a free man. an appeals court rejected a prosecution bill to put him back in print out -- pre-trial detention. gary had already left the room but when prosecutors ruled in they lacked sufficient evidence to hold him over the presumed death of his travel companion, robyn gardner. the prosecutor office said it was disappointed with the ruling but still considers him a suspect and will continue to pursue the case with the assistance of the fbi. >> montgomery county police say they have the bad in custody who has been carjacking aldermen in a shopping center. he is also accused of beating and stabbing his latest victim, a 77-year-old man with a box cutter. older men kidnapped and forced to withdraw money from atm machines. each one of them happened at the

and washateria. he is start with multiple counts of kidnapping and robbery. as a city police investigate a homicide in west baltimore, tonight the identify the man who was killed. they are confirmingkenneth davis was shot in the head around 7:00 tuesday evening. he died about half an hour later after he was taken to shock trauma. we are told investigation is ongoing. >> the first civil case in the penn state sex at least scandal was filed today. a native victim filed a lawsuit against jerry sandusky, his charity and at penn state university. it out once the allegations oncesandusky and claims that they helped cover up years of abuse. >> fallout from the child sex and abuse scandal continued today.

police say he shot and killed a burger king manager back in march as she opened the restaurant. frederick police plan to serve the warrant after sentencing. police confirm one of the drivers in a multi vehicle crash yesterday was killed. the accident happened tuesday morning just before 8:30. investigators tell us a chevy pickup was trying to pass and suv when the driver lost control and ran into oncoming traffic and flipped over. the other driver was not injured. speed and aggressive driving were factors in the crash. >> the occupied protest and two of the nation's biggest cities have been effectively shut down. philadelphia and los angeles police moved in over 92 event protesters. they were protesting against economic inequality and corporate influence over washington.
