a pit bull on fire in may 2009. day five of testimony and the retrial picked up where the prosecution left off on wednesday. surveillance video shows men interacting and kicking a dog, then the dog running from the alley on fire. sgt jackson entered via -- identified the boys as brothers travers and jermaine johnson. he talked about the day in june 2009 when sierra goodman walked into the western district and said she witnessed the dog being burned. goodman testified in the first try but refused in this trial and was held in contempt. jackson said she identified pictures of the brothers and wrote on the back of the pictures, i saw this individual running from the scene of the

crime where the dog was burnt to death. the judge granted the defense motion to exclude the gas can fell at -- founded michael taylor's backyard from evidence. the judge allowed the prosecution to introduce the can because during his questioning of defense lawyers open the door to questions about the gas can. sgt jackson spent the afternoon on the stand identifying pictures of items collected during several search and seizure warrants issued in the case, including two pairs of jeans, compared sneakers and a backpack and out in an upstairs bedroom in the house of the defendants live in with their father. the testimony was interrupted frequently by sidebar bench conferences. the prosecution finished its examination of sargent johnson around 4:00 in the afternoon. >> the judge said that because the trial is moving so slowly, he is holding hoax -- holding

investigation led to the arrest. they are being held without bail at the baltimore county decent -- detention center. >> maryland lawmakers are still haggling over how to share the cost of teacher pensions with local jurisdictions. >> is a key element of balancing the budget this year and legislatures are running out of time as well. david collins is keeping an eye on this. what is the governor doing about it? >> we can get to that in just a moment. we have breaking news from annapolis. minutes ago, senate negotiators offered a major compromise on two fronts, the pension shift and on raising the state income- tax rate. senate negotiators are offering to go with the house version of shifting 50% of the cost of teacher pensions the first year. the house wanted to do this in three years, the senate in four years. as far as raising income taxes,

senate negotiators proposed going with houseplant of raising the tax on single filers making $100,000 or more a year, and on joint filers making $150,000 or more a year, but phasing out some exemptions. no decisions are expected this evening, since the compromise was just offered. meanwhile, senate president mike miller says the governor wants to mediate the negotiations. we caught up with governor o'malley's today. >> i am pretty much food to the statehouse and working with the senate president. i just came from a meeting with him. i spoke at length with the speaker yesterday. we have three different versions of what next year's budget should look like. the first one was the one i put in. now we really only have two versions. one in the house and one in the senate. they need to find some compromise.

>> a major car maker is hoping to drive more area high school students to college. toyota is giving $1.50 million over the next three years to the boys and girls clubs of america. it is for a program called diplomas to degrees. the financial pledge was made today at bowie state university. boys and girls clubs, but the of mentors, will help prepare more students for college. -- with the help of mentors.
