in the long run, legislation now on the house for could reduce your monthly electric bill. the house gave preliminary approval to the governor's bill to foster wind energy. a final vote is expected tomorrow. the legislation still has to be approved by the senate. david collins is following the issue and joins us live from annapolis with the latest. what is the holdup? >> a senate committee has a similar bill and the chairman is on the record in support. the committee members wanted to wait to see what happened to that bill in the house before the acted on it. -- they acted on it. the house -- changes to the bill may reduce the number of wind turbines. environmentalists are still pleased. the bill requires consumers to pay $1.50 a month war on the bill starting in 2017. subsidize capturing wind energy. 10 to 30 miles off the coast of

ocean city. >> delegates expressed concern about the cost to customers. >> in 2017 the way the bill is written it would not be $1.50, it would be that and the adjustments. >> and other delegates worried about the state moving too fast. calling for a test run. that is the approach business -- for gin is taking. what about business? what is the maximum cost business would have to pay? >> the fee was cut to one. -- 1% of the bill. in a reversal of political philosophy, republicans offered an amendment requiring the state to study weren't here, and climate and mechanics. delegates did vote in favor of language making sure that taxpayers did not pay for any study. another accepted amendment caps costs. their operations are tied to

on our website, wbaltv.com, click on session 2012. >> to twin brothers accused of burning and killing of people are back in court for their retrial. travers and tremaine johnson will once again face animal cruelty charges. >> a jury of nine women and three men have been chosen to decide the fate of travers and tremaine johnson. the prosecution is hoping to get a guilty verdict the second time around but the defense insists their clients are innocent. after almost two days of selection from a pool of more than 200 jurors, a jury is finally seated thursday afternoon in the retrial of twin brothers tavis and jermaine johnson who are now 20 years old. in late may of 2009, the then- 17-year-old set of people on

fire with an unknown flammable liquid. phoenix would die several days later at a pennsylvania animal hospital. the twins were put on trial on -- in february of 2011 but the jury could not reach a verdict and a mistrial was declared. in opening statements, prosecuting attorneys explain the evidence in the case would prove the brothers set phoenix on fire. this evidence would include a video surveillance showing them running from the crime scene. to witness accounts linking them to the crime scene, and clothing that one of the brothers should it was wearing when he was arrested in was the same one he was wearing as seen on the video. defense attorneys countered the state claims saying that their clients were innocent but the video never shows that johnson brothers lighting phoenix on fire and you cannot see their faces and the city box to the crime scene from the beginning, deciding to launch a criminal investigation six days after the

crime. defense attorneys also claim that the brothers were arrested because of public outrage and pressure and police have to -- had to arrest someone so it was convenient to arrest them. so far we're off to a slow start. one witness has been called to the stand, a detective who was going to show that the video. much of the afternoon was spent with the defense arguing against showing this video. the judge decided they can show the video. that will be done tomorrow. the brothers are charged with aggravated animal cruelty. we're live outside mitchell courthouse. >> of baltimore county judge has denied a motion to modify of the kit -- a vehicular sentence. matthew miller wanted the judge to grant him probation. we have more on why the victim's family and prosecutors fog

vehemently against it. >> the family believed that matthew miller was trying to run from what happened and erase his record. angela and charlie ryan leave with a sense of relief but sympathy for matthew miller, the man who's drunk driving led to their son's death. >> i feel badly for matthew. feelings without any for him. we do not wish him bill will. we wish him to be a successful human being. to do the things he said in court he would do to continue working to make this right. >> miller was looking to have his guilty plea modified to probation before judgment. in court, he apologized for what happened in october 2007 when he

lost control of his vehicle while drunk and speeding, he jumped a curb and fled the scene. he killed 18-year-old kevin ryan. he talked to college athletes and served a year and paid fines. he was not convicted of a family -- a felony. >> the fact is he is not trying to run away from it. he runs towards it. he uses his crime to help teach other kids how to hopefully avoid the mistakes he made. >> any time a person's life is taken, i believe it is not appropriate to get probation for judgment. >> the judge denied the motion because of the nature of offense and opposition. >> to bring this fact up and to ask the judge to what the case is rare victimizing the
