over a paintbrush. our news reporter has more. >> it was not long before a fire at this west belvedere tire shop escalated to three alarms. sources tell 11 news that the blaze may have been caused by an argument over a paintbrush. jason hicks and other workers have been using tar and gasoline to paint tires at the shop. apparently, he got into an argument over a paintbrush being used by another worker. that paintbrush eventually caught fire, along with the tar and gasoline mixture they had been painting with two witnesses claim jason hicks pulled out a lighter, collected on, and everything caught fire. sources say he tried taking the burning mixture out of the building and dropped it. police have since arrested and charged him in connection with the fire. 11 news led to his last known address to the statement from relatives, but no one answered the door. we also stop the house of the owner of the tire shop, but

apparently no one was home. one person was injured in the fire, and it took fire crews several hours to contain the flames. the building was destroyed in the process. wbal-tv 11 news. >> hicks is now facing assault charges, in addition of first and second-degree arson. we now know jason hicks is expected to receive a bail review this afternoon at the city district courthouse. we will bring you more details tonight at 5:00 and 6:00. three people are in shock trauma after coming into contact with the carbon monoxide leak. firefighters responded to a home in roosevelt just before 10:00 a.m. this morning. the home was equipped with a carbon monoxide detector. officials credit the device with preventing more serious illness or death in this incident. a man remains in the hospital this afternoon after a police- involved shooting nights of baltimore. the incident happened just before 9:00 p.m. last night in

the 3600 block of saint victor street. police responded to reports of unarmed man inside a home. once on the scene, police uncovered a man in his '40's or 50's who refused to cooperate with officers. >> officers identified themselves, asked numerous times at the drop the weapon. the suspect did not comply with commands, turned toward the ball smartly saucers, at least on the fired at least one defense and shot. >> the suspects of a gunshot wound to the body and remains in critical condition at johns hopkins. the shooting is under investigation. police investigating a deadly overnight shooting and west baltimore. a man was shot in the back around midnight. we're told the victim died of his injuries. no word on a suspect or a motive in this case, and the victim has not yet been identified. ♪ >> boy, has it been a chilly day. temperatures started off about

10 degrees below normal. now we have rainshowers. a batch of shares eased up the bay, down to ocean city, and another one lined up west of 95 in northern maryland down to the washington, d.c., area. lots of clouds and a very chilly, and some showers today. right now, most of cloudy at the airport, 53 degrees. we're not going to warm up much more than this as we go into the afternoon. a potential for showers in the time this afternoon. that decrease is slightly into the night. tonight, we drop back into the 40's. another chilly one. but warmer weather is on the way. >> thank you. recovery crews continue their search for the body of an elderly woman who was on board a small plane when it crashed in the chesapeake bay. state police said the plane went down sunday about 3 miles off the coast of smith island, near somerset county. authorities say the pilot managed to swim to safety. but told police his elderly

mother died in the water. ♪ [chanting] >> protesters continued to voice their concerns in new york city. more than 700 people have been arrested during the a occupy wall street protests, which is now heading into its third week. many are concerned with the economy, but others have set up camp to argue for equality and changes in an arctic policy. experts say americans are now drawing inspiration from this spring's middle eastern uprisings. >> this revolutions are led by young people, and i think they have been unemployed and wondering what to do. so i think that is another, let's say, inspiration. >> i want more opportunities for my children, for my students, and for all americans. >> new york's protest remains the largest, but activists have now started rallying in california, colorado, and north carolina. ♪

if you have not heard, at the ravens are celebrating a dominating whenever the new york jets. it was not a fantastic game for the offense, but the ravens' defense and no problems taking control, scoring three defense of touchdowns. the 34-17 win pushes the ravens to the top spot in the afc north. next week, the team get some well-deserved time off. we will have more tonight at 6:00. that was awesome. coming up, i will talk to an oscar-winning actress about the new season of her show. plus, amanda knox pleads for an appeal on the day the verdict is expected. her words and what is next for the trial. first, the supreme court begins its new term. what will it decide on the

the court has already agreed to hear 50 high-profile cases better still debating on whether to back up the case of president obama's health care law. politicians of both sides have asked the high court to make a decision on the law's constitutionality before the next presidential election. experts say the decision will make a huge attack on a future loss in the powers of future government. >> there's always this question of the court trying to identify the boundaries of legislative authority. this presents a good case. it will settle a pressing national question now, and it will establish a precedent about the limits of congressional power. >> the court has said it will decide on cases involving gps tracking, strip searches, and sec bans this upcoming term. covering the nation, the conrad murray trial moves into its fifth day with a pair of important testimony is planned. a pharmacist to seoul dr. murray several types of drugs, including the propofol that allegedly killed michael jackson, is set to take the

stand today. a los angeles county coroner senior criminalist is also expected to testify. conrad murray is charged with involuntary manslaughter of michael jackson. all amanda knox can do now is wait. she addressed the court with tears in her eyes today, insisting she did not commit the murders she has been convicted of. her fate is now in the hands of an italian jerry. >> speaking fluent in italian, the 24-year-old student from seattle insisted she is not guilty of any crime. in a voice breaking with emotion, she said, i do not want my life taken away from me, because i am innocent choking back tears, she said she is paying with her life for something she did not do. her co-defended and former boyfriend also spoke to the judge and jury. he said he had been living in a

nightmare. in slow, measured tones, he declared yet nothing to do with the murder of amanda knox's roommate. he described his former amanda knox girlfriendamanda, as sweet gum a bit of all, and shining. but the defendants denied knowing the african uplifter also convicted of murder and sexual assault of meredithkircher, an exchange student from england. today, and a final plea from the defense lawyer, he repeated that there is no evidence his client had anything to do with the crime. >> of the crowds are so gathering outside the courtroom, all the judge has said it will not be until late p.m. tonight local time before the judge and jury returned the verdict, maybe even longer. but it shows the incredible interest in this case, not just in peru shut, but around the world. nbc news, p rishel. >> still ahead, i will sit down

>> a compensation fund for people who worked at ground zero after 9/11 is now available. the nearly $3 billion fund has been set aside to help those workers paper illnesses. today is the first day victims can apply for compensation, while most common illnesses will be covered, the government says funds will not cover cancer costs, because cancer has not

been conclusively connected to working at ground zero. ♪ with the cooler weather setting in, many folks were hoping for a warm vacation. royal caribbean is hoping to capitalize on that. the two-day sale can say vacationers up to $200 per room and offers a 50% of the deposit requirement for new bookings. the sale starts tomorrow and is good on all royal caribbean cruises said to be part honor after january 1, 2012. consumers are urged to use caution, some exceptions to apply. not many shows control of a character who offers legal services right out of her own shoe store, but nbc's drama "harry's law" has enjoyed great success with that concept. i am joined by the oscar-winning star of the show, kathy bates. thank you for being with us. as always, we love to have you.

>> thank you, a pleasure to be here. >> season two is up and running. you are defending a murder case now. would you like most about this story line? >> well, the thing i love most is that i have wonderful guest stars to appear with. a man is accused of bludgeoning his wife to death, and then there's the prosecutor. >> i was going to saygtoene -- a was going to say, jean off smart, what a talented addition. she is giving hariri a run for money. >> she sure is. >> can you give us any idea how this story line will play out? >> no, you have to tune in. it is at 9:00 p.m. on wednesday. i do not know what time on the cusp. i hope everybody will tune in for the conclusion of the case. >> how much fun is it to play a character like harry? >> i am having a blast. wonderful to be able to play a

character who was blunt and speaks her mind and gets away with it. >> what are we missing out on behind the scenes? i would imagine you guys have so much fun. >> we do. you know, we have all settled in with each other. we're shooting our aid that is the right now. one of the most exciting things that happen this season was that paul mccrain won an emmy for his performance last year. we have fun celebrating that. >> in the twists and turns to look forward to? >> after this case, harry tries to defend a young girl who has been arrested for cyber- bullying. it is a very compelling case. actually, paul mccrain directed that episode, and it is one of my favorites. i hope everybody will watch. >> are there any new cast members this year? >> yes, we have one woman who

has been giving away from the 95 corridor, still affecting the northern tier of baltimore county. these are moving out towards the west, but they are standing back in from the south. it is not out of the question that as we go through the day, we could see some more wet weather. add your umbrellas or rain jackets ready. this area of low pressure, the same one we have been talking about for days and days, is still spending over the mid- atlantic. that is why you see this rotation of the clouds, as well as the showers. until this moves offshore, we're still talking about the rain chances. eventually, high pressure is going to move in. it will come with clear skies, pleasant temperatures, and much drier conditions but that will be arriving into tomorrow. they will stick around for quite some time. we have high pressure and sunshine. it has been warming up. a 78 right now in south dakota. 71 in kansas city. we're stuck in the '50s.

we're one of the coolest spot ran out, even cooler than minneapolis, where they are normally much colder than we are this time of year. here the temperatures across the state. 53 at the airport. 48 in westminster. we're still stuck in the 40's, even now as we head into the afternoon. 46 thine hand, . oakland is stuck in the 30's. we're not going to warm up to much more. mid '50s by the afternoon. that is keeping as well below average. yesterday was as well. it was 51 at the airport, and the low was 45. normally we should be at least around the 70's this time of year. we're far from that today. we're still going to stay below normal. futurecast was shot chance for rain at any point this afternoon. you can see the showers are on the baltimore area, throughout the evening, maybe into tonight, maybe some left over tomorrow morning. it should be mostly dry. i think the western mountains are more likely to see showers, even as we go throughout the day

tuesday. in clearing wednesday into the next couple of days. tonight will be another chilly one, dropping down into the forties, especially up to the west. mostly cloudy, a chance for showers, and the wind should be like. here is what is coming in the seven day, what we have been waiting for. we start to dry out by tomorrow afternoon. then temperatures and finally warm back up, near normal by wednesday. we get above that heading into friday. ♪ >> in the medical alert, a new study shows certain types of jobs of higher concentrations of smokers. according to the cdc, 30% of all miners and food service workers smoke, making them the heaviest smoking employees. construction workers were a close second, with 29 + 7% of workers smoking. researchers say low education levels are a factor in the high rates. a separate study shows smokers
