he says election day went smoothly even though there were long lines at the polls yesterday with people waiting hours to cast ballots, no pushing, shoving, no yelling. this has been a contentious race. hillary clinton won the state of massachusetts, but donald trump will be america's 45th president. he says his department is prepared for any protests that may follow these number of officers that are going to hang in tonight until the election is decided. we're ready and we don't anticipate anything, but better to be ready than not. >> reporter: trump striking a calm, even tone in his speech early this morning calling for unity, peace, and healing following this divisive election.

counted. as you mentioned roughly 39% of precincts are reporting right now, many considering maggie hassan and kelly ayotte in a tie. kelly ayotte is trying to hold onto her seat, but it has not been an easy run for her. she hit a wall of criticism when it came to her voting record in washington leaving her headquarters feeling confident this morning. >>we're verybe know tonight, we believe, what the outcome is. and i believe strongly in the fact that we want to have every vote in in this race before we come out and really talk to you about a victory here. >> reporter: two-term governor hassan is trying to upset ayotte, but ayotte's incumbent

and an uphill battle for her. >>there are still votes to count in a lot of small towns, and we're confident we're going to maintain our lead when every vote is in [ cheers ] >> reporter: certainly we continue to follow the race closely. all the votes have not been counted. i can tell you republicans do have control of the senate and the house in washington. that's the latest wbz this morning. >>in new hampshire chris sununu has been elected governor there. at the age of 42 he becomes the country's youngest governor. sununu had served three terms on the state's executive council. he succeeds maggie hassan. we want to give you the results of four ballot questions.

question 1. question 2 wasn't close either. voters saying no to the expansion of chatter schools. 26% voting against, just 38% in favor. those opposed to charter schools telling us they're happy with the outcome. >>it's a great victory for the students. it's a victory for education. it's a victory for the possibility of turning schools around rather than abandoning them. >>question 3 has passed. it will make it illegal calves. they must have room to lie down, stand up, extend their limbs and turn around. that passed 78% to 22%. and marijuana getting the nod from voters. 54% said yes to recreational marijuana. 46% said no. voters went against top lawmakers who wanted to keep substance banned. >>i'm troubled by it because there's no test for impairment

there's too many people getting killed now on our highways with the alcohol. >>we're going to have a major problem with citing these and the legislature is going to have to act on some of the rules and we're going to have to act in the city council. >>the initiative put limitations where the dispensaries can be located, the number of dispense tease that can be in a town, 20% of that town's mb getting on board shows this is a trend and the majority of people think it's reasonable and acceptable. >>recreational marijuana isn't legal yet. residents will have to wait until december 15th and pot shops will not open until 2018. 5:10 now coming up more on the election. plus one person shot and killed, details coming in

candidate named barrack obama was named president of the united states over a variety of issues, so in that sense, not to compare the two men directly, it's not necessarily that big of a surprise that this kind of thing could happen. let's face it. each of the two no, ma'am needs, trump and clinton, tried to make this a referendum on the othe of doing so. and hillary clinton's negative ratings were right up there with his at the end. he demonized her more effective than she demonized him and that's what happened in the short term. now we all have to look and i think look at least with some modest hope at the tone of the president-elect's remarks last night. they were sober. we were an attempt to reach out. that was the right

character for him going forward, if he can continue to find that suite snot a divided country. >>what happens next? i mean congressional control in the republican's hands as well. what is next, do you think? >>well, again, it's going to be a test of character. keep in mind when we talk about our divided country, the republican party was dramatically divided here, and so just saying, well, the republicans now control republican in the white house, the door is wide open for all sorts of mischief, not necessarily. don't forget all of the members of the house and one third of the senate are up for election in two years. mid-year elections are historically not kind and they're particularly unkind when the president is not doing well. so there's a lot invested in this new president getting off

reasonably and fairly and governing in a popular way. the question is can he do it. i mean, let's not sugarcoat it. there are a lot of people who think we've just elected the single most unfit person in the history of our country to be president. but he deserves a chance. i think that's what you're going to hear hillary clinton say later this morning, and so he'll get a chance, how much, how long, that's 'nother story. we're not a culture right now with a big attention span and a lot of patience. >>our success depends on his success, whatever you voted for, whatever you think, at this point you have to want him to concede s otherwise, we all fail. >>that makes perfect sense. for us sitting here, i think for some in washington. don't forget a lot of democrats are
