he was fount with a.38 caliber smith and wesson and a small amount of marijuana. as he sits in jail, an official complaint has been filed accusing him of murdering susan berman in december of 2000. >> get ready to extradite him according to what the court decides. he was a witness she was witness to a crime and killed because was fact. berman was going to be questioned about durst's wife kathleen before she was killed. his lawyer said he will plead not guilty. >> she able to end the rumor and speculation. >> susan knew too much and he wanted to shut her up. >> the author of two books on the susan berman murder said the evidence revealed in a document the jinx is the key. a letter addressed to berman

all of a sudden he went into the bathroom and the revelation was something we had been waiting for for 33 years. >> do you feel he confessed to the murder of your sister. >> in my heart of hearts absolutely. he was a note taker and make a list of things to do. since he didn't have pen and paper, he was audibly making a list of things that happened. when he said they got me or words to that effect they got him. you hoping for whatever reason you may get answers, perhaps from mr. durst himself about what happened to your sister? >> i am very hopeful and prayerful. i have a lot of faith in the god that made us all. i believe he will have an epiphany of conscious contrast to the advice of lawyers as he went against his lawyers's wishes when he made the tapes for the jinx. i think he is about ready to

talk to her. durst is confessing but more than that. he unearthed evidence that matched a letter to a letter that only the killer could write. >> your reaction when you saw that handwriting analysis and the misspelled word in beverly. the reaction was son of a b. do you think that will put him away? >> yes, i do. even durst himself could not distinguish the letters, the black letters from the person he said is the killer and his own handwriting. that's why you got that reaction. >> he gets up after seeing the envelopes and goes to the bathroom and now that's famous audio where he said that's it you're caught. is it admissible? >> a judge will rule on it but he knew he was being tape and he consented and he was not in

custody and he was not under interrogation and he had a red hot mike on him. >> he said you have to be careful if you are the prosecution and you enter that one small piece of audio, the defense said let's play all the video and that's strong for the defense. >> look you can play the whole audio for that jury. the bottom line is only one person wrote that cadaver note and only one person's handwriting is consistent with it. you have him confirming it verbally and he had motive and opportunity. >> they will prosecute durst on the murder charge and had nothing to do with the jinx the documentary. do you take them at their word? >> i do. l.a. worked very hard and worked with them as da when it happened. they knew this was a case that had to be put together and the timing had to be perfect.

they did what they had to. durst was about to leave a country and go where there was no extradition treaty. he had murder charges before. this wouldn't be the first time he ran. >> good to have you here. thank you very much. >> she would like to prosecute the case herself. >> we turn to the frightening scare on a united airlines scare to denver. he had to be subdued and pilots were forced to return. cristkristen welker has more. >> a spokesman said the flight 1074 returned to dell us airport in the washington area after a passenger failed to comply with crew instructions. now another passenger caught the scary moments on camera. >> no come on! >> frightening moments after

passengers had to restrain an unruly man on a united airlines flight. >> declaring an emergency due to a passenger disturbance. he is restrained. we need to return to the airport. >> airline officials would not confirm what caused the disturbance, but one passenger on the boeing 737 said he attempted to reach the cockpit and claimed he had a bomb. audio from the air traffic control tower showed how others got involved in the scuffle. >> there is a passenger in the back, he ran forward towards the cockpit and he is being restrained by other passengers. the cockpit is secure and we would just like to return to the airport and have the authorities meet him. >> please stop! >> after the passenger was restrained the plane returned to dell us around 10 time 40

p.m. they detained the passenger and he was taken to the hospital. officials found no weapons and none of the flight's 33 passengers and six crew members was hurt in the incident. >> kristen welker thanks. >> the boston marathon bombing trial is focusing on the end of his 24 hours on the run. they have to decide if they put the admitted bomber himself on the stand. at the courthouse good morning to you. >> reporter: good morning to you. the jury will hear from the owner of a boat stored in a back yard what saw him hiding. it brought a week of chaos in boston to an end. juries seldom take field trials in federal criminal trials, but they did. gathering with the judges and lawyers to see the boat where he hid before surrendering. they showed it riddled with

kids and sports. and as parents, we know there's a risk our ch children can get injured in any activity. >> but did you know according to the cdc, kids between the ages of 5 and 14 account for 50% of all sports-related injuries in hospitals. so here with advice on how to prevent those injuries is a team division for the new york knicks basketball organization. >> and a sports medicine specialist, both from here in manhattan which frank and cody know very well. >> i can't believe those statistics how young these kids are and the kinds of injuries they're sustaining. what sorts of injuries are these kids experiencing? >> i think it tends to be more sports-specific. in the racket sports like tennis or baseball, more upper extremity injuries. and basketball or soccer, more hyperextension sprains.

>> and what about concussions? >> concussions are very common as well. i think one of the things that's interesting is they've gotten so much attention recently. i think that's a combination probably of them being more common. there's a lot more people participating in sports. there's probably an increased roughness of some of the sports. i think a lot of it is just increased awareness and people are getting diagnosed more. >> but what about the equipment? we hear so much about the fact that -- frank, my husband, played in these kinds of things. and without even a face guard. can these hurt the person as well? >> well, there's a theory that if you're wearing more protection, that you tend to be less cautious. so the theory of the old leather helmet was they weren't hitting with their heads as much. and now that they have more protection, they might not be as cautious. but the let me tell yous fit them well. and especially in the youth athletes, when i was a team physician for a high school football team i'd go around and check some of the people's

helmets. and some were borrowing from someone else and it didn't fit them well. that's the most important, that it fits them well. but it's a combination of factors. >> some kids play one sport and they're so into that one sport and they play it -- so they're using the same parts of their body, i guess you could say. is that unhealthy for kids? should they be playing multiple sports if they have the choice? >> i think in general, the risk with playing one sport is you get overuse injuries because using that joint or doing that activity all the time. and it's important to be involved in a wide range of sports, develop better -- learn to move better and you don't overuse those specific joints for a given sport. >> anything you can do to prevent -- besides quit the sport? some advice for parents to give their kids, do this before you go out and do that? any kind of advice for them, preventative stuff? >> stretching is really important and getting accustomed

to a new activity before you -- that's true for kids and adults. making sure they have a good base before they start a sport. but warming up is really important for injury prevention. >> how would a kid he had a concussion? used to, you had to get knocked out cold. but how would a kid know from a regular football game if he's got one? >> a lot of education is around getting your bell rung is concussion. only 10% of concussions have a loss of consciousness. so the old idea was that a concussion required you to lose consciousness but that's not true. >> how do you know? >> that's tricky because the symptoms evolve over time, too. it's important to evaluate a kid right when they come off the field and they might be a little out of it they might have been -- looked off kilter or unsteady -- sometimes you have to wait and see what evolves with their symptoms. so you want to be cautious. you might keep them out and

jacklyn: our middle schools have classes that are devoted for test prep. my kids only have a half a year science and a half a year social studies to make room for preparing for the test. gina: we have no after-school programs, we have no freshman sports, we have no extra anything... okaikor: we're cutting those programs to make way for test prep. and we're not taking in to all the other things that makes a child whole. gina: we are setting our kids up to fail.

nbc 10 news starts now. >> right now at 11:00, a penn state professor from our area is arrested after an airline says she became unruly on an international flight. good morning. i'm vai sikahema. new at 11:00, students at penn state abington talk to nbc 10 about what this professor was like in class. karen halnon was on an american airlines flight heading from nicaragua to miami on saturday. she was arrested at miami international airport after being escorted off that plane. nbc 10's matt delucia is live at penn state's abington campus for us. we're hearing from that professor and students about what happened. >> yeah vick.
