the perjury charges will have to wait, if they come at all. it is what the mayor's legal team won, separation of the charges against sheila dixon, with the allegation she sold give cards intended for needy families now set to be tried first and on its own. >> it comes as no surprise. we have indicted two different cases, and it was up to the defense to make a decision as to whether they wanted them tried together or separately, and they have elected to try them separately. >> no one juror will have to judge the mayor. as a politician who allegedly took lavished gifts on one hand and stole from the port on the other. she is accused of perjury. trial on those charges will now wait. >> they will not go forward on november 9, and they are to be rescheduled in the future. >> dixon is trying to get the

perjury charges tossed altogether. her lawyers argue that part of the cases lot and needs to be dismissed. the claimed dixon is protected by a far-reaching doctrine of immunity. dixon's lawyers argue that prosecutors stepped out of bounds when they used as evidence in a perjury case meetings dixon had with lipscomb concerning a development project that later got taxpayer subsidies. >> if you go as far as meetings with constituents and individuals who are discussing present, spending, proposed, and possible legislation. >> prosecutors say dixon's lawyers are trying to stretch the legislative immunity doctrine beyond its intent. >> it does not encompass everything a public official does. >> the judge said today he will rule quickly on the perjury charge arguments. either way, his decision is likely to be sealed.

prince george's county. the fine for a speeding violation is $40. >> distracted driving is being called a menace to society. today secretary ray lahood opened a two day summit for distracted drivers like those who text behind the wheel. they were blamed for almost 6000 deaths last year and half a million injuries. transportation officials say it is not just limited to texting. it is also talking on cell phones, using ipod, an even playing video games. >> you cannot do that while you are manipulating a gps, talking on a cell phone, even bluetooth. these are all distractions that we need to address. >> transportation officials are convinced even talking on handsfree devices can create a diversion. >> what happens when people text and drive? computer simulations are giving cars and idea of exactly what can happen.

states our meeting goals for fruit and vegetable consumption. not a single state qualified. that aim to have each state eating at least two fruits and vegetables a day. consumption is even lower among high school students. only 13% of them said they had at least three servings of vegetables a day. >> some cool air rushes in, kicking up a few scattered showers and sprinkles. some scattered light showers crossing to the lower eastern shore, three parts of dorchester county and about to click the southwest corner of delaware. a brief shower in that location, and it should clear out. for most of maryland, the clearing trend is under way.

overall, it will be a clearing pattern overnight tonight, and a chilly one as the winds of the northwest tap into some of the coolest air of the season so far. you can get a feel for the northwesterly flow sweeping in. the clouds are banking up against the ridges of to the northwest. sometimes in this weather pattern, deeper into winter season we will see lake enhanced snowpack. the last of the showers are clearing the bay and heading down to the lower eastern shore. has been a chilly morning and a cool afternoon. it is only 45 in brevard, pennsylvania. it gives you a feel for how cool the air is invading the mid atlantic region. these were the actual morning lows.

we started the day this morning with temperatures below freezing on the canadian border, 30's across the upper peninsula. it was 47 in detroit and 51 in pittsburg. it will be a lot chillier tomorrow morning as the northwesterly breeze brings a cool fall air mass in. look at the way this guy is clear out heading toward 7:00 a.m. tomorrow morning. that sets the stage for perhaps some crossed out and allegheny and garrett counties. -- for some frost out in allegheny and garrett counties. around here we will see a wide temperature spread. downtown baltimore and areas on the shore of the base staying in a 50's, but north and west of town, you will see temperatures getting into the low 40's overnight. it should be a beautiful day tomorrow after a chilly start.

themselves. >> the documents and photos reveal an ongoing challenge to keep up with wear and tear caused by mother nature and mankind. >> bridge inspection reports reveal what appears to be more severe deterioration. the problems are well documented, and each are assigned a number in terms of priority. inspections by the maryland transportation authority are done more aggressively than even just a year ago. it is now following the recommendations from a peer review panel. it is developing a plan of action rather than just monitoring the situation. being on the fast track does not necessarily mean a quick fix. >> we believe we need to get in within the next three to five years to actually accomplish the work. >> the combined cost of depicting the two bridges will exceed the $2 billion.

-- will exceed $50 billion. >> we have also just learned that state officials have placed weight restrictions on the ocean city expressway bridge after an expression -- after an inspection there found deterioration. vehicles that weigh more than 6,000 pounds will not be able to use the bridge. a small, unloaded pickup truck weighs about 6,000 pounds. gretzky lawyers for sheila dixon are preparing for two separate trials. it is unclear when the trial on perjury charges will begin, but the mayor's defense is trying to get those two indictments dismissed. the state prosecutor says the move will not affect how he tries the case. a student from montebello elementary and middle school is now the ninth person in our state to die from complications related to the swine flu.

health officials say 14-year-old destinee park is the second victim to fall -- second started to fall victim this week. two arrests have been made in the murder of a 70-year-old david weeks of white marsh. he was found with blood on the sheets and pillowcases over his head. two are charged in the case with murder. both were tenants of mr. weeks, and they were due in court for an eviction notice on the day his body was found. >> the taliban is expanding, and al qaeda is better protected, so what should president obama do about the mess in afghanistan? how will he change u.s. strategy? that is the subject of a big meeting today at the white house. >> president obama call all
