stable condition. police say it was a domestic violence call from this home here on gladstone street. an apparent argument over a stat. but the domestic violence corlopam a deadly call as -- violence call became a deadly call as police were met with gunfire. as officers were still waiting to search the home on gladstone street, it became clear how ferocious the fire fight was. for officer richard cintolo, a 27-year-old veteran and matthew >> i've got to commend the officers for rushing into that building with no fear whatsoever to rescue two fellow officers. >> we've got shots fired. i need every officers to make their way 146 gladstone street, please. >> reporter: the two officers stepped into the home answering a domestic violence call when they were met with a hail of gunfire from a suspect wearing a ballistic vest and armed with an assault rifle. >> pop, pop, pop, pop, pop, it

>> reporter: that's what neighbors heard when they saw the commotion unfold and a swarm of officers arriving on the scene. officer cintolo was shot twice, officer morris struck in the leg severing a critical artery and getting immediate first aid from fellow officers who dragged them out to safety while returning gunfire likely saving their lives. shot and killed was 33-year-old kirk figueroa. a boston constable who also runs a private security firm. his vehicle was towed from the scene. and when someone is going to use deadly force we're going to respond appropriately. >> one of the best places around, you know, that's why i'm really shocked that this happened. >> reporter: police say figueroa wasn't licensed to carry the weapon and they don't believe they were set up for an ambush. it is unclear how it all escalated. after meeting in the hospital with the wounded men, commissioner evans says officer morris told him this. >> i want to thank this particular officer. he saved my life.

>> reporter: crews remain outside the home here on gladstone street. police say domestic violence calls are often the most unpredictable. nine other officers have been treated and released for minor injuries and stress after police say they ran in to take on the gunman. reporting live from east boston i'm beth germano wbz news. >> word spread quickly in the overnight hours. the two veteran officers were fighting for their lives. >> both rushed to mass general hospital where they un to show their support. mayor marty walsh tweeted, "please pray for the boston police officers injured last night in east boston." and watertown police tweeted out, "we're praying for a quick recovery for the boston police officers. their thoughts are with the families and bpd." officer donahue was seriously wounded in the shootout with the boston marathon bombers tweeted his support for the officers today saying, "hoping

our live team coverage continues now with bill shields who is at mass general hospital. bill? >> reporter: excuse my voice, i lost my voice a little bit. but who cares at this point because i have some good news to report. both officers now have been upgraded slightly to stable condition. still critical, but now stable. a little while ago we spoke with a friend of both officers and also nick donahue at logan on his >> it's some guys you want to know. matt, same thing, just a very, very easy, quiet type of guy. they didn't deserve that, that's for sure. >> ryan knows both officers. apparently the bullet suffered the artery of morris' leg. richard cintolo, 27 years, a boston cop. he was shot in the throat and shoulder. both officers lost a lot of

both, you know. >> this is an instant shock. your thoughts, your prayers, your hopes, you're praying for everything to go well after the fact. >> reporter: nick donahue nearly lost all his blood when he was shot in the leg during the watertown shootout. >> it definitely rings true, but from what i hear up to this point that it looks like some of the things that changes, the training, the tools that went to and after my shooting hopefully helped to save the officers lives. >> reporter: a lot of police officers nowadays are getting training on wounds like this for tourniquets, how to use a tourniquet, how to apply a tourniquet properly. apparently in this case one of those tourniquets was applied to officer morris. again, very good news. both officers are now in stable, but still critical condition.

thank you. nine other officers who were there on the scene of the shooting were taken to the hospital. >> tonight, we spoke with the the former boston police commissioner ed davis about the effects on other officers. >> the reactions that occur when you're in a middle of a fire fight that is well documented in the military and among police officers. so i think out of an abundance of caution we send as many people as we can to the hospital so their blood pressure checked and they get to the point where they come down off this adrenaline. >> tonight we're learning more about 32-year-old kirk figueroa who was wearing body armor, was armed with a tactical rifle when he started firing at the officers. today police commissioner william evans called him a very dangerous individual. we want to get to jim smith who is live on where this took

neighborhood are absolutely stunned. they said kirk figueroa really hadn't been living here for very long and nobody seemed to see this coming. >> when i saw his picture, i recognized him. >> reporter: neighbors know figueroa by sight. a marked car that looked more like a police cruiser, his vehicle. the phrase justice has been done on the front panel. >> it was just an old car with bail run on the back or along the side. i'm not sure exactly you strange? >> yes, because we didn't know what it meant. >> reporter: according to his bio on the website of the security company he said he founded the company. he was an eight-year veteran who spent eight years in the military. he called himself a bounty hunter. figueroa was also a constable in the city of boston with some police power. >> he is new to the neighborhood. when i walk the dogs i see that

tops. >> reporter: no trouble before? >> no, quiet. >> reporter: but what would have lead him to -- led him to put full body armor on? neighbors say it was an argument with a fellow tenant over heat. >> when my husband happened to run into him in dunkin' donuts who lives in the house is when she said that it started over the heat. it was too hot, turn it down, then that's how it happened. >> reporter: an argument over heat? >> yeah. >> reporter: and tonight neighbors tell me seemed pleasant enough, but some online postings reveal a much more angry side. more on that coming up at 6:00. live in east boston jim smith wbz new had -- wbz news. his past is raising questions about how he recently became a constable in the city of boston. the eye team ryan kath is here with some of the details you discovered from out of state court records, ryan? >> reporter: david, figueroa

a boston constable, which means he's responsible for serving papers in civil cases, like lawsuits and evictions. a background check is required, but tonight it appears that search did not turn up some red flags. a divorce case filed last year in georgia talks about a history of domestic violence. and in the complaint figueroa's ex-wife wrote, "he gave back black eyes, choked me, pulled out my hair, verbally abused me." the eye indictment when he faced felonies for arson along with impersonating a private detective without a license. despite those requirements for having a clean criminal background, figueroa still received his constable license. >> when we do a background check on someone like that, we are not allowed to check the fbi data base. it is a general check only limited to such. if we were applying for a license to carry, we would do that type of check, nationwide

some breaking news right now at 5:00, an outbreak that could be devastating to the shellfish industry on cape cod. the oyster beds in wellfleet have been shut down. the shellfish has been recalled because of a norovirus outbreak. public health officials say that 75 people have reported norovirus symptoms in just the past two days. most of them just after eating shellfish at weddings and restaurants in the outer cape cod area. this is particularly bad news that was suppose to take place in wellfleet this weekend. of course it is very popular. and also breaking tonight, former state speaker of the house salvatore dimasi could get out of prison soon. he should be released after serving a little more than half of his sentence. dimasi is battling tongue and prostate cancer. he was convicted of contracts in exchange for kickbacks. a judge though must approve this recommendation. on the campaign trail

some of the aftermath shows the floodwaters are left behind. 26,000 people without power. but overall bermuda faired pretty well thanks to the island's sturdy structures, which eric i know you've been talking about how well prepared they are for hurricanes. >> we could take some cues from them no question. they are built for these big storms. there is damage and i'm curious to see what we're going to hear about that bridge that connects the airport to much of the rest of the island if you have been to bermuda. that was damaged during fabian. >> the video looked pretty good. it looks pretty good. >> it's a resilience place, it has to be. big storms roll through there. take a look at the satellite picture when you roll the storm. the eye goes directly over the island, the whole a cappella of bermuda, which is earlier this morning and they topped 120 miles per hour there. you think about that storm and that we would come up into new england that you would have incredible devastation. bermuda is a hit for sure, the 26,000 homes are almost the

worse. now it's going to race off to the north and the east and weaken as they head out into the cooler waters. we'll have interest to the ships out to sea, which will be the main impact going forward. here at home tonight with a few sprinkles, light showers moving across the area. not a whole lot of rain falling from the clouds that will move in -- that will be moving in. a quick rain shower will move through this evening. by the overnight we're going to clear out with the winds turning to the north and the west turning much colder. now most towns degrees today. new bedford is sitting at 65. but tonight we're going to fall back through the 40s, even a couple of upper 30s north and west of the city. and as that wind will go northwesterly at 10 to 20 it will be a lot colder during the overnight hours, especially as we head towards tomorrow morning. expect the chill in the air with the breeze and the bright skies. but the temps will be in the 40s with a very brisk autumn day tomorrow as we will have those cobalt blue skies and the puffy cumulus clouds and those temperatures in the 50s to

and the strongest gust, they would be near the coastline, especially cape cod and the islands for tomorrow as we would get those winds coming right off the bay. and so looking at the high temperatures tomorrow heading down towards the south coast. the cooler day by far and with that wind it'll be chillier. this will set up the stage for a cold night tomorrow night as they have put out a freeze watch already for tomorrow night. this is for areas that have not had a killing frost yet that it will be the first widespread killing freeze across the region that we have seen this season. and they will not see those cold temps inside boston and towards cape cod in the islands, we will avoid it. take a look at this weekend it will be in control. and on sunday their winds will turn a little more southwesterly and increasing cloud cover, but a real nice day. nothing, but son on friday. that they could top 70 degrees

breeze. a real pleasant day and great for the patriots, the temps in the upper 60s at kickoff with no issue through the game with the drive home and that they have been showing these pictures over the last week to just look at that from crawford notch. that it is just stellar out there right now. even here across southern new england, sending in the nice colors and towns. a great weekend to go and check it out with their cold temps and plus the fact that we're getting mid-october with a lot of the areas in northern new england that will be up after this weekend. head out and en northern worcester counties would have excellent color too. here is your accuweather seven- day forecast next week with the 70s on monday and a couple rain showers too. maybe a chance for 80 on wednesday. if everything comes together. >> wow, that would be something. all right, eric, thank you. some good news out of north carolina where the governor says power is being restored to parts of the state. and it seems people are heaving the warnings about the floodwaters because there have been fortunately no additional deaths. still waters are rising in the
