> reporter: but a report by the city's department of investigation now reveals that a complaint was called in by a resident hours earlier. he did not take immediate action after the complaint. investigators uncovered multiple lapses in communication. a series of inspections found similar malfunctions in 80 brake monitors city-wide. >> on any given day a thousand people probably go up and down in an elevator and 80 of those brake monitors are not working. that's a lot of people put at risk. >> reporter: commissioner mark peters said his agents found failures from top to bottom.
