show. the big question is, is it because of their age? we're going to take that on coming up next in our big board. >> we will. but first in this half hour that new twist in the murder of chandra levy. the case rocked the nation as you know 15 years ago after levy was romantically linked to congressman gary condit. he was questioned, ruled out as a suspect. now prosecutors suddenly dropping charges against the man later convicted in the killing. abc's david wright has up more on this. good morning, david. >> reporter: good morning, robin. this is a it throws this 15-year-old murder case wide open again and it's a case that brought down a congressman, but prosecutors have dropped all the charges against the man who was ultimately convicted because a key witness now admits he lied. who killed chandra levy? the 24-year-old washington intern who disappeared in d.c.'s rock creek park in the summer of 2001, the case was a national obsession. but it turns out the murderer was likely not ingmar guandique,

el salvador who was convicted based on a jailhouse confession. guandique protested his innocence and passed an fbi lie detector test. his conviction later set aside. a retrial set. but prosecutors are now asking all charges be dropped due to recent unforeseen developments that were investigated over the past week. >> congressman condit, do you know what happened to chandra levy? >> no, i do not. >> levy's disappearance and murder caused her former married boyfri california congressman gary condit, a powerful california democrat told abc's connie chung he was not involved in her death. >> did you have anything to do with her disappearance? >> no, i didn't. >> did you say anything or do anything that could have caused her to drop out of sight? >> you know, chandra and i never had a cross word. >> do you have any idea if there was anyone who wanted to harm her? >> no. >> did you cause anyone to harm her? >> no.

>> i did not. >> reporter: but in may as the retrial approached guandique's lawyers petitioned the court to raise new allegations about condit's alleged fondness for rough sex claiming a sex act gone wrong may have resulted in levy's death. overnight condit's lawyer issued a statement saying gary condit was extremely disappointed the prosecution has decided against a retrial. the failure of authorities to bring formal closure to interest disappointing, but in no way alters the fact that mr. condit was long ago completely exonerated by authorities in connection with ms. levy's death. her mother and father are devastated. >> i wish that the right person whoever did what they did to my daughter, we get answers. >> reporter: well, gary condit's lawyer says he expects his client will speak publicly on this case in the near future.

ago returning to public life. prosecutors have never named him as a suspect and they are not saying he's a suspect now, robin. >> all right, thank you very much. to talk more about this abc news chief legal analyst dan abrams. so tell us why charges were dropped. >> this is a really big deal. a guy tried and convicted already for this crime. and now the u.s. attorney coming forward and saying, we're not going to try him again. why? because they obviously have no faith in their key witness. this case was witness and that is a prison informant. the reason that first conviction was overturned is because it turns out that informant hadn't told the truth about past contacts with law enforcement. it sounds like now these u.s. attorneys have lost even more faith in this same witness who was their key witness in the case. >> this is still an unusual step here and seemed like they did have other evidence. >> the other evidence they had was primarily other crimes he

attacking women, right? he seems like the perfect kind of defend. this is a guy who's done stuff like this in the same area. the problem is there was never any physical evidence linking him to the crime. so you needed this key witness, this prison informant and if he's lost all credibility now and that's got to be the reason that the u.s. -- it is such a big deal for a u.s. attorney in a case like this so high profile to say we're not going to try them again, we're done. w your heart goes out to them because you're wondering after all these year, is it ever going to be solved. >> and probably won't be now. i mean that's the incredibly heartbreaking thing for the family as i'm sure all they want is closure and want to know this is over and i don't think this case is now ever going to be officially solved. >> all right, dan, thank you. >> thanks, guys. we move on to a real-life leap of faith. california skydiver planning to jump from 25,000 feet without a parachute or wingsuit hoping to
