police got a tip that 23-year- old irving fenner may have been inside. officers used tear gas before going in but say he was not there. he is accused of shooting officer tim brakine in the chest on saturday he was look for fenner after he missed a court date on a outstanding weaponscharge. >> we treat every case the same but when a police officer is slain it shaoitens up the threat -- heightens up the threat level e has taken one officer continue to and who knows if he wants again. >> the officer was 12 year veteran of the force and leaves behind a wife and daughter and four others are under arrest inconnection with the case including his half sift here was take en. >> custody in rhode island yesterday. jury selection will begin in the death penalty row trial for gary sampson. sampson pleaded guilty to carjacking and killing two massachusetts men during a week long crime spree back in 2001a jury gave him the death penalty in 2003 but that was overturned
