alabama for a third day involving a man who shot and killed a school bus driver and took a boy hostage. he remains in an underground bunker after taking a child hostage. neighbors described him as a loner and survivalist who is scheduled to appear in court next week for threatening neighbors. chuck hagel will be back on capitol hill again today. he was questioned about his opposition views on the iraq war. he is expected to win confirmation and become the first enlisted men to serve as defense secretary. >> the super bowl is big business but not all those businesses are legitimate.

more than $30 million worth of fake nfl merchandise has been seized. to national shipments of counterfeit merchandise were targeted. fake jerseys and baseball caps were confiscated. they have shut down 313 websites and have made 23 arrests. the labor department will release the january jobs report. hallie jackson gives us a preview. >> economists are predicting we will see basically what we have been seeing. the unemployment rate around 720% for the third year in a row -- 7.8%.

tried as an adult. prosecutors say robert gladden is a remorseless teenager that wanted to make a name for himself. the defense said that he has shown remorse. the judge said he will make his decision by february 8. john leopold will have to wait longer to learn his fate. he was found guilty of two counts of misconduct. john hammond is serving as the interim executive. >> there's one area of common ground and that is driving fast on maryland highways. a measure to raise the speed limit to 70 in western maryland. it is an idea whose time has
