[captioning made possible by constellation energy group] captioned by the national captioning institute --www.ncicap.org-- >> we begin tonight with two big stories including a verdict in the trial of three men accused of killing former city councilman ken harris. >> of murder investigation tonight in baltimore city. the victim, a 78-year-old man who was found stabbed to death inside his home. earlier today, george was following the late breaking developments. he joins us with the latest. >> as far as police tell us, that don't have a lot of information on this case. there are still fuzzy as to how the perpetrators got in the home and why someone would want a senior citizen debt. >> i like him, he was a sweet person. >> birdies robinson did not see or hear anything, but at some point friday afternoon someone got into the house next door and the 2600 block of edison high way and stabbed the man who lives there multiple times.

he was a dignified as sterling bomber, 78 years old. his wife discovered his body when she returned from running an errand. paul was a retired mta bus driver. -- palmer went to church every sunday with his family. >> who would kill a 78-year-old? especially a nice guy like that. i don't know what to say. everybody says it cannot happen in their neighborhood. crime is everywhere. >> detectives were still collecting evidence into the night. from outside the home, there was no clear evidence of a break-in. >> they will look into whether it could have been a robbery or a home invasion. >> that is what they had hoped someone with the regime will give the police a call.

-- someone with information will give the police a call. >> the verdict is in on the three men and killed -- accused of killing ken harris in 2008. >> we spoke to a net harris for the first time since the trial began. barry simms was following the case and now has more on the verdict and what his widow had to say. >> i am wearing purple today because canada said that purple meant victory. i feel that today we have the victory. thank you. >> for and at harris and her two children, the jury's verdict offers some resolution to the tragic -- tragic murder of kenneth harris. jurors convicted 70-year-old jerome williams and 22-year-old charles mcganey of felony murder -- 17-year-old jerome williams. mcganey's attorney described as his client's reaction.

>> shock. he almost could not speak. he did shake my hand and tell me thank you. >> prosecutors said they could not prove mcganey r. collins pull the trigger. surveillance video capture the last moments that harris was alive. as he left the bar, the robbery was announced. harris led to his car and was shot in the upper back. the jury did not believe another defendant, gary collins, fired the fatal shot. collins was acquitted of murder but was found guilty of conspiracy, assault, and gun violations. the surveillance video shows two men wearing bandannas at another wearing a mask entering the jazz club immediately after harris was shot. they robbed the place and then ran down a hallway, a sitting out a back door. the prosecutor argued all three men conspired to commit a robbery and all three were equally guilty for everything it happen. >> i honestly believe there was not a conspiracy to kill mr. harris. i believe it was something that

occurred only at the moment. >> this is one of the largest and most high-profile cases because of the fact that canada's was a city councilman. jakekenneth with a city councilman. we all feel it very deeply. >> one juror, and it, saying i am glad is over. it is clear jurors struggled with the case. >> what i watched was the whole panel, while the verdict was being rendered. it took up to a half-hour. there was clearly descension. that ultimately agreed on a verdict, but i do think that some of the jurors in their heart of hearts, were not satisfied with the outcome. >> prosecutors believe the strongest evidence was the dna of williams down on this mask and the dna of williams,

mcganey, and collins found on latex gloves located during the investigation of the murder and robbery. >> this is a message to the criminals of baltimore city that they can just not get away with murdering someone and think they are going to walk away free. >> mcganey, william, and collins will be back in court on october 19 when they are scheduled for sentencing. the defense is considering whether or not to appeal this case. reporting from downtown baltimore, barry simms, wbal-tv 11 news. >> another trial begins in baltimore county where a man is on trial for the murder of his wife. she disappeared while heading for a concert, never to be seen again. relatives say tracy told him to move out. to this date her body has never been recovered. as the trial begins, his attorney says the state has only

circumstantial evidence. >> our defense is that the state cannot prove beyond a reasonable doubt that there was even a murder committed, much less that my client was guilty of that murder. >> the prosecution says they don't need a body in order to prove the case. an update on the breaking news we brought you last night at 11. autopsy results should help police figure out if the woman found dead in the elevator shaft of a vacant downtown building fell or was the victim of a crime. police discovered the body last night at the bottom of an elevator shaft inside a vacant building in the 300 block of north howard shstreet. they believe she was homeless and living in that building. >> crabs are protesting what they say are incorrect and inaccurate water bills -- crowds are protesting inaccurate water bills.

they had printouts of actual water bills showing big, and explain fluctuations in usage in the past few years. the city says the meter readings and procedures are 99% accurate. now to the ongoing slots battle. neighbors opposed to slots at the mall called the tv ads misleading and bogus. >> on monday the developer called his opponents ads full of lies and those responsible hypocrites. david collins joins us live in the studio with more on this. >> according to one observer of this battle, there is lots of whining going on. opponents of slots at arundel mills mall said that are in ms about location. they call their opponents as bogus and misleading. >> our opposition is doing a good job at trying to hoodwink the citizens of anne arundel county to believe that our fate is tied to their fate. that is absolutely not true.

>> the red brigade is part of the notes like that the mall campaign. a rebel mills neighbors are determined to set the record straight to counter what they call bogus claims. exhibit a, the proximity of the stand-alone casino. >> this is the actual renderings from their engineer. it shows that the casino is a mere 30 feet across and interior ring road from the mall itself. >> traffic is another bone of contention. state highway study identified 19 failing intersections. opponents argue that the area cannot handle another 40,000 vehicles per day. >> there traffic engineers are saying no one will take route 295 northbound exit of urumqi mills boulevard. it blows your mind when you hear some of these things. >> they also take exception with parking at the mall. the developer says he plans to

create 6500 parking spaces. the net effect will only be to four hundred new spots. the group suggests -- 2400 new spot. the master plan for slots at laurel calls for retail shopping district to be built there. the jockey club funded the petition drive. anne arundel county voters will decide whether to allow slots at the mall or start the zoning process all over again. the maryland jockey club is owned by -- mayor law prohibits an operator from having more than one license. how much money has been pumped into the campaign has not been made public. excalibur ask why you are not releasing your campaign finance reports that are due today -- can i ask why you are not releasing reports? >> by law, we are not required to. >> what happens with the slots

the midterm elections. the report was a little disappointing for the fourth straight month. the u.s. lost jobs in september. that keeps unemployment nationally hovering just under 10%. he is feeling the political fire in washington. >> the jobs are not being created because of the policies coming out of washington. >> the cuts to census workers and local government jobs were just too much to overcome. >> for the latest on foreclosures, what some are calling the 4 -- foreclosure fraud scandal has forced the nation's largest bank to stop selling foreclosed homes. bank of america has halted foreclosure sales in all 50 states. it will still foreclose on homeowners behind on mortgage payments but will not sell the property until it can verify the foreclosure documents. other banks are also being targeted.

through the ohio valley, southbound into the carolinas. cutting across vermont and new hampshire, a little line of cloud cover. we will keep an eye on that tomorrow. it could be a weak front coming down the coast through the backdoor. it might bring a few scattered clouds, but that would be about it. temperatures are cooling off, but for this time of year, these numbers are relatively mild. about to dip into the 40's out in the far western part of the state. strong high pressure is not only pushing into our region but stretches all the way back across the plains states. this week front is producing the clouds in new england. it will come south and dissipate through maryland tomorrow. just the slightest hint that we might see some scattered cloud cover moving through as that front is fizzling out.
