the state forensic lab. now stephen rankin's defense team says they were ready to go for march - their witnesses are ready but they had no objection to the delay. that wasn't the only big topic discussed in today's hearing. commonwealth's attorney wants to ban off duty police officers from wearing their uniforms in court - or at the very least - limit the number to 10 - and together in groups of three or less. at today's motions hearing there were about 6 officers in uniform present. however at rankin's initial bond hearing there were about 20 morales argued today that groups that large would create undue persuasion of the jury - she says it would unfairly bolster the credibility of the defendant. and their presence would be quote stifling. here's what william chapman's cousin said about that motion. earl lewis/chapman family spokesman 1:19:56 if they're not working and they're in that courtroom just to see what's going on, no we don't wnat them there.

for good. he just announced the plan shut the prison down about an hour and a half ago. the president says his staff is submitting their plan to congress. he says holding terrorists in a prison outdated. he cited cases like dzhokar tsarnaev as to why it is safe to hold terrorists in the united states. for years, the president has said terrorists use guantanomo as a recruiting tool. of the 800 prisoners that used to be held at guantanomo, more than 85 percent have been transferred to other countries. more than 500 of these transfers happened under president bush. since i took office, we've transferred 147 more. each under new, significant restriction to keep them from returning to the battlefield. during his address, president obama cited his predecessor george w. bush for also wanting to close the prison while he was in office.

the parents of a 14-year-old girl nearly killed in saturday's mass shooting in michigan are breaking their

abigail kopf was dead. they were about to harvest her organs when she squeezed her mother's hand. four others with abigail in a cracker barrel parking lot died that night. that includes barbara hawthorne, who despite no blood relation, abigail called "grandma barb." they would go see shows together, just like they did saturday night. abigail's mother, vicki kopf, wants people to know her daughter is a fighter. (s/vicki kopf/victim's mother:52-1:00) "everybody needs to get that straight. my daughter is not dead. she is alive and she is fighting for her life. i want everybody to understand that." (s/vicki kopf/victim's mother1:01-1:10) "abigail is strong, and she is a vibrant beautiful young lady and she did not deserve this... and either did her grandmother or those other victims." meamwhile, accused shooter jason dalton made his first appearance in court yesterday. he is charged with six counts of murder. the judge denied him bail. so far, police haven't been able to find a reason dalton went on the rampage. he could spend

a judge granted a virginia beach police officer bond this morning. police arrested her over the weekend for allegedly driving drunk. virginia beach police accuse sergeant margaret hobbs of driving under the influence sunday evening. police say she had two young children in the car with her when they pulled her over. 10 on your side's jason marks was in court this morning for the bond hearing. he joins us now from dam neck. that's where sargent hobbs was pulled over. it happened here along dam neck road in virginia beach sunday night just after 7. court records show that she attempted to get on base twice before base police were called. base police officers arrived and found the off duty virginia beach sergeant in her toyota 4-runner with her 2. she was turned over to virginia beach police and charged with dui. prosecutors say her blood alcohol level was at .23. that's more then double the legal .08 limit. hobbs bonded

i can tell you she is a highly respected officer. she's served for 17 years and i spoke with many officers over the last two days who are just shocked that this happened. hobbs was so thought of- when she was decided to become a sergeant, she was number one on the department's list . tommy shattuck/former vb police sergeant 18= :2:24 "in 2010 when she was promoted she a very highly qualified officer she was pio as you know. she was an svu as a detective she was a about margie hobbs in my career" :2:35 thousand dollar bond. as part of hobbs bond she isn't allowed to drive a car or have any alcohol until her trial date. that's scheduled for viriginia beach jason marks 10 on your side.

some people are very upset about a seemingly prejudiced vanity licence plate. we do have to warn you, this may be a little shocking to see. here it is. you can see it says "f-muslims." someone put a picture of it on social media. hundreds of people commented and criticized the picture. state officials say the plate was issued last june. the picture also caught the attention of governor mark dayton, who ordered the state department of public safety to take the plate away. activists say they are getting pulled. (s/ haji yusuf / activist:07) "it's been overwhelmingly saying, 'this is wrong.' this is what this community is the deaprtment that issued the plate apologized in a statement. it says the plate should never have been issued. things got a little rough on the shores of hawaii. yesterday, a historic swell hit oahu. waves sent lava rocks onto the highway. some waves

a clash at chuck e cheese. police in connecticut say at least a dozen people were involved in an all out brawl. and someone caught it all on camera. police think the fight

breaking news about the murder trial of former portsmouth police officer stephen rankin. a judge granted a continueance in the case. commonwealths attorney stephanie morales asked for more time to get her case against rankin ready. the trial is pushed back to august 16th. morales says there are three witnesses that can't make the original march 21st court date. also discussed at today's hearing, the presence of uniformed police officers. six officers were in the courtroom today. however at his first bond hearing, there were 20. morales argued today that groups that large would create

where a school bus was involved in an accident on jefferson avenue and oyster point road. a 10 on your side viewer sent pictures. dispatcher was hurt. you can see traffic is being diverteed in the area. we're working to find out more. stay with us for update throughout the newscast. this morning, a judge in virginia beach granted bond at $5,000 dollars for a veteran city officer, accused of driving drunk. virginia beach police say officers arrested sgt. margaret hobbs sunday for driving under the influence. court records show her blood alcohol level was more than twice the legal limit, and that she had two children in the car with her, ages 2 and 5. hobbs is a familiar face because she served as a public information officer for the department. police have released few details on the arrest. sources within the department say hobbs got into an accident sunday evening near the oceana nas, dam neck

shooting in arizona. police say a man shot relatives in a house in phoenix. investigators say the shooter is dead. a child survived the shooting, but has life threatening injuries. police responded to the 9-1-1 call overnight. when they got there, the gunman started shooting at them. none of the officers were hit. the house was on fire, and officers put on safety gear to get to the victims inside. the gunman is described as a son and brother to the victims. new at midday -- we can now show you who police say robbed a gas station in williamsburg. this is 18-year-old william hayes of hampton. police in williamsburg say he used a gun to rob the valero gas station on york street near quarterpath road yesterday morning. the york-poqouson's sheriff's office arrested hayes, after they pulled him over near the scene. the sheriff's office says he also robbed at least five businesses in york county. hayes is facing several charges, incuding robbery and abduction.

people in damascus are reacting to the news the u-s and russia agreed on a new ceasfire for syria. the news comes a day after a wave of isis bombings killed 130 people around the capital. some people in damascus are skeptical the ceasefire will be properly enforced by all parties involved in the conflict. s/ tarek al nawat/ damascus resident :22 "it will not work because the terrorists don't have any decision-makers. they are getting all the decisions from outside politics. and our government they have the decision to stop the fire but the problem is that they will not accept this decision from our government." the ceasfire starts saturday. take a look at this incredible video of a crane collapsing in australia part of the crane caught on fire and as it started to spread, it caused the arm of the crane to give out and come down. as you can see, the arm did stay attached

hit anyone on the ground. nobody was hurt. investigators believe an electrical problem started the fire in the crane's motor. one person died after a commuter train crashed into a crane crossing the tracks in the nethelands. the happened 80 miles east of amsterdam. the train driver died and seven passengers were hurt. police say the detained the driver of the crane for questioning. you can see the crash split apart the cars. the mayor of the town where it happened says the train was going full speed when the crash happened. investgators are still working to figure out what exactly caused the crash. the wife of notorius cartel boss "el chapo" is talking about her husband's time in jail. she says she fears for his life. emma coronel aispuro claims the mexican government is using harsh conditions inside the prison to "get even" with joaquin guzman because his escapes

look bad. coronel is a former beauty queen who holds both u-s and mexican citizenship. she made the comments during an interview with telemundo over the weekend. she refused to criticize actress kate del castillo. text messages between "el chapo" and del castillo led to his recapture last month. the mayor of the nations capital is in cuba as muriel bowser traveled with officials from maryland and virginia. she met with cuban officials and talked about a range of topics including the economy and education. during a news conference, bowser called for continued change and talked about president obama's upcoming trip to the island. s/ muriel bowser/ washington dc mayor :22 "and we know that the discussions that a fierce urgency now. and i know that the president wants to leave his mark
