and good evening everyone, i'm ken macleod. we are following several breaking news stories tonight. first, police video of the controversial officer-involved shooting of a black man in north carolina is now public. the man was killed and that has protestors taking to the streets again tonight. this is video just coming into us from charlotte. people upset with police demonstrating here, even as the f was justified. let's go to wbz's chantee lans now live fors in the satellite center. >> reporter: again, charlotte's police chief decided to release the video after state officials says it would not impact their investigation. keith lamont scott refused to drop a gun. we want to warn you that you might find this video disturbing. five days after the shooting

dashcam and body camera video revealing the final moments of scott's life. >> in the spirit of transparency, you are going to get everything that we can deliver. facts, footage, and an explanation of where we stand. >> reporter: chief put knee says officers were attempting to arrest someone else when they saw scott with marijuana and a gun. the department provided pictures of both saying the gun was found on scott. >> yes. based on the totality of what possession of a handgun. >> reporter: a handgun, never clearly seen in either of the two videos released saturday. the chief says the video doesn't show scott pointing a gun and an officer shot scott after police say he didn't drop the weapon. the chief says his officers acted appropriately. >> don't shoot him. don't shoot him. he has no weapon. >> reporter: but scott's wife who recorded her own video on her cell phone said her husband was not armed and posed no threat to them.

have demonstrated since tuesday demanding to see the video for themselves. >> unfortunately, we are left with far more questions than we have answers. >> reporter: the scott family says they still don't understand how and what specific actions led to his death. >> we shouldn't have to humanize him in order for him to be treated fairly. what we know and what you should know about him is that he was an american citizen who deserved better. charlotte remains under a state of emergency and a city wide curfew takes effect at midnight. live in the satellite center, chantee lans, wbz news. also breaking news tonight a suspect is now in custody accused of killing five people in a mall in washington state. investigators say this rifle toting man opened fire friday night inside the cascade mall in burlington, washington. that's about 60 miles north of seattle.

the shooting happened at the macy's makeup counter. four women and a man died. the victims range in age from a teenager to senior citizens. police say the shooter acted alone but motive has not yet been discussed. breaking news tonight in maryland as well. baltimore police are saying there's been a shooting and eight people are wounded including a 3-year-old. the investigators say shooting happened in eastern part of the city. officers are on the scene right now. three ampled suspects are -- there we are told and more when we get it. in oklahoma, a funeral tonight for a man shot and killed by police in tulsa. officer betty shelby is charged in the death of terence crutcher. her lawyer says she thought crutcher was armed but police say he was not. shelby is free after posting $50,000 bond. we will follow all the breaking news stories throughout the night and bring you the latest

the forecast now. this is the first weekend of fall and mother nature is behaving accordingly. actually that frost advisory for some spots tonight. pamela gardner has a first peek at the forecast. >> cooler temperatures are settling in here and running in the 50s or 40s for now. 57-degrees in boston and 42 in keene and down to 50 degrees in worcester. and 41 is degrees for our friends in taunton it's a beautiful starry night and getting some rereports from some folks and it's just a gorgeous fall night for much colder compared to this time yesterday. and almost all spots except for here in boston this actually tying where we were at this point yesterday. but 20 degrees colder in taunton and 12 degrees colder in chatham. you'll want a heavy coat heading out the door perhaps tomorrow morning or at least something. low temperatures will be in the 40s and with some areas in the mid- to upper 30s. and that's where we have a frost advisory. national weather service has it out for central and northern parts of worcester county but

the young jogger found brutally murdered here seven weeks ago. her body discovered in the woods. >> i think in the beginning, it was a shock. everybody was locking up and closing down. and then we became a town again. and i think we've relaxed a little bit. we're just a lit -- doing it a little bit more cautiously but we're not going to let it beat us. >> reporter remain. it's been more than a month and a half now. >> people trying to stay together. there are many people who are runners and they want to run together now rather than singly and we're hoping for the sake of the family that this case will be solved. >> i have spoken with some people who you know, very saddened by what happened obviously. and very confused as to how this could happen in a small

with. he tweeted this. if dopey mark cuban wants to sit in the front row, perhaps i will put gennifer flowers right alongside of him. cuban the billionaire business tycoon has been a vocal critic of trump and has been offered a front row seat at the debate by the clinton campaign. and speaking of trump. the local rally for the republican nominee caused quite a stir today. wbz's paul burton reports the demonstration didn't break any plenty of neighbors. >> reporter: on saturday morning, residents rallied behind homeowner rick early. who has put up more donald trump signs than the city allows but early along with many friends are standing ground. >> just to show of short. a lot of -- support. lot of people want to support what we're doing and i don't think the city is doing the right thing. >> his first amendment rights to support whatever candidate he wanted to. >> reporter: the city has the law prohibiting political signs that total more than 3 the

300 square feet. >> weigh in excess of what's allowed. and that's all he's been cited for. is that he's over the signage allowed by the city ordinance. >> reporter: police say mr. early definitely has a tight assemble in front of his home here and though many of the supporters here are not necessarily here for donald trump but here to support the first amendment rights, however there are some neighbors who aren't very happy about this rally. >> i'm upset at the disturbance in the neighborhood. since 8:00 a.m. this morning. >> we're neighbors and we don't approve. however, we have been polite and not rocked the boat. >> i'm not decided yet. but it's been getting pushed around for exceeding the square foot limit. i don't see where this isn't anything but for his free speech. >> reporter: early put up the signs back in january. and he hasn't encountered any problems. saturday he experienced both support and disdain.

a contractor had to be rescued today. the worker was digging a trench to bury a water line near carroll road just after 10:30 this morning when the small backhoe overturned. trapping him inside. now because it happened right over the trench he'd just dug as you can see, firefighters summoned the technical rescue team and it took nearly three hours to free the man. the injured worker was taken to

released. many big names helped open a new museum at the smithsonian today. as the world's largest collection of african-american history and culture. cbs reporter marlie hall was among those on hand for that dedication. [ bell dinging ] >> reporter: with the ringing of the 130-year-old freedom bell, president obama officially dedicated the national museum of african- american history and culture before a crowd of thousands on the national mall. >> it to understand where we've been. >> reporter: dignitaries and celebrities including oprah winfrey and will smith helped celebrate the historic occasion. with poetry, speeches and musical performances. ? i'm coming, but i know change is going to come ? >> reporter: black civil war veterans conceived of the idea more than a century ago.

bush signed legislation authorizing the construction of the museum in 2003. >> this museum tells the truth that a country founded on the promise of liberty held millions in chains. that the price of our union was america's original sin. >> reporter: the 400,000 square foot museum showcases four centuries of black history. with nearly 3,000 artifacts on display. museum visitors are encouraged to start wi exhibit then move chronologically through displays on freedom, segregation, civil rights, then lastly the achievements of black icons. every story is told through an african-american perspective. >> african-american history is not somehow separate from our larger american story. it's not the underside of the american story. it is central to the american story. >> reporter: a story with a chapter that was never fully

marlie hall, cbs news, washington. we have heard nothing but great things about that place, i'd love to see it. i bet it's fascinating. all right, let's move on to the forecast now. fall definitely showed up today and does it stick around for the week? that's what we want to know. >> it does actually. we'll have beautiful temperatures all week long and we'll get a little bit of a warm-up by midweek. but still not warm enough i don't think so to turn on the air conditioner. >> you don't think so? >> i don't think so. >> windows open? >> how about that. windows open especially the next couple of nights. >> you can >> yes but also probably want an extra blanket because by tomorrow morning some temperatures will be in the 30s and a little bit of a shock to the system for some but wbz weather watchersed or ago beautiful day -- watchers reporting a beautiful day today with high temperatures in the 6 o oz.. 68 degrees -- 60s. 68 degrees north weymouth according to craig. and john in nashua reported 66 degrees. we also had 67 degrees for that official high at logan airport here in boston and 66 from

gorgeous weather. gorgeous temperatures again in store for you tomorrow. feeling very similar to what we experienced today. currently in boston down to 57. the dew point very low at 37 degrees and indicating that the dry air definitely in place. the wind from the west now at 8 miles per hour and that light light breeze sticks around overnight tonight. current temps elsewhere 50 degrees in worcester down to 42 in keene and already 41 degrees there in springfield. some oh cool temperatures will funnel in thanks to radiational cooling as that wind subsides just a little bit and as we have a clearer starry sky out there, we lose all that daytime heat that we accumulated plus with the dew points very low in the mid- to upper 30s for some, those low temperatures can really have the potential to get downright chilly. and frosty for some especially as you get farther to the north and to the west, but we aren't tracking any record lows for the next couple of mornings here. sunday and monday, here are those record lows so far.

from hartford to boston and worcester and providence, in the 30s but 28-degree morning low for the record on monday morning and worcester, not even close to that. so it will be chilly but frost advisory in effect 2:00 a.m. to 8:00 a.m. sunday. as we get into the northern half of worcester county and towards the northern western parts of the state. that's where temperatures could dip into the mid 30s. bring the plants inside if you haven't already and if you can cover them too. any sensitive vegetation may be having a garden outside cor those too. all right local events heading off your sunday. r5 5 degrees for the balk to end alzheimer's in cambridge and also in foxboro and in worcester and temperatures will be nice and cool. tomorrow's highs in the of os and gorgeous weather and still a northwest gusty wind. maybe going out west, well sunday 64 degrees crisp and school and here's high pressure in control as we go through sunday hour by hour. our next system doesn't move in
