captured. the seven-week manhunt for this accused cop killer in the poconos is over. eric frein is in custody this morning and we're live with what's ahead this morning for one of america's most wanted now caught. breaking in philadelphia, fire destroys apartment injuring several people and forcing many more out into the cold. strike decision. septa is expected to announce today whether or not commuters will need to find a different means of getting to work on monday morning. and we eare off to a colder start this morning on this final day of october, but warmer weather is ahead for halloween night and then the weekend, well, it may offer more tricks than treats. good morning, everyone. this is nbc 10 news today on

this friday, i'm chris cato. bill henley eaand first alert forecast. good morning, bill. >> colder temperatures in the 30s and 40s. that's a clear view from the comcast center in center city. look at the 30s northeast philadelphia at the airports, 38, 39 in wilmington and trenton is down to 36 degrees and in the pocono mountain below freezing in the 20s. 28 degrees there. we will see sunshine at least to start with. 44 degrees at 7:00. nice and clear. sunny and chilly, 45 by 9:00 and by lunchtime clouds will start to move am to the area. when i come back in less than ten minutes and look at the future weather to show you where you might see some raindrops this afternoon. jillian mele is watching us friday morning. happy friday, jill. >> looking at 95, where things are actually pretty quiet right now. very quiet look at 95 at broad

street. no accidents or delays to report there. same situation on 76 at university avenue and i'm fallingo a few sets of construction. southbound between red lion road and rising sun avenue. and just use caution in that area. chris? this major story breaking overnight. the manhunt is now over. after 48 days, seven weeks on the run, eric frein is in custody. later this morning, he will be arraigned on charges that he shot and killed a state trooper, byron dickson and tried to kill another. this is the video as frein was taken to the police barracks the same spot on september 12th he is accused of ambushing those two troopers seven weeks ago. u.s. marshals arrested frein around 6:00 p.m. last night at

birchwood pocono airpark and that's about 30 miles from those barracks where the shooting occurred. here we see the video, again, shot by our jim friedman. troopers taking eric frein out of the patrol car and walking him into the barrack. this is after they surrounded the hangar and after someone saw a man going in and out of the hangar, it turns out it was frein. he surrendered without resisting. after 48 days on the run, he looked healthier than expected. >> eric frein had a mission and that was to attack law enforcement. if he got out of those woods, we were very concerned that he would then kill other law enforcement, and if not them, civilians. that's why we had to keep the pressure on him. >> and they say inside that

hangar he did have a .308 hunting rifle believed to be the weapon that the trooper was killed and also shot. his arraignment scheduled for 9:00 this morning at the pike county courthouse. here's a aerial virtual. the airpark was added in the 1960s and closed in 1998. now, after frein's capture we were on the scene there where police set up this road block, less than a mile from that abandoned hangar. enclear how long frein was held up in that hangar. we went to his parent' home to see if they would comment. >> will you speak via spokesperson? >> no, good-bye. get off the property. >> as you may have heard there, the man who answered the door told us to get off the property. frein was living with his parent

on and off and at one point he tried to call them while he was on the run. of course, all of this means that things can start returning to normal. for the past seven weeks, the people there have had their lives disrupted by this ongoing manhunt. tracy davidson has that part of the story joining us now live from the digital operation center. tracy? >> a huge relief for people living in and around that search area now that eric frein is behind bars. life has been disrupted for so many people and put on hold for a lot of people. schools put on hold and sometimes residents didn't have access to their own streets because of all the police activity. >> wife was at choir rehearsal one night and couldn't get back home because they wouldn't let her back into the neighborhood. >> the township supervisor tells us kids will be able to go out trick or treating tonight it had been previously canceled because of the manhunt.

many are remembering the state trooper that was killed in the attack. he leaves behind a wife and two young sons. dickson used to work in the belmont barracks in philadelphia. last night when officers cuffed him they used dickson's handcuffs, which was fitting. >> fitting to use corporal dickson's handcuffs to place them on frein when we caught him. >> the other trooper involved in the ambush spent more than a month in the hospital with serious injuries. he's still recovering. if you attack troopers and a civilized society, the pennsylvania state police will bring you to justice, adding that corporate byron dickson and alex douglas are true heroes. tracy davidson, nbc 10 news. >> the story of his capture is fascinating. we have details online for you at nbc10.com. we'll continue to have live updates throughout the morning.

we're also following another breaking news story we need to give attention to. this is a two-alarm fire that tore through apartments in west philadelphia injuring several people and putting others out of their home. sky force ten was flying over that scene shortly after the fire broke out around 11:30 last night. here is the view from the ground. this is a live picture. this is taped that time of the fire. at least three people were hurt in the fire and they mostly suffered smoke inhalation. and a firefighter is among those being treated. fire crews did have to rescue several people who were trapped by the flames and smoke. we spoke to one of the residents who had to leave their apartment. >> my whole apartment's gone. i mean. >> now, this morning the red cross is on the scene helping people who were affected by that fire, including those who lost their homes. no word yet on what caused the fire. this is the live picture here of

the scene this morning as it stands in west philadelphia. crews are still there on scene making sure no hot spots flair up. monique braxton is arriving on the scene shortly and we'll hear from her at 4:30 on how many people were displaced by this fire. eight minutes after 4:00 now and, again, the clock is ticking towards a possible strike by septa. the main transit workers union could make a decision today on whether workers will walk off the job and that strike, they say, could happen as early as monday. both sides will return to the bargaining table today at noon, trying to avoid a walkout. septa and leaders of transport workers union 234 met again yesterday, but, once again, could not come to an agreement. if those workers go on strike, it means it will halt buses, trolleys and subway trains in the city of philadelphia and, listen to this, a ripple effect here. nbc 10 spoke with the vice president of another union that represents unions that operate in delaware county and parts of montgomery county. they, too, are negotiating with

septa and his members have also authorized a strike. so, it's possible, he says, that they could also walk out if negotiations break down. a lot of riders are bracing for the worst. >> the strike would be a really big problem for me because i need to get to and from work and i work in center city. >> it would cause a big catastrophe. >> if the transit workers strike, the regional rail lines are expected to be up and running but much more crowded than usual. you can see exactly which lines will be shut down and which will still be operating. we also have some alternate travel routes to help you get to where you need to go. check it out now at nbc10.com. it's back. the colder air that we started the week with. temperatures in the 30s and 40s and have to bundle up this morning. clear skies allow the temperatures to come down. during the day we'll see

sunshine and milder afternoon into the 50s later on and most of the area will be completely dry this weekend that will turn windy and wet, at least to start with. right now, look at the cold in mt. pocono. 28 degrees. 36 in trenton and drover is at 41 degrees with clearer skies. clouds will be building over cape may. this is a live view of beach avenue. there's a chance of a few sprinkles later today at the shore. look at the temperatures down ten degrees in trenton. five degrees colder right now in wilmington and reading is off by 1 1 degrees this morning, which has most of the area in the 30s. potstown now is 39 degrees and northeast philadelphia at the airport is 38 degrees. fair meadow farm a degree above freezing and just below freezing in west town. phoenixville you're at 34 and just under the freezing mark for chester spring. a cold start this morning, but we'll see sunshine before the weekend clouds arrive with the rainfall. the satellite shows clouds off

to the north and west. but the sprinkles at the shore come from the clouds that are moving up the east coast just off shore. the future weather shows it nicely ewith temperatures in the upper 40s by 10:00 this morning and look at the clouds building at the shore with showers just off shore. a few sprinkles may move inland, but i think most of the area will be try and farther inland, it's going to be nice and sunny. when i come back in less than ten minutes, a look at your trick or treat forecast. let's hope some for treats out on the roads this morning. a smooth drive to school or work on this friday. first alert traffic reporter jillian mele has that. jill? >> smooth sailing on the blue route. live look in delaware county. both directions very quiet right now, but an accident in mu montgomery county. at dekalb pike and also dealing with an accident investigation right now out of bucks county. an accident that happened in the overnight hours. crews are still out there on

4:14 now. this morning we continue to follow the breaking developments in eric frein. within the past ten minutes we learned that frein has been moving from the barracks to the police facility. scheduled to be arraigned at the pike county courthouse at 9:00 this morning. we'll be covering that for you. prosecutors are asking for the death penalty. troopers honored their fallen brother, corporal byron dickson. >> when this day did come as had been talked about from the day after the shooting, he was placed under arrest in handcuffs, with the handcuffs of corporal dickson, which i think is very appropriate. >> now, corporal dickson left behind a wife and two sons. the fbi, as you remember, put frein on the ten most wanted list. this morning you can see the word there in red beneath his photo, captured on their website. and here's a timeline of how things unfolded.

this all began, again, on september 12th with the deadly ambush in bloominggrove. 13 days later frein's suv found submerged in a swamp. in october, on the 16th. trooper alex douglas who was wounded in the ambush was discharged from the hospital to a rehab facility. schools were closed after a possible sighting of frein on the night of the 17th. then last night, of course, the 30th, it all came to an end. eric frein was captured ending the 48-day manhunt. our coverage of his capture continues online at nbc10.com. and right now nbc is monitoring the developments and getting reaction from relieved people there. you'll hear from them on nbc 10. in other news this morning, a pennsylvania state senator is

expected to step down today after misusing her office. yesterday we saw this cheerful state senator liana washington crying after taking a plea deal that will put her on house arrest for three months. also serve 57 months probation, but get to keep her. washington used her senate staff and money and she had a message after taking the deal. >> i apologize to those who have been negatively impacted or affected. >> again, she was accused of misusing funds and staff to have fund-raisers for herself and even throw herself a birthday party. the attorney general's office said washington is cooperating in another investigation, but they wouldn't give details about what that investigation is surrounding. the husband of a delaware state senator who is up for re-election turned himself into police yesterday morning. dana long is facing a

misdemeanor charge of theft. bethany long seen here at an event in september. caught on video here stealing the campaign signs of the republican party in delaware. nobody answered our knocks at the door of the family's home. now to decision 2014 and heading into the final weekend of campaigning before tuesday's election in the race for pennsylvania governor, democratic challenger tom wolf continues his fresh start bus tour. today making stops in phoenixville and wolf will get some star power this weekend. president obama making a campaign stop in philadelphia on sunday to make a final push for candidate wolf. meantime, republican tom corbett will be in pennsylvania and making several stops and attending a gop luncheon with rand paul. the eelection, again, four days away, tuesday. voters will head to the polls. count on nbc 10 and nbc10.com

for complete coverage leading up to the election as those results roll in tuesday evening. new information this morning in the atlantic city casino crisis. business is getting business. borgata's revenue increased by nearly e5% in the third quarter of this year. borgata's president said it has improved and he also said internet gambling has helped his operation be successful. college students from new jersey are taking a closer look at internet gambling statewide. it has been awarded more than $1 million to study online betting. starting in january, people in new jersey will be surveyed on the phone and online. and then a follow-up survey will be conducted 18 months later.

clear and cold this morning. the temperatures have really dropped. there are a few spots in the 40s. center city is one of them. that's a live view from center city, but much of the rest of the area has drop under ped int 30s and now three hours from sunrise are still falling. nice and clear over center city. a live view looking across the delaware. no sign of any fog this morning. don't have to worry about that. 4 degrees cooler in philadelphia and dry at the shore and later on, a few sprinkles. right now we're seeing more and more colder temperatures. 32 right at the freezing mark for allentown and potstown. 30s for millville and atlantic city eand some 30s in delaware, as well. watch the radar screen during the day today. some clouds when most of the rainfall will hold off until tonight and overnight tonight and into tomorrow. 50s this afternoon. not quite as warm as yesterday. we'll start with sunshine, but there will be clouds building

later this afternoon and this evening. just making a little bit spooky for halloween. trick or treating, though, not bad at all. but the forecast is calling for it to be dry, cool, yes. 55 degrees at 5:00 and partly cloudy skies and by 7:00, the temperatures start coming down a little bit more. 53 degrees and little chillier at 9:00, but dry right on through the evening. back with a lock at the latest temperatures as they continue to fall in less than ten minutes. all right, jillian, we have to key keep the tp and the eggs away from bill's house. that's no fun. >> good morning to you, chris. >> how is trafficic looing this morning? looks like we have flashing lights out there. >> nothing too major, though. 76 eastbound right near belmont avenue little bit of road work out here. the left lane is blocked but traffic can get by using the right lane and no delay as a result. and we're still following an accident investigation out of bucks county.

we're back at 4:24. the nfl is asking a judge to dismiss a lawsuit. team officials gave them powerful pain killers and other drugs to keep them on the field without regard for their long-term health. the nfl argues that the players

that waited too long to file that suit and the statute of limitations was expired. gerber's claim that good start can reduce or prevent allergies is false. the federal trade commission wants gerber to pull its claim from labels and ads and reimburse consumers who bought that formula since 2011. gerber's vice president disagrees. gerber met all legal requirements to make those claims about that product. the website does not include the allergy claim any more. a run for your life on the night before halloween, that's the name of this 3k fun run that we see video of here. nbc 10 was at west laurel hills cemetery last night as runners in costume got ready to take part in the event after they posed for this photo op. they ran through the cemetery or with various scary creatures chasing them. a local nonprofit that delivered healthy food to people who are
