forward that other prosecutors could prevail at trial. there's no word from unger's attorney on whether the re- sentencing will be challenged. e serintendent of the naval academy won't be forced to recuse himself fr a sexual assault case... involving three midshipmen. the attorney for the alleged victim asked a federal judge to block vice admiral michael miller from deciding whether the midshipmen will face court martial. she says miller is ang with her clien... for making the case public... but yesterday... a judgruled that there weren't any grounds for the court to interfere in the military court proceeding. "you can't have a just and fair process judge has an ax to grind...also make a direct appeal that he simply step aside." the alleged victim claims the three fellow midshipmen... and former naval

academy football players... raped her at on off- campus house party in april 2012. a maryland state trooper is showing signs of improvement after a car hit her during a traffic stop this weekend. jacqueline kline has a serious head injury that could keep her in the hospital for weeks. but doctors say she's doing as well as can be expected under the circumstances. kline was on duty sunday morning in pasadena helping another officer with a road-side sobriety test when a car slammed into her at full speed. her family is by her side this morning, including her boyfriend, a fellow-trooper. (massoni) "maryland state police have been so helul through this whole process.. and staying with us, we're all family. they've been so supportive of us. everybody w so shocked and upset to hear what happened. but we have to be strong for her and that's what we're doing." kline is in critical condition, but we're told she's able to respond

to doctors by wiggling her toes. today is day eight of a partial government shutdown, caused by the inability of congress to pass a spendin bill thatunds government programs. andrew spencer reports politicians are still trying to level blame as they struggle to come to any consensus on government spending, the budget, and the debt ceiling. just under one thousand employees with the flida national guard returned to work, this week, after a nearly week-long furlough, but they can't train or buy supplies -- and there's only enough money through the end of october. "even though we are able to pay our employees -- most of our employees -- we still have significant, significant problems." a new round of the congressional blame game started this week, as a pro- obama group targets house speer john boener in ads that try to hold republicans responsible for the partial government shutdown. ...but organizing for action isn't the only group blaming the other side of the aisle. an 11-year-old in colorado wants to boldly go whe no child has gone before. he's brewing a beer that can be used in space. as he tells mark meredith, this experiment has nothing to do with getting astronauts drunk. this is how we cruh them. following a recipe usually meant for adts... (nats) michal bodzianowski,t age 11, is turning beer making into a historic achievement. "i really didn't expect this from the start, i just designed this experiment to get a good grade in my class" but his idea is earng him a lot more than a goodrade. his experiment... to see how the fermentation process works in cro gravity... is grabing the attention of nasa. "beer while known to most people as a party drink actually has some medical properties"

in december, michal's idea will leave the classroom and arrive at the international space station. it's there astronauts will find out how well the beer ferments in space... something the 7th grader hopes could be used to help in a medical emergency. "you can clean wounds like that, it could be a reliable amount of water that won't contaminate you." the project ile unique is exactly what the stem school, a facility that focuses on science and math, in highlands ranch wants to see more of. "what a perfect way to show them this is why... this is why you have to learn how to write a lab report becau you may have to write a real proposal one day." for teachers like sharon combs, seeing a student's imagination come alive is what it's all about. conference in texas. take a look at 3-d food printing. this machine makes pizza using powdered ingredients to build a square of dough, a layer of sauce and some cheese on top. a heated plate then cooks the pie. the product developer says astronauts could potentially use the printer in space.
