new motion, today, in the case against stephen rankin. commonwealth's attornyey stephanie morales wants police officers attending the trial to be banned from wearing their uniforms in the court room. 10 on your side's andy fox broke this story on twitter this morning. he joins us from the newsroom with more on this. andy? former police officer stephen rankin shot and killed william chapman last april 22 in the parking lot of the frederick blvd walmart. chapman was unarmed. in the motiuon, prosecutor stephanie morales does not want uniformed officers in the courtroom. she calls their presence intimidating in the motion she states the family of the man rankin killed william chapman, should be able to demand that their son's killer be tried in a manner that excludes any suspicion, intimidation, or improper influence. moarales writes, "the stifling presence of so many law enforcement officers will have a chilling effect on the jury's ability to

minds and without fear of rendering a verdict based soley on the law and evidence presented." we asked rankin's attorney james broccoletti about that. in the motion which i will have more of beginning at four, morales asks the court if uniformed officers are not prohbited, then morales asks for no more than 10 in the courtroom at a time, and only three uniformed officers can sit together at a time. today at four, what rankin's attorney james broccolett thinks about that. students at denbigh high school in newport news are in school today, despite

against the school. authorities went through the school this morning, but they didn't find anything suspicious. a school spokeswoman says officials learned about the threat sometime last week. however, authorities later determined the threat was not credible. still , newport news schools say they will have extra police presence on the campus throughout the day. going on right now in florida -- the coast guard is having its first of two hearings about the el faro accident. today's hearing is dealing with the events leading up to the ship's sinking. we expect to learn more about the crew members and where the ship went before the final journey into hurricane joaquin. the second hearing will focus on the ship's last journey. all 33 people on board died, including men from chesapeake and virginia beach. the light rail is a topic of discussion at the commonwealth transportation board workshop in richmond. the future of the funding for the project in virginia beach is one of the things they are talking letter to city councilman

villeanueva informing him 155-million- dollars in state funding could be put towards other projects. 10 on your side's erin kelly is following the meeting for us. she give us a look at what about starting on wavy news 10 at 4. norfolk are investigating an attempted bank robbery. police say a man rolled up through the drive-thru teller window at the sun trust on west little creek road near granby street around 8:55 this morning. he allegedly gave the teller a note demanding money. the note also said there was a bomb inside the bank. police came five minutes later and arrested the man without any problems. nobody was hurt, but police did close off part of west little creek road so the bomb squad could make sure everything was okay in the bank. questioned by police right now and we are working to get his name and mugshot for you. as soon as we do, we'll bring it to you on-air, and on wavy dot com. virginia beach police

robber. take a close look at the man in these surveillance photos. investigators say he robbed at citgo on diamond springs road last tuesday with a shotgun. police say he demanded money from the clerk, and then ran off toward the driftwood apartments. if you recognize this man or have any other information about the robbery that could help police, call the crime line at 1-888-lock-u-up. we're working to learn more about an accident that closed 1-64 eastbound in portsmouth overnight. take a look at the scene from our wavy traffic jam cams. vdot closed all lanes and put a detour in place. the scene is clear and the road is back open, but we are working to find out if anyone was hurt and how many cars were involved. we'll let you know as soon as we hear from police. we're still working to learn how a child is doing after paramedics in virginia beach say he almost drowned. rescue crews say the three-year-old boy's family found him unconscious in a backyard fish pond. it happened saturday off

broad bay neighborhood. paramedics took the boy to the hospital and say he was in a serious condition. it's unclear if the boy fell into the pond from the side or fell through thin ice on the surface. the child's family says they were at home, and the boy was missing for only a few minutes before they went looking for him. a woman is desperate to find her son's killers. now she's asking for your help. its been almost two years since police found 29-year-old (kyle) cyle strahl dead his home on red horse lane in the lake edward neighbors reported hearing gunshots. police still have not said how strahl died. his family says someone shot him in the head. his mother is asking anyone with information to come forward. 10 on your side's erin kelly talked to her via skype skype interview for erin leslee costantino - victim's mother 2235 every day that goes by, every minute of every day, it's just like it just happened again. 2241 do you know what i mean? it's almost unbearable 2244 police say this is still

know anything, call the crime line. a hampton family is upset after a pharmacy reportedly put her son's name on her medication. amanda mccoy says both she and her five-year-old son were sick at the same time. both of their prescriptions went to the rite aid on east pembroke avenue. the boy's doctor prescribed him eyedrops, but someone put his name on a bottle of "prednisone", which is a steroid used to treat inflamatory diseases. the pills were supposed to be for his mother. mccoy gave her son two pills before realizing the mistake. her son is okay, but she contacted 10 on your side to warn other parents. amanda mccoy - mom "we panicked, we were like and it wasn't even prescribed to him." "i wanted to warn other parents that it could happen to your children, it could happen to yourself, i mean if they're just wrongly labeled and stuff they could have put a whole different

today in los angeles. lonnie franklin is accused of killing a girl and nine women over three decades. the case lead to a documentary and a made-for-tv movie. his case is referred to as the "grim sleeper," becuase of the 13 year gap between the first string of killings and the second. the first murders tied to franklin happened in 19-85. the victims range in age from 15 to 35. franklin pleaded not guilty. prosecutors are seeking the death penalty. prosecutors will not file any charges against two police officers who shot

drug dealer in november. this edited video from the cruiser's dashcam shows the two officers trying to arrest the man. you can see, the man trying to resist arrest. he manages to free one of his arms and grab a gun in his waistband. he then shoots one of the officers. that's when the officers return fire and kill him. a background check on the suspect shows police arrested him at least three times on drug and gun charges. the officer he shot is still his injuries. a mother is in jail after witnesses told police she gave birth inside a public bathroom and then left her baby in the toilet. police caught 38-year-old mary grace trinidad by following a trail of blood out of a subway restauraunt and into a nearby parking lot. employees heard the baby crying, and got to the child in time to call 9-1-1 and save its life. both the mother and the baby are in the hospital. trinidad is charged with attempted

police in sacramento may have a bit of an easy time catching a home invasion suspect. he left behind a pretty valuable clue. a 52-year-old man came home from work two weeks ago, and found himself face- to-face with the barrel of a gun. the man quickly ran into his bedroom and called 9-1-1. after the thief left, he went to the kitchen to see what was missing. then he saw something shocking. the theif's phone charging on the counter. (s/carlos / home invasion victim:38-:42) "looking into his eyes, it's like looking into the eyes of the devil," (s/carlos / home invasion victim:42-:48) "even though i got away and got into the room, but for those few seconds, my life flashed before my eyes." police say the suspect is still on the loose, but they hope the selfies left on the phone will make it easier to find him. some lawmakers in oklahoma are in a battle to get a religious monument back on the grounds of the state capitol. crews took down a statue of the 10 commandments four months ago. oklahoma's supreme court

capitol grounds violated the state constitution. crews moved the monument down the street and it now sits outside another government building. since the move, lawmakers have introduced several bills aimed at changing a section of the oklahoma constitution. the change would allow public money to be used for religious reasons. lawmakers want people to vote on the change. however, opposition groups like the american civil liberties union say they will fight any proposed change to the law. severe thunderstorms rocked several communities across mississippi and florida yesterday. a lot of homes and damaged. residents in mississippi think tornados touched down in the towns of sylvanena and weston, but the national weather service hasn't confirmed that. people in another county say they saw the tornado that destroyed a house there. a witness said the tornado was coming straight towards her, but it just narrowly missed her home. the storm happened during school hours and officials say the emergency preparedness

despite all of the damage, there are only a few minor injuries. and the damage from the storms trapped some people underneath debris. take a look at this video of crews rescuing a woman from her home, damaged by a tornado. the workers had to dig around her to clear a path to get her out. at least 10 homes in the area recieved a lot of damage from the tornado and severe weather. . vote 5-3 in order to win his appeal. a 4-4 tie reverts back to the lower court's decision. president barack obama is expected to nominate a new supreme court justice soon. a local political poll puts donald trump and hillary clinton in the lead with just two weeks before virginia votes in the super tuesday primaries. christopher newport university interviewed 735 registered voters for two days last week. among republican voters, they found trump got 28 percent of the gop vote, followed by 22 percent for marco rubio. 19 percent picked ted cruz. among democrats, hillary clinton got 52 percent and bernie sanders got 40 percent. both parties hold their presidential primaries in virginia on march first. new nbc news-survey monkey online poll found donald trump maintain their leads nationally. trump leads the percent followed by senator ted cruz with 18 percent, and senator marco rubio with 14 percent. the poll also found more

two men pleaded not guilty for their alleged involvement in the deadly bombing of a shrine in thailand last year. the suspects made their first court appearance since novemeber earlier today. the lawyer of one of the suspects says police tortured his client to get a confession out of him. the two men are accused of bombing the erawan shrine in august. 20 people died and more than 120 were hurt in the most devestating attack in thailand in decades. police say they have d-n-a evidence to support their case. the next hearings for the case are in april. people in north korea are celebrating the birthday of their former supreme leader. today would have been kim jong il's 74th birthday. it is a national holiday in north korea, called the "day of the shining star." north koreans who talk about the holiday in public are very careful to talk about kim positively, referring to him as "the great general." a giant flower show featuring thosuands of flowers named after the former leader are on display in pyongyang. after all of the celebrations are

reportedly get time to relax with their families, as tomorrow is also a day of observance of the life of the former leader. brazil is stepping up its fight against the spread of the zika virus. the government sent almost 55-thousand soldiers into the streets to combat the mosquitoes responsible for the spread of the virus. the soldiers helped health workers apply incesticides in places with standing water, sewage pipes, and anywhere else mosquitoes could breed. both the c-d-c and the w-h-o say the spread of the virus is an international health emergency and countries need to take steps to prevent it. after a prison riot left 49 inmates dead, authorities in mexico made a shocking discovery about the facility. the riot happened last week when two rival factions of a drug cartel faced off for control of the prison. after outside police got it under control, they found several cells outfitted with luxuries

still have to apply for permission from u-s regualtors to fly specific routes before the sell tickets to cuba. the agreement only allows 20 flights per day between the u-s and cuba, but the deal is still expected to help increase tourism and business on the island. police in idaho just released footage from a high speed chase that happened last year. it ends with an incredible crash which shows the driver being ejected. this may be a little hard to watch for some. in this video from last april, boise police are trying to chase down jose sanchez on the highway. after a long chase, sanchez loses control of his truck, and somehow, he wasn't badly hurt, and actually tried to run away from police. an officer pulled out his

forced sanchez to give up. a judge sentenced sanchez to 15 years in prison for the chase. crews in texas fought a massive fire at an oil facility. take a look. you can see the fire shooting out of the south cross energy plant. investigators say an explosion set off the fire. emergency workers shut down roads and had residents leave the area as a precaution. crews controlled the fire after they were able to shut off an oil valve fueling it. investigators are trying to figure out what caused the explosion. slick roads are being blamed for an 11 car crash on i-81 in pennsylvania. the wreck happened overnight. fire officials say icy roads caused the chain reaction crash just north of scranton. eight tractor trailers and three cars got caught up in it. fortunately, only three people were slightly hurt. the accident closed a five mile stretch of the

some popular acts won big last night at the 58th grammy awards. kendrick lamar was the big winner, he took home a number of grammy's, including best rap album and best rap performance. taylor swift took home three grammy's, including album of the year for her smash hit "19-89." she becomes the only female artist to win album of the year twice. ed sheeran won song of the year for "thinking out loud" and bruno mars and mark ronson got record of the year for "uptown funk." megan trainor won for "best new artist." and chris stapleton took home the award for best country act. speaking of big winners, the u-s national women's soccer team keeps rolling through the competition. and one striker's performance last night is one she'll remember forever. forward crystal dunn scored five times as the u-s beat puerto rico 10 to
