>> yes. >> especially when you have this weekend to look forward to, danielle. >> it looks awesome. i feel like there's something for everyone. good morning, everyone. happy friday. 56 in boston right now. similar to the past few mornings. a cool start but the clouds have been on the increase. once the sun comes up, we'll see sunshine out ahead of areas of rain. notice this first batch through new york and vermont. it's behind that that showers and downpours will move in later on today. so between now and late morning, notice getting into the pockets of rain. we top ought around 70 degrees. it's north and west of boston. can't rule out an isolated thunderstorm that could contain gusty wind.

neglect when it comes to the safety of young women. two women, one from here in massachusetts, the other out of south carolina claim they were drivers. their names, jane doe number 1 and jane doe number 2. they say the company falsely advertises safety but instead solicits young women who have been drinking. in february, jane doe number 1 salted her. she and two of her friends were picked up. jane doe number 1 was the last in the car. that's when she says the driver times. the 36-year-old man was arrested and charged in that case. the attorney for the victims released a statement saying "the lawsuit holds uber accountable for what we believe to be a focus on profits over safety." uber's statement reads in part "we pro effectively worked with

share information and aid their investigations. both drivers have been permanently removed from the platform." this, of course, comes in the midst of uber coming in are fire for what many would check. i should add that according to an uber spokesperson, the boston suspect in this case did undergo two background checks which we're told he passed. in boston's north end, nicole jacobs, wbz this morning. new this morning, a serious crash at the borne rotary. a man drove through the rotary and crashed on a hill right around 3:30 this morning. the suv ended up on its roof. the driver a man in his 60s had to be cut out of the car. injuries. also new this morning, a crash. state police tell us its owner is under arrest and facing oui charges. the crash happened early this in auburn.

the female driver went off the woods. injury. the dog was very friendly and take ton tufts animal hospital. the driver is in state police custody. this morning, two fantasy sports sites have been named in a class action lawsuit. this after they were accused of insider trading. our reporter susie steimle is live in boston with new developments on this class action suit here. susie? >> reporter: good morning, chris. we're live for the second time this week as the company tries to win back the public's interest, a class action lawsuit is filed accusing the company of fraud, false advertising, and negligence. it's also in that class action lawsuit rival site fan dual. these are fantasy sports sites

that allow tons on the weekend rather than waiting for the entire season. they have been wildly popular this season. earlier this week, we learned that a draftkings employee earned $350,000 on rival site fan duel. then we learned others claimed $6,000 launching an investigation by the attorney general of new york. maura healey says fans have expectations. >> i think that those who play want to be and expect to be assured a level playing field. i think someone who cares about that is in place. >> reporter: as she said, fans should have expectations of the

sites treating their fans fairly. draftkings and fan dual have yet to speak publicly on this issue. we're live in boston, susie steimle, wbz this morning. it is 6:07 right now on your friday. the united states navy is taking over efforts to find a cargo ship that sank in hurricane joaquin. the el faro disappeared near the bahamas last week. the navy will use sonar to find the data recorder to determine why it went down. trouble for a potential juror in the trial of a danvers teen accused of murdering his math teacher. juror 39 admitted he had case. his son goes to danvers high school and he attended at least one vigil for the victim colleen ritzer. he'd already been dismissed from the case but was still talking about it to other jurors.

now he could face charges. jury selection continues. a new chapter in a war of words in brookline. parents and students showed up at a school meeting last nature to save a beloved teach area's job. bree is here with the latest on this battle. hi, bree. >> good morning. that middle schoolteacher was taken off the job after he was heard swearing. now former students are organizing protests on his behalf. students filed into the brookline school committee meeting to explain why teacher larry chen should get a second chance. termination from the outgoing superintendent after he used the grown-up version of b.s. in the presence of students after school. the movement to save chen has become a teachable moment. >> mr. chen teaching us about the civil rights movement. this feels like it on a smaller scale but something similar. >> a final decision has yet to be made. students will get another chance to make their case at a meeting next week. chris, back to you.

one couple is looking for a new home after this fire at a quincy marina. the fire broke out at a boat yesterday morning. the flames quickly spread. at least 11 boats were damaged, four sank. a brewster ambulance crew used a drone to show how bad it was. >> we just sold everything to move and live on this. all we had left was in there. >> now we have to find our next move. >> a friend offered them a place to stay. nobody was hurt. boston residents have given the city an ambitious wish list when it comes to fixing the transportation issues. based on interviews with more than 6,000 people, a group known as go boston 2030 says city residents want every household in boston to be ten minutes or less from a rail station, a key bus route, hub way station, and a car-sharing location.

>> one eighth grader made a bet with her principal after learning about the dangers of phone overuse. so they both gave their phones to the health teacher who locked them in a closet. after 15 days, it was principal justin who caved. mia says being disconnected actually helped her get back in touch with life. >> i kind of, like, realized more what was going on actually in the world, and, like, i'm really seeing through my phone, but now i actually saw it with my eyes. >> there you go. for losing that bet, principal cameron is promising to treat mia and her friends to lunch. i like how they challenged each other in that way. but he caved. that's interesting. >> who do you think would cave first, you or i? >> that's a tough call. >> you think me? >> definitely. i think we should challenge each other to not text each other. >> do you think we could do it? >> absolutely not.

the bus stop forecast with temperatures around 50 degrees. i am having a friendly suggestion rain coat instead of the umbrella. by the way, barry burbank visited third graders, i think it was, at the huckleberry hill elementary school in lynnfield. yes this is the 80 third graders. their school motto is we are a team. they like to save someone's day through a kind word or action. barry had a blast with you guys. today, yes, you may want the rain coat. you may get showers by the time we get to the bus ride home from school. it's generally after pittsburgh p.m., and temperatures come up near 70 degrees as well. the wind will be gusty and showers on the way. 56 in boston right now. 50 in worcester. 43 in nashua. clouds a bit on the increase. we'll get a little bit of sunshine before they thicken up. here's rain coming back through vermont. downpours in upstate new york.

it's the tail end in western new york with the showers and your pours. that's what's going to look in our direction. watch what happens with this front. most of the rain missing us to the north. at least the steadiest rain through late morning and midday. there may be a couple of showers through manchester, concord, jaffrey, keene, the berkshires. the main story comes in later on today. so 4:00 p.m., north and west of town, scattered showers and downpours. i can't even recall out embedded thunderstorms today. because the wind is so strong above the surface, too, any downpours and thunderstorms could drag down that wind. we may get gusts up to 40, 45 miles per hour. during the evening commute. 9:00 p.m. boston. still pockets of rain south shore to the cape. that will clear the coastline around 11:00 p.m. and drier air and clearing skies comes in overnight tonight, setting us up for an awesome weekend. notice by lunchtime, that wind,

to shift out of the southwest. gusts 30 to 40 miles per hour. not just at the coastline, across the board today. it's going to be a windy afternoon and behind the front, the wind will still be gusty tonight, but it will drag in that drier air. it also drags in the milder air tonight. upper 60s in the worcester hills. look at this. these are our high temperatures tomorrow sop definitely a cooldown. upper 50s to low 60s. crisp air, dew points will be in the positives. so it is a dry air that comes in. 65 to 70, though, on sunday. columbus day, look at this warming trend with a lot of sunshine and late day clouds. high temperatures top out in the low to mid-70s. accuweather seven-day forecast monday night into tuesday, showers are likely and that's the leading edge of relatively cooler air that comes back through the middle part of the week. there's an accident on 495 north at exit 7 to tell you about. that's route 24. we're seeing a five-minute delay there.

the expressway is already bad as well. you are slow from the braintree split up to the gas tanks. north of town, 93 south is slow going from woburn to 128 to spot pond. we are following breaking news in arizona. right now, a shooting at northern arizona university in flagstaff. three others wounded. in custody. the school sent out an alert indoors. again, this is a deadly shooting at the campus of northern arizona university. we're going to continue to monitor this for you and keep you updated right here on wbz this morning. a worcester school bus driver off the job now following a crash last month that was caught on camera. take a look at this as the bus driver takes a turn. she loses control slamming into parked cars. the crash sends her flying out of her seat. police say the video clearly shows jean did not buckle her seat belt.

she has been cited and lost personal driver's licenses. there were no children on the bus at the time. logan airport. state police say they found drugs in his suitcases. 100 pounds of marijuana sealed in plastic in his checked bags. troopers stopped the california man after he flew in from san francisco. is he expected to be arraigned in court. a food fight over dumplings is now heading to court. the owners of dumpling daughter say two former employees learned as much as they could about the restaurant's family recipes and business practices and opened a nearly identical restaurant this summer in millbury. >> i take a lot of pride in the recipes that my mother and i created together. we tweaked everything together, and it's something that's very special to us. >> reporter: so we checked out the millbury restaurant accused of stealing the recipes.

62% of us have one or more pets in the house and almost all of us told the pollsters we see our pets as family members. extra beloved family members considering how we treat them and the billions we spend on them money fearly 50% of them say we buy birthday gifts for our pets. 31% of us cook for them. sometimes regrettably, 20% of us like to dress them you the in outfits. of course, more than 7 in 10 of us let the dog or cats sleep in our beds. a special plus on cold winter nights. i admit that's where buddy the wonder lab sleeps in my house when she wants to. is there something wrong with this? you can find experts somewhere to claim there's something wrong with everything. "the globe" reports a biology professor says our love affair with dogs is "ridiculous." the average dog has a whole

we've been following breaking news in arizona this morning. there's been another school shooting. let's get right over to bree. she's been following the details. good morning, bree. >> reporter: good morning, kathryn. it's the shooting in flagstaff. we do know that one student is dead and three others are wounded, but there's no word on the extent of those injuries just yet. checking the school twitter feed, then say the shooter is in custody and that the situation is stabilized. the school did send out an alert telling students to shelter indoors. it is a deadly shooting on the university. this on the same day as prime minister is heading to oregon to meet with the victims' families of last week's school shooting where nine people dade. chris, kathryn, back to you. >> keep a close eye on that one for us this morning. lawsuit. >> two women, including one from boston say the company didn't do enough to protect them.

closer look at this case. good morning, nicole. you. the federal lawsuit. two women claimed they were drivers. one of them many massachusetts, the other in south carolina. they're named as the alleged victims, jane doe number 1 and jane doe number 2 in the lawsuits. they say the company falsely advertises safety. instead, it solicits young women who have been drinking. it was in february jane doe number 1 said a boston uber driver assaulted her. she and three friends were picked up on the north end. jane doe number 1 was the last in the car and that's when she says the driver indecently touched her several times. a 36-year-old man was arrested and charged in the case. an uber spokesperson says the driver passed two background checks. of course he no longer works for the company. the company also says they have

we're live in boston's north end, nicole jacobs, wbz this morning. >> thank you very much. boston police are searching for two people who stabbed a man outside the parks street t station. paramedics rushed one person to the hospital. he is expected to survive. the only description of the suspects is that they are a man and a woman. piles of cash, drugs, and a manned gun. police in arlington say they found these items in the grocery home of 32-year-old paul after executing a search there. the suspected cocaine dealer is due in court this morning. a man from new bedford busted with more than 1,000 oxycodone pills. rhode island state police say they pulled over jose cabrera for violating the move over law. during the stop they pound $33,000 worth of drugs in a backpack. it will be another two weeks before baby bella's funeral.

another autopsy on the little girl. her headstone is ready to go but they can't bury her until the medical examiner's work is done. her mother and her mother's boyfriend are now facing charges in connection with bella's death. this morning, two fantasy sports sites have been named in a class action lawsuit coming days after fan dual and draftkings were faced with insider trading. what can you tell us? >> reporter: it's been a tough start for football season for fantasy sites draftkings and its rival fan duels. we told you about the insider trading information in which an employee of draftkings made $350,000 on rival site fan duel. that certainly raised a lot of eyebrows. now it's looking even worse. a class action lawsuit was filed in new york city

yesterday by a fan out of ken condition that alleges that the draftkings employee or multiple draftkings employees, rather, have made $6 million total, betting on rival site fan duel. this launched an investigation by the new york attorney general's office, maura healey in massachusetts looking into it as well. we have yet to hear from either draftkings orphan duel on this issue. they have stayed silent. as to how this might affect people who are playing, it's unclear at this point in time, but some espn analysts suggest that it's not only going to hurt people's trust, but it's going to make fewer people play at least this week if not more in the future. live in boston, susie steimle, wbz this morning. it's 6:36 on your friday morning. today, bill crosses by will have to testify under oath about an alleged sex assault as part of a lawsuit filed in december 2014.

to perform a sex act at the playboy mansion that 1974 when she was just 15 years old. the claims set off a string of accusations against the comedian. it remains to be seen if today's deposition will be made public. a hearing on that matter will happen in december. the 2015 nobel peace prize has been awarded to a tunesian democracy group. the announcement was made about an hour ago. the nobel committee honored the national dialogue quartette for its work to -- quartet for its work on when tunisia was on the brink of civil war. it faced years of turmoil after the 2011 revolution. republican congressman kevin mccarthy was about to be elected speaker of the house when he withdrew his name before the vote. outdoing speaker john boehner planned to leave october 30 but now says he'll stay until the

senator rand paul will host a business themed town hall in manchester this morning. then tomorrow, he's in nashua for the national convention of the republican liberty caucus, part of the republican party's libertarian wing. and chris christie will be in hannicer today for a pancake breakfast holding a town hall at the legendary breakfast spot for locals. that one start as the 8:00. homeland security secretary will get a first land look at the flood damage caused by days of rain. the governor is urging residents in coastal areas to evacuate as storm water flows back toward the ocean. the anti-vaccination trend could put one of eight children at risk for measles according to a new study. researchers say the u.s. could be on the verge of an outbreak. bree?

families who choose not to vaccinate their kids tend to cluster in the same communities. that makes an outbreak a much stronger possibility if measles were to be introduced to those communities. the study by emery finds the number of americans vaccinated against measles is dropping dangerously close to the level where large outbreaks of more likely. a now discredited study once linked the vaccines to autism, which fueled an anti- vaccination campaign of sorts. the new emory university report says children, especially those under the age of 3 are at the most risk. a 2014 measles outbreak at disneyland in california sickened 125 people. parts of the baystate also need more vaccines. >> we're lucky to live many massachusetts where vaccination rates are generally high. however, there are areas of the state and in new england where vaccination rates are slipping. that really scares me. >> reporter: the spots where

the bulk of the rain passes to our north. back through vermont and back through maine. we will be mostly dry with breaks of sun through the midday and early afternoon. then it's 2:00, 3:00 north and west of town, we get showers and downpours. notice the exception boston back down to the cape and the south coast mostly dry through mid-afternoon. there may be thunderstorms out there, i think, will be isolated, but brief gusty winds can't be ruled out. any downpours and thunderstorms that do develop could drag some of the wind down to the surface. 6:00 p.m., a rumble of thunder commute. 9:00 p.m., we're drying out still leftover rain from the south shore down to the cape after that. that sets us up for an absolutely fantastic stretch for the holiday weekend. the wind will be quite gusty today. it ramps up quickly here this morning so by noontime we're gusting over 30 miles per hour. this is not just a coastline thing. this is across the board in southern new england. numerous gusts 20 to 40 miles
