a woman identified as jackie claims she was assaulted by seven woman at a fraternity in 2012. this report from a journalism school finds rolling stone violated basic journalistic principals by contacting jackie's friends to check her story. >> if this reporter contacted you, would this be avoided? >> absolutely. >> two of jackie's friends are mentioned in the article. >> i wondered why there was a photo i had never given. >> they did not try hard enough to find the person accused of orchestrating the assault and give them a chance to review the details. i allowed my concern for jackie's well being, my fear of retraumatizing her and my confidence to take the place of more questioning and more facts.

searching for three suspects wanted in connection with five people in a townhome including three young children. one is just six months old. police don't believe the shootings were random. all are in serious condition. california governor jerry brown is responding to critic who is say farmers should be included in the first ever mandatory water restrixz. they said farmers faced cuts to the federal water supply costing many their jobs. the farming industry uses the most water state-wide. brown said he will reexamine the issue if the drought persists. >> edward snowden said americans shouldn't curb their use of the internet because the government is watching. snowden spoke to john al ver in moscow where he has been for more than a year. >> what you don't want is you don't want them spying inside their own country.

you are under weight or overweight it's your business. it became distracting. i would do a two-hour show and be so proud of the interviews and fun moments and i would go on the internet to see 99% of the comments about my weight and not about the interviews. i found it very interacting and i thought it's time to just tell the truth and tell people what's going on. >> what are is going on? you are in fact very, very thin. people think you have an eating disorder. >> i never have had an eating disorder. i want to be clear about that. i eat burgers. it's not working. the main thing is i lost a considerable amount of weight in the past year or two due to the cancer medication i'm on. when i was eating more than i have ever eaten, i was losing weight and i was scared.

i didn't think this is great. i thought what the heck is happening to my body. >> you would like to gain weight. >> yes. you start losing weight on the cancer medication. i thought is the cancer back? a side effect of the medication is weight loss. >> you have been through a lot and one is the struggle with fertility. duke is over 2 now, but i know you were hoping the surrogate would be able to have another baby and we got sad news about that. >> we did. everybody was asking about the last embryo. we had our final shot at having a biological child and unfortunately she did miscarry. it didn't work out. that's okay. there other options. i have always been open to adoption even before we had issues. we are definitely looking at our options. >> let's talk about fashion police. you are creating headlines for a lot of reasons.

first of all, there was the exchange about zendaya. you made a comment that a lot of people perceived as racist including zendaya and you apologized. >> yes. >> she accepted your apology. >> she did. >> what did you learn? >> it's something i want to be very clear about because i have never spoken out about it. i made a reference to the hippy culture. i talked about patchouli oil which is a hippy perfume. in the editing process, some of the gestures i made and things i said were taken out for time. i meat peace signs and said bohemian twice. some people were offended by it. i find racism reprehensible and i don't tolerate it at all nor have i ever. that's important for me to get out. that is the hardest part of all of this is that somebody could

i was broke not so long ago and in my business i wanted to be successful and i made a lot of mistakes and i had no idea if it would happy. i can give advice on something i made mistakes in. it's about do as i say, not as i've done. i'm still on the journey. >> you have been so public. that's part of your profile. is it hard to go through things -- it's your life. these are things that are personal and here they are out so public. has that been difficult to have that journey? >> it does put a spotlight on you obviously, but it makes you stronger. being in the public eye, i am so resilient to anything negative that i have a better perspective on it and a better attitude. it's difficult. i do feel that when i'm going through something, i write. it pours out of me. through the years when things are great, i wrote a place of yes. when i used to have food noise, i wrote naturally thin.

i am going through something. if i can help people and talk about what i'm going through in realtime and express it which i think i have a gift for, i think it's great. i love this book so much and all of the practical advice in it. >> we mentioned the real housewives of new york city. i watched the real housewives and you were always one of my favorites. what made you want to come back? >> i didn't want to come back. people say that because of the failure of my talk show i had to come back. i was offered shark tank and "dancing with the stars" and cinderella but i wanted to go home again. i never thought i would go back. it got to a point where i didn't enjoy it anymore. i am so glad i waited because i'm enjoying it. i respect the women and what everyone is going through and we are at different times. some of them i have known and it feels like i'm going back to high school. like a reunion. there is drama, but people are

going through so many interesting things personally and so many transformations and transitions, it's the most interesting season and it's funny. which i missed. i miss the humor of it. >> a lot of the franchises some of them have a lot of drama. maybe it's fake drama like the glass of wine and this or that. should we expect that from you? >> no. i have never seen someone smash a glass or rip someone's hair extension out. i have never seen that. i have seen a lot. i think it's real. we are going through real things. i miss the connection with the fans. i did miss talking to women and going through things realtime. people don't know me anymore or they think they don't know me. i went through so many things with the people and i miss being free and honest and open. >> you are very real and open. one of the things you talked about in the past is your

weight. we had a similar conversation with giuliana rancic. we put a picture up and the paparazzi snapped a photo. some people say you look great and others say you are too skinny. >> people do comment a lot. i say yeah i am thin. i have a brand called skinny girl. it's not a giant mystery. you can't please everybody. you try to please everybody, you end up pleasing nobody. sometimes i agree i look too thin when i'm hire and haggered. i do eat. nutritionists comment that i don't weigh 100 pounds. i weigh 115. i would be happy to get on the "today" show scale. >> the day we get a scale is my last day. >> i don't need to dress for success if i don't weigh what i say i do. i have done it in the past. people don't talk about people who are overweight. imagine being like weigh, that

you should take if you can't file your taxes on time. millions of americans miss the deadline. what do you need to do with ten days to go? jean good to see you. good morning. the first thing is don't do nothing. >> doing nothing gets very expensive. you have to file even if you can't pay. the penalty for not filing is 5% of what you oh, per month up to 25%. that's 10 to 20 times more than the penalty for filing and not paying. >> if you don't file then the irs generates a return based on what the company you work for tells them you made. >> exactly. the irs gets information from two source. they are supposed to true up. they are supposed to be the same and that's how you know what you owe and are not cheating. >> you say figure out when you might be able to pay. that's an important question to ask yourself.

>> there different methodologies based on your time frame. if you think you can pay within 30 days just file the return. the irs is going to send you a bill and penalize you, but .5%. a half of a percent of what you owe. it won't be a huge amount. if you think you can pay from 30 days to 120 days to four months you want to ask for a short-term payment extension. they are willing to do this. you have to ask for it. you will be penalized, but it won't cost as much as installments. >> a lot of people qualify to have interest feas waved. >> this is what they call their fresh start initiative. there is a separate form but they are clear. you have to be going through a hardship not just an inconvenience. it will require to you sell assets at significant loss. >> we have gone from asking yourself when you might be able to pay. now you need to ask how am i

going to pay? >> if it's going to take you more than four months you are looking at a couple of options. the first is an installment agreement from the irs. if you owe less than $50,000 and can pay it within six years, they are willing to allow you to go on installments. there is a set up cost from $50 to $120. the lower cost is if you are willing to allow them to pull money out of your bank account each month. that drops the monthly penalty from a half of a percent to a quarter of a percent. >> if you owe the irs money, it may be a red flag that you have got this whole thing figured out wrong in the first place. >> you want to go back and adjust your withholding. you don't want it to happen year after year. the other option is to pay on a credit card. before everyone says that's a bad idea if you have a 0% credit card and you can't pay

within a year or two, you may well do better putting it on that credit card. high interest no way. >> what if it's not about money, but you can't get it together by april 15th? >> you want to fill out an extension and they are willing to give you a six-month extension, but for filing, not for paying. pay what you think you owe them and base it on last year. just be careful. you don't want to under cut by 10% or more or face penalties. >> people are qualifying for filing for free and always at this time just be careful of scams out there targeting taxpayers. >> you get a call from someone saying they are the irs, they are not. hang up the phone. >> good advice. thank you very much. we are back in a moment. this is "today" on nbc.

they became very, very sick. apparently due to a pesticide that was used at their hotel. pesticide poisoning that they are suffering from. the rental agency said they were staying on the second floor of the condo above a property that was recently sprayed for bugs. now what is used in this pesticide is a highly toxic pesticide that is illegal to use indoors in the u.s. and the u.s. virgin islands, but i guess other places it is still being used obviously. such a horrible story. the mother was released, the father is now in stable condition the twos however, the teens are in critical condition this morning. they say it is a neurotoxin and affects the brain and the central nervous system. my thoughts are with that family. it makes you think as stephanie gosk was reporting, one of the questions now is you might want

joke. it was in context. >> there were 40 people in the studio audience and in addition 40 people, just executives, not one person said anything. it wasn't a live show. it was taped. we had several hours to fix it. no one saw anything wrong because when they heard the joke it was truly a joke about the hippy -- >> why didn't kelly say something about it at the time if she was so incensed by the joke? >> that's the thing. she was right next to me. everyone was laughing. the audience was laughing. in everyone's defense, though, it truly was -- when you talk about the oil -- when you look it up. >> i didn't know what it was. >> i grew up wearing it because i was trying to act cool. my sister liked the grateful dead. but no matter where you go online, incense there's really nothing -- it's not a stereotype. the oil is really about the

hippy culture. >> at all. >> is that why kelly left and is that why kathy griffin left? >> i can't speak on their behalf as to why they left. we've never had that conversation. i will say this. there were issues with the show from even before episode one. you know -- >> such as -- >> come in and doing the show without joan rivers but yet keeping the format the same just didn't work. i think that's why it was a very smart move on the producers for the producers to pull the show, reassess it and figure out what -- because "fashion police" is a fun great brand, but maybe if the focus is maybe on fashion. maybe if we're having fun not making fun, then the show could work. but that's what they're looking at right now. >> a lot of people talk about your weight. >> yeah. >> it must get old if for you after a minute. do you kind of put that to rest too?

>> i agree. definitely i struggled a lot with infertility. that's a lot of the reasons i wrote the book. we showed a lot on our reality show but there's a lot we didn't show. women asked me all the time, where do i go, what do i do, i'm not getting pregnant. when should i see someone. it was lies to be able to put that information out there. and a lot with my cancer struggle i've never talked about as well which is obviously in the book. >> a lot of people write books who have nothing to say. you are certainly not one of them. coming away from it, what have you learned the most? >> i learned a lot. especially the past -- i've learned a lot. but in the past six weeks has obviously been a really hard tame. the "fashion police" incident was really tough for me because i found it just horrifying you know. as i said early today with savannah, you know, i don't tolerate racism in any way,
