wasting no time at all -- diving into a hugely controversial case. fox news correspondent shannon bream has more on the start of a new session -- and a very old conflict -- that even has the president weighing in. obama says: "what it means is ordinary americans are shut out of the process." today president obama reisited the campaign finance controversy that sparked a showdown at his 2010 state of the union address, causing justice samuel alito to shake his head and mouth "not true" - in response to the president's characterizatio n othe court's ruling in a case

about political campaign donations by entities like unions and other organizations. the supreme court tkled part two of that discussion this morning - this time looking at the constitutionalit y of limits on individuals who contribute to political candidates - as well as giving to committees controlled by the national parties. limits the president wts to see the justices uphold. obama says: "there aren't a lot of functioning democracies around the world that work this way. where you can basically have millionaires and billionaires bankrolling whoever they want, however they want." the original plaintiff - shaun mccutcheon - is an alabama businessman who says he's baffled that he can donate to candidates across the country - but once his donations hit a specific dollar limit, he can't spend another dime - meaning he can't give to all the candidates he'd like to support. chief justice john roberts questioned how that logic squares with the first amendment saying quote... "you could not have a rule that says the -- th post or the new york times can only endorse nine candidates."

others - including justice ruth bader ginsburg - noted the anti- corruption argument behind the current law quote " ... that by having these limits you are promoting democratic participation ... and you won't have the super- affluent as the speakers that will ntrol the elections." opponents of the caps argue - however - they serve to limit who gets to speak - and how. murphy says: "by getting rid of these limits, we can ensure not only that people can do that but that they're doing so inhe most transparent way possible." harkening back to that 2010 decision today - the president saide believes that it contributed to the breakdown in washington right now - saying quote "some ideological extremist who has a big bankroll can entirely skew our politics." at the supreme court, shannon bream, fox news. not weighed down with the business of passing a budget, several congressmen found a way to get themselves hauled off to jail. eight democratic members of the house, including longtime civil rights activist john lewis, were arrested after refusing police orders to move during an immigration rights rally. the senate
