over michael jackson's children. his ex-wife debbie rowe says she wants custody. it is one of many new developments. jeff rossen is at the jackson family home. good morning to you, jeff. >> reporter: good morning to you. debbie rowe now says that she will do anything to get her kids back including a dna test to prove she's the biological mother. she's been in hiding since michael jackson's death but when debbie rowe breaks her silence, she breaks her silence. dropping a virtual bomb on the custody case. jackson's ex-wife now says she will fight for her two kids, 12-year-old prince michael and 11-year-old paris. she's also willing to take jackson's youngest, blanket, too. the 7 year old has a different mother. knbc anchor chuck henry spoke with rowe by phone. >> she made it clear that she wants the children. we had an agreement but he broke the agreement. he died.

>> reporter: custody is awarded to his mother, katherine and backup diana ross and rowe was cut out of the will entirely. legal experts say her case is weak any way. she gave up her parental rights in 2000 in a multimillion dollar divorce settlement. >> she has no relationship with these kids. these kids don't know her. it's not in the best interest of these kids to be with somebody they don't know. >> reporter: and still mourning their superstar dad. who just two days before his death was making moves you don't need to be a relative to recognize. concert promoters just released this video to prove jackson was healthy, thin but healthy, before he died. this is jackson rehearsing on june 23rd. 48 hours later, he was dead. >> i'm not a doctor. i'm not a drug rehab specialist. i could not tell if he was

taking painkillers or other medications as they say. >> reporter: it will be at that very site where jackson rehearsed where fans will say good-bye. a public memorial now confirmed for next tuesday at the staples center in los angeles. they'll issue 11,000 tickets free of charge. but it's the issue of prescription drug abuse poised to overshadow the tribute. overnight a law enforcement source told nbc news investigators did in fact find the drug diprivan inside michael jackson's home, an anesthetic so strong most doctors say it's used only in hospitals. now state investigators are turning up the heat. the california attorney general is using a tactic that helped to crack the anna nicole smith case. they're looking through a medical data base giving them the name of every doctor, patient, quantity and date for every prescription filled. they are hunting for the doctors who supplied jackson with his

pills. and as police look to question those doctors involved into the michael jackson case, there's a question about procedure. some say the lapd investigators allowed jackson family relatives back into the family home too early and that the crime scene was contaminated. the lapd responded saying they acted correctly because there were no signs of foul play. >> jeff rossen in california. thank you. the army unit viper company will spend this fourth of july holiday with their families. the soldiers returned home to ft. hood, texas, last night after serving one year in afghanistan. viper company became well known because of a picture on the cover of "the new york times" there it is showing a soldier engaged in a firefight wearing pink boxers saying i love new york. he jumped out of bed to help his fellow soldiers. a south carolina state inquiry shows that mark sanford did not use money illegally to

on thursday matt was live at jackson's neverland ranch where he sat down with michael's broth brother, jermaine, and got a look inside his home. ♪ >> i'm matt lauer reporting from neverland ranch. the only place that michael jackson ever called home during his adult life. he considered himself to be a modern day version of peter pan and, boy, did he quickly turn this place into a fantasy land. now let me take you inside. there was a pedestal here. on top of the pedestal was an academy war statue, an oscar from 1939's best picture for "gone with the wind." these were two of michael jackson's dog.

this is flower and joey that have been cared for since then by the people who own this place. michael jackson had a two-story bedroom. this is the main floor of it. this was the sitting area. boy, did he have a closet. this is a full cedar closet. you see another security panel and it reveals a secret section of this closet. this was the sleeping loft. this is the area that was went over by investigators back in 2005. after that trial michael jackson never returned to neverland. now to our exclusive interview with michael's older brother, jermaine. this family has been through hard times in the past. is there anything that you can compare to this? >> there's nothing to be compared to this. we lost our brother, our hero,

the world is mourning. we're mourning. the fans are mourning. it's unreal. it's unbelievable. to hear my mother say michael's dead, to feel and hear the tone in her voice to say her child is dead is nothing that anyone can ever imagine. >> how are the kids doing? >> they're strong. when i inteentered the hospital they were there. the therapist thought it was important to see their father so they could get it over and understand. >> they were taken in to see their father after he had passed? >> yes. >> that's a hard thing for kids. >> now they're fine. i know it's tough. i think it was the best thing to do. at first i was against it. what do you say if you don't show them? >> according to the will, michael wanted your mom, katherine, to care for his children. >> yes. >> your mom is 79 years old.

is she up to that task? >> she's capable and up to it. she's always with all of the grandchildren all of the time. she loves the laughter and crying and all the excitement. yes. she is. >> with such persistent rumors if the autopsy report comes back and toxicology comes back and it shows he was using or abusing prescription drugs, would you be surprised or shocked? >> i would be hurt. >> hurt why? >> hurt because michael has always been a person who was against anything like that. i'm not saying it's right because it's not right. but in this business the pressure you go through, you never know what one turn to. >> you're saying it's possible? >> i really don't know, matt. i really don't know. i'm being honest. i really don't know. i do know this. michael was always concerned

about everybody and to have that weight on your shoulders to have that kind of pressure, i don't know. i don't know. >> everybody was talking about the genius of michael jackson and then it seemed in the days since there has been a drip, drip, drip of more negative stories coming out, speculation. as a family, how are you dealing with that? >> i'm very angry, very disturbed. i tell you why. no one should be using this moment for self-promotion, self-gratification. i mean no one. we just lost the most incredible person this world will ever see. >> the accusation that became the trial took place here. did it change his love for neverland? did he look at this place differently after that? >> he felt that they sort of invaded his privacy. a place that was so beautiful. they wanted to turn it into

something so ugly. >> what did this mean to him? what did he find here? >> this was the ultimate happiness. he had some bumps with the county and the trial and everything. they humiliated him. but still the love that michael has in his heart and the love for people cannot be pushed aside. >> what is the legacy of michael jackson? he will be considered a genius always. a tortured genius? a flawed genius? how would you describe him? >> the legacy of michael jackson is michael being a wonderful person, a wonderful father, a caring person. a humanitarian. a person who wanted good for everyone. a person who would give his last whatever just to make someone else happy. >> when you close your eyes, jermaine, and you lie down in bed at night.
