was an adult male and was shot somewhere in the upper body. happening right now at city hall, and nominations -- i nominations committee is entertaining a hearing. it may not be a quiet hearing. we understand protesters are starting to gather, sheldon? >> yes, donna. they just wrapped up prayer. they are upset. they say they were not involved in the selection process of the city's new commissioner. some of the protesters outside say they are able to go into the public hearing because they are banned from city hall -- they are unable to go into the public hearing because they are banned from city hall. the new commissioner has been on that the job for a few weeks now. they are protesting his nomination.

even though they have the opportunity to speak at this public hearing, they are angry because they say they were left out of the process. >> the swearing-in took place two weeks ago, but this is the first time the city council is to publicly interview him. this is the first time the citizens have an opportunity to articulate their concerns. this is ceremonial, quite frankly, at this point in time. this should have been on the front end. >> i spoke with the mayor's office. they say the mayor spoke with community leaders before the process took place. she met with eight groups. that includes the bel air association, northwest citizens on patrol, the baltimore jewish council, the baltimore archdiocese, and the baltimore branch of the naacp. these are just a few of the groups that the mayor met with when she was deciding the

>> late this afternoon we are learning more about why state delegates don dwyer is still not facing charges after that drunk driving voting crash that sent six to the hospital. the investigation over the accident may not be completed until next year and there are a number of reasons why, we are told. police say the toxicology results have not come back in and boating accidents usually take a long time. on top of that, every person injured in the accident has been seeking legal counsel.

meanwhile, a towson firm has filed complaints by patients who accused doctors of overstating conditions to justify in asserting stents. it all stems from one cardiologists accused of performing hundreds of unnecessary procedures. now named eight additional doctors and the st. joseph's medical center. the doctor claims he is being used as the hospital's scapegoat. >> in tonight's medical alert, health officials say four people have died in that national meningitis outbreak, bringing the number of deaths to 19. on top of that, another death in maryland.
