passed away during a flight from phoenix to boston. 57-year-old michael johnston was from utah. his wife says his passion was flying. johnston's family believes he suffered a heart attack behind the controls. >> as far as we knew in perfect health when he left yesterday he seemed perfectly fine. he said he'd spent the last week couple of weeks working on losing weight had lost about 10 pounds and said i feel better than i felt in a long in a long time. >> these two incidents in two days raises concern about the health of airline pilots. captain sully sullenberger security consultant says pilots undergo strict health checks. >> every airline pilot in the country is required to undergo medical exams by faa designated examiner a doctor and for those under 40 it can be once every year for those over 40 it would be twice a year.

to retire when they reach the age of 65. >> convicted killer aaron hernandez wants to stop his second murder trial before it ever begins. today his lawyers made their case in court to throw out some key evidence. hernandez was at the hearing in boston. of course he's accused of killing two men in 2012 outside of a nightclub there. hernandez' lawyers say the state found the alleged murder vehicle based on statements from hernandez' associate carlos ortiz. and they argued today the search warrant should never have been granted because ortiz failed to polygraph exam. the judge will rule on that argument at a later date. the trial itself is slated to begin in early december. tonight the search continues for any survivors from a cargo ship that went missing during hurricane joaquin. among those onboard 7 people with ties to new england including jeffrey mathias a graduate of mass maritime academy. the coast guard just tweeted out these pictures of debris

the coast guard confirmed that the ship sank they are holding out hope survivors will be found. the ntsb is expected to give us an update at 9:00. in the wake of the umpqua community college constitute national guard oregon many schools want to make sure they are doing everything they can to keep the kids safe. bridgewater state university police tested their lock down protocol. they tested their emergency siren and text messaging system this morning. university's remote locking system actually allows police to lock exterior doors on buildings all throughout campus with a flick of a switch. the phone alerts, text and call mobile classroom and office phones flag flew at half staff to honor the victims of the massacre in oregon. flags were lowered to honor army sergeant christopher vairs of redding missing in action fighting in north korea in 1950. he was buried today with full military honors. he was finally brought home last month when his remains

family 65 years after he went missing during the korean war. the military offered him a burial spot in the arlington national cemetery. but he was burred in a family plot in everett. a request vairs older brother made when he died 20 years ago. all new tonight at 6:00 a local mom looking for a place to pump breast milk is literally sent out with the dogs at dulles airport. tonight she's getting an apology. what happened here cate. reporter: united airlines is apologizing tonight and changing their policy after a newton mom was forced to pump her breast milk in a public terminal. the other option she argues were disgusting and dirty. >> i can't believe that in 2015 this is happening. reporter: new mom live cooper is outraged. >> i'm not looking for free drinks. eye i don't want free meal i don't want anything i want a secure private location for 15 minutes to express breast medical milling and i'll be on

my merry way. reporter: when she asked united airlines during her lay over where to pump her breast milk two options family bathroom or pet relief area. is there there was a red fire hydrant for dogs to relieve themselves. that's obviously not where i'm going to pump my breast milk for my baby. reporter: she posted pictures to twitter calling united harold and the airport. they said this was her only option. instead she sat in the terminal. she says this is a choice no mother should have to face. >> people just don't get it it's 2015 of it's not like i'm a pioneer breast pumping woman. there are a lot of working moms out there that need to pump their breast milk. this is not groundbreaking. reporter: united called liz a short time ago they say they are sorry and there will be a place to pump at dulles. they are glad she brought the issue to their attention.

. saved by a shark attack. a fitchburg pan says if it wasn't for hester firing encounter in the ocean he wouldn't be alive. he was left cut bruised and in pain when a shark smashed into

him off the california coast. >> it's what happened next that has him crediting that shark with saving his life. this is a wbz exclusive tonight. >> the shark was a real message to me. reporter: it was just a family vacation on huntington beach, california. eugene his two kids and girlfriend having a carefree time. then during a swim. >> something struck me from behind. i had never been hit like take before. it was pretty jaring. it gave me an instant whiplash. reporter: it was a shark. eugene struggled out of the water. >> that's when my daughter said to me daddy how come your back is all bloody, this was the damage. a mean gash down his back. the headlines blared the news. >> that night i started having pretty serious chest and back pains. reporter: when he got home it only got worse. so he went to st. elizabeth's in brighton. >> the pain was caused by interior bruising of the thoracic cavity due to blunt force trauma. reporter: it was what they

told him next that hit harder than any shark. >> they had discovered a growth or a tumor on my right kidney about the size of a walnut. reporter: it was cancer and two weeks ago a doctor took it out. >> if this hadn't happened with the shark causing me to go in with this chest pain i would have never known about this cancer. >> the situation saved his life that's pretty fascinating when you think about it. >> i feel fortunate. i feel like i've gotten a second chance at life i'm not going to blow it. >> the doctor says catching the cancer early even if it was by accident made all the difference. his prognosis is great. he doesn't need radiation or chemo. >> he is lucky. >> i love that surgeon. >> you can watch the entire 12

mainly clear skies high cirrus clouds working their way in from the west. cold front out by the great lakes. doesn't have a lot of moisture or energy all we'll see are a couple of clouds and that's about it. temperatures tonight going back through the 40s not quite as cold as last night. as we head toward tomorrow another pleasant day after that cold start we warm right back up. you have a jacket on in the morning. 60s at lunch time. mostly sunny not too much wind west northwest 5 to 15. few frisk he gusts mixed in. mildes day of the week many towns hitting 70 degrees. worcester at 68. nantucket staying in the 60s as will. as we head toward thursday a blast of cooler air moves down behind that front. we have a lot of sunshine still but highs struggle to get much above 60 degrees. there will be that chill in the air. friday we switch the wind around that comes from the south. it's going to bring in more moisture. by friday afternoon and evening

we should see some showers and downpours with a bit of lightning and thunder on friday afternoon. something we'll keep tabs on through friday night. if you have friday evening plans it is looking pretty wet. over that front should move offshore on saturday mornings. we'll see clearing skies on saturday. pretty cool air behind it. highs will stay in the 50s higher terrain about 60 in the boston area to kick off our columbus day weekend. feels weird that it's here already. felt like summer a couple of weeks ago now we're all rehe the mid point of fall. a lot of school weekends off parents weekends. 60s on sunday into the 70s on columbus day itself. warming trend as the weekend continues. now fall foliage peaks columbus day weekend. this picture more green than anything else. that picture was today. we've seen photos from northern vermont more green than color. starting to get where we're near peak. adirondacks. green mountains but well behind schedule compared to most
