walmart a new store. rob roblin has more on that decision. >> the belair walmart has been here since the 1990's, but folks decided they wanted to close the store and build a new one down the road. walmart wants to build the new store here, but area residents say that is not a good idea. >> we the people -- i hope that you guys will respect we the people. [applause] >> a lot of those people showed up today at a special development advisory committee hearing, and they are not happy with walmart's plants -- plans. >> we hear that they are going to bring all these jobs, but the jobs are low-paying and they will be offset by the jobs that are lost. [applause] >> traffic is the major problem.

than 1500 county residents who were in support of this project. >> rob roblin, wbal-tv 11 news. >> baltimore's new police commissioner has been on the job for a couple weeks, but it was not until tonight that the city council sat down to confirm them. residents are not happy about that. sheldon? >> those protesters have already come and gone, but a dozen of them were gathered outside city hall at the beginning of that hearing. they are protesting police brutality. they say that they were left out of the selection process. right now the city council is hosting a public hearing on the nomination of tony batts. the commissioner is laying out his plans for the department. he is talking about listening to different ideas for improvement.

he also talked about a renewed focus on the quality of life crime and getting those numbers down. demonstrators gathered outside at the beginning of that hearing because they are protesting his nomination and police brutality, as i mentioned, and even though they had the opportunity to speak at the public hearing, they are upset they were left out of the initial process. >> the swearing-in took place two weeks ago, but this is the first time the city council gets to publicly interview him. this is the first time the citizens of the opportunity to articulate their concerns. this is a ceremonial, quite frankly, at this point in time. the people should have been involved on the front end. >> i spoke to the mayor's office and a spokesman for the mayor said that the mayor spent hours meeting with community leaders throughout the community. in fact she met with 28 different community leaders and

organizations. the belair community association, the baltimore jewish council, the archdiocese of baltimore, the baltimore branch of the naacp, just to name a few of these folks she met with about this nomination. reporting live at city hall, wbal-tv 11 news. >> one of the officers accused in the beating of the university of maryland students testified in his own defense today. lowell melser is live where a judge dropped the most serious offense against the two officers. >> defense attorneys were able to convince the judge to drop the most serious charge in this case, first-degree assault, this as one of the two officers to the stand in his own defense. >> the judge did dismiss the most serious charge, yes. no further comment.

we are still in trial. >> defense lawyers react following the dropping of the most serious charge in the case. happened -- one of the police officers took the stand in his own defense. he is a former marine and special officer and says he was ordered to protect the mounted unit as part of the team armed with batons and shields. while his team was holding the line at knox road and rte. 1 in college park, he says he saw two males rick t-line. refused that's mckenna to get down and get away.

when he refused, he used his baton to get him into a state where the other officers could arrest them. >> the prosecution questioned his actions while showing video of the beating, most likely to get that image into the minds of the jury. it is unknown whether the other officer james harrison will take the stand tomorrow. both officers face charges of second-degree assault and misconduct. wbal-tv 11 news. >> state delegate don dwyer may have admitted to operating a boat under the influence of an alcohol, but he has not been charged with anything. officials say that probes into boating accidents usually take a long time. on top of that, everyone injured in that accident has been seeking legal counsel. it is unclear whether the

investigation will be completed by the start of the next general assembly session. and gov. martin o'malley at the center of a legal battle over whether pit bulls should be considered inherently dangerous dogs. the plaintiffs claim the governor has an obligation to execute laws according to the constitution. it is believed a court ruling that the bulls are a liability is unconstitutional. the ruling stems from an incident when a 10-year-old boy was mauled by a pit bull. >> another lawsuit to bring to your attention tonight. this one accusing eight more doctors of overstating conditions to justify it inserting parts stance -- heart stents. it is all part of a three-year legal battle centered around a cardiologists accused of performing hundreds of

unnecessary procedures. he denies wrongdoing and claims he is being used as the hospital scapegoat. the centers for disease control reports that 19 people have died from the meningitis outbreak, four more than yesterday. the pharmacy that may be contaminated steroids is being searched. federal officials say more drugs have been identified. the center recalled all of its drugs and says it is cooperating with authorities. >> i knew security measure will be in place in schools tomorrow. >> we will have the details. >> terrell suggs returns to the ravens practice field tomorrow -- returns to the ravens
