combination of drunk driving and road rage. the 67-year-old is the suspect is due to be arraigned in court any moment now and we caught the suspect walking out of the police station overnight and this is not just his first oui charge. he has two others and a lengthy driving record. it was before 11 yesterday morning heinz was driving drunk on 495 north when he intentionally hit 37-year-old jared oriniss car not once but twice and fled the scene. the car flipped over and he was pronounced dead on the scene. another male passenger who was with him was med flighted to a hospital and in serious condition. we caught up with the parents.

>> the creature that cause the accident, he is a creature, who has priors and should not have been driving. i hope that whatever judge he goes before will give him a maximum amount of time. >> reporter: heinz is facing multiple charges. his case should be heard shortly. back to you. >> thank you very much and keep us updated. >> a water park owner chains himself to a water slide. he opens liquid planet in new hampshire. in august, the park had to close after the tests found high levels of bacteria in the water. that is what hurt the business. the bank foreclosed and plans to auction the property next month. he said he is staying on top of the side tower in hopes to save the business and hopes someone will partner with him. and right now, a stabbing suspect is still on the run.

police say a tip led them to a home on archdale road last night in roslindale. they believe the man was hiding in a relative's apartment with two women and four children inside. at some point, the man jumped from the window and got away. police say this was not a hostage situation and that nobody was hurt. a pennsylvania mom who drove her infant son to boston for medical treatment triggering an amber alert is expected in court this afternoon. last month, tiffany cherry took her son to a pennsylvania clinic. a nurse there told her to take emergency room. children's hospital for treatment. the lawyer said the amber alert was overblown and now a judge will decide if he gets her children back. in court, a fugitive convicted for his role in the murder of a police officer was found in boston. police arrested things-year-old kevin paul who was convicted for his role as an accomplice in the murder of a police officer. he got out of prison this year and violated parole.

. hey, welcome back. a new push to make school buses safer. the federal safety officials want seatbelts on owl school -- all school buses. they're required only in six states and massachusetts is not one of them. the ntsb estimates that four kids die every year in school bus crashes. investigators said adding seatbelts could cut that number in half. and a question to legalize recreational marijuana could go on the 2016 ballot in massachusetts. backers have collected more than 100,000 signatures in support of it. that is well above the mile per hour numb needed to process putting the question on the 2016 ballot. the measure would allow adults 21 and older to have up to one ounce of marijuana and grow a limited number of marijuana limits in their homes. the city of boston will give letter grades to restaurants and that is for cleanliness and food safety practices. a pilot program will begin in january and it's well iser to a system in place in new york city.

the restaurants will initially get either an a, b, or c and the first grades will be available online. after the first year, grades windows. a new way for out-of-up tickets. the city's parking office is using spike and people not living in massachusetts can log on and video chat. they're asked to send in any evidence that they would have that would help their case ahead of time. all five cases appeal via skype so far have been dismissed. so the people are winning. today, a candid conversation with gisele. she sat down with charlie rose and why she's successful, her relationship with qb tom brady and deflategate. >> and are you the best of the look is that you had? >> and he had as much competition and competitive instinct as you did? >> i think. >> every bit as competitive as you aria and is that part of the attraction? >> i would say he's more competitive than me. >> and how tough was it when tom had to go what he went through? >> i think that is when you know when who are your friends and who loves you, i think and my father always said the quality of your life depends on the quality of your relationships. and i think no matter how challenging it was, it was a -- we have supported one another and that is the most important thing you can have. >> gisele said her future is wide open and although she retired from the runway earlier this year, she's not done modeling just yet. and we'll see more of her all right. switching gears. and weather -- . >> i know. and we started off okay.

>> and it's a bit of rain along the south coast that will good. i have been torn with the >> okay. >> and some people have tomorrow off for veteran's day and there is a lot of ceremonies and parades and things like that and any time you add rain, it slows us down and the impact on the traffic and commute should be slow to moderate and cape and islands and high impact tomorrow morning, that is going to come in and should be improved by the time we get into tomorrow evening with some leftover pockets of light rain and rain we haven't had much of but a trace and dry. each box represents a warm day and warm temperatures. it's been a record warm start to the month and the next few days, our temperatures are cool tomorrow and we start the warming trend back up into the end of the week. 52 in boston right now.

the map here, keane to nashua. the clouds are placed and the rain is slowly advancing northward here and some light westerly, rhode island, to narragansett bay and through buzzard's bay now and will impact far eastern massachusetts and i can't rule out a stray shower north of the main line but a lot of moisture passing to sea and we're waiting for an additional piece of energy to the west to fill in the rain and into the late evening and no into the afternoon, pockets of rain, cape and the islands, evening hours and that is after the evening commute around midnight and that is when that rain is steadier and heavier into it remember morning. the downpours and earlies on in here indicate a lot of leaves down and we're past the peaks of drains creating ponding of water and localized flooding tomorrow morning and use

remember, too, the leaves get slippery when wet and late morning, still pockets of heavy rain and that tapers off after that and i think there will be pockets of rain into the the intensity. how much rain can we expect? a half an inch to an inch and a half in the blue-shaded areas here and there might be high amounts set in and we could use some of that rain. tonight and tomorrow. and i don't think it's strong enough to cause widespread damage but into the cape and wind advisories into affect tonight and tomorrow, i think we will see numerous gusts, 40 to 45 miles per hour and there might be gusts as high as 50 on the outer cape and nantucket. and 40s and that is what we're stuck for our veteran's day -- veteran's day. and tomorrow night, that storm pulls away and we get a break in the action and thursday

the next round of showers come in and pockets of rain thursday afternoon and evening and we dry out on friday. a couple of rounds coming in and the mild breeze on saturday and pushing to 60 and with some sun back out. the weekend returned cooler and breezy on saturday and could be a brief evening shower and 50 on sunday and staying in the 50s next week. >> and looks like a nice fall weekend ahead. >> yeah. and there are a upbow of colors tonight and tony tantillo shows us how to get the best and most aught of those mini peppers. >> reporter: today is the day. they're sweet peppers. red , yellow, orange, and green. and report they beautiful? and they're mainly because they're sold by the pound and not individually.
