forecast. barry, did you turn the heat on at home? >> i broke down, i broke down and gave in. >> it's just one night. >> it's kind of chilly. >> i do like to have a sweatshirt and like to bundle up, but i had to give in. sorry about that. 31 agrees in boston now. -- degrees in boston now. it is sub-freezing in the city. that -- we haven't broken any records, not a record low, but still, we haven't had it this cold in a long, long time so early in the season. you can see it's all in the 20s. the dew points are lower. not seeing much frost in some locations because the air is so dry, but we have freezing temperatures and the freeze warning along the coast were we didn't get the freeze yesterday morning. we've got clouds over the outer part of the cape there, but most of the rest of the region is on the clear side and just a few clouds coming from the system from canada. we may see just a little bit of cloudiness later on this afternoon. here's the daily planner, in the 20s, a cold, freezing start

dormitories, not too far from where we're standing. at this point, police haven't made any arrests and all of this happened during parents' weekend leer at bu, so an extra scare for students and parents visiting hearing about this. the report came in around 2:00 on sunday morning. a female student says a man she did not know came into her dorm room and sexually assaulted her. she was able to give police a good description, saying he was 5'9" with a long sleeve shirt and a vest. because the dorms have a lot of security, most students believe this was a fellow student who attacked her. >> i think it's a student. i think it's hard to get past security if you're not a student. so i don't think that would be an issue. i think it would be someone who lives in the dorms and has access to swipe in. >> that's kind of scary. >> disappointment. it's a secured building.

that's just unacceptable. >> reporter: bu police haven't been speaking to the press about the event so far. they did send out an alert to all students on their phone immediately after this was reported. we're hoping to hear more about the status of the investigation later on this morning. for now, we're live in boston, susie steimle, "wbz this morning." >> susie, thank you very much. 5:04 now. a mother whose infant son was the subject of an amber alert is deny court this morning -- due in court this morning on a number of charges. name cherry was arrested saturday after bringing her son to children's hospital. she faces child endangerment charges in pennsylvania where a doctor told her that her son needed trauma care. police issued the amber alert after cherry left pennsylvania without getting care for her son. and whitey bulger's long time girlfriend, catherine agreeing, will be in federal court today for refusing to cooperate with investigators. bree sison has more.

>> reporter: she refused to tell police that other people helped bulger during his 15 years on the run. she's charged with contempt. she refused to testify before a grand jury looking into who might have assisted bulger. she's serving eight years for conspiracy to harbor a fugitive and identity fraud. her attorney says her only crime was living with bulger. he says she has repeatedly been brought back from a federal prison in minnesota to appear before a grand jury in boston, even though she says she has no information and will not testify. agreeing's first appearance of this new contempt charge will be this afternoon in front of a magistrate judge. we do expect him to set a hearing for the charge. convicted, contempt could add years to the sentence. >> thank you, bree. the patriots taking care of business in indianapolis, beating the colts, 34-27. now, it isn't the first time these teams have met since last season. >> the patriots sent a strong message with their play on the

field. levan reid breaks it down for us. >> good morning, everybody. last night's game was extremely competitive. the colts had the pats on the ropes. they forced tom brady here. the game was competitive for about a half. then the pats kind of do what they do. you make a big mistake, they capitalize and don't look back. pats and the colts, new england down 7-0 until now. tom brady, rolling in, 12 yards and hauling. julian pumped up like that, but he would break his pinkie finger on the play. check it out. jules is tough, though. he didn't miss a step. he's not even a hockey player. he picked it up in the 3rd. brady, that old friend of ours. 25 yards. colts take it closer to the end, but the pats win 34-27 and

to the x-ray room to look at his right knee. hey, that's sports this morning. i'm levan reid for wbz sports. coming up,a bicyclist sent to the hospital after she was hit by a car in alston. police are investigating the crash. it all happened at the intersection of harvard and cambridge streets yesterday. witnesses say they were horrified by what they saw. >> she rolled up on top of the car. the bike literally went up one way. she went on top of the car. so it was like really, really bad. so i mean, you could hear her screaming. she was in pain. >> the victim was taken to the hospital. boston police tell us her injuries appear to be non-life- threatening. the car did stop at scene. a house fire kills two people in chicopee. firefighters say by the time they got there, the home on montcomb street was engulfed in flames. three people in the home were able to escape, but two adults were trapped inside. their identities have not been released.

figure out what caused the deadly fire. flames shooting from the roof of a home in newton. take a look at this. the fire started in the chimney of the home yesterday and quickly spread to the rest of the building. the home suffered extensive damage, but no one was hurt. now to campaign 2016, donald trump says if he were present in 2001, he probably would have been able to prevent the 9/11 attacks. it's the latest jab in the ongoing battle between trump and fellow republican jeb bush. yesterday, trump said the 9/11 hijackers never would have made it into the u.s. if he was commander-in-chief. >> i'm extremely tough on people coming into this country. i believe that if i were running things, i doubt those families would have -- i doubt those people would have been in the country. i'm not blaming george bush, but i don't want jeb bush to say my brother kept us safe. >> this is another example of

the children were encouraged to share bypassing out pumpkins to the animals. they were also entertained with ghoulish games and creepy crafts. >> look at the care bear. oh, my gosh. that's so cute. we take the dogs for a walk yesterday and all the kids -- it was packed. we walked right past and it was absolutely packed. >> and it was chilly. so i'm surprised that it would be that packed. >> yes, with the kids snyt they look so cute. i can't wait for halloween. all right, barry. it is that time of year. it doesn't feel it, but it is october. >> it's like a winter feel going on. >> it's crazy out there. it really is. hard to imagine yesterday was, like you mentioned, in the mythle of october, we saw all that snow. now we have the cold following the snow, but it's all going to be chased away. don't worry, it won't be a long- lasting event. much milder weather coming up this week after we get rid of today's weather. but today will be mainly clear. you won't see any snowflakes

31 in boston. sub-freezing across most of new england. most of cape cod in the mid- to upper 30s out there. clouds in the outer part of cape cod, as well. it's a freezing cold morning. and in some places, the dew pointesare so low, there's no frost to see on the ground. but we have freezing temperatures, that's for sure. a few locations do find the air temperature actually down to the dew point temperature and so, therefore, you're seeing frost in a few spots. so, boston, 31 this morning. that's the earliest it's gotten down to 32 or below since 1979. the last sub-freezing temperature in october was october 31st in 1988. so, quite a statistic there. the sky is clear, it all cleared out last night after the scattered snow showers and we got a few clouds in the outer part of cape cod with the cold air across the relatively mild ocean waters. high clouds streaming southeast with a few this afternoon. so, other than those low clouds on the outer cape this morning, maybe an isolated sprinkle,

this will start dipping south this afternoon. may see a few streams of high clouds, that sort of thing, but overall, the day will be nice and sunny and there won't be as much wind as yesterday. tonight, rain and snow showers across the northern mountains, and we turn cloudier overnight tonight. then the cold front moves offshore, the warm front comes tonight and the cold front coming down, so, tomorrow morning, not nearly as cold as this morning, as this mild air comes in with a southwest breeze. there could be a sprinkle tomorrow. the front comes down, blaifj coming in tomorrow night, so it falls apart on wednesday. we've got mild weather on the way. so, in the upper 40s for highs this afternoon. in spite of the 20s this morning. then high temperatures tomorrow should be around 63 or 64 degrees. how's that for a nice recovery? that's what it should be or maybe a little above the average coming up for tomorrow. so here's your forecast, we've got temperatures going up today into the upper 40s for the most part. and lower 60s coming up for tomorrow and wednesday. that's it.

traffic and weather together. >> thank you, bear barry. here's a live look at the roads this morning. traffic is moving along well. smooth-sailing so far on 93, 495 and 128. the mother of a navy seal, glen doherty, killed in the benghazi attack, is upset about a new political ad aimed at former secretary of state hillary clinton. >> dear hillary clinton, i'd like to ask you why you ignored calls for help in benghazi and then four americans were murdered. >> doherty, who is from winchester, is among four americans killed at the u.s. consulate in benghazi, libya in 2012. his mother says it's crude to use her son's death for political purpose. on thursday, clinton is set to testify before a house panel investigating the benghazi attack. it is the latest in a number of hearings on the consulate attack and many charged that

the hearings are republican political witch hunts aimed at hurting clinton's presidential campaign, but the committee chairman denied that. >> i get that there's a presidential campaign going on. i have told my own republican colleagues and friends, shut up talking about things you don't know anything about. and unless you're on the committee, you have no idea what we've done, why we've done it and what new facts we have found. >> he says the committee is also looking at a batch of clinton's e-mails they received from the state department. the iran nuclear deal has formally taken effect. the u.s. expects the iranians to take several months to live up to their end of the pact. it would provide the country relief from international sanctions. president obama says u.s. from the agreement. a deadly weekend in the middle east. israeli police say a man armed with a gun and a knife launched a violent attack at a bus station yesterday. one israeli soldier was killed,

five police officers and five civilians wounded. police are now building concrete barriers in east jerusalem as the new security attacks. and the pentagon says an air strike in syria killed a top al-qaeda commander. that man was allegedly sent to syria to plot attacks against the west. defense secretary ash carter says the military operation is a significant blow to the terror group's plan to attack the u.s. and its allies. 5:19 now. the nativy is bringing in sophisticated listening devices to find the wreckage of the cargo ship. it will look for pings of the black box on the ship. there was a memorial in florida to remember those lost on the ship. the ship was based in florida. from mass maritime academy. >> we can say we don't know your plan, god, they may be in a better place. but we want them to be here

5:23 now on your monday morning. statewide park exam results will be released this week. this comes as state officials are considering using the test instead of the m-cats exam. right now, the m cats is the way to rate school performance and is a graduation requirement for high school seniors. a decision on whether or not to switch to the new exam is expected next month. state insurance officials are going on the road this week. they will be holding a series of public hearings to explore how homeowners insurance is sold in massachusetts. the division of insurance will discuss marketing, pricing policies and availability. homeowners will be able to discuss whether they were denied coverage. breaking ground on a memorial to the victims and

bombings. >> work is under way on the krystle campbell peace garden in medford. bree is here now with a look at the garden and the dedication. good morning. >> reporter: good morning. medford is krystle's hometown and the amount of thought the town put into the tribute is amazing. it will be lined with krystle's favorite flower and also symbols of the marathon. hundreds gather in medford for the official groundbreaking of garden. >> on this joyous occasion, it is with a deep sense of respect and admiration that i dedicate this location as the krystle campbell peace garden. >> reporter: four doves are releaseed in memory of krystle campbell, martin richard, lindsey lou and officer sean collier. around the ceremony, there are sunflowers, krystle's favorite and a flower that will one day line the garden. >> it just lifted me up a lot. >> reporter: the garden will also feature five water

fountains, four in memory of the lives lost. >> in the middle of these fountains, there will be a fifth fountain. larger than the others. representing the world and our quest for world peace. >> reporter: marathon survivors say the garden symbolizes peace, also, love and hope. >> he is a great guy and has a huge heart. i wanted to do something for all the survivors and the four people who lost their lives. and, you know, it's just an amazing place now, where everyone can come. >> the garden will cost about 1.3 $1.3 million to construct and it's located next to town hall. back to you. >> thank you, bree. 5:25 now. today, the heather abbott foundation will award its first prosthetic leg to a woman from wall pole. >> the 26-year-old amputated her right leg because of complications with a genetic disease. she's excited to be the first

at boston university on alert. a female student says she was sexually assaulted inside her dorm room. the student says an unknown man entered her dorm room at student village 2 around 2:00 yesterday morning and sexually assaulted her there. he took off from the scene. bu sent out alerts telling students to be on alert for a college-age white mail with dark hair wearing a down vest. whitey bulger's long time girlfriend catherine agreeing will be in federal court in boston today on criminal contempt charges. she refused to tell police if other people helped bulger during his 16 years on the run. in december, she refused to testify before a grand jury. she's already serving eight years for harboring a fugitive. also in court this morning, the mother whose infant son was the subject of an amber alert. >> tiffany cherry was arrested on saturday after leaving pennsylvania with her son. nicole jacobs is live outside the court in roxbury this morning with more on this court

appearance. nicole? >> reporter: chris, kathryn, authorities knew right away that this 2-month-old little boy was with his mother, but exactly where they were headed was the big question. no one knew 37-year-old tiffany cherry was actually taking her severely dehydrated child to children's hospital here in boston. an amber alert was issued detailing the make and model of the char she was believed to be driving, along with the license plate number. it was a nurse who recognized her name and called it in to police. cherry had driven her son from pennsylvania all the way to boston after doctors in pennsylvania said she needed -- or he needed serious trauma care. police documents indicate the 37-year-old mother felt she was getting the run-around from doctors in pennsylvania and drove her son to boston. now she faces child endangerment charges out of

piston, pennsylvania. she also has several open warrants here in massachusetts related to prostitution and some driving violations. those span over the course of about 13 years, but she is expected to be arraigned here in roxbury sometime today. in the meantime, i should also add, dcs now has custody of that little boy. nicole jacobs, "wbz this morning." update this morning. 5:34 now. today, the governor is holding an open house of sorts to outline a plan for utilizing some of massachusetts's real estate holdings. more than 300 potential developers are expected to attend. the governor's office says the event will focus on leveraging state real estate through public and private partnerships. 5:34 now. a day of rememberance and tribute in west roxbury. the massachusetts marine corps. hosted a parade yesterday to mark the 40th anniversary of the end of the vietnam war. more than 1300 massachusetts residents lost their lives in

the event served as a thank you to all branches of the military that served in the vietnam war. meanwhile, the state's revere. he was given a lifetime achievement award yesterday. the 101-year-old fought in france and german during world war ii. he's a retired accountant and lived in east boston for 80 years before moving to revere. the event also included a wrestling and boxing match to raise money for the wounded warrior project. and thousands bundling up for the chilly temperatures to help fight autism. the walk launched from mansfield yesterday. the event raises money to fund programs for those struggling with autism. wbz helped host the event. this isn't something you new york city. >> not at all. york, roaming around staten

the dew point is so low, but they're up where there is frost. we got a picture of westar mouth. there is a cranberry harvesting in progress there. the picture was taken just before they got snow showers on the cape there, as well, yesterday. morning. pretty much all in the teens, but there are a few pockets down in the river valleys that are -- i should say 20s. down in the upper teens this morning. and boston below 32 degrees. so it dropped to 31, so that's the earliest since 1979, the really last sub-freezing temperature in boston was october 31st, 1988. across the region. on the cape, there are clouds out here, but for the most part, the rest of the region is crystal clear and we're looking approaching front, which may drag down or sit down and slip england later today.

this morning, but otherwise, it's going to be turning nice and sunny with the sunrise at 7:01. after 7:00 in the morning. that's tough. and the sun sets before 6:00. that's even tougher. we're looking at decreasing daylight going into the season here. plenty of sunshine all day long. some of the cloudiness comes down, we will see a few streams of high clouds later on this afternoon, but most of the cloudiness tonight. the reason for that is the front is on its way. so we will say goodbye to the cold air this morning. it's freezing cold, you've got to bundle up. tomorrow, more of a southwest wind. you can see the air particles, the wind particles from the southwest. they're turning milder tomorrow with maybe an isolated sprinkle around, especially up north in the morning, then the cold front heads to the south and it comes through here sometime on wednesday morning. with clouds around on wednesday. so it may be possibly a little cooler, especially along the coast on wednesday with a bit of a sea breeze. then the front comes back to

girlfriend heads to federal court today. >> and a bu student sexually assaulted in her dorm room. here's your top stories on this monday morning. >> reporter: good morning, i'm susie steimle live on boston university's campus where that female student did report being sexually assaulted sunday morning. she said it happened around 2:00 a.m. and then a man she did not know came into her dorm room and attacked her. she was able to give police a pretty good description, saying it was a white male, about 5'9" with long hair and a medium build in a long sleeve shirt and down vest. police are asking anyone on campus to keep a lookout. they have not made any arrests in the case at this time. it did prompt a campus-wide alert. you will hear from students coming up at 6:00. morning". i'm nicole jacobs live in roxbury. a pennsylvania mother is set to

be arraigned here in roxbury district court, stemming from a weekend amber alert. you can see here, 37-year-old tiffany cherry was charged with child endangerment out of piston, pennsylvania after she drove her son from piston to boston, this after doctors in pennsylvania say the infant needed care for severe dehydration. cherry drove to children's hospital and was arrested when a nurse who recognized the name from the amber alert called police. at 6:00, hear why cherry said she drove five hours to get her child treatment. we're live in roxbury, nicole jacobs, "wbz this morning". whitey bulger's girlfriend and fugitive companion is back in boston today to face federal contempt charges. prosecutors say catherine greig refuses to testify in front of a grand jury. she's facing eight years for harboring a fugitive and identity fraud.

coming up, how much longer she could be found in prison if she's found guilty and what her lawyer has to say about the new charge. florida police are looking for the person who opened fire at a festival. one person was killed, five others hurt. the shots sent thousands through the streets. the organizers of this posted a statement on facebook saying they're deeply sandened by what happened. the drug kingpin known as el chappo injured while evehicle and vading authorities. there was new intelligence received over the weekend. he got away, but not before sustaining injuries to his face and leg. he broke out of prison back in july and has been on the run ever since. the u.s. is offering a reward of up to 5 $5 million for information leading to his arrest. today, the federal aviation administration is implementing new rules for droughns. the faa will require owners to register the drones with the government to be tracked if the
