12:00 pm
so i know what the smell of urine is. i worked around it my whole life. >> cat urine, with cat urine. >> it was cat urine. i didn't know where it was coming from until i opened the main sail and there was a giant urine stain right there on my sail and the sail was ruined and i have photo evidence of it. >> let me see that. there was no way that you could have cleaned the cat urine? >> well, your honor, you can only do so much. i used to have a cat when i was younger and it peaed in the basement. >> was it folded or something. >> it was folded up. you can tell from the picture this wasn't a one-time thing. this cat was marking its territory. >> that is a huge stain. you must have had it folded. >> you know it is tied around the mast. when you unroll it, it opens up and that is how it was revealed. >> you have done everything. >> i tried to clean it. they can even -- sometimes they paint over the sail in these situations and they couldn't do
12:01 pm
that because it wouldn't mask the smell and after the situation i approached jerry and he didn't think it was his cat but i saw the cat jumping from boat to boat prior to this. that is why i approached erin on the suect in the first place. >> is the marina fully enclosed where a stray couldn't come in. >> it is a gated community. >> have you ever had any problems with stray cats or dogs or animals coming in to the marina before? >> not prior to this we haven't. it is not to say that a cat couldn't get in but we never had that problem. >> in the 50 years. >> 30 years. >> never had a problem with urine on a sail, a cat or that sort of thing. >> we haven't but our members are fa diddous about about living by the rules. people don't bring the animals to the marina unless it is for a day. so we haven't had a situation like that.
12:02 pm
>> what is your process for taking complaints for marina member sfwls it is laid out in the contract if you have a problem or situation with another tenant, the procedure we follow is you write and an e-mail to me and i give it to the board of directors. we have a meeting probably a week later, if possible, and then we will take care of it ourselves. >> so the board of directors handles the complaint. it takes them 30 days to do it. why didn't you do that. >> your honor, first of all, i'm old school and like to deal with things in person. i don't send out e-mails when there is an issue like this. that's why i went to jerry in the first place. i wouldn't go to erin without talking to jerry in the first place. i thought it was something we could handle man to man and i thought if i go to the board of directors they would think erin isn't doing her job and she has always done a good job and it is a cat on a boat i thought it could be handled in an easier fashion than a board meeting to
12:03 pm
decide. i did what i thought was right and went to erin and told her about it. >> have you had any other complaints? >> i have not. >> the complaints the members are supposed to take under advisement and respond the person in 30 days is that improvements or complaints. >> complaints. >> what about blatant violations, wait 30 days. >> 30 days is the maximum. if we get a complaint, a letter of complaint we try to have a meeting within the next week. >> dpot it. >> coming up on "justice for all" with judge cristina perez. >> did i know for a fact that that boat, the cat was living on his boat or could it possibly be a stray cat in the marina and i said i didn't know that. >> you would have known for a fact if you had talked to jerry. >> i'm getting a headache because you are yelling. i don't know why you are yelling. please don't yell. please don't yell. >> i'm u after 19 years of pro ball, i know pain. but icy hot lets me power past it.

living with hair loss, that is. losing your hair is no fun and no one wants to be bald, but there is hope. >> getting my hair back was the best thing that ever happened to me. >> i'm happy with the way i look now. >> i'm very excited about my hair. >> i feel beautiful. >> i love my hair. >> announcer: hair club offers all-proven hair loss solutions backed by our commitment to satisfaction guaranteed. if you're not 100% satisfied with the solution you choose, hair club will apply the purchase price to another proven hair loss solution or transplant more hair at no charge. >> and that was the best thing i've ever done. >> it looks good on me. >> announcer: call in the next five minutes to get your free brochure at no obligation. it will tell you everything you need to know about your hair loss problem, and it's free if you call now. >> i am more pleased than what i had even imagined. >> i at least look, i would say, five years younger. >> i'm 52 and i look better now than i did when i was in my 40s. >> i feel great. >> announcer: and that's not all! the first 100 people who call will also receive $250 off any hair loss solution from hair club. call now! 12:06 pm
>> you are watching "justice for all" with judge cristina perez. we are back with the case of johnathon michael who is suing erin brightener for the cost of his marine sail. >> when he told you, you said that jerry, johnathon had cat litter. did you see him have the cat litter? >> i wasn't on jerry's boat at
12:07 pm
all. only on johnathon's. >> i understand that you went to see the man about his sail. and you saw the urine. >> yes, he's 100% right. it was a terrible, terrible smell. the sails were stained and i understand. >> johnathon, i understand that you are not the only person that complained about the cat in the marina. >> honestly i don't know the situation of who complained. i know i went to the members in question and told them the issue. >> how many people complained about the cat? >> as far as i know just johnathon. i hadn't really gotten another complaint. >> when john thathon approachedu about the cat did you talk to jerry right away? >>, i didn't and i probably should have. but again we have a standard procedure we go through. yes, i did mention it to our board of directors. >> what did they say when you mentioned it to them? >> they said that, did i know for a fact that that boat, the
12:08 pm
cat was living on his boat or could it be a stray cat in the marina and i said i didn't know that. >> would you would have known for a fact if you had talked to jerry. you would have seen the litter box right there. >> that's what with i am having a hard time. you are the owner. so you have got more here at stake than the board of directors. you are the owner. he tells you and you are telling me you didn't even go to jerry's boat to figure this out. >> i did not go to jerry's boat. >> here's the problem i have, erin, the marina. >> yes. >> you are the enforcing group. you, especially you, you are the enforcing group. >> yes. >> you are the owner and the board is there for one reason, to protect the rights of each marina member. >> exactly. >> that is what you are supposed to do. >> yes. >> you are supposed to protect each person equally. >> yes. >> and your failure to protect him equally is what you have
12:09 pm
gotten in to trouble with here. you have exposed yourself to liability because what you have done is that you have a member in good standing who specifically told you there was a blatant violation against the rules. you knew it, he told you. you visited the sail. you saw the sail but never went to go look at the other member. so that's a failure to protect one member. okay. that's a failure for you to do that. therefore, i have no other choice but to rule in his favor. >> all rise. >> judge perez has ruled in favor of the plaintiff. the defendant is ordered to pay $1,040. >> i'm sorry it had to come to this but you didn't follow up on my request and i think i got what i deserved. >> i'm sorry you feel like that because honestly if you followed protocol and the rules laid out clearly in the contract we wouldn't be here. >> later, you know what i am getting a headache because you
12:10 pm
are yelling. i don't know why you are yelling. >> because i'm upset. >> i'm upset, too. i'm upset, too. for aches and pains trust bufferin, the only non-steroidal anti-inflammatory pain reliever formulated with special buffers so it's gentler to your stomach.
