live from the channel 4 studios in boston this is wbz news at noon. >> we begin with breaking news this noon. state highest court has just ruled aaron hernandez has to turn over his cell phone as part of the investigation into a double murder in boston south end. prosecution took the argument over the former patriots judicial court after a lower court ruled he didn't need to hand over the cell phone to police. >> today the sjc says that's not the case. prosecutors say that cell phone was used by hernandez to make calls and text following a 2012 murders. and in today's ruling a court said the search warrant can be issued for the cell phone which would take it away from hernandez' lawyers. ruling reads in part "the continued retention of this device can only be understood as having the effect of

namely the commonwealth. the suffolk county district attorney says today's ruling is grounded in the law and common sense and the office is preparing a search warrant to obtain hernandez' cell phone. earlier the court ruled he will go on trial for that double murder in february. breaking news in the u.s. olympics swimming scandal. ryan lochte apologizing for his behavior saying he wishes he was more careful and candid when he claimed he was at gunpoint. two swimmers with him that night arrived in the u.s. after they were detained and questioned by brazilian authorities. one of those swimmers paid nearly $11,000 to leave brazil. >> reporter: ryan lochte says he learned valuable lessons from the incident at a rio gas station. in a statement on instagram he says, i want to apologize for my behavior last weekend. for not being more careful and

to be out late and a foreign country with a language barrier and have a stranger point a gun at you and demand money. several security cameras captured what happened early sunday morning. lochte and his teammates disappeared down the walkway leading to the bath rooms and they are behind a wall and pulling down what appears to be a poster when they attempted to leave, security guards blocked their taxi.police say the swimers were drunk -- vandaized the bathroom and left 50? 50? dollars. >> stupid is the op at this time word. >> reporter: the subsequent actions made things worse. >> you pay the damages and you apologize for being an ugly american and let them know when you did and everybody moves on. >> reporter: he claimed they he were returning from a night of partying robbed at gunpoint. >> put it to my forehead and said get down and i pulled my hands up like said like whatever.

i can tell you both toddlers left the home and were taken to the hospital with a tragic outcome for one of them. 15-month-old noah john was in the care of baby-sitter when emergency crews received a 911 call. little noah's twin sister was here as well and she was also hurt. she remains at boston children's hospital this noon. her condition is unknown. wbz has learned noah was on life support before passing traumatic injuries. parents of the twins are understandably upset through a note on their door they have asked for privacy. taking yet another live look at the kilby street home where theincident happened it's unclear this noon exactly what happened to the twins how they sustained the injuries and perhaps who is responsible. the department of children and families is investigating and the district attorney's office

active and open investigation. live in woburn nicole jacobs wbz news. >> thank you. also out of woburn police are searching for suspect wanted in a stabbing outside a sports bar. >> the 31-year-old victim was rushed to the hospital with serious injuries this morning. anna meiler is live with the latest for us. anna. >> reporter: chris the district torn's office says that 31-year- old man is -- attorney's office says the 31-year-old man is in critical condition after he was stabbed outside jake and joe's sports investigators are reviewing video from security cameras hoping it leads them to the suspect. just as jake and joe's is closing for the night the popular sports bar turned into crime scene. sources say a 31-year-old man from woburn was stabbed in the neck and the suspect took off on a motorcycle. >> pretty crazy actually. very crazy. >> reporter: dan went to the bar to watch the patriots game but never made it inside. >> it was crowded and i went back to the hotel and ate

bed but it could have been different i guess. >> reporter: now he is glad he turned around because at one in the morning, police rushed to the restaurant where they found a man with stab wounds and a large pool of blood on the ground. victim was rushed to the hospital where he is in critical condition. investigators blocked off part of the parking lot with crime tape and spent several hours collecting evidence. the director of operations says he is shaken up. >> distraught. you know i be with this company for 20 years and we have never had anything like this happen. >> reporter: crews spent the morning cleaning up the gruesome crime scene toe shah -- so that jake and joe's can open for business. employees hopes something like this never happens again. >> we value our patrons and staff' safety. we will continue to totally cooperate with the authorities and anybody else and our thoughts are with the victim

apprehended soon. >> reporter: after the stabbing local police departments were told to be on the look out for a green motorcycle. wakefield police say one of the officers to theed -- spotted a motorcycle matching the description on route 128 northbound when the officer tried to pull the motorcycle over, the driver took off at an estimated -- estimated 100 miles per hour. if you have information call police. reporting live, anna meiler, wbz news. now back to you. >> thank you. this noon a new jersey bus driver is dead af collide in the middle of the morning rush hour. authorities say one bus with no passengers t boned another filled with about 2 dozen people. you can see one bus nearly split in half. about 20 people had to be taken to the hospital and several are in critical condition. no word on the exact cause of the crash. but a preliminary investigation shows one of the buses may have run a red light. breaking news on campaign 2016 donald trump campaign

bermuda. it's way out here it's likely to not develop at all. it's going to remain weak and unfavorable area for anything developing there. it's not in a good environment. but down here there's a way which -- wave which we will watch to see what that does because that may move westward and become more -- get in an environment favorable for development there. meantime, yesterday, boston had the 18th day this summer this year that the temperature reache last winter i forecasted and thought it would be a hot summer forecasting 22 days and we got 4 more to go and may have a couple coming up later next week when we get to the 7- day. but no 90 degrees today that's for sure in boston and holding in the upper 70s to near 80 much of the afternoon with the onshore breeze not a strong one but enough a keep temperatures down. so sunny poo partly cloudy skies -- to partly cloudy skies. 78 in boston and there are 80s inland and it will go to the mid and upper 80s this afternoon.
