out early this morning. police say the two suspects fled the scene, with $13. they stole from another customer. at the paper today the victim's co-workers were struggling to make sense of it all. >> life is a cycle. and so you are born and grow old and then eventually you die. but when it is cut short by something that doesn't seem to have any rhyme or reason. and that's kind of what really is struck us here. >> detectives spent the morning canvassing the neighborhood searching for clues and no, no suspects. >> 16-year-old that created such a stir during the lamont davis attempted murder trial yesterday. failed to appear in court today. despite a judge's order. there is now a warrant out for her arrest. crime and justice reporter joy lepola has the latest. >> the state witness that failed to appear is the mother of the defendant's two children. she left court abruptly while the jury was taking a break

yesterday. deputies found haul near a bus stop. instead of sending her to jail last night. the judge ordered her to be back in court this morning to wrap up the testimony. but that did not happen. jurors were told haul would return to the stand at a later date. >> those that did testify today, included this man. derrick cromwell senior, witnessed the shooting. and identified the davis as the shooter. at times the mother of 5-year-old raven wyatt had to leave the courtroom as eye witnesses gave details about the shoo shooting of raven. we talked with brooks leaving court today. >> she is great. >> how difficult has the past year been for you? >> very difficult. >> ravens' mother has been keeping a low profile during this whole trial. i asked if she had any reaction to haul not appearing in court today. and she simply said no. joy lepola, fox 45 news "late edition". >> concerns tonight over baltimore city's practice of rotating fire company closures.

after three people, including a firefighter are seriously injured. truck company 12, a ladder truck with lieutenant jeff novac arrived first at the apartment fire wednesday night. novac and others face the fire without water since the first three closest engines were unavailable. he rescued one person. came out of the building. then went back inside. >> eventually we're not sure what happened yet. but fire overcame him. he had to go out a window. he was hanging out of the window. eventually he let go and dropped. 2 1/2 floors to the ground. >> now, fear from union representatives that novac may have suffered career ending injuries. two closest engines that night were on other calls. the other closed as part of the city's budget cutting rotating closure plan. >> baltimore city nightclub surenders its liquor license today. club uzo's license is in the hands of the bank that issued

the loan to finance the club. this comes after several incidents at the club, including a shooting last month that sent three to the hospital. the club will remain closed until the club has a new owner. >> we're not all bar owners or good neighbors. and in this particular instance, this neighborhood has been disrupted many, many times as a result of the actions or inactions of the licensed beverage hold simpler well, the club will remain closed until a new owner is found. >> it started out as another he hot beautiful day. then the clouds rolled in and brought in the rain. chief meteorologist vytas reid joins with us a look at what is going on out there now. and, of course, looking ahead to opening day tomorrow. >> yeah, a lot of people would be nervous if you have tickets heading down to the game tomorrow. not a washout. rain pushes through tonight. and front continues to push up to the northeast. taking the rain with it. which is good news. take a look outside and see what is happening on radar. decent shower tryst over the city. right around the entire beltway.

baltimore city getting rain. pikesville, timonium, lutherville you are getting rain. and towson looking at heavy rain also. down to the south of the city. looking at decent rain in glen burnie. over to annapolis. and eastern shore, we have rain coming down. in chestertown. you are not out of the woods either. as we see the showers. because of this warm air pushed off to the east as the colder air moves in. strong storms back west of us. but that has pretty much dissipateed and we are left with heavy rain through the overnight. dropping temperatures. 61 in baltimore right now. 43 in oakland. we have 80s earlier today. and that's all gone as we see on the next day planner. showers ending by morning rush hour. showers off to east. clouds breaking 58. and at noon 60. i will have a detailed breakdown now for the opening day game forecast and the weekend outlook in a few minutes. >> thank you, vytas. >> five people were arrested last night in annapolis, after a month long investigation.

officers executed a search and seizure warrant on broadneck road and arrested and charged all five suspects, and with crack, powder cocaine and pot. >> helmet camera video posted on "youtube" leads to a felony charge against a harford county man. >> get off motorcycle. get off the motorcycle. state police. >> anthony graeber pulled over for speeding along 95 last month. he faces reckless driving charges and state police confirm now that he faces an additional charge of making an audio recording without consent. >> in this situation here, the trooper did see what he thought was a camera on the helmet of this individual and asked him if he was recording. and he said no. >> well police say they issued a warrant for the additional charge after seeing the video posted on the internet. graeber admits to speeding but

was shocked when officers came to arrest him for the additional charge. >> i took off my helmet, turned off the camera. and he asked me at that point, probably 10 minutes later. 15 minutes, if i was recording. i was not recording at that time. so i said i was not recording. >> well police did not arrest graeber today. because he is recovering from surgery. he is expected to turn himself in next week. >> meanwhile a hi tech battle is brewing over your cell phone and privacy. hundreds of millions of cell phone subscribers may be unaware that cell phone companies can actually track and record your location. using your cell phone. the fbi and other federal agencies are now obtaining and using information at a record pace, and without a warrant. or ever even notifying cell phone subscribers. >> this is the same thing as if the federal government came to your home, knocked on the door and said do you mind if we look around? >> federal appeals court in philadelphia is addressing the issue of warrantless tracking.

and civil liberty groups are not opposed to the progress as long as privacy laws are not broken. so the question of the day. should police be able to track you with your cell phone without a warrant. 13 percent say yes. 87 percent say no. marcie writes on facebook f there is no warrant no need to damage that means not enough evidence. i would call it entrapment. kim writes on our website. two words, big brother. >> 32 baltimore police officers are ordered to pay $7.4 million to the family of a man that died after being in their custody. dante johnson arrested in november of 2005 after urinating on a public street. the lawsuit said he was handcuffed, but not properly buckled into the police van. then alleges the officers drove recklessly and he was hurt. johnson taken to the hospital and died two weeks later of a fractured spine. >> traffic alert for people

back to texas. and they better go now. >> well, the group plans to be in west virginia for the next few days. >> lively debate in annapolis on a bill that would legalize medical marijuana. bill would allow pharmacies to distribute small amounts of pot to patients with chronic or severe illnesses. marijuana is grown and regulated by the state. but today senators debated details of the program and whether pot would wind up in the hands of patients that are not seriously ill. >> but mr. florida be honest this bill goes way, way, way beyond terminal cancer pain. we are talking about people going through agony. and pain. people with cancer. people with leukemia. people with wasting disease and other terrible awful symptoms. >> debate on the medical marijuana bill is expected to resume tomorrow in the senate. >> almost 200,000 maryland drivers may soon be paying

higher premiums under a benefit enacted by the general assembly. raising the minimum amount of insurance drivers must carry. for drivers that only have minimum liability coverage premiums could increase between $50 examine $300. the bill now goes to governor o'malley for the signature. >> a bill that would require first time drunk drivers to use ignition interlock system appears to be in trouble. the group mothers against drunk driving is upset that the bill has been weakened. the senate amended the measure to exclude first time offenders. who are given probation before judgment. now some lawmakers are suggesting the ignition interlock system should be required only for drivers who test nearly twice the legal limit. >> we do have some concerns with that. although we believe that some mandatory provisions should be applied. but not exactly. >> the bill remains in the house judiciary committee. >> state officials take another

step toward bringing slots to maryland. the board of public works has approved a contract that would allow the state to buy 5000 slot machines. officials voted on the $200 million contract yesterday. they have agreed to fund machines for casino locations in ocean city and cecil county. both could be up and running by this fall. the contract also covers the purchase of about 2500 machines for arundel county. >> well from sunshine to stormy skies. we will check back with chief meteorologist vytas reid that will tell us about tomorrow. >> seeing sunshine on the horizon. after we get rid of the activity tonight. coming down good around the city. downtown on our skycam inner harbour. wet there. as we continue to see decent showers falling across the area. looking at rain coming down. temperatures much cooler at 58. winds out of the northwest at eight. at this time, yesterday night. we were feeling the temperatures more in the 70s. lower 70s. so it was mild out there.

winds out of the northwest at eight. and our humidity levels 87 percent. looking at the highs across the state. earlier today. 86 degrees in baltimore. 83 in d.c. 82 in salisbury. and looking at 84 in hagerstown. so nice warm air. but that is being replaced by cooler temperatures as we see the 50s and 40s back west. marching in behind the cold front. as we go through the overnight. as far as the bigger picture. you can see here. illustrated across the region. the temperatures cooler back west. we have a few temperatures in the 60s around richmond. and then baltimore. 55 in harrisburg. 44 in pittsburg. then we are seeing 39 degrees in chicago. so you see much colder air toward indianapolis, falling out of the great lakes, over behind that cold front. so you can see along the cold front, where the showers and thunderstorms have fired up. stronger storm activity down south. and in parts of virginia, to the north of us, also, heavier thunderstorm activity. but for the most part n the form of rain. already tapering off in western maryland. and over parts of western

portions of west virginia. so a break from the rain by morning rush hour. as the front pushes through, removing the warm air with cooler temperatures. for rush hour, the ground may be wet but start to get breaks in the clouds through mid-morning and afternoon. maybe a trailing shower on the eastern shore. but dryer air with high pressure moves in. cooler temperatures for the next day or so. but we will see more warm air trying to inch in by sunday. and taking the temperatures back into the 70s. mid to upper 70s. rain tonight. down to 65 degrees. and the temperatures will fall through the overnight actually into the 50s. for tomorrow, looking at temperatures around 61 for the high. and clouds breaking. making way for partly cloudy skies. northwest winds 15 to 20. and saturday looks like 65 degrees. and then sunday, 77. with more sunshine. and then we holdout into the mid to upper 60s for monday and tuesday with more sunshine. jennifer? >> the plot grows deeper tonight as investigators try to figure out what was going on with a man on board of a flight from dc to

denver last night. now the man it turns out is a diplomat from ca tar. and air marshals restrained him after they thought he was trying to light his shoes on fire. then they said it was just one big missing the guy was trying to sneak a cigarette in the bathroom. today we find out the diplomat was traveling for a consult lat visit to see a imprisoned al-qaida agent. they reacted to the scare that involved the scam bling of two, f-16 fighter jets. >> they have to do. that i am sure there are procedures they have to follow. and we go along with it. inconvenient. but, you know, you dune want them to be careful. >> consult lat officials visit foreigners held in the united states to make sure that they are being treated well. officials say the diplomat will be sent home or transferred to another country for touching off the bomb scare. >> orioles turn to a rookie pitch tore avoid the sweep
