shopping and getting ready for christmas. >> thank you, dave. we begin with breaking news now. the national democratic committee has reached an agreement with the bernie sanders campaign over the data breech that led to a lawsuit. the dnc denied bernie sanders to the data base after they found a breech in the list of hillary clinton voters. the sanders' campaign considered the data base so crucial to fund raising, they sued the dnc to be allowed back in, and bernie sanders himself learned from the breech, not from his own stares, but from his own chair. 24 hours after it happened.

campaign is fights back. his campaign sued the national democratic campaign after they were blocked from accessing a key data base. >> when we have to people come to call, we can't general rate phone numbers to do that. >> reporter: the dnc was charged with sabotage saying it could cost more than $600,000 a day in donations. it started with a 45 minute computer glitch that allowed sanders' staffers to look at the data from the hillary clinton campaign.

a family gunned down trying to cross the street. the father trying to push a stroller down the street lost his life. >> my heard goes out to them. the with the holidays nearby, that's the last thing you want to hear. >> reporter: a sad story from lowell. three people hit by a car, including a 3-year-old girl. police say a 9-month-old girl was also hit along with the girls' father. neighbors found a grim scene with a stroller in the road. >> we heard the lady screaming, and when we came out, she was sitting on the ground, next to the guy, and the baby was still in the carriage. we heard the baby cry a few minute the, and then the baby stopped. >> reporter: the mother was not struck, but the father was thrown to the pavement.

the hospital with nonlife threatening injuries. the 2-year-old was also transported with nonlife threatening injuries to a children's hospital in boston. >> all the of a sudden you hear people get on the gas drive down the street like maniacs. it's a matter of time before anyone backs out here and get hits by somebody. >> reporter: the driver was not hurt. he did stop and remain on the scene and speak with police. as of now, he's not facing any continues. the fired operator of a runaway red line train is not fight. david vazquez was fired earlier this week. he wrapped a cord around the

u.s. marshals just released a picture of ethan couch. investigators said he was too spoiled for prison after killing four people in a drunk driving crash. he skipped out on his probation, and now investigators want to know if his mother helped him escape. a dangerous driver was caught looking at lights with kids on the roof. a neighbor in texas captured the risky ride. you can see three kids clinging to the car as it cruises down the road. what is he thinking? the north pole elves must be busy right now, and that's why he was seen at wal-mart. is today your birthday? let's see who you share with it.

while crossing the street in lowell. the dad, 9-month-old, and 2- year-old were taken to the hospital. the injuries were not injured life threatening. the driver did stop and there's now an investigation. there's new charges in the baby forrally known as baby doe. michael mccarthy has been charged with first-degree murder and michelle bond accessory after the fact, and she's accused of collecting state benefits for her daughter even though she knew she was dead. bella bond was not identified for months after her body washed ashore. a rude awakening for a family forced from their ohm after a teenage drive slammed into their home. as katie brace reports, it's amazing there were no serious injuries. christmas was not supposed to look like this.

on the death of the former pilots. the coroner ruled that scott wayland died from an accidental drug and alcohol overdose, and the medical examiner revealed heart disaster and other problems linked to his long history of drug abuse that contributed to his death. he was 48 years old. a it's man will spend more than 48 years in prison for destroying a million dollar car. it was this video on youtube that may have been his undoing. the driver bought this 2006 bagadi for over $1 million, and he drove it into the lagoon. what he didn't know, a stranger who happened to be admiring the

off the road. the driver pled guilty to insurance fraud. parishioners fighting to save their church are going to court now. the group from saint francis will ask for an emergency stay pending their new appeal to the highest court in the country. for more than 10 years, the parishioners have been having a vigil to keep the archdiocesing from selling off the church. pope francis will cannonnize mother teresa because he says she did perform a second miracle. >> reporter: mother teresa will soon be saint teresa after pope francis said she cured a worshiper's illness. it happened in 2008 when a brazilian man with brain tumors

i think tomorrow morning boston should be below freezing, and that's the second time, but look at all of this mild air, monday, tuesday, wednesday, thursday, and friday, it will all be above normal, and then the week after that, it looks like more warm weather after the cold snap. this month could very well end up as the warmest december on record, and now, i don't like the term ever because it's only on record and the records go back to the late 1800s. it could have been warmer than this in 1612. we don't know. 1996, 61, there's the record. i think lower to middle 60s, and i don't think the record is going to go, but other christmas eves, 1999 back to 1900, 1957 in the 50s. there's been other christmas eves where the weather has been quite warm, and this is one of them. no doubt about it.

flurries especially west of the reservoir to berkshire. the low pressure is pushing in, and look at the lake effect. the great lakes are not even remotely frozen over. it's producing the lake effect, and. so snow showers could just make it into the area. you look up and see a quick flake, and where it's really going to accumulate is east of the great lakes because of the air, rushing over the water, pulls the moisture and just deposits it there. 1-2feet you will see in the watertown area and the suburbs. winds will be gusty this afternoon, gusting over 20 miles an hour that puts the windchills down in the 20s. windchills going down, and
