new this morning, a home in marlboro is damaged at an overnight fire. flames broke out near broad street. it reportedly started in the kitchen of the home. no word on any injuries. also new, a historic home on the cape damaged in this crash. the driver of that pickup truck lost control in cochituate last night. so far no charges have been filed. historic flooding in south carolina now being blamed for 12 deaths. the threat isn't over yet. water is slowly being released from dams in the area over fears it could break. 500 roads and bridges are shut down because of the flooding. cemeteries are being uprooted. there are caskets floating down streets. more than 100 people have been rescued from their homes.

declaration to send disaster aid. a pilot had a medical emergency and the co-pilot kept scary, bree. >> reporter: indeed. michael johnston of utah was at the controls of the american airlines flight from phoenix to boston when his family believes he suffered a heart attack. >> a medical emergency. the captain is incapacitated. >> reporter: sounds of the co- pilot there taking over. passengers are commending that co-pilot and staying calm and working with air traffic control to get the more than 150 people on board safely to the ground in syracuse. the replacement crew came aboard and flew the plane onto logan airport about four hours late. here you see pictures of the pilot. his family says he has 25 years experience. in 2006, the days and weeks

poorly timed engine trouble is being blamed for the sinking. the company defended the captain's decision to travel through the storm saying if the ship hadn't lost engine power it likely would have made it through joaquin. a possible motive behind the campus shooting in oregon. a law enforcement official says the 26-year-old who gunned down nine people left a manifesto ranting about not having a girlfriend and complaining that other people thought he was crazy. this comes after an emotional day of students, teachers and staff members. classes are canceled all week. president obama will travel to oregon on friday to meet with the victim's families. hillary clinton making an emotional appeal for tougher gun control laws as she campaigns. she held a town hall meeting in manchester vowing to expand background checks and tighten regulations on people and

will debate a bill that would require drivers to use hands- free devices when talking on the phone. nicole jacobs has a closer look at the proposal. nicole? >> reporter: chris, of course there are countless distractions while you are driving, but here in massachusetts, lawmakers are trying to minimize even those that we see on a daily basis. they are looking at the idea of banning handheld cell phones while driving. of course texting behind the wheel was banned several years ago, and drivers 18 and younger are not allowed to use cell phones at all while driving. the conversation opens today that could ban it across the board. these are laws that have been implemented in 14 other states including new york, new hampshire, connecticut, and vermont. several bills are on the table today. one would impose a $100 fine

it's locally dense in norwood where the temperatures are so cool. we have dense fog. the fog will burn off by mid- morning for most of us. there is joaquin sailing out to sea. there's that moisture impacted in the carolinas. still a chance for showers during the day today. for us it is a quiet day. the wind will relax, too. it's been so persistent from the south shore to the cape. that will die down today. coming in from the north to the northwest. tomorrow we start with sun and clouds. there's a cold front coming in but not a lot of moisture with it. we'll get a reinforcing shot of cold air that comes in on thursday. high pressure will build in again. bright sunshine looks gorgeous with highs topping out in the low 60s. then we get wet weather approaching as we head into thursday night. it takes a little bit of time to get here so it doesn't arrive as showers until later on friday. i think our friday will start

among the 33 people on board. massachusetts could be going hands free. today, lawmakers will debate a bill requiring drivers to use a head set or bluetooth device. the change will cut down on distracted driving. at least seven people are recovering after a train derailment in vermont. the train hit rocks that fell onto the tracks. bree is here with the latest on what vermont's government calls a freak of nature. good morning, bree. >> reporter: good morning, kathryn. vermont's governor says there was no wrongdoing and that thises what an accident. meantime, the tracks remain closed as crews clear the tracks. amtrak plans to bus passengers who are booked on the vermonter to and from springfield. yesterday morning, the train was heading to washington with

98 passengers and four crew members on board. near montpelier where the wreck happened, several inches of rain fell that could have triggered a rock slide. >> we felt something like a bump. the next thing we knew, we swerved to the left and swerved to the right and wear all going, uh-oh. pretty soon, it just stopped. we were very lucky it stopped like that but we were all going, are you okay? we're asking each other. other than that we were lucky. >> reporter: one of the seven injured people was air lifted to the hospital and evaluated in the emergency room. the six others went to a local hospital with things like neck, back, and shoulder pain. at least four people were released by last night. state officials say a freight train passed over the tracks sunday night with the no problems. the crash where monday's crash occurred was $220 million upgrade area.

a woman from suffolk county is now the seventh person diagnosed with west nile virus in massachusetts. the would am in her 90s in is the hospital. health officials say she likely contracted the virus in the area. two people in massachusetts have already died from west nile this year. an unwelcomed visitor is prowling the streets. several residents have reported seeing a coyote. someone posted this picture on twitter. animal control is warning people to keep their pets indoors and cover their trash cans. dunkin' doughnuts is apologizing to a providence police officer who got an unexpected message on the cup the employee serving the officer was rude, and when he later looked it he cup, he saw the female worker wrote hashtag #black lives matter. the franchise owner has apologized to that officer.

he had a history of heart problems. he was required to get a complete physical every six months since then. he calmly landed the plane in syracuse with 150 people on board. he appeared healthier than ever before, before his final flight. lawyers for aaron hernandez will be asking for the double murder charges against the former patriots player. prosecutors say he killed the two after an altercation in 2012. hernandez's lawyers say there's not enough evidence in the case. >> reporter: good morning, i'm nicole jacobs live at the statehouse where lawmakers are poised to start a conversation about a possible ban on hand- held cell phones while driving. it is a law that's already on the books in several new england states and of course those who are 18 years old and

cell phones at all, but today a public hearing will take place considering the possible ban to ban the handheld cell phones across the board. the discussion will take a look at several bills, current laws, and technology. coming up at 6:00, we'll break down and give you a closer look at some of the fines that could be implemented with such laws. we're live at the statehouse this morning, nicole jacobs, wbz news. cooler weather is here, and that means turning on the heat and higher energy bills for some of us, but we have tips before you crank up that thermostat. keep the dial at 68 degrees when you are hope and lower when you go to bed. for every degree lower, you save 2% on your heating bill. you want to keep water heaters set at 140 degrees and check doors, windows and walls for air leaks. also replacing filters can save you energy, time, and money. it is 5:51 on your tuesday morning.

time for today's "daily talker." a lot of us dread going to the doctor's office and having to wait around for what seems like an eternity. >> the worst, right? now we know how much time we're wasting and on what. here's robi to explain. >> reporter: chris, at a doctor's appointment, i was immediately told by the receptionist that my 1:00 appointment would be more like 1:45. so how much time do we spend with the doctor and how much time do we spend waiting for our physician? the study estimates that the typical outpatient medical visit takes 121 minds of the patient's time, 37 of that spent commuting to the doctor's office. once you get there you under the waiting room for an average of 64 minutes filling out paperwork or reading "people" magazine. the actual amount of time you see the doctor is only 20 minutes. all of this waiting costs consumers money. researchers found that americans spend 1.1 billion
