he left his open tab and credit card at the bar. then the cab by who took his gun away -- cabbie who took his gun way from him. >> disbelief for local cabbies. >> i think i would floor it and get out of there instead of grabbing a gun. >> reporter: after a boston taxi driver took a gun away from a passenger shooting in the back of his cab. on tuesday, that passenger, 34- year-old andrew flack from florida was charged with multiple gun charges. cops say it started around 10:00 at the bar of one of boston's sheikest hotels, the stage. court documents state flack tried to leave the hotel with a drink and when an employee tried to stop him, the suspect became argumentative, smashed the drink and demanded the employee step outside. moments later, police say, flack fired a shot somewhere on

credit card behind. cab. the driver said he took the gun away from flack after he fired the gun inside the taxi. a gun shell was found on the car floor. police caught up to flack. he couldn't produce a license to carry a gun and they arrested him. he is being held on $30,000 bail. now, he has a criminal record including a gun charge from south carolina. but now according to court documents he is a waiting at the ton of the hub. he is due back in court on february 23rd. live in boston, wbz news. >> thank you. tonight worcester police are trying to figure out if a man hit by a freight train was already dead before he was struck. the body of hector ramos was found owned the tracks sunday night. police say they have lots of questions about the death which lead them to believe ramos may be the victim of a crime.

it's late at night, on the train tracks, no one is supposed to be on the tracks as most people know. again, given the condition of the night, darkness, location, just not sure. >> so, police are awaiting autopsy results to determine how ramos was killed. skyeye over the fire at a quincy plant. it's finally out after burning more than 24 hours. workers brought in a crane to remove concrete slabs so they could get better access to the fire. five workers were hurt when the explosion and fire started yesterday afternoon. investigators say there is no threat to the environment and despite the fire, the sewage plant is functioning. one year ago the winter we will never forget got started. the first blizzards of 2015. the storm delivered damage to the coast then the mountains of snow that followed and would not disappear for months.

what a difference a year makes. >> in the weather office, the top half of our ten foot ruler measuring snow. we almost went to the 10-foot mark. 110 inches. almost 120. 20.6 in boston. billing area of -- big area of 2 to 3 feet of snow. in boston, it was the sixth biggest snowstorm and immediately followed a short while later by the 7th largest snowstorm in the history of boston. quite a stretch. nothing of the sort tonight. temperatures in the 40s. we will be above freezing region wide. a lot of clouds. a couple of showers heading to tomorrow morning. focusing on the cape, islands and the south coast. by tomorrow morning, worcester is one of the only areas at the freezing mark. many towns around 40 with increasing sun.

a few more of those in the forecast, too. we will take a look at the weekend and beyond coming up. >> thank you. just in to the wbz newsroom, a judge is ordering sealed documents from the boston marathon bombing case to be unsealed. the prosecution and defense jointly agreed that the documents used in the dzhokhar tsarnaev case can be unsealed. the court cannot say when it will happen or what will be released yet. someone set fire to a sign supporting donald trump's campaign in hull. the burnt sign near 36 was discovered before midnight last night. police say that they are investigating. turning to the campaign now, most of the candidates are focused on iowa this week but not republican john kasich. he is focusing on new hampshire hoping a surprise there will invigor rat his campaign. he picked up the endorsement of the "boston globe" and concord monitor.

hillary clinton is sending a new campaign surrogate to new hampshire, ted danson. he will stump for her on friday. staples is reportedly cutting hundreds of jobs. the company is not confirming the news but a source tells the boston news that hundreds are being let go. staples has been trying to merge with office depot. the government is blocking the deal over monopoly concerns. the best on time numbers of the year for the commuter rail in december. key ola says between july and december the number of trains was 25%. two men badly injured in a small plane crash in june are thanking those that rescued them. >> the pilot and his passenger crashed into the woods near the hampton new hampshire airfield

they were rushed to portsmouth regional trauma center. >> someone they just met come through the door an hour before. they didn't know who i was, what happened, what i was about. my list of injuries ended up being more than facial injuries reported at the time i was in the hospital. >> he broke 18 bones in the crash, suffered burns. both men say they will fly again. coming up, a wrestler with a perfect record is winning a lot of fans with his first loss. >> the opponent that he decided record. >> the grades are in for the first statewide evacuation of our educators.

talking about the weather, you were mentioning a year ago we were beginning the huge digout. no idea what was in front of us. >> on cloud 9. i saw tulips outside, a couple of stands in boston. this aura of late march. today's record high is 72 set in 1950s. it can get warm even in the depths of winter. january is running above average by a couple of degrees. el nino winter forecast is for above average temperatures and that is what we are seeing. 46 in the city. worcester 41. a lot of melting snow across the region, not just here but in new york. down to d.c., 50 degrees this afternoon. cold irrelevant and drier air to the west. that starts making in roads by tomorrow morning.

gusting about 30 miles per hour at times. that will keep temperatures from dropping off that much tonight. on a front starting to move in, separation between our milder air and colder drier air behind it, a few rain showers in the new york city area and along long island sound and we will see some as we head into the overnight continuing into tomorrow morning. in particular, the south coast, cape and island, best chance of seeing raindrops. temperatures above freezing. not expecting icy areas. hour-by-hour forecast, a few massachusetts. a lot of clouds into tomorrow morning. the chance for a few more rain showers to develop. slowly tomorrow from west to east we work in more sunshine. the brightest skies for the boston area west eventually bringing the sundown to the cape and islands. you will notice a change in the air from the mild to spring- like stuff to a drier more wintry air mass by the evening.

temperatures won't move much. upper 20s to 30s for the entire day. tomorrow night we will see teens. anything that melts tomorrow will freeze up. high near 43 in boston and rockport. central massachusetts 30s. same stories for southwestern new hampshire. thursday a chance to melt away more snow, low 40s. friday we are watching an on shown storm. the main part is out to see -- ocean storm. the main part is out to sea but there is another disturbance crossing new england so still a chance for areas of snow to break out, snow showers. i don't think it's a big storm but something to keep tabs on the next couple of days. weekend preview, a couple snow showers and flurries saturday. not accumulating snowfall. well up to the 40s sunday. the colder pattern in place

it sure has been a pleasure. bruins take on the anaheim star break. they have won five of the last six and they are four points back of the panthers for first place in the atlantic division. they kept it going. the flyers tied it. bruins take it 3-2. great to see the win. >> nice that we are learning how to win even if we do let a team back in the game and, you know, we have to be a little better when we get a lead we have to maintain it. before we would have crumbled and teams would have come back and won those games.

eye on education. high marks for our state's teachers. the department of education released teacher evaluations for last year, the first year all school systems were using the same evaluation system. the vast majority of teachers with professional status or tenure were rated as exemplary or efficient. nearly 90% were exemplary or
