. and we begin good breaking news. a deadly crash on 495ment a van filled with passengers flips over in the middle of the highway. good afternoon, everyone. >> we're told some of the passengers were thrown from van when it crashed in merrimac this morning. nick vee owe van any is live with the very latest. nick. >> reporter: if you take a look behind me, you can see all northbound lanes on 495 have reopened. but i can tell you it took emergency crews some two and a half hours to sort through and clear off all the debris that was scattered across 495 just at the start of a morning rush this morning. a van overturned as you mentioned with six people inside at the time.

you see the aftermath, ladders, tools of all sorts. we're talking drills, shingle-removers. all sent fliers. one person was confirmed dead, the other five seriously injured as they were all rushed to the hospital. massachusetts state police telling us seat belts were a factor. they don't know if any of the passengers wither wearing a seat belt but they do know that some were, in fact, not. now this -- they were learning al of the investigation and clean-up as only breakdown lanes were open. that is no longer the case as we showed you just a minute ago. i can tell you the investigation continues into the cause of this crash. we are continuing to follow this as soon as we have anymore update we will pass them along. >> nick, thanks. we've got some new information today on that deadly crash pay tee saturday shop in newton. six months after two people were

charges. crease tina hager is live in wakefield now where the middlesex district attorney has just spoken about the indictment. christina. >> reporter: marion ryan is here on an unrelated event. she did stop and talk to us on the way in about the indictment and why it took so long. >> these are complicated situations. we do a full and fair investigation. and in -- these situations it takes we are also often dependent on information from other agencies. and awaiting that and then presenting that information to the grand jury. >> reporter: district attorney marian ryan leafing questions opened after the announcement newton driver bradford casler has been indicted after he allegedly slammed into the sweet tomatoes restaurant during the dinner rush six months ago. the crash left seven people

killed. 32-year-old gregory morin from newton and 57-year-old eleanor miele from watertown. her mother had been waiting for the driver to be held accountable. >> i just think that it should be brought to, you know, justice. whatever he gets, he gets. it was tough. and it still is tough, i'll tell you. i still -- every day, when the phone rings, i think it's her calling me. >> reporter: casler faces two counts of motor vehicle homicide and one count of driving to struggled with health issues, the district attorney would not address that. >> the importance now is focus on the integrity of the prosecution. so the case will play itself out as we go through court and making information available to the court as we proceed through that process. >> reporter: the d.a. indicating we may learn more when casler faces a judge in court and she expects that may happen within the next couple of weeks.

hanging over boston has finally starred to lift. the city was socked in all morning long. now the sun definitely out. let's check in with daniel and find out how long that continues. >> it's going to be breaks of sunshine through the rest of the day. visibility is just fine now in boston. believe it or not still some patchy areas of fog in cape cod. quarter mile visibility in nantucket as the storm's passing 76 in boston right now. 72 in wooster. low 80s in province -- providence. mid-70s for most of us right now. some upper 60s where the fog and clouds are hanging. the dew point is up there. so it's soupy. you feel it when you step outside. that humidity is going to be staying with us today. there's that counterclockwise spin. there's hermine getting its lack kick out of.

we is -- we may see an isolated shower throughout the day. partly sunny and humid. 80 for the ride home. muggy with a chance of a shower. it will be uncomfortable for sleeping tonight. 70 for an overnight low. look at that. 90 tomorrow. light and breezy. i'll let you necessity -- let you know if the heat sticks around. a kayak has been found safe. coast guard spent hours searching for the nan quincy. that searchas 2:15 this morning when the kayaker's girlfriend called authorities to say he was safe. coast guard officials say he was not wearing a life jacket and lost all of his belongings. six people including three children are being treated for carbon monoxide poisoning. firefighters were called to a apartment complex for a straining smell last night. it was an oil burner. oy fishels discovered extremely high level ofs. y.o.

presidential candidates attended a televised commander-in-chief forum in new york. >> how totally unqualified he is to be president. >> reporter: at the forum, she admitted it was a mistake to have a personal e-mail account as secretary of state. but she defended her handling of top-vet information. >> i commune -- top-secret information. >> i communicated about classified material on a wholly separate system. >> reporter: her comments came the same day house democrats released a 2009 e-mail exchange secretary of state colin powell. in it powell described how he had a personal computer hooked up to a private phone line to avoid going through state department servers. donald trump appeared separately at the tore um -- forum where he said the u.s. military needs new leadership. >> the generals have been reduced to rubble. >> reporter: he went on to phrase russian president. >> in that system he's been a leader for more than our president. >> reporter: president obama hit back during a press conference

follow up and ask questions about what appear to be either couldn't dicktory or uninformed or outright wacky ideas. >> reporter: craig boswell cbs news, the white house inch the fbi is seeking your help looking for a gang member. he's a convicted felon and alleged member of the ms-13 gang. the feds say he's got so-called homeboy status with ms-13. meaning he's likely killed before. the 34-year-old native of el salvador was last seen two months ago in everett. he's one of several dozen gang members indicted on various charges in january. he's got tattoos of the grim reaper and a skeleton on his right arm. there is a $20,000 reward. six commuter rail employees have been fired, some others might be for attendance in timecard issues. keolis, the company's subcontracted to run the rail, says an internal audit found

keolis tells wbz that the employees broke rules and violated the trust of taxpayers. well there's now a $2,000 reward posted for a tip that nails a lobster thief. not just any lobster. the sculpture that was swiped. neighbors have been chipping in with -- with the hope it will lead to the return of the lobster. it vanished on saturday. it's all part of an art display sponsored by the chamber of commerce. when their alarms went offth students knew summer had come to an end. nicole jacobs explains, school officials are still dealing with some problems left over from last year. >> back back to school. >> reporter: a hardy welcome at that. 200,000 boston public school students getting back to the routine. >> i felt the alarm clock and i wanted to go back to sleep. >> reporter: of hitting the books and the classroom. >> i was just like i'm not ready for this.

. a big clean-up effort today in delaware after a highway winds up covered in pennies. >> a tractor-trailer crashed on i-95 overnight spilling blank copper pen yiz all over the road. blank meaning no images or words are stamped on to them yet. the truck split over and burst into flames but the driver was able to escape with only minor injuries. just a few minutes ago, swimmer ryan lochte said he won't challenge the suspension for his phony story about being robbed during the olympics. the international olympic committee handed down that sentence last night. lochte had initially claimed he was robbed by gun-toting thugs, but security gam ras -- cameras revealed he was stopped by armed

officially opened. it's called warrior ice arena. and it's located at boston landing along the mass pike there. bruins management and players will be there tonight along with the governor and mayor. after the opening ceremony, the first official game will take place on the ice. some youth all-stars with you face off against the alumni. bruins fans can score tickets today. individual home game tickets for the joup coming -- upcoming season are now on sales. they will open new jersey devils on october 20th. well, katherine witser made history today as the first woman to officially run the boston marathon in 2017. she will be back on the course. she has been part of the wbz player thon coverage for years. but next year, she will trade in the microphone for sneaker and mark the 50th anniversary of historic run. she is now officially registered for the race. back in 1967 the marathon was

late in the day. high tide coming around midday tomorrow. temperatures are still 9060s to 70s in the costal waters. in the meantime today, not quite as hot. 76 but the dew point is up there. 69 right now. it's a tropical sticky air mass. wind out of the east right now. it's variable. temperatures kind of a wide range depending on where you are. it's 80 in burlington, vermont. 81 in providence. most of us are running in the 70s it does feel warmer because is so humid out there. we've had some low clouds and patchy fog lingering on the cape. seeing a little bit of green up here. a few patchy areas of light drizzle. the remains still counterclockwise there, about to kick out of it thanks to an approaching cold front. that will bring the chance of a thunderstorm overnight. it's not going to be all that widespread. i think it will be isolated but

it's going to be pretty uncomfortable for sleeping too. humid with temperatures right around 70 degrees. so the rest of the afternoon, again isolated shower and patchy fog on the cape. mainly dry the rest of the day. see how it fizzles as it comes over us. western new england may get a few thunderstorms on the stronger side that come in overnight. i wish i could say they would be stronger the father east you go. but it looks like they kind of lose a little bit of steam. by tomorrow morning, long gone. it's a blend of sun and clouds. tomorrow. another day at the bus stop for the kids. it's going to be mid-70s. recess time we jump into the 80s and then we'll be near 90 with sunshine for the ride home for the kids at school tomorrow. speaking -- speaking of which we'll all be near 90 degrees. we have that wind shifting around so even at the coastline we push 90. boston hits 90, it's not going to hit the record. that will be 93 degrees set back actually last year.

tomorrow. 90 in plymouth. hot in taunton, 92 degrees. probably around 80 on nantucket. there may be a few lingering clouds along the south coast tomorrow. saturday we start with a weak area of high pressure. but there's going to be some clouds around in the morning. i do think those part for breaks of sunshine will keep the risk of a pop-up shower or thunderstorm but this may be a little bit overdone. i think that risk comes in saturday evening and overnight and then lingers into the f part of sunday. sunday early in the morning. couple different things to watch in the tropics. two waves. they're favor disorganized right now. low chance of developing into tropical depressions over the next several days. so just something to watch with those kind of clusters of thunderstorms way out off the african coastline. we're not going to be as hot for the weekend. we'll be in 80s for both saturday and sunday. coastline will be in the 70s on saturday afternoon. and then really just a beautiful
